Opening Note Winning Attitude

T

his issue salutes the 2013 Best Independent Insurance Agencies to Work For. They all say it’s an honor to be recognized. Given that employees are the ones doing the rating, it is a well-deserved honor. They all say it makes them proud — owners and employers alike — as it should. We say the honor is ours and it makes us proud, too, to get to know them. It is humbling to go through the many entries and realize what a great industry this is to work in. There are so many agencies out there that do the right thing for their employees. It is humbling to speak with these owners and employees and learn how they got where they are, how they survived the downturn and soft market, and how they remain committed to their customers and to one another. The best agencies to work for are not necessarily the biggest, or the ones that pay the highest salaries, offer the best benefits, or have the best public relations agencies. They could be or have those things, but those things have very little to do with being the best workplace. Agencies are not great places to work because they have great products or services. They don’t necessarily have great customers. Their physical offices may be nondescript. The best workplaces are about people and relationships. Happy employees have great relationships with their immediate boss or supervisor, and hold their agency owner or principals in high esteem. The best workplaces foster good communication, so that everyone knows what is expected and where the agency is going. The best agencies are about teamwork. They make sure that employees understand the agency’s game plan and that everyone’s contribution is important and rewarded. The best agencies are about sharing; they are places where when the agency does well, everyone benefits. The best workplaces care about community. Every single outstanding agency gives back in some way. It’s a big reason employees take pride in their place of employment. Hundreds of customer service representatives, account executives, producers, managers and other agency staff nominated independent insurance agencies for this year’s survey. They really are all winners. This competition barely scratches the surface of the employment picture in this industry. For every winner profiled in this issue, there are probably hundreds of others in cities and towns across the country that could have won. Congratulations to the winners in this issue and to the many more winners out there who are doing the right thing for their employees.

News & Markets Missteps in Employee Hiring Costly for Agencies: MarshBerry

F

or most lines of insurance business, commission income is growing, and most insurance agents and brokers expect profits to be similar or better in 2013 compared to 2012. That’s according to the 28th Annual Market & Financial Outlook Survey by MarshBerry launched in conjunction with Insurance Journal in June. By Megan Bosma The survey — which compiled anonymous general independent agency information along with financial, market, carrier and technology data — indicates that there is an optimistic outlook for the insurance industry. Sixty-three percent of survey respondents indicated that they are increasing headcount in the next year. Continued employee reinvestment is a positive sign for the industry. Hiring new employees is necessary for future growth. However, missteps in employee hiring can be very expensive.

Fixed costs of hiring new employees include recruiting and headhunter fees, costs associated with posting positions on a job board, referral fees paid to employees, as well as costs for licensing and outside training. Hidden costs are more difficult to quantify. Those costs include the knowledge lost when a trained employee leaves, lower productivity for the individuals who need to assume additional work until the position is filled and the time spent reviewing resumes, interviewing candidates and making job offers. There are also costs associated with internal training. A knowledgeable team member must train a new employee on an agency’s processes and procedures, as well as spend time checking their work, until the new employee is up to speed. Based on MarshBerry’s proprietary financial management database, “Perspectives for High Performance,” 52 percent of employees terminated in 2012 were hired in the previous three years. For 2012, the first year turnover ratio was 20 percent. That means that 20 percent of employees terminated in 2012 also were hired in 2012. Of the employees terminated in 2012, 19 percent were hired in 2011 and 13 percent

Develop a Plan Similar to other areas of the business, an agency should develop a plan to hire, bring on-board and retain new employees. However, many firms have not invested the time or money to build strong employee retention strategies that include career paths and corresponding compensation scales, clearly defined job descriptions, on-going meaningful performance evaluations, and effective on-boarding and training programs. A Few Ways to Reduce Employee Turnover

T

here are several ways to reduce employee turnover. First, review agency compensation packages to ensure commission rates, salaries and benefits are in line with the market. Start by benchmarking compensation by position against insurance agencies of a similar revenue size, with similar average account sizes, or in a similar region or metropolitan area. Next, develop salary bands or ranges for each position. To retain key employees, it is important to link pay to performance. Recognize above average employees and reward them for their efforts. Before posting an open position, develop a position description to outline the roles and responsibilities, and identify 10 | INSURANCE JOURNAL-NATIONAL October 7, 2013

the necessary skills for the position. It is critical to select the right person for the position. Utilize employee assessment tests to screen the candidates and identify whether their personality characteristics will match the position. Once hired, employees need to know what is expected. Communicate the roles, responsibilities and goals for each position. In addition to annual performance evaluations, employers should regularly praise good efforts and provide feedback on the individual’s performance. Create career paths to illustrate how an individual’s career could progress through the organization. Implementing a four-tier service model allows service

personnel to progress from an entry-level processing role to a high-level account executive. Provide opportunities for employees to share their knowledge. This can occur through one-on-one training sessions and mentoring. For example, the mentor assigned to a new producer should be an experienced producer who provides direction about the types of business to target and assists with sales training by going on new business calls. Employees will leave. Use the departure as an opportunity to get feedback on ways to improve the organization. Conduct exit interviews with employees to understand the positive and negative aspects of the agency. www.insurancejournal.com

