Many people will also pay religious respect at the temple which is brightly light and decorated for the festival.

Returning to Phuket’s Ao Po Grand Marina from 22-25 February 2018, the next TYS will be unlike any other boat show, with visitors being able to actually get out on the water and try out a whole range of watercraft. Held during the Lunar New Year, one of the busiest times on Phuket when it is buzzing with regional visitors, the Show will place an emphasis on the experience visitors will have and how it will enhance their ongoing yachting lifestyle.
Treadwell has been in discussion with the various Thai government departments involved in the Superyacht Charter Licence project for the last three years, and believes that the issue is about to be resolved. Teams from TYS and the TMBA, the local marine industry association, are helping the tax department to finalise a modus operandi based on the successful New Zealand model, which enables foreign yachts to enter the country under a “temporary import” scheme - and spend millions of dollars directly into the local Thai economy.
TYS also provides a unique opportunity for thrill seekers to enjoy the Show’s Demo Platform, where the more intrepid guests can come along to test the latest in yachting toys and accessories. Once again, exhibitors will have a platform to demonstrate their products at this dedicated area of the Show precinct and in so doing, make more meaningful connections with potential buyers. Andy Treadwell, CEO of 3L Events, organisers of the Thailand Yacht Show, explains, "One of the most important focuses of the third edition of TYS will again be on superyacht charter - and another being the 'experiential' style of the event. We want potential buyers and charterers to have an opportunity to climb aboard and try some of the sailboats, sports-fishers, dinghies, tenders, watersport boats, day cruisers and superyachts that our exhibitors will have on display.”
Running simultaneously, the Thailand Yachting Forum (TYF) is designed for industry professionals to network and meet face to face with government representatives. The conference will deliver a focused agenda to support the development of the local yachting industry and promoting Thailand as a premier superyachting destination. Those looking to relax can slow down and soak up the atmosphere. The HYPE Luxury Boat Club will be the hub of such, where DJ’s will be spinning the latest tropical beats, and bartenders will be keeping you cool with their yacht show exclusive cocktails. Then as the sun sets, we amp up the fun, with a variety of parties on yachts and ashore, making Ao Po Grand Marina in Phuket the place to be this coming February!
Pre-qualified guests will also be invited to join some of the superyacht fleet on display for short "sea trials" prior to the Show hours. For those who are new to yachting, it is a perfect opportunity to discover first hand the benefits of yacht charter. From the aft deck there is easy access to the water via the wide steps on each pontoon and a staircase leads up to the well-appointed fly bridge. Equipped with a partial shade bimini, an abundance of seating, as well as a dedicated forward facing built in sunbed, the flybridge is a wonderful spot to take in the spectacular scenery. SEVEN has four qualified crew on board ensuring proficient service. Seajet, which will start production in February 2018, generously donated a Stingray for a silent charity auction that raised US$ 5,500 (185,000 baht) with all proceeds going to the Phuket Youth Sailing Club. The Kata Rocks Superyacht Rendezvous welcomed numerous VIP guests including, 30 superyacht owners, celebrities and captains of industry to its jam-packed schedule of events that climaxed with the Charter Season Opening Party. Guests were treated to a lavish gala party, live band, and a special stage performance including a surprise appearance by Thailand’s celebrity singer Tata Young and spectacular fireworks over the Andaman Sea. Wandering the streets of Phuket Town gives an opportunity to rummage around the shops. While some of the shops sell copycat items, if you have a shrewd eye and are willing to look hard enough you will be rewarded with some outstanding items to purchase. A number of shops in town specialise in Thai silver. Although the silver is mostly from the northern regions, it is still a nice gift to take home. If you are looking for Thai silk, there are a few boutiques in town that sell some very fashionable scarves for women and neckties for men. If you are really looking for a tropical memento, pick up some handmade soaps and lotions as well as local favourite, coconut oil. Although certainly not unique, coconut oil is a crowd pleaser and worth taking a bottle or two back as a reminder of your tropical holiday. Local Phuket pineapple products are also available in the form of lip balm and organic face and neck creams.

