Some say it takes a village, and indeed it does. s the new publisher for Life Publications, I’m delighted to be given the privilege of taking the helm of this magazine. After years in the magazine industry, it’s particularly refreshing to have the opportunity to make real connections with the community and readers that we serve. I’d like to use this first column (you’ll be hearing from me every month) to let you know my philosophy of how a magazine should serve its audience. Life Publications has built its success on being an important source of relevant, useful information that touches all aspects of our readers’ lives. It’s my belief that while the readers we reach may think globally, they act locally. In this sense, this magazine is very much a community project, and that is no small role to play. What I mean by that, and why that is so important, is that today we are becoming more and more aware of the impact of community. Call it the power of grass roots. One person’s belief—or the beliefs of a small group of dedicated citizens—can induce a sea of change. Or course, community means different things to different people. At Life Publications, we naturally want to look at the fun side of life, as well as the touching, personal stories within our local community. But we also want to tackle some of the more serious issues that we know you, the citizen readers, are engaged in. This is where I ask you, the reader, to tell us what you want to see in the magazine. In coming months, we will be providing you with numerous opportunities to participate and engage with Life Publications. In the meantime, however, if there is something
you want to see covered—or there is a compelling story you want to share—we want to know about it. Please feel free to email us at mystory@lifepublications.com. We’ll do our best to act on your input. Some say it takes a village, and indeed it does. We at Life Publications are a community of people truly invested in being the best at what we do—which is to provide you, the reader, with a monthly community magazine that features stories which are real, relevant and smart. And entertaining, of course. In the end, this magazine is your magazine. It’s all about you—where you live, where you go and what you do. So come along with us and enjoy the ride. Optimal Health
“Everyone tells me how great I look for my age, but I don’t feel great inside.” Celeste did look great, either from her modelesque figure, breast implants, Botox, or the combination of all three. Looking at her new patient questionnaire, however, I had to agree, she wasn’t as healthy as she looked. Celeste continued, “My friend Jena raves about you and handed me one of your brochures. She said you made her feel twenty years younger. I want to get what she’s getting!” “Patient-to-patient referral has always been my best source of new patients, but rather than ‘selling the same program’ of tests, supplements, and hormones to everybody, whether they need it or not, I do what a board-certified physician is trained to do, I evaluate each patient individually. Tell me, if there was a miracle tonight, what would be different tomorrow?” “How about tonight? I’d sleep. It seems that I’m up at 3:15 like clockwork every morning to pee, and then I can’t get back to sleep until hours later. And when I wake up for real, I’m destroyed.” “God created night then day; night came first because it’s so important. I want you to wake up fully refreshed, anticipating your day.” “How can I look forward to things when my clothes don’t fit, I need to use hair extensions and acrylics, everything I eat bloats me to where I’m 5-months pregnant, and my girlfriends have more libido towards my husband than I do?” Luckily, not only do I have 80+ minutes to spend with new patients, I also had a box of tissues to hand to Celeste. “All of this is fixable. Instead of using ‘pharmacy’ (or ‘green pharmacy’ of vitamins and hormones) to cover up your symptoms, I prefer a Functional Medicine approach to make your body work properly, the way it did in your 20’s.” “Just up to a few years ago, I was able to eat great tasting food without running to the bathroom, drink champagne at charity events, and still be able to play tennis the next day. Now I’m just spent.” “I’ve seen all this before, and I’m confident we can get you back to optimum health. Let’s finish off our assessment. Besides my history and physical exam, there are some tests I need. Even though you have a concierge physician who did a screening panel, I need to look in depth at your adrenals, thyroid, and other hormones. Food allergies and dysbiosis (bad bacteria in your gut) can cause that bloating, and vitamin insufficiencies are common enough that we have to test for those as well.” “Anything we can start off now?” “Yes! I’ve been practicing this way for over a dozen years, and based upon what I know now, we can start with a little of everything: behavior changes, diet, exercise, supplements, stuff like that.” I continued, “You don’t have to change your life drastically, but little things will make a big difference.” “Like what?” BOCADELRAY LIFE • SEPTEMBER 2013
“
I do offer injections of vitamins, minerals, glutathione, and other nutrients.