News & Markets Idaho Fly Shop Owner Gets Jail Idaho Gun Show Canceled Due Time on Workers’ Comp Law to Insurance Requirements

state judge has ordered a Coeur d’Alene, Idaho fly shop owner to serve five days in jail for violating a court order stemming from allegations he failed to provide workers’ compensation insurance. The Idaho Industrial Commission announced the penalty in September for Joe Roope Jr., owner of Joe Roope’s Castaway Fly Shop Inc. The commission won a judgment against Roope in 2011 after the store’s workers’ compensation policy lapsed for eight months. Commission officials also say the 2011 lapse followed two other periods where the business operated without insurance for workers. A state court ordered Roope to close his business until he obtained insurance, a requirement under Idaho law. In a statement, Roope did not address the commission’s allegations, but said the shop now has insurance and remains open for business.

embers of a southwestern Idaho gun club may have to end a decades-long tradition of gun shows because Ada County raised its insurance requirements after two people were injured in an accidental firearm discharge at the club’s show in April. The Idaho Press-Tribune reported officials with EE-DA-HOW Long Rifles canceled its Fort Boise Gun Show after Expo Idaho increased its insurance requirements to $5 million. The insurance would have cost the Kuna-based club $18,000 — more than it makes from the show. Expo Idaho Director Bob Batista said he did not know if the higher insurance cost would affect the other five guns shows the venue hosts each year. Gun show coordinator Kim Tish says the club is looking to find insurance at a reasonable cost.

Montana Residents Suing Over Petroleum Pollution

Synthetic Marijuana Death Prompts Lawsuit Against Colorado Store

early 50 Cut Bank residents have filed a lawsuit alleging their properties have been polluted by petroleum from a crude oil transportation and storage facility on the eastern edge of the city. The Great Falls Tribune reported the lawsuit was filed in U.S. District Court in Great Falls on Sept. 6 on behalf of 46 property owners that say petroleum discharged from the Tank Hill storage facility has contaminated soils and water, reduced property values and exposed owners to health risks. The lawsuit names five companies that operated and either owned or leased the tanks, pipelines, pump stations and related equipment on or near Tank Hill, which has been in operation since the 1930s. It was declared a Superfund site in 1994. The plaintiffs are seeking compensation, restoration of property damage and punitive damages. Copyright 2013 Associated Press. he death of a 19-year-old who died after smoking synthetic marijuana has prompted a wrongful death suit against a Colorado Springs convenience store. Stephane Colbert alleges that her son, Nicholas A. Colbert, died in 2011 after using a pot alternative called Mr. Smiley. He bought the product after Colorado lawmakers and the federal government banned the sale of synthetic marijuana earlier that year. Colbert seeks punitive damages, said her attorney, David Woodruff. The lawsuit was filed in Denver. Woodruff said it is Colorado’s first wrongful-death synthetic pot lawsuit. The Centers for Disease Control and Prevention has said it is investigating dozens of recent hospital admissions and three Colorado deaths related to synthetic marijuana use. News & Markets Allstate Wins Major Medical Fraud Lawsuit in Nevada

A

llstate Insurance Co. received a judgment of more than $7 million following a Racketeering Influenced and Corrupt Organizations investigation nearly 10 years in the making. It is the company’s first medical fraud lawsuit in the state. “Medical insurance fraud affects all policyholder’s premiums, and it’s not fair for consumers to pay higher rates for criminal behavior,” said Chelci Vaughan, Allstate spokesperson. The RICO complaint was filed in 2008 in the Las Vegas Federal District Court against chiropractor Obteen Nassiri, D.C., and his businesses: Advanced Accident Chiropractic Care; ONN Management; Digital Imaging Services; and Digital X-Ray. Since the suit was filed, the Chiropractic Physicians’ Board of Nevada has revoked Obteen

Nassiri’s license. Allstate’s lawsuit alleged Nassiri began defrauding Allstate in 2003 by exaggerating clinical findings, submitting improbable diagnoses, charging for treatment he did not provide, providing unnecessary and excessive treatment, grossly misrepresenting billing, making inappropriate referrals, and exhibiting a general pattern of illegal and fraudulent conduct. The jury in the case also found Nassiri’s spouse, Jennifer Nassiri, liable for negligent misrepresentation. The case accused Obteen Nassiri of running a practice that referred patients to his clinics for unnecessary medical consultations and expensive diagnostic studies in an effort to generate more revenue and profit. The verdict sided with Allstate in June

and the final judgment and award was made in late September. The total judgment against the defendants included an award to Allstate for $3.59 million in compensatory damages, $2.51 million in punitive damages and $1 million in pre-judgment interest. The company is pursuing more than $1 million in attorney’s fees and costs. The award means Allstate will recover money for the settlement of more than 150 auto accident claims that involved fraudulent costs. Allstate sought recovery against each defendant. California-based Confie Seguros named Darrin Silveria chief revenue officer. The national insurance broker focused on non-standard auto insurance and the Hispanic consumer created the new role to support the company’s growth and continued expansion. Prior to Confie Seguros, Silveria served as senior vice president and managing director of Trivista and spent more than seven years with T-Mobile, most recently as vice president and general manager. At T-Mobile he led a transformation of the retail and sales business. Prior to T-Mobile, he spent 15-years at PepsiCo and Pepsi Bottling Group, where he was responsible for the branded retail sales channel, developing strategy and tactics, as well as leading a team of sales leaders. Flood Issues Insurance Industry Changes to Follow Wicked Colorado Weather

