Dispute resolution Our dispute resolution practice has been covering Asia for over 50 years and we have offices in Singapore, Hong Kong, Shanghai and Beijing. We offer a Singapore law contentious practice and across the region have the ability to deliver English and Hong Kong advice. We represent clients in local and cross border matters in Asia and around the world covering international jurisdictions and domestic commercial litigation cases. International commercial arbitration is often the most appropriate dispute resolution for resolving issues in both domestic and cross-border business. Many of our lawyers have worked for arbitration centres and served as arbitrators.

Our litigators have extensive experience in acting and advocating for clients in litigation in all levels of Courts in England, Singapore, Hong Kong and China, as well as both ad hoc arbitrations in London, Hong Kong, China and Singapore and arbitrations governed by ICC, LCIA, UNITRAL, HKIAC, CIETAC, SIAC, CMAC and LMAA rules.

We have experience in all of the major Asian arbitral centres in Beijing, Hong Kong and Singapore. We also have experience resolving disputes in China. Although foreign law firms may not appear in local Chinese courts, our lawyers assist clients in supervising, managing and overseeing the progress of domestic arbitration and related award collection proceedings in China, often resolving disputes before they reach the court room. We can also assist clients with negotiating and drafting arbitration agreements to protect their rights in international transactions and provide risk mitigation advice to avoid issues arising. Sometimes overlooked, we advise on the important issues of appeal (it’s not always easy to appeal an arbitration Award) and enforceability (not always as easy as it should be), as well as on the interaction between arbitration and Court proceedings, particularly as regards attaching assets to secure a claimant’s position.

Acting for a major Chinese oil and gas company and successfully defending claim by sellers under a contract for the sale of coal in SIAC arbitration. Represented Chinese commodities trading company in SIAC arbitration against arising out of the change in price and late delivery. Defending the seller of a vessel against claims by the buyer for misrepresentation and breach of contract. The dispute was governed by Singapore law and arbitrated under the SIAC. The buyer’s claims were dismissed and cost was awarded to the seller another major. Represented one of Singapore’s leading power generation companies and key provider of energy solutions in a complex SIAC arbitration against oil and gas company over a multi-tiered gas supply agreement. Acting for a high net worth Indian seller in SIAC arbitration in a dispute over iron ore sale contract with a Chinese buyer arbitration construction dispute with contractor. Advising an Australian pipe supplier and the buyers in a Hong Kong arbitration arising out of a dispute over a cargo of iron pipes which was damaged when shipped from China to Australia. Acting in an HKIAC arbitration in relation to a dispute regarding whether or not an anchorage near Shanghai on the Yangtse River was safe for a ship to conduct loading operations given the high level of fishing activity at certain time. Acting in a series of SCMA arbitrations for the buyers under shipbuilding contracts for Offshore Supply Vessels in connection with claims for cancellation of those shipbuilding contracts as a result of excessive delay on the part of the shipyard concerned. Acting for an Indian conglomerate to defend a claim by a coal trading firm in a commodities dispute in SIAC arbitration. Acting for the contractor in a KLRCA arbitration in relation to a dispute in the hundreds of millions of US dollars arising out of the construction of a semisubmersible floating production system for deployment offshore Malaysia. Acting in an HKIAC arbitration over a claim for losses arising from damage to the client’s cargo during discharge and improper stowage. Advising a Chinese shipyard on its dispute, subject to LMAA arbitration, with an owner who refused to pay due to alleged design defects in sea trials. Acting for a subsea construction company in a BANI arbitration in relation to disputes arising out of the installation of risers in a project offshore Indonesia and subsequent assistance in connection with efforts to enforce the resulting BANI arbitration award.
