Supreme Court has ruled: Towns can't restrict political yard signs

A

s county elections loom the fifth of August, candidates are putting up political signs and yard signs across the county, including the City of Selmer, where the city mayor is enforcing a sign ordinance that some consider a violation of First Amendment rights. There is a simple solution according to legal experts for candidates who want to put up political yard signs bigger

than the local laws allow. To put them up whenever they want and leave them for however long they choose, to just challenge the local law. The New York Civil Liberties Union says a unanimous 2015 decision by the U. S. Supreme Court clearly called regulating signs based on content unconstitutional. The confusion and debate about political signs is one that was never enforced by the previous city administration. Residents are further confused as are some politicians, about how the ordinance

is being applied. “I can't stress to people enough that any ordinance they don't agree with to voice their concerns. We are open to discussion,” said Replogle. In many arguments across the country regarding political signs, the courts have made it clear that aesthetics and traffic safety are not compelling reasons to regulate signs. There is a question of constitutional rights being violated under United States Supreme Court rulings in “City of Ladue v. Gilleo,” “Reed v. Town

of Gilbert” and “Wilson v. City of Bel-Nor.” County Mayor Larry Smith put up a number of large signs around the city weeks ago. It wasn't until other candidates put up signs, like Clifford Wynn,

who is a challenger in the county mayoral race, that the ordinance become an issue. Wynn reportedly put up signs at the Highway 45/64 intersection and only had about 8 small signs in the ground when

he received a call from Building Inspector, Jim Replogle, that his signs were in violation of the city sign ordinance and need-

Walking Tall Music Fest set for June 4 By Janet Rail Publisher

A

one day music festival, Walking Tall Music Fest, is set for Saturday, June 4, in Adamsville City Park marking a first to honor the late Sheriff Buford Pusser sponsored by the Buford Pusser Home and Museum and the City of Adamsville.

Pusser served as sheriff of McNairy County from 1964 to 1970 and is known in history as a legend in law enforcement. Pusser was no stranger to music as the late singer Eddie Bond wrote and recorded several songs honoring Pusser, beginning with “Buford Pusser” in 1968. Pusser himself was also a recording artist,

with “It Happened In Tennessee,” released in October 1973 on Stax Records. Pusser is known for his war on moonshining, prostitution, gambling along the Mississippi– Tennessee state line. His efforts inspired several books, songs, movies and a TV series. Museum curator, Tina Mullis, is excited about the music fest and the entertainment lined up as people come from all parts of the globe. Headlining the fest is Georgette Jones, daughter of Hall of Fame husband and wife country artist, George Jones and Tammy Wynette. In fact, her parents performed at the very first Buford Pusser Festival and were friends with Buford. Charlie Rich and Johnny Paycheck also performed that day in 1973. Several fire departments including Finger, Leapwood, McNairy and Selmer responded to a structure fire at 1646 Finger Leapwood Road, Finger at 6 a.m. Tuesday morning, May 17. The home was known to many as "The Lemons Home." Upon arrival the home was engulfed in flames as firefighters worked to extinguish the blaze coming from the attic area but quickly overcoming the structure. There were no injuries reported, however, the fire was still under investigation as of printing.

CAT Crump recently hosted their first annual Farm Career Expo. 22 industry representatives and several hundred area high school students participated to learn what the the new Farming Operations

Technology Program had to offer. Lunch was provided as well as vendor demonstrations. Financial aid and employment opportunities were presented to the students. Local ag teacher Jeff Lipford took 32 Adamsville High

School students. Lipford stated, "The students were excited and had a great time meeting the various agriculture representatives. The interaction between students from the various high schools was a good thing to see. "

