Spinal fracture diagnosis delay results in successful out of court settlement
The medical negligence team advised our client to enter court proceedings which resulted in a £50,000 settlement. The client had injured his back following a fall caused by diabetes which was misdiagnosed following many visits to hospital, his GP and chiropractor. The defendant admitted the fracture should have been diagnosed earlier, but said that our client would still have had pain and reduced mobility due to the injury sustained.
Failure to diagnose glaucoma leads to serious loss of vision The team negotiated a settlement of £165,000 prior to trial for our client who experienced a change in vision which was later found to be glaucoma. If diagnosis had not been delayed by four years and treatment started much sooner, our client’s loss of vision would have been relatively mild, contained to his peripheral vision and more easily stabilised. It would not have required such invasive treatment. However, the delay resulted in extensive visual field loss, likely to increase further despite eventual treatments and potentially leading to total blindness and significant disability.

The medical negligence team agreed a £20,000 settlement following the misdiagnosis of a 97 year old man who was experiencing reduced vision in his right eye. The defendant admitted our client had been misdiagnosed and there was a delay in his actual diagnosis as well as a failure to properly investigate his symptoms. It was also admitted that had earlier treatment been given the gentleman’s eyesight would not have deteriorated to the extent it did and he may well have retained some vision in his right eye.