”
“You already take baths, so we’re going to add Epsom Salts (to absorb magnesium through your skin) to make your skin less dry, your muscles less achy, and your sleep better. I have a ‘detox diet’ handout that mentions safe foods to eat, but if you just think ‘protein and colorful vegetables and fruits’, you’ll do okay. Before you leave, I’ll teach you a stretch that decreases that ‘pouch’ at your beltline, and there are a few vitamins that are so obvious for you to start with (but safe to take too).” “But what about that IV therapy that Jena told me about?” “When patients are really sick, or are trying to get the most optimal results yesterday, I do offer injections of vitamins, minerals, glutathione, and other nutrients. For example, iron injections rapidly help hair growth, brittle nails, fatigue, memory/concentration, and muscle cramps (restless legs).” Celeste’s testing did show causes for all her symptoms and on her second visit, a plan specific to her was put in place. Three months later, she was glowing and her visits were now spaced out to where she only had to be seen once every six months. “Next week you get to see both my husband and daughter. I just booked a family trip to tour the volcanoes in Hawaii. I need them to keep up with me.”

Awesome, Artsy, Aussie:
Boca’s Lady From Down Under
Artist Romaine Kaufman of Boca Raton
By Halli Moore
Usually painting in the style of the Aborigines, Boca Pointe resident Romaine Kaufman, who’s originally from Australia, has now switched to Abstract Expressionism. Patch Reef Park in Boca Raton recently had an exhibition of Romaine’s painting, which was very well received. Romaine’s paintings reflect the kind of person she is: joyful, colorful, even mysterious. You can see certain things in her paintings like an eye placed in the
middle of a splash of color, a face looking at you from behind what looks like a storm, and many other interesting things. Romaine says she is concerned with arranging a variety of colors in different formations. Jagged shapes and encrusted surfaces suggest some geological formations. She uses a palette knife more often than a brush and slathers and molds the pigments instead of dabbing and blending them. Some of her paintings are characterized by

“I Can’t Live With Excruciating Foot and Leg Pain!” Announcing A New High Tech Method For the Treatment of Peripheral Neuropathy and Type II Diabetes Symptoms...
‘Doc, I can’t live with this excruciating foot and leg pain?” When you hear this from a patient it gets your attention, Typically, I get the worst of the worst pain patients but when I recently heard this exclamation, my attention was particularly peaked. Let’s call this patient Bob. Bob is 62 years old with neuropathy in his hands and feet. He had poorly controlled Type II Diabetes and his life was literally as he described it “a living hell.” Clearly he was coming to the end of his rope. The nerves in his legs and feet were damaged and he was in HORRIBLE CONSTANT PAIN! I can’t Sleep at Night! He complained to me, “I can’t sleep at night because my legs feel like they are being eaten by little bugs or chewed on by small animals. During the day, he could hardly walk and every step sent shooting pain like lightning from his toes and up his legs up almost to his knees. He has numbness in his feet and couldn’t feel his feet very well and had terrible balance problems. He was worried he might fall and injure himself. He said that he could not go on living with this constant, debilitating pain that had made every day a tragedy. I had to help This Man! I recently was fortunate enough to accidentally discover a new noninvasive and nondrug treatment for severe and constant foot and leg pain caused by Neuropathy. I learned about a new type of non-surgical and painless high tech treatment that was working wonders with severe, constant chronic pain, including pain caused by Neuropathy. It had the ability to quickly increase circulation to an area (much needed in a neuropathy patient). It could reduce and/or eliminate pain in as

little as a few treatments and was changing the lives of patients with severe debilitating pain in offices across the nation. Based on the research about this new type of technology and because of the almost immediate type of pain relief, I had to have one of these deep tissue treatments in my facility no matter what the cost. I invested and implemented this new treatment that utilized state of the art pain relieving therapies some of which include IPLT (intermittent pulsed laser therapy) as well as other therapies, all customized to the patient's particular needs.