Baby formula shortages have you Circuit Judge Blake Neill seeks scrambling? election Here's a helping hand from local moms and a merchant

aby formula shortages are a national crisis with the recent out-of-stock percentage climbing to 43 percent as of early May causing parents across the globe to search for new formulas for their infants. After an initial post on the Independent Appeal and Miss Maggie's Consignment Pages for baby formula free to local parents, over 18,000 people viewed the post with hundreds of shares. WREG Channel 3, in Memphis, even picked up the story. A parent will do whatever it takes to feed their baby. In addition to the global pandemic causing supply chain issues, the Food and Drug Administration (FDA) pulled certain powdered baby formulas in February – including Smiliar, Alimentum, EleCare and Similar PM 60/40 made at a single Michigan facility by Abbott Nutrition. The recall was issued due to a possible contamination with Cronobacter, a bacterium that can cause severe foodborne illness. The FDA has received four reports of infants who were hospitalized after using the products where two of them later died. Stores removed the affected products from

shelves. Parents were already struggling to find formula but a local children's consignment shop owner, Dayna Patterson, felt she had to help local parents in dire need of formula and knew her mom's would be in for the assistance too. There are option available but you need to speak to your pediatrician for advice. Some grandmothers are suggesting going back to homemade baby formula, which is an option worth discussing. Miss Maggie’s Children Consignment Store is now a location to receive free infant formula, as available. “I have seen the panic from different moms and friends on my Facebook page and I just knew I wanted to help.” Selling kids clothing puts Patterson in touch with lots of mothers. “I mean, I sale kids clothes I wasn’t really sure what I could do, but I got to brainstorming and thought, you sale kids clothes, kids clothes newborn up to 14/16 and encounter a lot of people with babies, ask them to help you help others. So that’s exactly what we did.” The store started collecting sealed and in date formula that other moms couldn’t use and give

it away tho those who may need it. After posting about it on Facebook, the reception in just three days was huge, according to Patterson. “Several people started pouring in with donations in exchange for a $5 coupon to my store.” By Saturday the store had given 54 cans/boxes away to families in need. “It’s such a warm feeling to be able to help someone in need. We often take things for granted and I strongly believe we should help others when our resources are plentiful.” “ God has been so good to me, I want to give back when I can, however, the community supplied The formula we have given

away, I am just glad to be the meeting place to give or receive.” The store is open Tues. - Fri. 11-4:30 and 10-1 on Saturdays. One can see updates on Miss Maggie's Facebook page of formula available. Plans are to keep this going as the need arises. “Formula is absolutely free but it is first come first serve basis. We will give away two cans per family per week,” said Patterson. Brands and amounts change so check on a daily basis. This is a blessing for many local families thanks to the generous donations of local moms and a merchant willing to organize the effort.

omerville attorney Blake Neill was appointed in September 2021 by Governor Bill Lee to complete the unexpired term of the retiring Joe Walker III. Neill has since secured the Republican nomination and will be unopposed on the August 2022 General Election ballots for one of two Circuit Court Judge positions in TN's 25th judicial district. The 25th Judicial District includes Fayette, Hardeman, Lauderdale, McNairy and Tipton Counties. Judge Neill is committed to four principles to govern his service on the bench. He commits to be fair and impartial, to always remember the law in making his decisions, to serve with humility and integrity and to treat each person in the courtroom with dignity and respect. Neill will serve alongside veteran Circuit Court Judge Weber McCraw. McCraw will be on the ballot unopposed as well as an independent candidate. The two judges have jurisdiction over both civil and criminal cases in the 25th judicial district. Criminal matters make up a majority of the court docket. The judges also have exclusive jurisdic-

tion over personal injury cases such as medical malpractice, automobile accidents, and premise liability cases. They also oversee Recovery Court which is designed to assist individuals in recovery through an intensive and continuous supervised treatment in hopes to reduce substance abuse and recidivism. Neill holds a B.A. in Political Science from Union University, Masters in Theological Studies from Samford University, Juris Doctorate from Memphis School of Law. He was an associate with Rainey, Kizer & Bell, PLLC from 2010-2014 in Memphis. From 2014-2021 he was a partner with the Somerville firm of Matthews, Rhea & Neill. Early voting will be held July 15-30 at the McNairy County Election Commission, 530 Mulberry Avenue, Selmer. Election Day is August 4, 2022.