Nikita’s boasts no fewer than 18 cocktails, but we settle for a traditional gin and tonic. A Tomato Bruschetta comes as appetizer, followed by an unusual dish, a spicy salad with glass noodles and peeled prawns. The wine list is well chosen – 12 whites and 15 reds, plus five choices available by the glass. A competitively priced Santa Alicia cabernet sauvignon from Chile – full bodied with supple tannins – provides a perfect complement to our meal. Seeking something distinctive for the main course, my friend orders a firm-fleshed and succulent Mahi-mahi (dorado). Served with a creamy white sauce laced with Thai herbs and mashed potato, it is pronounced superb. My choice is a whole, Deep-fried white snapper in fish sauce (sweet and sour sauce is also available) with a Thai inspired salad of crisp slivers of green mango and peanuts. Delectable. It is worth noting that many of the vegetables served here are sourced from Nikita’s own farm. Famous for its thin-crust pizzas – all cooked in a wood-fired oven – the choice includes classics such as Margarita with mozzarella, tomato and basil. All Nikita’s pizzas are celebrated for their lavish toppings. Then there’s English style fish and chips, coated in beer batter, a house speciality. Though Nikita’s emphasis is on seafood and international dishes, there is an impressive range of authentic Thai dishes. We finish in style with a slab of hot, dark chocolate mousse and a scoop of fragrant ice-cream. A sensational and contrasting mix of flavours, textures and temperatures. Shenanigans with a Thai lawyer
W
hen I had first come to live in Phuket, I had needed, as all “expats” do when faced with the unfamiliar tenets of Thai jurisprudence, a good lawyer. I hadn’t bothered to shop around: a lawyer was just down the road and Nok said he was a “good man.” Softly spoken and well dressed, he had the round face of a cherub, an impression reinforced by a permanent smile. His impressive office walls were plastered with pictures of graduation ceremonies, pictorial evidence of the award of two law degrees from universities and an ongoing Thai passion for elaborate ritual and ceremonial. Sumptuous gowns and hoods. Plus hundreds of certificates and company stamps. Farangs trooped into his office in droves. For this was the time when all house-owning expats were advised to start a company as a way of circumventing the byzantine laws about foreign ownership of land and property. He helped with the purchase of our first house. Wan was friends with his wife. Everything seemed “tickety boo”. One day, and out of the blue, Somjet blurted out a confession. “Farang partner – he take my money...” I was shocked. “That man from Liverpool? Can’t you sue him? Get the money back? He seemed a nice guy. Inoffensive.” “He gone to UK. Take Thai lady with him.” The next day Wan told me that Somjet wanted to borrow money. I was unsure. “Yes, I thought as much. What do you think? He seems honest. You have known him a long time.” “Up to you… He OK. He pay you back. Rio, rio. Mai pen rai.” “OK. But I want to have a proper signed agreement. Will he pay it back soon?” “He say three months.” Once the deal was agreed in principle, Somjet arrived, hot foot, the very next day, sporting his smartest suit and armed with two copies of the agreement. It was agreed he would pay back the loan in six instalments starting the following month. The first instalment was duly paid – a few days late – plus the agreed interest, which was lower than the bank interest rate. The following month the interest was paid, but no instalment was forthcoming. The next month, nothing at all. When confronted in his office lair, Somjet was all smiles. “Oh, I pay next week. Money come from property deal I do with farang. I get three million. He brandished a photograph of the condominium in question. Sorry.” To cut a long story short, that was, apart from a couple of softeners – small sums of baht notes handed out at protracted intervals – the end of the story, at least as far as
