ometimes emerging risks are hiding in plain sight. As was the case for the man who was seriously injured when he fell through the floor in a museum in Portugal. The exhibit was designed to look like a hole in the floor and, as he came to discover, it actually was a hole in the floor. Security later installed ropes around the exhibit. Risk assessment is not always rational or based on facts and information. One classic example is the public fearing nuclear power over driving a car, even though car accidents are responsible for far more deaths and injuries than nuclear plants. Part of the explanation is that the public is familiar with car accidents while nuclear power is not well understood. This same dynamic may be reflected in today’s questioning of fully autonomous driving due to a handful of accidents over human-controlled driving, which accounts for 40,000 fatalities a year. Experts tend to have more information than the general public when assessing emerging risks but they, too, are human and their approach can also be influenced by social, emotional and cultural factors, not to mention by their field of expertise. Insurance Journal decided to ask a number of P/C insurance experts about emerging risks. The question was: What do insurance experts see as the most important emerging risk for the property/casualty insurance industry? Insurance Journal chose to define an “emerging risk” as one that is new and not yet widely recognized or perhaps recognized but not well understood. The responses were varied. Some saw macros issues; other worried about micro events. To the extent there is any consensus, it is that cyber is the greatest emerging risk — but everyone seems worried about a slightly different aspect of cyber. National Insurer Downgrades Jumped in 2018 But Were Still Outnumbered by Upgrades: A.M. Best

atastrophic weather events in 2017 helped spur an increase in rating downgrades for the U.S. property/casualty (P/C) industry during the first half of 2018, according to an A.M. Best report. But the report also notes that overall ratings activity in that same period was modestly favorable, with upgrades outnumbering downgrades. According to the report, “Downgrades for U.S. P/C Industry Increase in First Half 2018,” the positive rating actions were driven by tightened underwriting standards that have led to favorable results over several years, higher risk-adjusted capitalization and improved enterprise risk management capabilities. “The majority of companies managed their exposures effectively, reflecting improved risk management capabilities and robust reinsurance programs. However, the P/C industry does face challenges, including growing frequency and severity issues in the automobile segment; the cost and time devoted to systems implementation; and, in the reinsurance segment, the impact of soft pricing margins,” A.M. Best said. Affirmations were again the most common rating action, at 78.6 percent, reflecting the overall stability of the U.S. P/C industry. The number of upgrades outpaced downgrades for a third consecutive year. Upgrades were similar to the prior year period, 7.1 percent of rating actions, compared to 7.4 percent in 2017. Downgrades increased to 6.3 percent of total actions, up from 2.4 percent in the first half of 2017. In the first quarter of 2018, the P/C industry posted an underwriting profit of $3.9 billion, reversing the $840 million loss posted in the first quarter of 2017. The improvement in profitability was driven by lower average catastrophe loss experience and nearly $7 billion in favorable loss development. A.M. Best said it is maintaining its stable outlook on both the personal and commercial lines segments, although the industry continues to face challenges. A.M. Best is also maintaining its negative outlook on the reinsurance segment. INSURANCEJOURNAL.COM

As Cyber Insurance Market Grows, Accumulation Risk Is Key Concern: Geneva Assn. By L.S. Howard
A
lthough cyber risk premiums have expanded sizably in recent years with loss ratios that compare favorably to other product lines, the danger of accumulation risks is a key concern for the market, according to a study released by insurance industry think tank The Geneva Association. The study, titled “Advancing Accumulation Risk Management in Cyber Insurance,” identifies three prerequisites to a sustainable cyber insurance market: • Customers and insurers must facilitate resilience at the source of risk for the principles of insurability to apply. • Insurers must be able to achieve an acceptable return on capital. • Insurance markets need to be able to withstand shocks from extreme events, which means absorbing accumulation risk. The concern about accumulation risk is widely held across the industry and is the reason the Geneva Association report is focusing on the market’s ability to withstand extreme events, said Anna Maria D’Hulster, secretary general of The Geneva Association (GA), in a forward to the report. “Expanding the boundaries of insurability is not new for insurers. However, cyber risks