Huntington native brings her “heart of gold” to McNairy County Cynthia (Cindy) Duncan, a native of Huntington, is just one of those people who is truly a good person. She lights up the room with her kindness and her smile. Cindy teaches at McNairy Central, and also assist the Selmer Middle cheerleading team. She wants all to enjoy themselves. She lets each child know how proud they make her and she wants to give them the best experience possible. Cindy would give you the shirt off of her back. She is a giver. She makes sure kids in her care are treated like her own. She spoils them and loves unconditionally. A friend, Mary Tucker, stated “She pours her heart and effort into all of her children, only having two children herself, she takes care of every child like her own. Her eyes are filled with joy to see them thrive.” Cindy goes out of her way on a daily basis to help others. “She always puts herself last, and never asked for nothing in return,” said Tucker. She and her daughter love shopping local and are known to share photos, great products and more from a variety of businesses around the area and even tag them is social media. It is not uncommon to see her in Without Borders Nutrition, Mammy's Soap Co., The Inn and Miss Maggie’s Children Consignment buying local but also working to support them. They love bringing family and friends in town to show off Selmer and explore. Huntington had a gem in her, but we are so glad love called and she now makes her home in Selmer. Cindy is married to Casey and they have two children, Aimee and Ethan. Duncan not only teaches full time but still helps coach the SMS cheer team. She is currently working to finish her Masters in English. Everyone needs someone to cheer them on and she does just that. Thank you Mrs. Cindy for loving God and loving His Children. She has also worked with her mom as a backup singer but have come into her own. A review of her 2019 record Skin stated an inspired work with one great song after another with excellent performances by Georgette and all the players involved. The results speak for themselves as the singer/songwriter's pedigree did not pass her up. Jones goes on state at 7:30 p.m. Gospel music fans will welcome Steve Warren at the fest. Warren, as a young child, began playing drums and singing with his family. When God called him into a ministry of his own, he continued the gospel through song. In 2001, Warren joined Sims Records in Nashville and in 2004 wrote a song, along with his wife, “Heaven on Her Mind” which

became a number one song on Christian Country National Charts. Over the past years, Warren has had many chart-topping singles and is known as a great entertainer. Warren will be on the stage beginning at 6 p.m. At 4:30 p.m. a local favorite Wayne Jerrolds & the Savannah Grass will perform bluegrass for the crowd. Jerrolds is a champion fiddler and mandolin player and is well known for his picking. Most folks just mention the name and people come to hear some great music. There is not much more to say about Wayne Jerrolds, to us he is one of the great musicians of our area. Starting the fest is Ezella Robinson, an artist, songwriter, author, speaker, playwright and actress is a hometown girl from Adamsvile. Robinson is an uplifting contemporary gospel artist and recently

To date, Wynn has not put any additional signs in the city. Candidate Pam Carroll, incumbent county commissioner, running in the 3rd District put signs up last week in the city limits. “I put the signs up in the exact location I did four years ago. I was shocked when I got a call telling me to remove my signs from Mr. Replogle. He told me that the past administration did not enforce the policy but the new administration was enforcing the policy and I would have to remove my political signs,” said Carroll. “My husband and I did remove my signs that evening.” Replogle said he would share the ordinance on social media to make all residents and politicians aware of the sign ordinance. “I did confirm that the policy was posted,” said Carroll. Some candidates were told that some signs were

on private property and not in violation of the ordinance, However, Carroll requested a copy of the ordinance and noted that it stated that no political sign could be put up prior to 60 days before the election. “I texted another candidate, Brian Dickey, who is running as an incumbent for Register of Deeds and told him that he might want to take down his signs in the city if you do not want a call from codes enforcement,” Carroll said. “I called Mayor Inman personally and she said we were going to call ya'll in the morning. The mayor stated there was no hurry, they were going to get clarification. That night I spoke to Pam Carroll, Clifford Wynn, John Finlayson and Mayor Inman and I was removing my signs,” said Dickey. Carroll did follow up with Replogle about how the policy was not being applied equally to all candidates. “If we are going to obey the rules, then we should obey them all. With that being said, I believe all the signs need to be taken down,” said Carroll. Replogle agreed, and

said that he would address candidates who had signs up in violation of the policy. County Mayor Larry Smith's signs were removed that evening. “According to Vice Mayor Finlayson, we should have left the signs up and were in compliance to his knowledge. I was told by Jim Replogle that the signs were ok and in compliance. Then this came up, so I am not sure what is going on. I do not want to violate any ordinance we just need clear direction,” said Smith. Was the sign ordinance applied fairly and equally to all candidates? That is a question residents need to ask local administration. This ordinance does not apply in the county. Both Selmer and Adamsville have sign ordinances. According to the ordinance, political signs in Selmer are not allowed until June 5th, 60 days prior to the election. The larger question is if the City of Selmer ordinance needs to be revised to reflect the Supreme Court decision.