A

s the sun peeked out of the normally bright blue Colorado sky, homeowners and businesses began to assess the damage done by the 100-year flood, as weather experts have labeled the devastating rain that pummeled the state’s Front-Range in September. As the weather improved, residents of the hardest hit areas immediately began dialBy Shane Christley ing their insurance provider for relief. According to industry experts, the total damage figure from Colorado’s flood event could potentially exceed $1 billion, after insurance claims from damage to homes, roads, bridges, other infrastructure and agricultural losses are estimated. Agents and brokers would be wise to familiarize themselves with companies that offer flood coverage separate from the National Flood Insurance Program. Chubb Personal Insurance, for example, offers replacement cost coverage up to $15 million, $7,500 in additional living expense and includes coverage for the basement.

In addition, 11,750 people were forced to evacuate. According to the Federal Emergency Management Administration, about 22,000 Colorado homeowners have flood insurance policies. With 2.2 million housing units in Colorado, according to Census figures, that means about 1 percent of the state’s residences have flood coverage. Other parts of the country have seen the devastation caused by Mother Nature and comparisons are being made to last year’s Hurricane Sandy that hit the northeast almost exactly a year ago. By comparison, FEMA estimates show Hurricane Sandy received a total of $5.6 billion in federal assistance that included: $3.5 billion in total National Flood Insurance Program payments made on claims to date; and $413 million in FEMA grants disbursed for individuals and households.

Ryan Specialty Group, S.H. Smith & Co. Ryan Specialty Group LLC has agreed to merge S.H. Smith & Co. Inc. into R-T Specialty LLC, the wholesale brokerage unit of Ryan Specialty Group. Terms of the transaction were not disclosed. S.H. Smith & Co. is one of the largest privately owned specialty brokerages in the country. Headquartered in Hartford, Conn., the firm is licensed in 50 states and works through a network of more than 2,000 independent retail agents. Formed by Scott Smith in 1982, S.H. Smith & Co. has more than 90 team members and manages its business across four segments: professional and management liability; commercial property/casualty; in-house underwriting; and program business. JLT, Towers Watson United Kingdom-based broker Jardine Lloyd Thompson Group plc (JLT) is acquiring the reinsurance brokerage business of New York-based Towers Watson for $250 million. JLT said the acquisition would provide “a very strong reinsurance platform” in the key North American market and bring further strength in the London market and in the analytical capability. The combined business will be branded for a transitional period as JLT Towers Re. Towers Watson’s reinsurance brokerage business generated revenues of $166 million and pre-tax profit of $26 million in the year ended June 2013, making it the fourth-largest reinsurance broker in the world, according to the announcement. Doeren Mayhew, Wolf-Hulbert Accounting and advisory firm Doeren Mayhew has merged with the Michiganbased insurance agency Wolf-Hulbert Co. LLC to form a new full-service insurance agency. Wolf-Hulbert will transition to the newly combined entity name, Doeren Mayhew Insurance Group (DMIG), on Jan. 1, 2014. Operations for the insurance group will move to Doeren Mayhew’s Troy, Mich., headquarters building in early 2014. Since its founding in 1884 in Detroit, Wolf-Hulbert has offered a comprehensive suite of property, casualty and life insurance to family owned businesses and large corporations, as well as personal insurance. ProAssurance, Eastern Insurance Holdings Medical professional liability insurer ProAssurance Corp. is acquiring monoline workers’ compensation insurer Eastern Insurance Holdings Inc. in an all-cash transaction that values Eastern at $24.50 per share. Lancaster, Pa.-based Eastern will become a wholly owned subsidiary of

ProAssurance. The transaction, with an aggregate value of approximately $205 million, is expected to close by Jan. 1, 2014, subject to regulatory and Eastern shareholder approval. The new exclusions now have an exception for insureds that are not considered to be “in the business of serving, selling or furnishing alcohol under the scope of the liquor liability exclusion simply by allowing someone to bring and consume their own alcohols on its own premises.” Many carriers offer discounts on liquor liability coverage to establishments that provide alcohol awareness education and training to employees.

challenges the company sees in the marketplace involves weather-related losses. “It’s not just strictly for restaurants,” Strommen says, “but obviously everybody is facing some challenges with the revisions in the catastrophe modeling.” She says major natural catastrophes during the past couple of years are causing insurers to view property coverages in certain regions differently: “It’s definitely something that has changed the market.” There also has been a change in underwriting appetite in some areas, “where we didn’t use to think of weather-related claims being a big issue, and it’s not just for coastal states,” she says. In the middle of the country, like Oklahoma and Kansas, there have been more wind deductibles being used because they are in the tornado alley, and they’ve had recurring disasters and catastrophic weather events in that part of the country, Strommen says. “Keeping up-to-date with underwriting for catastrophes and how to address them in the book of business is certainly a challenge for everyone these days,” she says. She also advises that as restaurants continue to experiment and seek new ways to boost revenues, it’s critical for agents and insurers to keep track of changes and assist policyholders in obtaining appropriate coverage. The Food Issue Insurers: Product Recalls a ‘Death Sentence’ to Food Manufacturers, Coverage Demand Still Lags By Amy O’Connor