The report went on to highlight four cyber accumulation risk challenges: 1. A single large event or a series of consecutive events may make affirmative cyber insurance unprofitable. (The report explained that insurers provide affirmative

non-affirmative, or silent cyber exposures, when they offer all-risk policies and other liability insurance policies that have not excluded cyber risks.]
3. Data are of insufficient quality, are incomplete and/ or lack the necessary consistency for more advanced modeling techniques. 4. Governments fail to provide frameworks for the sharing of large-scale cyber terrorism-induced losses.
Market Consequences
The study said there are many market consequences if risks from these challenges materialize. “Insurers and reinsurers could withdraw from the market after unacceptably high losses and fear of repeat events,” the study continued, noting that such losses also could stall the growth of the small alternative capital market and prevent insurers from accessing needed capacity. In addition, re/insurers could introduce tighter policy terms and increase the number of exclusions and/or make buybacks prohibitively expensive,
the GA study said. “The lack of confidence in advanced model outputs could stifle growth if models are deemed to be too blunt for insurers to extend portfolios or offer higher coverage levels,” which could result in a further constraint on the amount of coverage available for larger enterprises and leave the market for small and medium enterprises underdeveloped. “A large event may also trigger regulatory intervention with the risk for insurers having to provide cover with uneconomic terms and rates,” GA said. In response, GA said, insurers have formulated several approaches: • Developing data analytics that analyze the characteris tics of cyber risk as well as data protocols that combine company information with digital risk indicators. • Novel approaches to analyzing the risk “footprint” and corresponding threats affecting the size. • Forward-looking threat assessments including external expert inputs. • Mapping cloud-related interconnectivity and digital supply chains, and using machine learning to assess the relationship between claims frequency and multi-exposures. “Of equal importance is the need to maintain underwriting discipline. Cyber risk is not unique in this respect. Historically, many property-casualty classes have suffered when underwriting standards slipped or when prices failed to adequately reflect the cost of risk,” the study said. INSURANCEJOURNAL.COM

California Court Rules Workers’ Comp Law Provides Exclusive Remedy in Utilization Review Case
T
he California Supreme Court issued an opinion in late August that utilization review physicians cannot be sued for malpractice, upholding established law that the workers’ comp system provides injured employees an exclusive remedy against an employer for work-related injuries. The court considered the application of workers’ comp exclusivity to claims arising from the utilization review process. Utilization reviewers act on behalf of employers and determine if a treatment plan recommended for an employee injury is medically necessary. If the reviewer concludes a treatment is not necessary, the treatment request may be denied. In 2008, Kirk King sustained a back injury while at work, and reportedly suffered chronic pain as a result, which in turn caused anxiety and depression. In 2011, INSURANCEJOURNAL.COM
a mental health professional prescribed psychotropic drugs, including Klonopin, to King. Dr. Naresh Sharma, an anesthesiologist employed by defendant CompPartners Inc., a utilization review management company, conducted a review in 2013 of the Klonopin prescription and determined the drug was medically unnecessary and decertified the prescription. Sharma’s decertification did not provide for a weaning regimen, nor did Sharma warn King of the risks of abruptly ceasing Klonopin and King suffered a series of seizures as a result. In 2014, King and his wife filed a complaint in court against CompPartners and Sharma among others, asserting claims including negligence, professional negligence, and intentional and negligent infliction of emotional distress. The defendants demurred, arguing that
the Kings’ claims were preempted by the Workers’ Compensation Act, and that the negligence claims failed because Sharma owed no duty of care to King. The trial court agreed with both arguments and sustained the demurrer without leave to amend. The Court of Appeal affirmed the order sustaining the demurrer but reversed the denial of leave to amend. The Court of Appeal also held that Sharma owed King a duty of care. The California Supreme Court in the August opinion affirmed the Court of Appeal’s judgment insofar as it affirmed the trial court’s sustaining of the demurrer, but it reversed its judgment insofar as it permitted the Kings to amend their complaint to bolster their claim that defendants are liable in tort for failure to warn. The case has been remanded to the Court of Appeal for further proceedings consistent with this opinion.