I enrolled in extensive training. My staff and I witnessed some amazing reductions and eliminations of some of the worst pain syndromes I had ever seen... And it was FAST! After just a few minutes treatment on patients with extreme chronic pain of the worst kind, including neuropathy of the feet and legs, we had patients telling us how their pain levels had decreased and they were shocked. Some of them had their pain even alleviated after only one treatment. We were able to reduce or even eliminate neuropathy pain of the worst kind. I now offer a non-invasive, non surgical and painless neuropathy pain treatment. I help patients reduce or eliminate their neuropathy pain using a combination of natural therapies, customized to each individual patient's needs. These therapies may include a possible combination of: Nutritional therapies. high tech deep tissue, super pulsed cold laser therapy, specific non-surgical, non¬invasive, relaxing re-integration and stimulation of peripheral nerves, vibration therapy. myofascial release. and more.
Here’s what some patients have said about their treatments: My experience with The Coral Springs Spinc & Nerve Institute: I am a vigorously active 69 year-old-man. For two years, I have pursued various medical specialists and solutions seeking relief from my agonizing affliction with Neuropathy in my feet. I had become completely frustrated with the surgical, pharmacological and exercise therapies that were prescribed for me. “Masking” the pain, burning and numbness were not acceptable solutions. All that changed when I was introduced to Dr. Kuhlmeier and The Coral Springs Spine & Nerve Institute. The integrated regimen of Neuroanalgesic, lower extremity circulatory massage and cold laser, combined with a carefully crafted combination of nutritional supplementation and lifestyle management, have resulted in an extraordinary improvement in my condition. My overall improvements in comfort and physical agility have been
nothing short of amazing. I have experienced dramatically reduced pain and burning. improved balance and agility, and gained a level of recovery I never thought possible. The staff at the clinic is simply incredible. I am deeply indebted to the professional doctors and staff at The Coral Springs Spine & Nerve Institute. -William I. Bunnell; ARRT, MS Radiological Sciences, CRA Executive Director of Medical Imaging (Retired), Coral Springs. FL. Coral Springs Spine & Nerve Institute when I came to the The Coral Springs Spine & Nerve Institute I never dreamed that anything would change. My hands and feet were so painful that I could hardly bear it.
I was taking pain medication two times a day and sometimes a third time if needed. It was even painful to wash my hands. They felt like they had been fried, My fingernails even hurt. My feet were terrible. I couldn't stand for anything to touch them Wearing shoes was miserable. Now I can tell a big difference. Before I started this treatment it even hurt to clap my hands, but not anymore. Thank God for Dr. Kuhlmeier and all his staff at The Coral Springs Spine & Nerve Institute. -Brenda, Hill, (Retired) Parkland, FL. and receive at least six hours of direct sunlight daily. Next consider what your planting source will be. You can either grow your vegetables from seed or starter plants. There are advantages to both. If you start from seed, the sky’s the limit with what you have to choose from but you’ll have both a longer growing period and waiting time before you can harvest. On the other hand, starter plants give you instant gratification along with a head start on your growing season, but you’ll have less of a selection. You also need to decide if you want to grow your plants in beds or containers. Container gardening is terrific if you have limited space or live in an apartment or condo. The plants are easy to move, which makes it simpler to find ideal growing conditions. Container types are limited only by your imagination. You can use pots, cans, buckets, recyclable bins, ice chests, inflatable swimming pools or even old bathtubs, as long you have the proper drainage. Vegetables that are susceptible to diseases and nematodes, like tomatoes and peppers, typically do better in containers. Or, you may choose to grow your plants in raised beds. These provide good drainage and act as a barricade to pests like snails and slugs as well as invading weeds. Roots will grow further into the ground to access helpful nutrients since the beds don‘t have bottoms. No matter which method you choose you should improve or “amend” the soil at least three weeks before planting by adding organic matter such as manure, compost or commercial potting soil mixes. It’s also important to apply fertilizer, such as 6-6-6 or 10-10-10, to provide a nutrient boost to your garden plot before planting. You should continue to fertilize once a month during the growing season. Vegetables that do well in south Florida include broccoli, peppers, tomatoes, carrots, radishes, leaf lettuce, Swiss chard, peas, scallions, pole beans, cabbage, onions, kale, leeks, cauliflower, spinach, romaine, turnips, tomatillos, arugula, celery and radicchio. Start planting in late September/early October, depending on the temperature. If it’s still very hot, wait a few weeks. You can continue planting heat-tolerant plants like peppers all the way through March. Plant celery in late fall and you’ll still be cutting stalks in May. Remember to stagger your plantings so you can enjoy multiple harvests. You also need a plan to combat both pests