payment was concerned. Every time the same excuse, every time the same ingratiating smile… Except it wasn’t the end – as far as I was concerned. Despite disapproving noises from Nok, I went to the office on a more-or-less weekly basis, sometimes cajoling, occasionally hectoring, at times furious. I lectured Somjet on the responsibilities of being a lawyer – all to no avail. The smile was fixed, permanent, infuriating. Meanwhile, expensive cars continued to be parked outside his practice. His Fortuna was replaced – first by an up-market Mercedes, then by a 7-Series BMW. I was advised to try other lawyers. The first simply refused to take the case on. The second at least discovered something – that Somjet had been operating under a false name. He opened a large tome with mug-shots of all lawyers registered in Phuket. Somjet was conspicuous by his absence. “Can you do anything about that? I mean surely it is illegal in Thailand to practise if you are not qualified – or use an assumed name. In England we have something called the Law Society we can appeal to. I have used it.” All those photographs of Somjet receiving his “degrees” flashed in front of me. The lawyer, a mournful looking Muslim with a wealthy practice in Bangkok, shrugged his shoulders. “Are you sure your partner is not involved in this…?” The question was left hanging in the air of his expensive villa. He wasn’t prepared to take things any further. I tried again. A bright, breezy young woman with excellent English. Highly recommended. Highly qualified. A notary, no less. And with her own law practice in Phuket. Expensive but perhaps she could oblige. She shook her head. “I simply don’t understand. If you don’t mind my saying so, you are clearly a good lawyer, very confident. You have offered to help with other matters in a very professional way. But you seem reluctant to tackle this issue. Maybe I will never get anything back, but at least I want put up a fight, to make this man feel uncomfortable.” “Look, Henry, let me tell you straight.” She looked around, almost furtively. Maybe she thought the room was bugged. “This man is – how you say – a crook. He is a criminal. Unfortunately, we have people like this in our business. Everybody knows about him. He has done this to other people – as well as you. My advice is: forget him. Write the money off. He is dangerous.” She pursed her glossy lips and rolled her deep brown eyes. So that was it. That was, apparently the final chapter in this sorry tale of deceit. Effectively, I had never had a chance, not now nor in the past, of ever getting my money. But why had Nok recommended him? Was she in on the act? She had never showed much interest in the matter even when I pointed out that the loan money could have helped her family. But the thought was unfair to Nok and I immediately discounted it. There were only two options left. The Thai solution – to hire someone to beat him up or worse – was out of the question. I didn’t tell Nok. She would have thrown up her hands in horror. For her, the only way to deal with him was Thai style – cap-in-hand, cha cha – and appeal to his better nature. No confrontation at any price. But did he have a better nature? I had decided while he was in London that I had to confront him, to embarrass him – in front of as many customers as possible. He was always busy on Saturday mornings, when people inconveniently discovered it was the weekend, and they had forgotten to file their 90-day immigration report, or worse, renew their annual retirement visa. Somjet would fix it – for a price.

I pointed an accusatory finger at the face behind the glass partition. He has even been operating under a false name. Take my advice. Go elsewhere. Find another lawyer. If you have any dealings with this man, you may live to regret it.” Shaking with emotion, I turned on my heel and left.
I marched into the office. About 10 clients there. Good. Somjet was in his glass-fronted inner sanctum, talking to a customer. I stationed myself in the middle of the reception area, took a deep breath and put on my best lecturing voice. ‘‘Look, all you clients, I want you to know something important. Very important. The guy in there – I waved a hand at Somjet – is a criminal, a cheat, a crook. He cheated me out of two million baht 10 years ago. Yes, 10 years ago. Promised to pay me back in six months. He has never paid me. I have been to this office at least one hundred times. One hundred times. That’s why I’m here today. Promise, promises!” I paused: “Do you want that to happen to you?” The rhetorical question hung in the air. People were looking at me in astonishment. Perhaps they thought I was demented. A day spent at Tarn Morakot Rafting is fun for everyone and is suitable for all ages. Kuraburi, much like any other small Thai town, is home to plenty of restaurants and street stalls serving fresh, delicious food. However, if you are looking for a complete fine local dining experience, it’s highly recommended to check out a modest, Muslim restaurant in town called Tasmeam Shabu & Coffee. Tasmeam Shabu & Coffee is a quaint, cozy restaurant popular for its shabu hotpot dishes of thinly sliced boiled meats and vegetables, along with its strong coffee varieties. In addition, Tusmeam Shabu & Coffee also features a small menu serving simple, delicious dishes guaranteed to satisfy.