California’s 1st Cannabis Insurer Expands Coverage

to lower rates, expand coverage options, and expand the classes of business covered. Jones last year approved Golden Bear’s filing to make it the first admitted com-

mercial insurance carrier to offer cannabis business insurance in the state. Since then, the department has approved five additional insurers to write cannabis-related insurance products in the California market. “We are very excited to roll out equipment breakdown coverage among other new coverages to our cannabis package policy,” Michael Brown, vice president and underwriting property manager at Golden Bear, said in a statement. “This additional endorsement will provide our insureds with vital coverage for losses to inventory and income caused by the failure of refrigeration equipment, HVAC equipment, and manufacturing equipment so important to the cannabis industry.”

new lawsuit says the Boeing aircraft company is poisoning the Duwamish River by pumping out pollution that is far and away above the legal limit. Environmental groups Puget Soundkeeper and Waste Action Project say the Military Delivery Center plant in Tukwila is a hotbed for highly toxic polychlorinated biphenyls, or PCBs, which flow out as stormwater runoff and then enter the food chain. The groups are suing Boeing on grounds that it is violating the Clean Water Act. Boeing says it “has demonstrated its commitment to improving the health of the Lower Duwamish Waterway by investing in cleanup activities, stormwater treatment, and habitat restoration for fish and wildlife.” Tests of the Duwamish Waterway show high levels of cancer-causing PCBs. Proper Insurance Coverage for Construction Crucial in Avoiding Costly Litigation By Elizabeth Blosfield

f residential property owners don’t confirm proper insurance coverage and carefully consider labor laws when hiring contractors, they could be in for some costly litigation, according to two speakers at a July roundtable held at Anderson Kill’s offices in New York City. Allen R. Wolff, a shareholder at Anderson Kill, and Edward J. Mackoul, president of New York’s Mackoul Risk Solutions, spoke at the roundtable, offering tips to condo and co-op boards and members regarding how to carefully handle construction work. “If, as the property owner, you do not make sure that you’ve crossed your T’s and dotted your I’s, these types of lawsuits can easily reach seven figures,” Mackoul said. “And I’ve seen a number of them.”
Wolff and Mackoul began the discussion with an overview of one of the nation’s toughest labor laws: New York State’s Scaffold Law. Labor Law section 240/241, commonly referred to the as the Scaffold Law, imposes liability upon contractors and property owners for all “gravity-related” injuries. While the Scaffold Law is unique to New York state, there are lessons to be learned for residential property owners, Wolff explained during the discussion. “These laws have been on the books for a long, long time,” he said. “They predate OSHA (Occupational Safety and Health Administration) laws. They predate workers’ compensation laws.” Wolff explained that there have been several calls for reform, stating that the Scaffold Law in New York was initially implemented at a

time when an injured worker may not have had adequate recourse. He stated that since then, injured workers have workers’ compensation and certain OSHA protections available. “Yet, New York still has these Labor Laws on the books,” he said. “…so you can see how out of time we are.” Insurance industry trade groups have previously pushed back against the law, asking for a repeal and alleging it leads to higher insurance premiums. The Lawsuit Reform Alliance of New York (LRANY) has also scrutinized the law, stating it continues to drive up the cost of construction in the state. “There are efforts every number of years to get these laws off the books, because they do add expense to everybody’s insurance in New York,” Wolff said. “They add expense to everybody’s contract prices in New York.” The New York Committee for Occupational Safety & Health (NYCOSH), however, has objected to the criticism, stating that The Scaffold Safety Law requires construction sites to be built and maintained in a way that protects workers, and contractors and businesses are only liable when there’s an injury or fatality on the job if they put workers at risk of injury or death by violating critical health and safety regulations. “Big business and insurance companies have attempted to lobby against the Scaffold Safety Law for years, arguing that the law leads to unfair insurance premiums,” it states on its website. “Instead of sacrificing worker safety by gutting the Scaffold Safety Law, we believe that insurance
companies should open their books to the public. That way, the public can determine if the premiums being charged to contractors are justified.”
Requiring Written Contracts
That said, Wolff urged property owners that hire contractors for construction work to be careful in requiring written contracts that specify additional insured requirements, include a written defense indemnity and hold harmless provision and provide for New York labor law liabilities. He said this can ensure the right protections are in place and avoid responsibility for employee or contractor negligence falling on the property owner. “You have to assess the risk, because if you don’t understand the risk to which you’re exposed, then you probably are going to get underinsured,” Wolff said. “There is no threshold for a labor law liability, and it can be really hurtful.” He said that although risk complexity can vary, assessing the risk at the beginning is typically a minimal expense at the risk management level. “But the consequences for failing to do it right can be quite catastrophic,” he added.