F

ood recalls are on the rise, but that isn’t necessarily because food manufacturers are not meeting safety requirements and more food is contaminated or unsafe. In fact, insurers in the product recall space who insure food manufacturers say safety standards are higher than ever before, thanks in part to the Food Safety Modernization Act (FSMA) of 2011. According to FDA.gov, the FSMA has increased the frequency of inspections of food facilities by the FDA, required certain food testing by accredited laboratories, and given the FDA access to the records of industry food safety plans. All of this — and more — is being done to “ensure the U.S. food supply is safe by shifting the focus from responding to contamination to preventing it” according to the site. The FSMA also gives the government the authority to issue a mandatory recall whenever there is evidence or concern a facility’s food item could be contaminated, and when the food manufacturer does not voluntarily conduct a recall when asked. Turner says considering the increase in risk, the rate levels aren’t ideal, but that is the state of the market. He says carriers differentiate themselves from the increased competition by what coverages their policies provide. For example, XL’s crisis management consultants only work with XL, so they are not spread too thin when a recall occurs. “There can be tens, if not hundreds, of manufacturers involved in one recall, and we want our clients to get that service right away,” he says. The carrier also launched a government recall endorsement for voluntary or forced recalls when it launched a new product recall policy for the food and beverage industry in 2010. LIU has been working on its own market differentiators. It recently launched a product recall policy tailored to the packaging industry, including manufacturers of packaging for food and beverage products. The new Packagers Protection policy offers a form with product recall, product contamination or manufacturing errors and omissions as the potential trigger. Lubrano says the company has had requests from the packaging industry for a product like this because of the complexity of the food supply chain process and the difficulty of quickly identifying where the source of a contamination occurred. Food packagers often incur third-party costs associated with a recall, even if they are not responsible for the contamination. “Before this product, a food packager could buy a broad product recall policy or contaminated product policy, but nothing was specifically tailored to the packaging industry like this policy is,” he says. The coverage also includes crisis management services from red24, the firm that LIU uses for specialized loss control engineering and loss mitigation services. “Insurance agents and brokers and suppliers need to understand you are exposed wherever you are in the food chain. From growers to the retail level you can contaminate a product and have the exposures,” Lubrano says. “There is no specific niche that doesn’t need this coverage.” www.insurancejournal.com

Professional Liability E&O Insights: How Well Do You Know Your Accounts?

P

rofessional liability, or errors and omissions as it is also known, is a unique line of business. After all, how many other lines of business have terms like claims made, claims made and reported, retro dates, tail coverage? Not many. On top of that, it is widely known that no two policies are the same, which presents unique challenges, By Curtis M. Pearsall especially when looking to move coverage from one carrier to another. While all of the issues have resulted in a fair number of E&O claims against agents selling this line of business, there are additional issues that agents need to be acutely aware of. New App Every Year With most professional liability carriers, there is a requirement that a new application be completed each year. This is not always the case based on the type of professional liability, the nature of the risk and the size of the account. However, for accounts that have professional liability coverage, it is essential that producers factor the possibility of a renewal app into their renewal process. If a renewal app will be necessary, producers should identify this requirement early on and make sure that they know exactly what app will be necessary. As professional liability carriers update their apps to ensure that they are aware of the exposure, agencies should not count on the fact that last year’s app is still the current one. Sufficient Time Give your carriers sufficient time to underwrite the account. Most professional liability carriers will request the app 30 to 45 days before the expiration date. There may have been times in the past where they were able to turn the app around in less time, but don’t count on it, especially in a 28 | INSURANCE JOURNAL-NATIONAL October 7, 2013

hard market where the application activity could be on the rise. To accomplish this, it will be necessary for the agency producer to meet with the customer approximately 60 days prior to the expiration date to get the necessary application questions completed. Account Changes Don’t expect that your account looks the same today as last year. One of the reasons that carriers want a new app on a frequent basis is to make sure that the carrier is aware of any changes in the exposure and that they are comfortable with these changes. This would be comparable to an insurance agency one year selling predominately main street basis on a retail level and the next year being an agency that has developed into a wholesaler specializing in tough classes of business. The E&O carrier may not feel comfortable with the new exposure or may decide to change the pricing, terms and conditions. There is certainly the possibility that the account will look the same as the prior year, but don’t count on it. Complete App Do not complete the application for the customer. Typically, producers want to make it “easy” for their customers to renew with them so there may be a tendency or desire to complete the application for the customer assuming no changes. Producers should never do this! As noted by the following E&O claim, this has tremendous potential to cause some major issues. A claim, involving an agency in one state with a resident producer in another, was an extremely complicated matter involving a professional liability policy secured for a commercial real estate broker. The broker was involved in some real