Everything on the menu uses fresh ingredients and plays on local flavours. Items are well-presented in simple, bamboo dishes giving the meal a rustic feel. Recommended dishes from the menu include leafy vegetables cooked in coconut milk known as pak liang, root vegetables fried tempura-style and served with spicy Thai nam phrik, a popular steamed eggs dish called kai toon in Thai and a delightful, tasty stirfried chicken dish with shrimp paste and chilies. The meal is rounded out with wild mushrooms and a variety of herbs including lemongrass steamed, wrapped, and served in bamboo leaves with a delicate dipping sauce. Cheap and cheerful, Tasmeam Shabu & Coffee is a must-try when in Kuraburi. Another restaurant option that provides the perfect meeting spot for dinner is Kosak Restaurant. Without doubt a local favourite, the restaurant serves up fresh and tasty seafood dishes, staples such as fried rice varieties and mixed vegetables and makes an absolutely delicious Thai omelette. Kosak Restaurant is a popular local institution and is often busy. Local Thai beer and karaoke is also up for grabs here. Do stop in for a bite when you find yourself in Kuraburi. From Phuket, it’s approximately 190km to Kuraburi; roughly three and a half hours, depending on traffic. The scenic drive can be made by taking Route 4 just after Sarasin Bridge and following the signs north to Kuraburi. There are daily buses depart Phuket to Kuraburi hourly from 7:00am until 18:00pm. Tickets cost approximately 160 baht and the journey takes about three hours.

“D
o it real, do it fast and do it honestly” is the catchphrase of Anchana Chulakanadecha, a remarkable lady, who gives every indication of living up to her avowed aim. Anchana is part of the founding team of three who are turning the Utopia dream into tangible reality. It says volumes for her virtues that she is part of a top triumvirate of seasoned and highly successful developers; the others being Khun Paranyoo from House and Home and Khun Hachi from IPA, the parent company. Anchana’s rise has been meteoric, though she does not see it that way. She comes from Hat Yai and went to university overseas. Returning to Thailand, she first worked in advertising sales, then switched to property sales – and has spent 15 years gaining in-depth knowledge and experience in Phuket’s challenging property market. More recently, Anchana joined Utopia, the real estate company which gives its name to the development at Nai Harn. A relatively new conglomerate, only created at the beginning of 2016, it has antipodean roots. An offshoot of IPA (International Property Advisory Group), a Melbourne firm, it was only incorporated in Phuket in 2014 after two years of market, land and planning research and capital allocation. Its first project was initiated in February 2016, when Utopia teamed up with the island’s largest builder, HYN, to develop Utopia Kata (UTK) – 20 serviced apartments at Kata Beach.

In April of that year, Utopia began work on two further and more ambitious projects in conjunction with House and Home – Housecare Service. It is here that we met today, in the first completed show apartment, at Naiharn. The project is a substantial one: nine pool villas and two condominiums comprising 110 units; one block boasts a roof-top pool. In keeping with Anchana’s dictum to “do it fast”, other developments have followed in quick succession: Utopia loft (UTL), 237 luxury loft- styled hotel condominiums at Nai Harn, and Utopia Central for entry level buyers – 410 units strategically located close to Phuket’s shopping malls, hospitals and schools. A final project for 2017 is Utopia Karon. Here 283 units offer both freehold and leasehold ownerships. In all this, Anchana is a relatively old hand. She has been in the Phuket real estate business for 15 years, first as a sales agent, then as sales manager and finally general manager for a Hongkong / Phuket company. As she says, by meeting up with clientsshe learnt a great deal about the development scene in Phuket. By the time she was professionally involved with Utopia, she was in a position to utilise all that knowledge – both good and bad as she candidly avers – in the service of

her new employers. That she has not encountered the ‘glass ceiling’ which so many young and aspiring women executives experience, is testament to her drive and dedication. Anchana is at pains to emphasise the advantages of a system in which she is a key and committed player. She deplores the fact that some developers sell their units off-plan, and even before they have acquired the land and assumed ownership. Such practices are not part of the Utopia ethic; the company buys all its land before construction work commences. Moreover, developments are backed by capital provided by IPA, sometimes by Chinese investors and not from Thai banks. And both design and construction utilise the best of Australian principles and techniques. Unsurprisingly, the apartments have sold faster than anticipated, a considerable achievement granted the rash of commercial building on the island.