Taking risk assessment into consideration, Wolff said condo associations and co-op boards should require that no contractors walk into the building without insurance, with exceptions only in emergency situations. Mackoul agreed. “Most of the time, nothing happens, but the one time it does, these are

He pointed to an example in which a co-op building hired an uninsured contractor for a $625 job to scrape and paint a water-damaged hallway. The contractor didn’t have a ladder, so he stacked two paint cans on top of each other, fell and was hospitalized, eventually suffering short-term memory loss. The case was eventually settled for $4 million. “This was a $600 job where a guy got on two paint cans, and he fell due to his own negligence, and it was deemed the responsibility of the property owner,” he said. “If we were another state, it would be comparative negligence where they would say, ‘Okay, well, John Smith was 50 percent negligent, and we were 50 percent negligent. We’re only responsible for 50 percent of this.’ That doesn’t happen in New York. In almost every single case, there is no defense for the property owner.” Wolff stated this is why it’s important to allocate risk to insurance through a written contract. During the discussion, both
Wolff and Mackoul broke down how these contracts should be structured. “Require copies of policies, including endorsements from the contractors, and never trust a certificate of insurance,” Mackoul said. “Everyone thinks they are doing their job perfectly by getting a certificate of insurance, but the truth is, you’ve got to take the next step.” He stated this is because property owners need insurance that backs up the certificate of insurance to make it clear they’ve been added as an additional insured and will receive benefits for an accident. “Why the property manager?” he said. “He gets named in every single lawsuit. The property manager’s contract has an indemnification clause in it, which requires the association to provide a defense or pay for their legal fees.” The board and condo or co-op should also be named as additional insured, Mackoul said. In addition, property owners need to be aware of exclusions within policies, he explained, pointing to another example when a building owner received a copy of the insurance policy for the contractor it hired, which stated anything above four stories was excluded. “It
was an eight-story building,” he said. “So technically, he had no insurance in the event of a claim.”
Specifying Insurance Type, Policy Limits
Mackoul said for this reason, contracts should always specify the type of insurance contractors have and the limit, as some homeowners insurance policies may exclude construction defects. “You think the insurance policy you have might cover it, but at the end of the day, it may not,” he said. Mackoul said the primary type of insurance contractors should have is general liability, which covers bodily injury and property damage. General liability coverage should include at least $1 million per occurrence and a $2 million aggregate in the event of multiple occurrences, he added. Products and completed operations insurance is also important in case of a defective product or faulty workmanship, he said, as well as workers’ compensation and even auto liability. “We’ve had situations where a contractor is running to Home Depot, speeding, makes a turn and runs somebody over," he said. "He gets sued, and so do
we. That’s the reason you want to make sure that he has auto insurance, because if we get named in a suit, we want to put it back on him.” Finally, Mackoul explained contractors should have commercial umbrella and completed operations coverage for six years. “Commercial umbrella is just extra liability insurance,” he said. “Nobody sues for $1 million these days. Every lawsuit we see is $5 million and up.” The statute of limitations in New York is six years for breach of contract, making completed operations coverage for that time an important element, he added. “That’s about the longest you can hope to usually get back to a contractor for something that went wrong that the contractor did,” he said. “Insurance needs to cover completed operations because four years from now, when the roof caves in because it was built wrong, that is a claim that I (the property owner) can bring back against you (the contractor). And when and if I do that, I want to make sure you’ve got insurance backing you up.” Wolff said overall, the goal of taking these steps to ensure hired contractors have proper coverage is to keep insurance premiums from rising by reducing the burden of unnecessary claims. “You don’t want to hire an uninsured contractor,” he said. “You simply don’t. In the event of a claim, that is just going to leave you with a greater effort to find the money needed to make you whole or to defend you from a third party claim.”