Veterans Coalition desires to assist all local veterans Summer Vet Fest June 25

he McNairy County Veterans Coalition is a group of dedicated persons with a mission to enhance the lives and livelihood of local veterans. They are planning a Summer Vet Fest for Saturday, June 25 at Selmer City Park.

Ten percent of the county are represented by veterans and the purpose of this event is to provide information to veterans, provide fellowship, and assist veterans with veteran's benefits. The day will be filled with live music, great food, and lots of information and assistance for veterans and their family. Some resources include information on how to file VA service connected disability claims, how to get a copy of your DD214 Discharge form, key Memphis VA Medical Center programs will be presented, a tour of the Mobile Vet Center with representatives available and local commu-

nity organizations set up and ready to serve. The committee plans to recognize McNairy County Korean War Veterans and presenting the Military Korean War Ambassador for Peace Medal to veterans that served in Korea during the war event. Just as important, the committee hopes to provide events that promote fellowship and recognition of local veterans, raise awareness of their contribution to country and community, promote the veteran population in the county and identify opportunities to benefit veterans and promote such causes in the county. The McNairy County Veterans Coalition will form a 501(c)(3) in the near future. Committee members are Jim Johnson, Wendy Worley, Amanda Fisher and Allen Strickland. OBITUARIES Ronald Jaggars May 6, 2022

R

onald Jaggars, age 74 of Hornsby, passed away Friday, May 6, 2022, at his home in Hornsby, Tennessee. He was born on Father's Day, 1947 at home in Stantonville to the late Amos F. and Inez Lucy Massey Jaggars. The family later moved to Hardeman County where Mr. Jaggars lived most of his life. A 1967 graduate of Middleton High School, he served our country in the US Army achieving the rank of Sergeant and was a firearms specialist. During his tour of duty, he was a sniper and Platoon Sergeant near the demilitarized zone in Korea.

Mr. Jaggars was united in marriage to Ramona Vaughan on February 5, 1971. He spent his working life as a supervisor in several factories in the area. He worked at Reichold Chemical in Grand Junction, Ring Container Technologies in Oakland, Bruce Hardwoods in Jackson and retired from Maxwell Hardwood Flooring in Monticello, AR. It was there that he and Mrs. Jaggars lived from 1994 to 2016 before returning to Hardeman County. An avid outdoorsman, he enjoyed hunting, fishing, boating, camping, and

gardening. He also liked to attend NASCAR races but especially loved and cared for his grandchildren. He was baptized at Stantonville church of Christ and attended Baptist church with his wife. Services were at 11 A.M., Monday, May 9, 2022, at Shackelford Funeral Directors in Bolivar, Tenn. with burial at Shandy Cemetery. leeta Cagle Teague was born July 14, 1965 in Nashville, Tennessee, the daughter of the late Robert Harlan, Sr. and Daisy Coughran Cagle. She was united in marriage to Kenny Teague on April 14, 1984. Aleeta was a 1983 graduate of McNairy Central High School and earned an Associates Degree from Jackson State Community College. She was employed as a legal secretary for Simpson & Simpson Law Office in Selmer, Tenn., for approximately 35 years. Fishing, spending time with her family, working with Boy Scout Troop 231, spoiling her two grand-dogs, Sadie and Oakley, and going on family vacations (especially to the beach) were some of Aleeta's favorite activities. She attended Ramer Baptist Church and was a former member of the Selmer Kiwanis Club. Aleeta departed this life on May 10, 2022 in Ramer, Tennessee at the age of 56