and diseases—ideally without using chemicals. Carefully examine plants before buying them to ensure that they’re free of insects and disease symptoms like leaf spots or blights—and if possible, choose vegetable varieties known to be resistant to nematodes and diseases. Try planting flowers like marigolds, nasturtiums and sunflowers in your vegetable garden to provide nectar and pollen that attract beneficial insects. Pick your crop as soon as it ripens as over-ripe vegetables can attract more insects. Solarization can also help reduce nematodes. Cover your tilled soil with plastic for 4-6 weeks prior to planting and the sun’s energy will heat the soil and kill these unwanted pests. Pesticides should be used only as a last resort only when a serious problem exists. A few pests don’t mean you have an infestation. If you do use chemicals, carefully follow the directions for application as some can’t be used on vegetables. Use these tips and you’ll be well on your way to reaping the benefits of a vegetable grower! Gardening is great for your health as you’ll get fresh air, sunshine and exercise. The nutritional value of chemicalfree vegetables is unsurpassed. It’s also fantastic for your mental health and easy on your pocketbook. You can grow produce for a fraction of the cost of buying it at a gourmet market. And, the taste will just knock your socks off! Happy planting! ●

Disney World A Magical Place
H
This month I wanted to feature the magic of Disney World. I have been many times but thought the best way to enlighten readers about Disney World would be to have my colleague, Stacey Fugere, give you the insight to Disney. Recently, she was named one of American Express’s Travel Insiders for Walt Disney World. As there are only 16 in the world, she feels pretty great about this and can finally use her years of Disney fanaticism to make your vacation the best it could possibly be. So read on for Stacey’s insider tips to the world of Disney.
ere in Florida we are a little bit spoiled. Not only are we super close to one of the world’s top attractions, but they also give us discounts to make it easier for us to go and enjoy! Walt Disney World ranks number 5 on the top 10 list by Yahoo of the country’s most popular destinations. Something I hear from friends and clients is that they have been there and done that. Why would they pay Disney prices for a day at the parks? I want to share with you some interesting experiences to consider the next time you are planning your Disney vacation.
Characters in Flight – A Hot air balloon ride at Downtown Disney which gives you a panoramic view of the entire Walt Disney World property. The best time to try and be on the hot air balloon? Fireworks time at the Magic Kingdom! ontinued on next page

Keys to the Kingdom – A behind the scenes guided tour of the Magic Kingdom, which includes the service tunnels beneath the park and hearing the secrets of rides as you ride them. Behind the Seeds Tour – A personal favorite. I have always loved Living with the Land in the Land pavilion in EPCOT Center. At times I loved it because it was a great time to nap, and others because I love seeing the vegetables that they are growing/creating on property that they then serve in the Food Court in The Land pavilion! One trip, I surprised my husband with the Behind the Seeds tour. This is a walking tour through the greenhouses which the ride travels through. On this tour I ate both Mickey-ear-shaped cucumbers and the most incredible banana I have ever tasted (it was called an ice cream banana, but I’m not sure that’s the technical name). Watching Wishes from your Dinner Table - Two restaurants, Narcoosee’s and California Grill, offer great views of the fireworks and they also pipe in the sounds so you can have the whole experience, but enjoy your meal at the same time! Make sure your reservation is for at least 30-45 minutes before show time so you can be ready. Festivals for every Season - Walt Disney World has something for everyone. In the spring you can go to the Flower and Garden Festival. In the fall you can go to the Food and Wine Festival. In the winter you can do Mickey’s Very Merry Christmas and the Osborne Family Spectacle of Dancing Lights. Each of these festivals brings an entirely different look and feel to the parks. Make sure you check them out.