hen insurance experts are asked what they see as the most important emerging risk for the property/casualty insurance industry, their consensus is cyber in some form. (See
accompanying article on page 20 for cyber risks.)
While cyber obviously poses tremendous risks, some experts are also eyeing a variety of other emerging risks. These include risks inherent in government and insurance policies, not to mention blockchain, urban transportation, coastal property, retail deliveries and recreation.
1. D&O Privacy
The new Facebook lawsuit suggests that privacy-related concerns may already represent a potential new source of corporate liability exposure. The advent of the EU’s General Data Privacy Regulation (GDPR) will magnify these possibilities. While predictions of this kind are always tricky, it may be that privacy related issues may represent an emerging and growing area of potential directors and officers (D&O) liability exposure. It is important to note that these kinds of privacy concerns involve not just new
18 | INSURANCE JOURNAL | NATIONAL SEPTEMBER 3, 2018
age behemoths like Facebook that are hoovering huge volumes of personal information. Many companies are capturing vast amounts of client and customer information, many of them in traditional industries — think how much your airline, your pharmacy, your credit card company, even your electric utility know about you. Of course these companies are mining this information for their marketing efforts and pricing analyses. These companies may well be sharing this information with collaborators, joint venture partners,
third-party vendors, and so on. The recent developments at Facebook not only show the problems that can arise with the use of this kind of information, but also underscore how claims that this kind of information was mishandled can lead to bad publicity, a corporate crisis, and even significant D&O litigation. I could be wrong, of course, but I think we will see more D&O litigation in the future involving privacy issues. 2. Government Actions
The greatest industry vulnerability is constantly evolving governmental actions. Government imposition of retroactive liability or limits on the ability of the marketplace to price risk can threaten marketplace stability. Industry security is also impacted by the effectiveness of government security policies preventing terrorist attacks — particularly cyber warfare. PCI is ever vigilant, working with policymakers to prevent or at least help our members mitigate and manage the next asbestos, superfund, or 9/11 solvency threat. Our members are also very focused on the current technology race that is driving massive insurer investment in IT and changing business strategies and platforms to meet escalating consumer expectations. Emerging government and technology risks intersect in the cyber world, with PCI members’ chief risk officers most worried about aggregate losses and direct company exposure to a largescale cyberattack. — Robert

3. Sandbox Trap

4. Tax Accounting
The Tax Cuts and Jobs Act took effect on Jan. 1, 2018, and has had an immediate impact on accounting professionals because of the large overhaul on the U.S. Internal Revenue Code. I think it has produced two primary risks for an increase in claims: advisory-related risks associated with fully educating clients and managing client expectations and increased risk of error in the preparation of the tax return itself. 5. Regulation Fragmentation
Regulatory fragmentation from state to state in the area of data
and cyber security. There are many differences between EU’s General Data Protection Regulations (GDPR) and emerging U.S. state regulations. GDPR provides provisions around processing personally identifiable data (PII) of people residing in the EU, regardless of country citizenship and location. These “data controllers” can be EU firms or firms operating in the EU from other jurisdictions and must demonstrate technology, process and organizational compliance. The PII definition is broader than definitions of the same concept used in the U.S. and covers almost anything that can be attributable to a person. The cost and confusion for international reinsurers will only increase as more state regulations emerge. — Mitchell

The fundamental changes to autos and the auto business in the next decade will provide opportunities and threats to

Private and commercial auto insurance margins are constantly under pressure. Technology will confluence with planned auto industry movements toward mobility-as-a-service versus vehicles as products. Driver assistance technology with lidar, radar and other sensors provides greater safety in select situations, but concurrently increases the danger of drivers failing to pay attention. Even where safety is enhanced, the proposed lighter vehicles and increased miles driven create challenges to established pric-
ing models. Ride sharing, rideon-demand and fully automated vehicle business models are largely based on the premise of doing away with individual ownership of vehicles, which would impact personal auto insurance. The biggest risks involve cyber crime. Under “emerging risks,” one of the biggest is the Internet of Things (IoT), and the cybersecurity risks created by billions of interconnected devices. The challenges for agents and brokers multiply in regard to understanding the potential implications, such as IoT devices in homes and businesses — tracking sensors, fire/flooding/intrusion warning devices and more. Agents need