oris Harper Phelps was born November 23, 1931 in Flat Rock, Kentucky, the daughter of the late C. C. and Mary Dee Beavers Harper. She was united in marriage to Earl Phelps on March 23, 1951. Rev. Phelps preceded her in death on April 21, 2016, following 65 years of marriage. Mrs. Phelps was a 1949 graduate of Fredonia High School in Fredonia, Ky. Her first job was that of teacher in a one room schoolhouse in Flat Rock, Ky. She retired from USAA Insurance, having worked at the home office in San Antonio, Texas, before transferring to Tampa, Fla. She also worked as a bank teller for First State Bank in Covington, Tenn. As a young mother Mrs. Phelps sewed all her daughter's clothes, did crafting and woodworking with her husband, and embroidered multiple items for the public. She was an avid Adamsville Cardinals sports fan, and was always ready to go if there was a trip to be taken. Mrs. Phelps was a faithful minister's wife who followed her husband wherever he was appointed, and was a lifetime member of the Cumberland Presbyterian Church. Mrs. Phelps departed this life on May 9, 2022 in Selmer, Tennessee at the age of

She was born January 9, 1929 and raised at Finger, the daughter of the late James Samuel Allen and Vera C. Smith Beene. She attended elementary school at Finger and graduated from Bethel Springs High School. She married C.H. Phillips November 13, 1948 and made their home in Henderson since 1962. She had worked at Brown Shoe, Owens Corning Fiberglass and General Electric in Selmer. She was also a licensed beautician working from home. She was a member of the Henderson Church of Christ since 1962. She was a member of the VFW Auxiliary. She and C.H. attended the annual reunions of the USS Iowa for many years. She was a member of the Chester County Senior Citizens and had earned hundreds of medals at the Tennessee Senior

Use the wrong words and you risk being misunderstood. If the words you choose aren’t clear, no one will know what you’re talking about. We all know the frustration of interacting with people who can’t convey a cogent thought, regardless of how much they say or write. Words are the essence of human interaction. They are used for teaching and learning. The ability to clearly com-

municate your thoughts is priceless. Not being able to explain yourself is frustrating. Shouting or yelling is never a replacement for using the appropriate words. Words once used can’t be recalled. Everyone has their own examples where they regretted the words they used. Thinking before speaking always works in your favor. s a concerned citizen of the Town of Selmer and an active member of Selmer Senior Center, I want to express my concern over the current condition of the parking lot at the Senior Center.

The concrete/pavement is in desperate need of repair or total replacement. I have already fallen and I am aware of others that have also fallen as a result of the broken pavement. I understand funds are available and they need to be used immediately to create a safer environment for our senior citizens. So far there has not been a serious injury, but the next injury could be very costly to the City of Selmer.

The Other Meaning of the Phrase “Perfect 36” By Bill Carey

I

f you have any interest in history, you know how Tennessee became known as the “Perfect 36.” You know that in 1920, states across the country were approving the Nineteenth Amendment, which made it illegal for any state to deny women the right to vote. You know that, as fate had it, 35 states approved it by August of that year, leaving open the possibility that Tennessee could become the 36th and decisive state (threefourths of states have to approve an amendment for it to pass, and there were 48 states at the time). You know that on August 18, 1920, the Tennessee House of Representatives approved the Nineteenth Amendment by the narrowest of margins –thus the origins of our state’s status as the “Perfect 36.” However, here’s something I recently learned, and I need to give credit to journalist Betsy Phillips and Nashville tour guide David Ewing for pointing this out to me. In the early part of the twentieth century, the phrase “Perfect 36” had a different meaning. Reporters who used the phrase to describe Tennessee in 1920 knew the double meaning, and they used it to be funny and, well, sexist. There was, in 1918, a silent movie starring Mabel Normand called “The Perfect 36.” The title of the movie referred to Mabel’s upper body measurement. According to its Wikipe-

dia summary, “the plot involves Normand's clothes being stolen in a mixup while she was swimming, necessitating her spending most of the film running around naked trying to straighten everything out.” We can safely assume that any movie made in 1918 was modest compared to what we’re used to a century later. But “The Perfect 36” got a lot of publicity, and parts of it were censored by several state and local film boards (apparently the federal government wasn’t in the business of doing this yet). I can’t find any evidence of such a promotion in Tennessee. But I do know that “The Perfect 36” played at Nashville’s Vendome Theater, Memphis’s Empire Theater, Knoxville’s Strand Theater, Chattanooga’s Alcazar Theater, Clarksville’s Lillian Theater and Greeneville’s Princess Theater at various times in 1918 and 1919. There’s more. Back then, traveling musicals were a big part of the entertainment scene. In 1919, one of the big hits was a musical comedy called “Flo-Flo and Her Perfect 36 Chorus.” The Flo-Flo show, I’ll call it, came to Nashville, Knoxville, Chattanooga, Johnson City and Greeneville that year. “Flo-Flo boasts the only comedy chorus ever assembled for a Broadway appearance,” said the Chattanooga Daily Times. “A sense of humor is only one of the accomplishments of the bride-shop mod-