And my last hidden experience for the day … Each year the Disney parks are home to many awesome races and challenges. The Disney Princess half marathon is the race that I ran this year. It was so much fun because throughout the 13.1 mile race course there were picture spots with characters! Definitely helps the miles fly by! So next time you’re planning your Disney vacation, work in some of these experiences and see Disney like you’ve never seen it before! ●

“New American” cuisine
taken to delicious new heights The first thing you notice entering Piñon Grill are the dramatic silhouettes of two Native Americans against a back-lit glass ‘canvas’ of deep red. Those striking symbols, along with four large bronzed pine tree sculptures (piñon is Spanish for pine), telegraph the message: This is a house of American cuisine—albeit one of great sophistication. What Piñon has done is taken food favorites from the American culinary playbook and paired them with new flavors, enhancing the classic, traditional tastes and taking them in new directions. The results are novel, interesting and just down right superb. “We serve New American cuisine in the truest sense,” says Kevin Blair, Managing Director of Piñon Grill. “We take dishes that have, over the years, through America’s cultural melting pot, become beloved American mainstays, and combine them with the unique flavor profiles of foods that have since ‘immigrated’ here.” Our foray into their innovative menu began with grilled artichokes and crab fritters. The artichokes were paired with a southwest remoulade sauce, and had a terrific roasted flavor. The crispy crab cakes were even better, combining shrimp, crab and risotto in the ‘cakes,’ which were hidden in a nest of shredded, crispy phyllo dough and laced with a lobster ginger sauce. Scrumptious. For entrées we sampled three: Chilean sea bass with pesto, roast chicken with key lime sauce, and New Orleans pasta. The
Chilean sea bass was outstanding, moist and flaky, paired with Thai chili butter and fried onions that dramatically enhanced the taste, and accompanied by Parmesan new potatoes that could have stood alone. The roast chicken was fresh and saturated with flavor, and though we liked the cilantroinfused key lime sauce, we thought there could have been more. The New Orleans pasta turned out to be the showstopper—all the basics you associate with a Big Easy jambalaya, (shrimp, chicken, cooked tomatoes and Andouille sausage) mixed with penne pasta and blanketed with a light Cajun cream sauce. Out-of-this-world delicious. The menu is full of many more of these delightful upgrades to the American palate, including a marinated skirt steak with ginger soy marinade and grilled pineapple salsa; maple and bourbon brined pork chops; and the signature chef specialty, pecan-crusted trout, which is sautéed with a hint of wine and toasted in a clarified butter. Add to these concepts a studied emphasis on fresh, organic and locally grown ingredients, which makes even their simplest of dishes strikingly good. BOCADELRAY LIFE • SEPTEMBER 2013
The dessert menu is thankfully limited to a few standouts (otherwise you could get into some real trouble), including a peanut butter pie and a flourless chocolate & “cherried” waffle with ice cream. We indulged in the latter, an excellent choice, but almost too much after the lovely entrees we devoured. The ambiance, meanwhile, is rich and dark, with all seating in either full booths, or combinations of half-booths with chairs, so you feel you are really settling in for a leisurely dining experience. Beyond the Native Indians dancing against the red glass, there is a lot of recessed woodwork, stonewalls, even log ends as part of an esthetic that is formal yet reminiscent of the Prairie School of architecture from the American West. Considering the quality, pricing is also reasonable, with a good selection of wine by the glass. Piñon Grill is located at The Terrace of Town Center at Boca Raton, which is on the eastern side of the mall—which means easier parking and no crowds to wade through. Just one more reason to visit this shrine to New American cuisine. ● BOCADELRAY LIFE • SEPTEMBER 2013

schoollife Calusa Elementary By Fran Glick We’ve made it through the first few weeks of school and now kick-off September, a very busy month for CES. We’re all settled in the back-to-school routine and are familiar with the expectations that will lead us toward a successful year. CES is very excited to work hands-on, side-by-side with our wonderful principal, Mrs. Jamie Wyatt and fantastic Assistant Principal, Mr. Chris Wotton. The PTA energetically supports the efforts of our enthusiastic and hard-working faculty and staff. The PTA subscribes to the notion that hands-on parental involvement with shared goals is the key to preparing students for academic success! As we bridge the back-to-school chapter and fall, the PTA invites parents to participate in Adopt-a-Class. It’s a great way to give back to CES. Families or businesses can make donations directly to the