estate transactions that caused some parties investing in real estate to incur large tax liabilities contrary to the advice the broker/client had given to them. The agency, apparently aware of the nature of the risk, sent the risk a very brief application with a signature page. However, the application that they sent to the carrier was much longer and contained many inaccurate answers to the questions. It appeared that the client had not seen those questions and the agent had answered the questions on his own. When claims started coming in, the carrier initially balked but then subsequently agreed to provide a defense. The carrier then took the position that it would not have written the account had it known the full and true nature of the risk. The carrier, along with the client, then came after the agent. The client stated that had it been asked all of the various questions, it would have provided accurate responses. With damages more than $1.5 million, the E&O claim against the agent was settled for $772,500. Producers may think that it is an inconvenience for the customer to complete the application, but this is really the best way to secure the “true nature of the risk.” This approach will also provide a significant degree of protection for the agency should a problem develop alleging application inaccuracies. www.insurancejournal.com

he votes have been tallied and the results are in for the 2013 Best Independent Insurance Agency to Work For survey by Insurance Journal. The owners of the Best Agencies to Work For in 2013 highlight different programs or benefits depending upon their employees’ needs, their community, agency history, resources, even their own personalities and styles. However, it is clear that it’s not all about benefits and programs. Happiness in the workplace has a lot to do with people and relationships. Employees of the winning agencies cite high personal job satisfaction; rate their relationships with their immediate boss or supervisor as positive; and express a high opinion of their agency’s owner or principals. Many employees are grateful the best agency owners support local communities through charitable efforts and community outreach. Employees are grateful for the opportunities their agencies provide for them to participate in community service. Employees take pride in working for agencies that are respected in their communities. Employees also appreciate the generosity of their agency owners in sharing revenues in the form of bonuses and trips. The best agencies also provide ways to help their employees grow — by giving them the tools and technology they need, and supporting them with education, training, annual performance reviews and, in some cases, mentors. The survey results clearly show employees value this support. As expected, the winning agencies score high for overall employee benefits including wellness programs and for working conditions including flex-time and alternative schedules that allow employees to work from home. The best agencies to work for also provide employees with a strong sense of work-life balance, and deliver a workplace environment where employees feel supported wholeheartedly by management and their peers. Many of the employees say they feel like family in their agencies. air, professional, ethical and transparent — just a few of the words employees used to describe Insurance Journal’s 2013 Best Overall Agency to Work For: Adrian, Mich.-based Kapnick Insurance Group. “Kapnick is successful because of the way they treat their employees ... like they do their clients. Employees are treated with dignity and respect,” one employee wrote. “Management encourages all to participate in the growing of this company by awarding incentives for process improvements and new ideas. Kapnick has created a team environment where every member feels important and informed,” another employee said. Founded in 1946, Kapnick is growing, and its employees are a huge part of that growth, says Jim Kapnick, president. Jim, 45, runs the third generation-owned, family-run independent agency with his brother Mike, 42, who serves as the chief financial officer and chief operating officer. Since taking over the reins as president 32 | INSURANCE JOURNAL-NATIONAL October 7, 2013

in 2003, Kapnick has grown the company to one of the largest privately held independent agencies in the Midwest, ranked No. 89 on Insurance Journal’s Top 100 Privately Held Independent Agencies list with $21.5 million in total revenue in 2012. Throughout Kapnick’s history, the agency has centered its business strategy on niche and specialty programs. Specialties by size of book include: manufacturing; real estate property management; transportation and related services; hospitality and recreation and professional services. Kapnick has about 130 employees in its three offices in Adrian, Southfield and Ann Arbor, Mich., and writes a balanced book of business — 47 percent commercial P/C insurance, 45 percent employee benefits and 8 percent personal insurance. “We used to be heavily on the P/C side but purposely, over the last seven years, we wanted to get our benefits equal to our P/C and we are pretty much there,” Kapnick says. “We wanted to have a good balance and have a holistic approach for our clients.” Balance appears to be a common theme

throughout the Kapnick organization. “Kapnick allows for flexible work schedules so employees can balance family, work and community involvement,” an employee said. Another employee believes the agency is one of the best places to work “because they genuinely care about their employees’ well-being and work-life balance. They know that it is their employees that make them great!” Kapnick says the key to success is in its roots as a traditional, family-run business. “We’ve pledged our allegiance to independence,” he says. “That sounds kind of hokey but it’s true.” Being a family company “puts accountability on us to be good stewards for the company, keep the name going and keep it growing so hopefully it’s around for future generations,” he explains. “We treat people with a lot of compassion. We try to treat them almost like a family member.” Part of that philosophy comes from how Kapnick views other business’s practices. “Too often I see people are cut-throat. We are very selective on whom we hire and bring in, but once they are hired we work very hard to make everyone as successful as possible.” The company allows employees to attend educational events to keep up with changes in the industry, for business building practices and regulations. Kapnick also recognizes employee accomplishments from passing tests, completing courses, to producer career accounts. And the agency celebrates economic and noneconomic success. Having fun and energetic enthusiasm in the workplace is paying off. “We are probably on track to hit about 13 percent to 15 percent growth, which we are very happy with,” Kapnick says, noting it’s 100 percent organic growth. The agency’s goal is to reach $30 million in revenue in five years. “We are adding staff and we feel good about where we are,” Kapnick says. And during times of need, everyone comes together and supports one another, as witnessed during last year's Superstorm Sandy. The New York-headquartered agency has 30 employees, with approximately $5.5 million in revenues and $32 million in property/casualty premium volume. The agency, whose main office in Island Park, N.Y., was submerged in over 6 feet of water when Sandy landed, is now getting ready to move back into its newly renovated building. Mackoul & Associates, which specializes in insurance for co-ops, condominiums and apartment buildings, invests in its employees and strives to help them grow, reimbursing all expenses for their professional development. “We promote education. We encourage and take care of our staff to go get their brokers license and purse professional development,” says Sally Dolce, the chief operating officer. www.insurancejournal.com