Architectural Digest magazine reports there is a new movement to bring risk back into parks and playgrounds. Children’s playgrounds, with features including spiked nails and steep drops, have been gaining popularity in the UK and are coming to the U.S. Educators are claiming that “purposeful risky play promotes resilience and builds more self-reliant young people,” the article says. Public playgrounds are being designed to actively present that risk. “What that looks like — playgrounds with access to saws,

11. Dockless Scooters
Electric scooters are popping up in urban areas across the

The report highlights several cyber accumulation risk challenges: • Insurers and reinsurers could underestimate non-affirmative cyber exposure leading to an unplanned shock from a major event. Non-affirmative cyber exposure occurs when a cyber attack causes major losses by triggering coverages in other classes. • Data are of insufficient quality, are incomplete and/ or lack the necessary consistency for more advanced modeling techniques. • Governments predominantly fail to provide frameworks for the sharing of largescale cyber-terrorismlosses.

There have been complaints of scooters abandoned on sidewalks and in doorways. Some cities have moved to ban them, if only temporarily, until rules are in place. Cities are balking, but the trend is taking hold. Injuries are growing. Dr. Natasha Trentacosta of CedarsSinai in Los Angeles said she is seeing injured patients on a daily basis, including some who need surgery at least once or twice a week. Personal injury lawyers have taken note. Bloomberg reported people hurt riding or hit by scooters in San Francisco and Los Angeles have been calling legal firms to file claims. Personal injury law firm Omega Law Group in Beverly Hills reports getting five calls a week for scooter accidents since April. “Most of the calls come from riders hit by reck- less motorists who are not used to sharing the road with the small scooters,” the firm’s website says. Another firm told Blomberg that while riders hit by cars may have a strong cases, pedestrians injured by scooters on a sidewalk are often out of luck because there is no insurance company to sue.
12. Driving Deliveries
Europe’s agency for workplace health and safety (EU-OSHA)
thinks the rising demand for fast and free home and work delivery of retail goods needs monitoring. Purchasers are expecting faster deliveries and more accurate delivery times but are not willing to pay the price, which is bound to impact delivery driving. First, the increase in e-retail means there are more driving jobs, including gig economy drivers who tend to use private cars to fulfil deliveries. There is a link between business driving and increased musculoskeletal disorders rates (especially lower back pain). Possibly compounding this are health risk factors for drivers, including: compromised employer terms and conditions related to gig economy drivers; long working hours, possibly resulting in driver fatigue; and increased performance demands linked to fast delivery and specific delivery times. While improvements in delivery vehicle and equipment design and the introduction of driverless vehicles may help alleviate health risks, these could take years to be mainstream.

Compliance Witnesses
New research from corporate consultants at Gartner indicate that employees who witness misconduct are twice as likely to leave an organization. Twenty-nine percent of employees observed at least one compliance violation at work in 2016 or 2017, accord-

ing to a Gartner survey of more than 5,000 employees. Fifty-nine percent of those who observed a compliance violation were actively looking for a new job, compared with 29 percent who did not witness bad behavior. “While attrition is not an obvious area of concern for compliance executives, it should be,” says Brian Lee, compliance practice leader at Gartner. “Employee misconduct and the failure of compliance to address it plays a considerable role in motivating employees to leave their current organization.” Lee also says that the departure of key employees should be deemed a warning of possible underlying compliance-related issues. Employee attrition costs large organizations millions of dollars each year and the loss of a particularly conscientious employee can be debilitating, not just to culture and morale, but to employee productivity, according to Gartner.