selected teachers or specialty area. Laurie Hochman, PTA president, welcomes all parents and community members to get involved in our school. Hochman says, “September can be a demanding and hectic time at school for kids and teachers. It may take a few weeks before everyone is accustomed to the school routine. But early parental involvement, right from the start, leads to greater school success.” The extra financial support is appreciated and highly needed. All supporters receive recognition for their donation. Please consider underwriting your child’s classroom in the Adopt-a-Class program. The PTA is busy getting ready for upcoming academic and social events. We are in the beginning stages of planning Tile Night and Calusa Carnival. Don’t forget to register your email at www.calusapta.com to get all notifications sent directly to your in-box. Thank you Lani Davis, PTA Membership Chair, for spearheading this year’s PTA membership drive. Lani welcomed families to school on August 16 for Meet the Teacher day. On behalf of CES, thank you Lani for your hard work over the summer and the start of school. Those who joined received a discount card for local merchants. Joining the PTA gives you a chance to help your school, while giving you the added bonus of receiving discounts for shopping and dining in our community. The Calusa discount card can be used at local retailers such as Casa L’Italien, Dunkin’ Donuts, Cowlicks, and many more. Thank you to all who stopped by and joined the PTA that afternoon. It’s never too late, so please sign up if haven’t yet done so. Important dates to remember: Monday, September 2—Labor Day, No School. Thursday, September 5—Fall Holiday, No School. See you in October!
Sandpiper Shores Elementary By Chantal Bayne September is here and the month is filled with fun and informative events for the whole family. We hope that the children have adjusted well and are now settled into their new classroom and that all the little worries have receded. Be sure your children are getting a good night’s sleep and eat a ‘’brainy’’ breakfast everyday to ensure a successful academic year. Adopt a Class program will begin in September which allows teachers to purchase much needed resources for their classroom. Remember that parents have a voice, so get involved. Our school can only be as good as the parents supporting it. Here are some important dates to remember: September 2: Labor Day Holiday - No School; September 9: Fall Holiday - No School; September 19: Early Release Day.

teachers that have joined us for the 201314 school year and welcome back to all the returning families. With all of our students settled into their classrooms and into the daily routine of back to school, the PTA, again led by Ryan Raffa, is hard at work to help create an incredible school year for Waters Edge. Our Family Activities Committee really knocked the ball out of the park with our Welcome Back Ice Cream Social on August 23. Our students got to cool off with some delicious treats in their very own Waters Edge ice cream helmets while being amazed by the magic of Gary Goodman. September is a busy month as we get the school year going and prepare for our first ever Boosterthon in October. Our Adopt-a-Class Program is in full swing. By “adopting” a class, your generous donations allow our teachers to increase their classroom budgets in order to purchase more educational materials for our students! Please support the Feed Our Community Food Drive by dropping off canned and non-perishable foods in the box outside the front office from September 9-15. Be sure to attend the Volunteer Orientation Breakfast/ General PTA Meeting on September 13 at 8:30am in the cafeteria. Find out all the great things your PTA has planned for this year. This meeting is important for anyone looking to volunteer at Waters Edge (Room Parents, copy moms, PTA volunteers, lunch helpers, etc.) as we will be going over policies and procedures for volunteering. Don’t forget … all volunteers MUST register at the front office and wait for approval before they begin volunteering. Mark your calendars for dinner on the 19th at California Pizza Kitchen for our first PTA Spirit Night of the year where a portion of all proceeds that night will be donated to Waters Edge PTA! September 27 will be our first “No Uniform Day” - for just one day and only $1, students can leave their uniforms at home and show their own personal style while supporting 5th grade activities! (No tank tops or open-toed shoes). Stay in the loop with everything Waters Edge PTA by logging on to the PTA website at www. myvlink.org/watersedge/. Last year, the launch of the website was a huge success, bridging the communication gap between the PTA and our families, allowing more volunteers than ever to help out at all of our amazing events! New this year is the Waters Edge PTA Facebook page! Be sure to like “Waters Edge PTA” on Facebook! We hope everyone is off to a great start this year! ● BOCADELRAY LIFE • SEPTEMBER 2013