She replies that Utopia is “nature friendly”, that they try to save every tree and strive to create a mature tropical environment. I ask Anchana if she is concerned about the natural environment. After all, this development is located in a green area between Nai Harn and Rawai beaches. Nor is Anchana concerned about the fact that there is no beach frontage. People, she believes, will appreciate the innate tranquility of the setting, an oasis of calm hidden away from the hustle and bustle of the island’s beaches. She talks of the future development of roads linking condo and beach with private transport available in the form of electric buggies. Everything, it seems, is taken care of. We meet in the show flat – already entertaining prospective clients. Anchana’s interest in design is immediately apparent. One suspects that her input to the style of the Utopia interiors is considerable – as she speaks enthusiastically about the high ceilings, the modernist lines of the furnishings with cream ceramic floor tiles, glossy black kitchen units and glass-topped dining table – at this moment serving another function as we talk across it. And since Anchana is a single mother of a six-year-old boy, she is especially concerned that everything should be as child-proof as possible. Anchana is clearly a devoted parent; her world revolves around work and parenting. She is too busy, she says, to have time for outside interests. No matter. property deposit scams Basic Concepts Certain innocent but naïve buyers are losing their good faith reservation deposits on a regular basis in Phuket – and eventually writing off what is often exceeding 5,000USD because they discover that verbal promises were untrue and that the costs of ‘suing’ for the return of a deposit payment, even if confiscated unfairly, are prohibitive.
However, agents and many sellers are fully aware that this provision is an empty, or false, assurance.
Over the last few years, there has been a significant slowdown in the re-sales market in Phuket, with those that wish to exit the market entirely finding themselves losing the capital appreciation they thought they had, by clearly being in a hurry to depart.
Then, the due diligence. The seller clearly bought the property and therefore may already have a prejudged opinion that the property is ‘fine’. They may not even be aware of access issues, potential illegality of issuance of title, or if Thai companies are involved – with potential unexplainable debts and loans which remain unpaid to shareholders, directors or third parties. No sensible or prudent buyer should proceed until issues are resolved or explained to their satisfaction.
The idea of a reservation deposit is normally for a willing buyer and willing seller to confirm to each other that they wish to contemplate finalising negotiations to effect a sale and purchase. A reservation agreement should set out key terms with certainty such as the parties, the price and a clear description of the property. Unfortunately, these simple concepts are often mishandled by incompetent or inexperienced agents, or worse – with dishonesty. I must say, of course, that there are lots of property agents who are honest and companies operating in Phuket who are very clear about deposit terms. I am unfortunately forced to write about the bad apples, which can spoil the perception and stability of the property market.
The Scams The typical scam is based upon what legal circles often refer to as ‘illusory’ practice. A reservation agreement is presented which actually contains very reasonable terms, does describe the key elements correctly, and importantly for an innocent buyer, commonly contains a provision similar to this: “...in the event of negative due diligence, the reservation deposit shall be returned to the buyer”. This can sound very reasonable. In a jurisdiction where the wheels of justice move quickly, where a claim for a deposit return could be conducted in a fast-track, small claims court in a commonly spoken language such as English, this provision in a contract would provide a lot of comfort to a buyer.
Agents, and sometimes agents in collusion with lawyers, persuade the prospective buyer to place a deposit into the agent’s or the seller’s lawyer’s bank account. Once the monies have moved, the buyer cannot ‘insist’ upon the return. No number of strong emails, demands and eventual legal notices will guarantee the return of the deposit monies.
The friendliness at the beginning of a deal can quickly turn sour when there is a difference of opinion over the degree of importance of an issue. Phrases such as “I bought it and I used lawyers to check” are bandied around freely without much application or analysis.
