Really?Clearly,thattitlelinemust berhetorical.Ofcourse,theFAA doesnotopposeflightsafety…or doesit?Mostreadershaveexperiencedthe policiesandpracticesofvariousgovernmentbureaucracies(Federalandlocal) thatseemtodefycommonsense,some evenbeingcontrarytothemissionstatementofthebureaucracyitself.Suchexamplesareregrettablyplentifulwithmany regulatoryagencies.Weareinclinedto passoffsuchfoolishnessassimplyan indicationofbureaucraticignorance,or thecloserelativeofignorance,stupidity. Butsurely,theFAAwouldnotoppose flightsafety…wouldthey?

Sorrytosay,butarecentpolicy(not regulation) recommended by the FAA Associate Administrator for Aviation Safety,Mr.AliBahrami(headoftheFAA Aviation Safety organization, “AVS”) seemstargetedatreducingaviationsafety byestablishingsignificantimpedimentsto apersonwhoownsorfliesaRestricted, ExperimentalorPrimarycategoryaircraft. Yes,thatincludes“homebuilts,”witha convolutedlegalinterpretationthatcould extendintoflightinstructingasawhole. Why,onemustreasonablyask,would anyonewishtocomplicateand/orreduce theavailablyofflightinstructionforthe improvementofpilotskillsandsafety… especiallywithrespecttotheoftenspecific characteristics of Limited or Experimentalaircraft? Regrettably,Mr. BahramiretiredonJuly1stofthisyear,as heandtheAviationSafetyorganization (AVS)havedrawnheavypoliticaland legalfireforeventsinvolvingtheBoeing 737MAX.We mayneverknowMr. Bahrami’s motives. His temporary replacement, Deputy Associate Administrator for aviation safety, Mr. ChristopherRocheleau,willmostlikely sail the course set until a permanent Associate Administrator for Aviation Safety(typically,apoliticalappointee)is selected. Hopeful, FAAAdministrator SteveDicksonwillstepinandexercise levelsofknowledgeandcommonsense thatwillresolvetheissuesinvolved.

Thefederalizationofaviationinthe UnitedStatestookplacewiththepassing oftheCivilAeronauticsactof1938, resulting in creation of the Civil Aeronautics Administration (CAA), directpredecessoroftoday’sFAA.The FAAcameintobeingonAug.23,1958, asareplacementfor,butalsocontinuation of CAAresponsibilities and policies. Bothoftheseagenciesrecognizedthedifferencebetweenflightinstructingand “carriageofpersonsorpropertyforcompensationorhire”requiringanaircarrier or commercial operator certificate. Specificregulationsweredefinedforairlinesandcharteroperations,oftenrequiring an “Operations Specifications,” meaninganapprovedplanfordoingbusiness,sometimesmorecomplicatedthan theregulationsthatrequiredsuchadocument.Astudentpilotwasnotconsidered apassenger,butisnowreferredtoas,“a learner,”payingfortheservicesoftraining.Paymentforstudentflightinstruction hasconsistentlybeencharacterizedas paymentforinstructionandnotforcarryingapersonorapassengerinanaircraft. Thisseparationwas,andis,important. Flightinstructionmaybereceivedwithoutthesometimesoverwhelmingregulations involved in common carriage, whichis“holdingoutforhire.”Theseparationof“commercialoperations”and “flightinstruction”hasbeenparamountto theU.S.becomingtheaviationtraining leaderoftheworld.Theonlycaveatto thistraditioncameintheformofFAR 91.315, which prohibits the use of Limited (most often warbirds) or Experimentalaircraftfrom“carryingpersonsorpropertyforcompensationor hire.”Additionally,flightinstructionwas onlyallowedinexperimentalaircraftfor thepurposeofmakeandmodelfamiliarization,butnotprimarycertificatetraining.Thebottomline,theownerofsuchan aircraftcouldhireaqualifiedCFIand traintoahighlevelofcompetencyand safetyintheirownaircraft.Beginningin 1998,theFAAappearedto(butdidnot providepublicnoticeofanynewpolicy or regulatory requirement) encourage individualsandflightschoolsproviding forfeeinstructioninaLimitedcategory