In today’s social media age, it has become relatively easy to track down an old friend from high school or college. Unfortunately, defense attorneys know the same tricks. If your pictures, tweets, biographies and blogs are public, they can be seen by anyone. The internet goes beyond just your Facebook and Twitter accounts and there may be pictures of you on friends' pages or websites that you don’t even know about. In the context of a personal injury claim, anything you post on the internet can potentially come back to harm your case. The law is relatively new, but there have already been favorable rulings prohibiting the disclosure of account access to Facebook. Piccolo v Paterson, a Pennsylvania case, involves a claim for personal injuries arising out of a car accident. When the airbag deployed, it left the Plaintiff’s face seriously disfigured, necessitating cosmetic surgery. The defendants had obtained numerous pictures taken before and after the accident in discovery. However, in Plaintiff’s deposition, she admitted to having a Facebook page, the defendants attempted to obtain full access to her account to compare her posts to her claims. The defendants filed a Motion to Compel, which was denied on the basis that sufficient information had been obtained in discovery and was available through other means. Facebook has taken steps to prohibit the dissemination of user information, even with a civil subpoena. According to Facebook’s Privacy Policy: Federal law prohibits Facebook from disclosing user content (such as messages, Wall (timeline) posts, photos, etc.) in response to a civil subpoena. Speciically, the Stored
Communications Act, 18 U.S.C. § 2701 et seq., prohibits Facebook from disclosing the contents of an account to any nongovernmental entity pursuant to a subpoena or court order. Parties to civil litigation may satisfy discovery requirements relating to their Facebook accounts by producing and authenticating contents of their accounts and by using Facebook’s “Download Your Information” tool, which is accessible through the “Account Settings” drop down menu. If a user cannot access content because he or she disables or deleted his or her account, Facebook will, to the extent possible, restore access to allow the user to collect and produce the account’s content. Facebook preserves user content only in response to a valid law enforcement request. However, in another Pennsylvania case, Zimmerman v Weis Market, the Plaintiff brought a claim for personal injuries after hurting his leg in a forklift accident. The defendants believed that there were pictures of the Plaintiff in shorts, although he testified that he was too embarrassed to wear shorts following the accident. There were also alleged pictures of the Plaintiff performing motorcycle stunts on his Facebook and Myspace pages. The Judge ordered the Plaintiff to turn over the account username and password within 20 days to the defendant. Further, Plaintiff was ordered to not delete any posts or information from his pages. As with everything in life, you must be careful and responsible about how you use social media. Make sure your privacy settings are adjusted appropriately, and try to be aware about what your friends and family are posting about you. ● BOCADELRAY LIFE • SEPTEMBER 2013

s the housekeeper is vacuuming your living room, she trips over one of your daughter’s toys and seriously injures her back. While your neighbor’s teenage son is mowing your front lawn, he steps in a large hole and sprains his ankle. Will your homeowner’s insurance cover you if one of these workers decides to file a lawsuit? Many homeowners do not realize that they could be held financially liable if a maid, landscaper, nanny or another house worker were to suffer from an injury on their property. Here are some things you should keep in mind before you hire a home worker:
An employee or a contractor? When you hire someone to help out around the house, you should figure out whether he or she is an employee or a contractor. This is one of the factors that determine whether or not you are liable for a worker’s injury. So, how do you know if the worker is considered your employee or a contractor? It all comes down to how much control you have over the worker. If you are uncertain about whether a worker in your home is considered a contractor or an employee, consult a lawyer or tax professional. If you hire a house contractor, such as a landscaper, carpenter or plumber, they should be covered by their own workers’ compensation insurance. If a contractor is injured while doing work on your property, he or she will be covered under that policy. If the contractor doesn’t have enough coverage, you may be held financially liable. If you are looking to hire a house contractor, it’s important to ensure they are covered for worker injuries, property damage and uninstalled materials. Don’t just take their word for it. Ask for written proof that they have a contractor’s license, workers’ compensation insurance for themselves and any subcontractors and general liability coverage.