The Excuses If a buyer gets fed up with a situation, they then dust off the reservation agreement and start talking seriously to their lawyers. The general response will be: 1. The Reservation Agreement was defective. 2. If Thai law and Thai courts apply, then there will be Court of First Instance, perhaps the Court of Appeal and even the Supreme Court as the path of litigation over a 5,000USD claim. Legal fees would exceed the claim. 3. You should have used a different dispute resolution mechanism. 4. You shouldn’t have put the monies in the agent’s account without a contract directly with the agent. 5. You shouldn’t have put the monies in the seller’s lawyers’ account – they owe no duties to you at all. 6. The meaning of ‘negative due diligence’ is ‘subjective’ and will now have to be defined in court, because it wasn’t defined in the agreement.

The Outcome Common results of this situation are that: (a) The buyer caves in and ends up ‘begging’ for a slice of their deposit back. (b) The seller may provide something back, but will cover their own legal costs and may even give something to the agent even though a deal hasn’t been done. (c) The parties may dig their heels in and sue, with the agent’s and the sellers’ lawyers being made parties to the legal complaint. All of a sudden, accusations are made towards the buyer if the buyer has slipped up on any timing or technical aspect of the reservation agreement. This effectively means that, even with a slow property market, sellers and agents are successfully pocketing cash from buyers who might not be proceeding with a deal. What they don’t realise, or seem to care about, is that this in fact results in a wave of negativity leading to less interest in Phuket’s property market, because it is seen as unfair and unregulated, with no attractive options for remedying a breach of contract over a relatively small sum of money. If you can’t afford, or don’t wish, to lose it, don’t risk it.

n some western countries, during the process to transfer ownership of real estate, the law obliges the interested parties to use the services of a public body or representative to protect the buyer by making ‘due diligence’ compulsory. In Thailand however, parties can directly go to the relevant administration to register the ownership or rights in immovable property transfer. But some choose not to. Consequently, some buyers take the risk to be engage (in a purchase) without performing a competent and comprehensive due diligence process and unfortunately stand to lose a lot of money if they don’t comply.
In Phuket, land use restrictions are encompassed under three laws with the relative ministerial regulations. • The Building Control Act • The City Planning Act • The National Environmental Control and Maintenance Act All of these have been enacted within the last 40 years. Due diligence is implemented basically on the title deed, the building, the owner or holder of the immovable rights and legal relations between them and third parties. The title allows certain private use and grants rights to use, possess, own, or to transfer rights by freehold and leasehold. There are three titles to be considered: the Nor Sor Sii Djor (chanote), the Nor Sor Sam Gor and the Nor Nor Sam. The due diligence report regarding the title deed will show all historical transactions and any encumbrances as servitude or mortgage.

The said building has also to be free of any debt, charge or other restriction of private or public laws other than the usual easements. To avoid future legal litigation, the construction must correspond to the correct permit issued. In condominium projects, rules and regulations are even stronger, and some developers use the word ‘condominium’ only for marketing purposes with the result that at the end of negociations the condominium license won’t be issued and the unit will not be registered under your name. In the case of land and building, the owner of both can differ, in this case, one of the assets can be subject to checks made for each particular owner as to his/her criminal and civil background which could impact on the legal process of acquisition. A Thai company can also be the owner of the whole asset. In this case, the buyer can purchase shares and become director of the company. The due diligence procedure will request specific verification in accounting and tax domains. For the above reasons, the first step of your real estate investment should be followed through with due diligence. It makes perfect sense.

Day tour of the viewpoints For a change from the beach, rent a car or motorbike and take in some of the island’s breathtaking views. Start at Rang Hill, to the northwest of Phuket City. A winding tree-lined road takes you right to the summit of Rang Hill, where a sala offers shade during the day. Once there you can enjoy views of the city and beaches on the south and southwest of the island. Then on to Khao Kad on Cape Panwa, which offers wonderful 360° views of the Andaman Sea beaches and neighbouring islands from a different perspective. There’s a stiff climb up 138 steps but once there you’re rewarded by refereshing breezes and sunsets here are on a par with Cape Promthep. Next drive across the island to the west coast and take in KataKaron’s 'Three Bays Viewpoint'. It’s located between Nai Harn and Kata Noi Beaches and offers superb views on several levels. From here Kata Noi, Kata and Karon beaches can be seen and out to sea is Koh Poo (Island).