“I was sent to school to receive my P/C license. I was paid for the work time I missed, as well as my schooling and licensing fees,” one employee said. “When my oneyear anniversary hit, I was given a review and a raise, and a gift card congratulating me. I don't know any other agency that would be so generous and supportive.” From team-building activities and expenses-paid outings to volunteer programs, the agency provides constant opportunities to create a supportive workplace. And as the agency meets its company-wide new business and retention goals, employees also receive bonuses and different perks — such as paid vacations for the entire staff. “Every year if we grow a certain amount, we take the staff away on a five-day vacation,” says Mackoul & Associates’ President Edward J. Mackoul, whose father, CEO Robert E. Mackoul, founded the agency in 1987. “We made our goal last year, so we took the staff away this past Labor Day, closed the office, and took all the eligible employees who were with us last year on

The managers of Mackoul & Associates were able to get us in a remote office and back to work, so we could properly assist our insureds with their claims,” an employee said. The management took care to speak with each staff member and “asked if there was anything they could do to help us during the hectic time,” one staff member recalled. “I really felt that despite the fact that the office was underwater, the well-being of the staff was the owner’s No. 1 concern.” “Our bosses kept their heads high throughout the whole process, even though they had lost so much personally as well,” one staff member said. “Many employees lost a lot as well, and management was there to help them. We are a family. We all work together and have been through a lot together.” President Mackoul says he credits his staff’s dedication for the firm's swift recovery following Sandy. “We always try to give back to them, and they give back to us. eliable Agency Inc. is known locally and in-house as the “Reliable Family,” and that’s exactly how its employees feel — that they’re part of a family. It is in that spirit that Reliable’s employees — its family members — endeavored to have the agency designated Insurance Journal’s Best Agency to Work For in the Midwest region in 2013. Reliable Agency in Cloquet, Minn., a town of about 12,000 about 15 miles from Duluth, promises customers that “We’re True to Our Name.” In Insurance Journal’s Best Agency to Work For survey, employees described an agency culture that is about equality and fairness, and in which everyone’s opinion matters. “From the day I was hired, I have been treated like I am part of a very close family,” commented one Reliable employee. “The work environment is one of hard work and fun. I can't believe how lucky I am to be a part of this family.” Another employee continued the family theme: “We are in essence, a family. This environment is created at the top, and we all share in one common goal — to provide 34 | INSURANCE JOURNAL-NATIONAL October 7, 2013

a great service to our community and surrounding area. We all have our individual goals and workload, however, many of these cannot be attained without the help of our family members at the agency. This environment also keeps each and every person accountable, as you never want to let your family down.” Reliable’s owners, Steve Micke and Val Wojtysiak couldn’t agree more. “We treat our employees as equals. We’re not any better or any worse. They work just as hard as we work, and they should be involved in the rewards of the business,” Micke says. Micke’s father, Ted Micke, who originally had been in the banking business, started the agency in 1974. Steve Micke joined the firm in May 1981 after serving as an underwriter at Allied Insurance Co. Wojtysiak at the time was working at a bank that had purchased some insurance agencies. She was recruited by Ted Micke and came on board at Reliable in June 1981. “We started out with six total employees and now we’re at 22 employees,” Micke says. With a mix of property/casualty, life/ health and financial and ancillary products, Reliable Agency’s annual premium exceeds

$20 million and its annual revenue is more than $2 million, Micke says. Many employees praised the agency’s performance review policies. “The agency owners are more than generous on their performance and salary reviews,” said one staff member. “They always look to the positive for each employee and help to fix anything that may be lacking. They are very willing to compensate each employee’s salary for the work that is put in.” Other employees described generous perks and benefits offered by the agency. “Our agency owners put everything back into us,” said one employee. “We have trips, bonuses, educational opportunities, raises, weekends away with company, etc.” “We are also offered amazing benefits — our health insurance is paid for, we have profit sharing and 401k matching contributions,” said another. “Our vacation, sick, and flex time is exceptional, as well.” Micke and Wojtysiak were not surprised that their employees had good things to say about their employee benefits packages. “We have a very nice 401k profit sharing plan,” Micke said. “If they put in 5 percent of their income, we’ll match four of that.” The company pays 100 percent of health insurance premiums. Vacation time and flexible schedules are generous. And employees can work extra hours to earn up to six extra days off per year, and can purchase an extra week of vacation. Micke also believes they pay very good wages, and “at the end of the year if the agency has a successful year and we have some profit, we share that back in the form of nice bonuses to the employees,” he says. One staff member summed up employees’ attitudes about how the agency treats employees: “Reliable Agency is the best agency to work for because management really wants us to succeed and will do what they can to contribute. Watkins Insurance Group Manages Steady Growth, Even in Difficult Times By Stephanie K. Jones