every homeowner’s insurance policy is different. Your policy may include a provision that provides limited coverage for minor workers performing lawn mowing or other tasks that require the use of power tools on your property. On the other hand, your policy may specifically exclude domestic workers such as nannies or maids. Your policy may cover the injuries of household employees, but only after a lawsuit is filed against you. Because homeowner’s policies vary widely, it’s important to read through your contract and talk to your insurance agent before you hire a home worker.
Consider an umbrella policy If you discover that your homeowner’s policy offers limited coverage for workers, you may consider purchasing additional liability insurance. While you may have some personal liability coverage through your homeowner’s policy, it’s probably not nearly enough to cover a major lawsuit from a home worker. You can further protect yourself with what’s known as an umbrella policy. This type of policy offers a higher level of liability coverage and ensures that you and your family will be protected if someone sues you for damages. ●
Know what your homeowner’s insurance covers When it comes to coverage for home workers,

In Search of a Great Communicator Fallout from FAU’s Year of Troubles continues, as the school looks for a new president By J. P. Faber

L
ast academic year it seemed that Florida Atlantic University could simply not get a break, with the news going from bad to bizarre. First, in February, students began protests against a proposed plan to name the school stadium for GEO, a local for-profit prison operator with a history of alleged mistreatment of inmates. GEO planned to donate $6 million to FAU for the naming rights. During one of the protests, thenFAU president Mary Jane Saunders was accused of accidentally hitting a student with the rear-view mirror of her Lexus when protestors surrounded her car. Next came an incident in March, in which a professor tried to punish a student who complained about a class assignment—by having the student stomp on a piece of paper with the word “Jesus” written on it. That professor now teaches online only. Then came an incident in April, in which another professor posted a blog that questioned the official accounts of the Boston Marathon bombings, saying that it was a “mass casualty drill” staged by the government. Also in April, a group of pro-Palestinian students who protested an Israeli speaker on campus (by unfurling a WAR CRIMINAL banner) were heavily sanctioned, put on probation, banned from leadership positions and put through community service and diversity training. Those students are still publically complaining about the school’s heavy-handed reaction. By late spring, FAU’s board of trustees
had pretty much had it with president Saunders’ mishandling of potentially embarrassing situations. First, they decided to cancel the plan to name the stadium for GEO. Then, despite her considerable success with expanding FAU’s scholastic prowess (she came from the academic ranks, after all) the board asked her to step down. She resigned in May; she is currently conducting a feasibility study on whether FAU should launch a physician’s assistant program. Now FAU is in the process of searching for a new president; last month that process was jumpstarted with the selection of executive search firm Parker & Associates to help them find the right person. In the meantime Dennis Crudele, FAU’s senior vice president for finance and administration who took over Saunders’ role, will continue on as Interim President. Crudele’s administration has already sparked a tad of controversy, albeit in an attempt to calm things down. In July, the Division of Student Affairs posted a brief “Free Speech and Campus Civility” statement requesting that, “everyone in the FAU community behave and speak” in ways that aren’t “racist, religiously intolerant or otherwise degrading to others.” While the posting seems well intentioned—the school calls it “an aspirational statement of values”—in August the Foundation for Individual Rights in Education (FIRE) criticized it for violating the free speech rights of students. That smack was followed by a slam from the national online news publication The Daily Caller, which declared FAU “quite obviously the worst place in the United States to attend college.” While this is an absurd exaggeration—FAU has improved radically since the days it was nicknamed “Find Another University”—it’s one more sign that whoever becomes the permanent president has to understand that communication skills, and how to deal with tumult, are as important as academic credentials. ● BOCADELRAY LIFE • SEPTEMBER 2013