els. Each one is also a ‘perfect 36.’” A perfect 36 in what way? You mean she could sing, dance AND march for the right to vote? I think not. All this explains why suffrage leaders generally didn’t use the phrase “Perfect 36” at the time. Even in 1920, the majority of the times the phrase “perfect 36” appears in newspapers, it was in reference to a woman’s measurements. Over the years, the public forgot about Mabel Normand’s film and the Flo-Flo show. The public did not, however, forget about the passage of the Nineteenth Amendment. The phrase “Perfect 36,” meaning Tennessee and the suffrage movement, has been used in recently years as a book title (by my friend Paula Casey) and a Tennessee State Museum exhibit. The first 100 women who donated $1,000 to fund the suffrage monument in Centennial Park are collectively (and proudly) known as the “Perfect 36” society. So, it’s okay to use the phrase the “Perfect 36” in the context of Tennessee’s suffrage. It’s also okay to laugh about Mabel Norman, the FloFlo show, and what the phrase used to mean. It is, I suppose, an amusing example of how things have changed. Bill Carey is the founder of Tennessee History for Kids, a non-profit organization that helps teachers cover social studies.

Dinner on the Diner with the Watauga Valley Railroad Historical Society & Museum

Dinner on the Diners event is coming up on Saturday evening, June 25, 2022, in Jonesborough, Tennessee’s oldest town. Proceeds from ticket sales will help fund the restoration program of Watauga Valley’s historic rail passenger cars, and to fund new exhibits and educational experiences at the Chuckey Depot Museum. The museum is housed in the former Southern Railway train depot, which Watauga Valley Railroad Historical Society & Museum (WVRHS&M), the town of Jonesborough, and the Heritage Alliance partnered to relocate and preserve. The highlight of the evening will be an elegant meal in one of WVRH&M’s vintage dining cars, followed by stories from an authentic Railroad Storyteller. We will also have train songs by the

Trunk Monkes. This unique opportunity allows young and old alike to relive a bygone era. The Clinchfield 100 began its long life in 1911 when it was built by the Pullman Company for the ACL as Coach 964. In 1929 it was rebuilt as a dining car and renamed the Orlando. It operated between Washington, DC and Miami for the next 40 years. It was purchased in 1951 by the Clinchfield Railroad, headquartered in Erwin, TN, where it was used as an executive car for another 32 years, including service on the locally famous “CSX Santa Train” out of Kingsport, TN. The WVRHS&M bought Car 100 in 2013, completely restored it, and renamed it the Clinchfield. In 2019, it once again served as the official Santa car on the CSX “Santa Train” after a 37-year absence.

The Clinchfield 100 just turned 111 years old. Dinner will be served at 5:00 p.m., 5:45 p.m., 7:00 p.m., and 7:45 p.m. Diners may choose a table for two or four. Parties with fewer than four will be seated with other diners. You must pick a seating time and an entrée option when purchasing tickets. Please dress casually for comfort while boarding, dining, and listening to the storytelling. Come enjoy this dining experience! All tickets must be purchased in advance. Tickets are $56.00 per person and are available at the Jonesborough Visitors’ Center, located at 117 Boone St., or by calling [423] 753-1010, between 9 a.m. and 5 p.m. Tickets may also be purchased online at www.jonesboroughtn.org.

Miss Rockabilly Pageant a success

ixty-one contestants participated in the Miss Rockabilly Pageant at the Selmer Community Center on Sunday, May 15, presented by Selmer Parks and Recreation and McNairy County Chamber. The pageant featured tiny tot 0-12 months to girls ages 16-18 dressed in their pageant finery.

The number of contestants made the event one of the largest Miss Rockabilly Pageants to date, according to organizers. Below are the winners in each category. All winners will participate in the Rockabilly Highway Revival on Saturday, June 11, downtown Selmer.