atkins Insurance Group has been on a growth trajectory for the past 20 years, and that’s just fine with the group’s employees, whose efforts led to the firm’s selection as Insurance Journal’s Best Agency to Work For in the South Central region. “We have been blessed to grow every year for the past two decades. This is a rarity, especially over the past few years with market and economic headwinds. This is due to great leadership, great personnel and a great team culture,” said one Watkins employee who responded to Insurance Journal’s 2013 Best Agencies to Work For survey. “We have had continued growth and profit since I started with the agency,” said another employee. “In eight years, we have grown from approximately a staff of 30 to almost 100 employees. We have more than doubled our revenue in this time.” The agency, which was founded in Austin, Texas, has grown up with the city, said company President Patrick Watkins. “We’re just proud to have grown up with www.insurancejournal.com

Austin so to speak, our Austin office. That’s a big presence for our agency and all the communities we serve. It’s great to be a part of the community as we’ve all grown together,” Watkins said. The agency was founded in 1949 by Patrick Watkins’ father, David. Patrick joined the firm full-time in 1994 and took over the reins of the company in 2002. Company expansion really accelerated in the past decade. The company, which has been deemed a “Best Practices Agency” by the Independent Insurance Agents and Brokers of America, writes business all over the country and has a presence throughout Texas. In addition to Austin, Watkins Insurance has offices in Holly Lake, Longview, Marble Falls, Minneola, Tyler and Waco. Annual revenue, including property/casualty and benefits, is in the $11 million to $25 million range. In addition to praising the company’s ability to grow even in difficult times, Watkins’ employees lauded the educational opportunities offered by the agency, the personal support provided by management

and fellow team members, and the firm’s commitment to its staff members, clients and the community at large. “I love that we volunteer at Casita, Habitat for Humanity and the Children's Shelter. It matters to me that we are involved in the everyday life of Austin's residents,” said one employee. “They are always providing us with education free of charge, I have way more ed hours than needed to renew my license!” another employee said. “Leadership and ethics start from the top down. Our leaders show us what is expected of us every day by their actions and not words and/or policies,” said another. “I feel like that I am very much a part of the success of this agency and in return, I give my all to each and every customer,” said another Watkins employee. “I know without a doubt that if my family needed anything, all I have to do is call anyone in this agency and they would come running. I would do the same for each person in our agency family. We are a team!” said still another. oo many cooks spoil the broth? Not at Senn-Dunn Insurance. The Greensboro, N.C., agency — the 2013 winner of Insurance Journal’s Best Agency to Work For in the Southeast — has 22 owners. That’s about 15 percent of its workforce. T. Gray McCaskill, CEO, says the ownership structure was created as a way to attract and retain the best people. The structure is an incentive and retention plan mostly for producers, according to Danielle Hoversten, chief financial officer. It’s also a management challenge. “It requires a very collaborative environment. We spend a lot of time basing decisions on consensus, getting a lot of input. We have 22 owners, plus managers who are not yet owners, involved in decision-making,” Hoversten says. “It takes a little extra time, but we have found it works for us.” The 22 owners have empowered an eight-member executive committee to make certain operational decisions as needed. 36 | INSURANCE JOURNAL-NATIONAL October 7, 2013

It all works for producers at Senn-Dunn. “The security of knowing we are going to remain privately owned and independent is a great way to wake up and go to work ... knowing that everyone has an opportunity to be an owner if they work hard,” one producer said. “I know that one day I may be offered a chance to become an owner, which is very exciting to me,” another employee said. The company has a separate profit sharing plan for non-producers. Senn-Dunn stresses open communication, transparency and teamwork. For McCaskill, communication is key. “The more you’ve got people asking questions, the more it shows that they’ve got faith that you’re going to be upfront with them,” he says. Employees praise owners for sharing financials, explaining goals and strategies, and maintaining an open-door policy. “This transparency of 'where we are and where we are going' promotes a team environment,” said an employee. To further the teamwork culture, all of

the offices in the Greensboro building are of equal size, and staff has window offices while owners are in interior spaces. The emphasis on communication paid off during the economic downturn and soft market. By 2008, McCaskill said the owners knew that the agency’s model at that time was not sustainable. P/C premiums were falling and too many customers were hurting or going out of business. Internal changes and a new direction to counter the effects of the P/C slide were needed. “Rather than pointing fingers, we got together and asked for input,” McCaskill recalls. “We didn’t go behind closed doors. We put all our numbers on the board. We made some tough senior management changes.” “Owners, managers, everybody” — participated in the cuts, Hoversten says. The adjustments worked. The agency started growing again and, most important, it was able to invest in a new direction: employee benefits. “This whole thing with Obamacare, we have sort of run through the fire on it,” McCaskill says. Senn-Dunn has been proactive, running benefits seminars, reaching out to clients and turning Obamacare into an opportunity. “At the end of the day, clients want that trusted advisor.” Senn-Dunn is a different agency today. It had been a primarily P/C agency, but now total agency revenues of $25.6 million are almost evenly divided between P/C and employee benefits. Also, the agency had 38 people back in 2000; today it has 152. “I was very proud of the way the company took a realistic approach to the changing business environment from 2008 to present day,” one employee told Insurance Journal. “We have a team that supports each other,” McCaskill says. He thinks it is working so well that if there were no insurance services to sell, the team would sell something else together. But for now, they’re doing fine with insurance and benefits. www.insurancejournal.com

C

ulture of care may sound like an ’80s band or a marketing slogan for an emerging nonprofit organization, but it’s a phrase Kevin Bogart wasn’t hesitant to use when touting the workplace he oversees. Employees at Wood Gutmann & Bogart Insurance Brokers in Tustin, Calif. — No. 74 on Insurance Journal’s Top 100 Privately Held Independent Agencies list — were asked what makes their agency a great one to work for, and there were a number of comments from workers with a positive attitude who obviously like their job. “The group of professionals that work within Wood Gutmann and Bogart are topnotch,” replied one employee. “They have great knowledge in their fields. It is a team approach environment, and everyone’s input is valued.” But beyond those workers were employees with stories to share that told of partners stepping above their roles as leaders and reaching into their own pockets to ensure employees were happy and well-compensated, even during the worst of times. “During a few very challenging economic www.insurancejournal.com

years when other agencies were laying off employees, the partners of this firm decided no one would lose their jobs due to the decline in profits. What they did do (a few of us found out later) is they each silently contributed from their personal savings to our payroll for a very long time so that no one would lose their employment,” wrote one employee. True story? “I would say there were a good three years there that we felt the need to go beyond what the business was spinning off on its own to make the bonus pools as robust as they should be,” says Kevin Bogart, a partner in the firm, which employs 73 in Orange County, 15 in San Diego, 15 in Ventura and three in San Jose, Calif. According to Bogart, employees who have been with the firm for five years annually receive about $2,500 from a tenure bonus on top of other bonuses, which typically add up to another $2,500 a year. It’s double that for people with 10 years at the firm, and it goes on up for those with more time. During the economic recession, the firm’s partners were kicking in to make up for roughly a 25 percent shortfall in the regular

bonus pool, he says, “because we’re committed to attaining and maintaining the best talent that we can find in the marketplace.” A benefit of providing a positive work environment is that the mindset reaches customers in the form of good service and a positive outlook from the employees. “We have a culture of care for one another and care for our clients,” Bogart says. Additionally, WGB has a “Flex Fridays” program that gives service staff three-day weekends once a month, a “Bowling Stress Busters” event that enables the ownership to interact with employees in a casual setting, and an adopted corporate charity called “Project Cuddle,” which helps women who are hiding a pregnancy. The firm’s charitable inward and outward attitude is reflected in one employee’s tale: “I had some major health problems when I first started my employment at WGB and before my 90 days, I had to take a month off for disability. They saw something in me and didn’t let me go. They offered me sick time in advance to cover some of the days I was out and worked with me through the health problems. When I came back fully healthy, I more than proved to them that the chance they took and the money they invested was worth it. How they handled the situation was a blessing for both myself and the company.” WGB writes all lines of insurance, including employee benefits, personal lines, and high-net-worth individuals. With roughly 3,000 customers, two-thirds of the business is from commercial lines. The firm serves primarily middle-market to large clients. Taking care of those clients by having happy employees has yet another side effect. Most of the firm’s employees have been there 10 years or more, with several marking 20- and 25-year anniversaries. “Once we get ’em, we tend to keep ’em,” Bogart says. “It really is a culture of care for one another. he insurance industry is facing a crisis. Twenty percent of the insurance workforce is near retirement age, compared to only 15 percent of the broader financial services workforce. By 2018, the number of the insurance workforce at near retirement age will climb to 25 percent. With Baby Boomers retiring in record numbers, it’s imperative to attract younger talent. However, many companies are not doing enough to encourage the next generation of insurance leaders. In fact, when it comes to developing strategies to recruit the best and brightest, the insurance industry lags behind other industries. This discrepancy represents a significant opportunity for companies to improve the image of the insurance industry and get a leg up on the competition for highly qualified college graduates. Fortunately, there are measures to help your organization gain visibility among colleges and make inroads into attracting your next workforce. University Partners and Student Clubs One way to identify business programs in your area is to tap your personal network. Ask if anyone you know has connections or has kids who are enrolled in a specific college. Check university, business school, or program rankings. Hire an Intern There are many benefits of having an internship program alongside your new-hire program. Internships test out potential new full-time hires. Benefits are not typically extended to interns, making internships fairly inexpensive. The competitive pay for insurance student internships generally ranges from $12 per hour to $19 per hour. Many schools also encourage unpaid internships in which the student receives course credit instead of a wage. This can be a great alternative if your company is willing to report back to the university with information outlining the student’s responsibilities and describing the learning opportunities over the course of the internship.