Coastal Communities and Property Values
Recent studies suggest that the threat of rising seas is undermining property values in coastal communities. Researchers at the University of Colorado and Pennsylvania State found that homes with exposure to the sea sold for 6.6 percent less than unexposed homes. Harvard University researchers found that properties at higher elevations were appreciating faster than properties at lower elevations. Insurance Journal has reported that, according to the Union of Concerned Scientists, accelerating sea level could put more than $1 trillion in property at risk by the end of the century.
The report shows Florida has roughly one million homes and $351 billion in decreased property values at risk of chronic flooding by century’s end, followed by New Jersey (250,000 homes), and New York (143,000 homes). Nearly 175 U.S. coastal communities may see 10 percent or more homes at risk of chronic flooding by 2045. Places that could be hit hardest include Louisiana, Maryland, New Jersey and North Carolina.
15. Smart Contracts
While smart contracting based on digital ledger or blockchain technology holds great promise for the insurance industry, it isn’t without risks. Locke Lord attorneys Christopher Barth and Theodore Augustinos, writing in Insurance Journal, point out that some of the benefits of blockchain — immutability, transparency and decentralization — also present concomitant risks. For example, if an insurer inadvertently discloses nonpublic personal information subject to privacy protections over the blockchain, there is no “control-alt-delete” button enabling a do-over. Further, remedial efforts will be hampered by the permanency of the disclosure and its widespread distribution. Ross Nodurft, risk management leader at One World Identity, reminded a PLUS audience this year: “One reason you have to be careful is because garbage in, and garbage out. You are going to build up an identity that’s either private or it’s wrong,” he said. “So, you have to be careful about what’s going in during the initial creation and verification when using blockchain for identity.” INSURANCEJOURNAL.COM

Q:I need to start working on a plan to replace my agency commercial lines manager. She’s within two years of retirement, but I don’t want to wait that far out. Plus, I’ll probably shift teams around, so I could use someone sooner in more ways than one. The market seems tight for candidates. How soon is too soon to start my search? – Paul in Detroit Rock City!
A:
Paul, the easy answer is if you have the budget for positions to overlap you need to start recruiting immediately. It’s much easier to slow-play a search than speed it up. You’re absolutely right, the insurance industry has a talent shortage. You can’t expect 10-15 qualified applicants for this type of role. In today’s market, three-to-five may be all you see in four-to-six months of looking.
It Took an Agency How Long to Hire a Commercial Lines Manager?
T
he old saying, “Our agency is constantly recruiting,” used to make firms sound very progressive. That barely cuts the mustard these days. Agencies must adopt a new philosophy: “We’re constantly talking to everyone.” Recruiting is worthless if you don’t talk to people. Engagement is key to successful talent acquisition. I have a great example to illustrate the importance of immediate, timely action on future openings. Below are specs of a project like yours that I just wrapped up for a national brokerage. TRUE: Pre-retirees have started giving less advance notice. The norm used to be 6-12 months. Now, many agencies have to backfill retirements with only 30-45 days’ notice. Be proactive with roles vacated by anticipated retirements. Extra payroll expense for a few months is money well spent.

Optimism is soaring to record levels as more construction firm owners are confident the market is going to continue to grow, according to a recent survey by the Associated General Contractors of America. The U.S. Commerce Department also recorded significant increases in spending in the commercial construction sector, and the Bureau of Labor Statistics recently reported the industry added 210,000 jobs in 2017, a 35 percent increase over 2016. While this is certainly good news, construction companies and contractors, both large and small, are increasingly faced with equipment security issues as a result. The Inland Marine Underwriters Association’s (IMUA) Contractor’s Equipment Guide to Loss Prevention cited vandalism or malicious mischief (VMM) and theft as representing one-third of all loss dollars for contractors’ equipment. Why? Construction tools and equipment are relatively easy to steal and re-sell, compared with other types of goods.
Thieves prefer tools and smaller mobile equipment, such as trailered compressors, generators and lighted road signs, followed by medium-sized equipment (e.g. skid steers, small tractors and forklifts), according to industry experts. Excavators, backhoes, bulldozers and other large machines, although costly to replace, are targeted least frequently due to the greater challenges thieves face in stealing and reselling them. Theft most frequently takes place during the weekend, and jobsites are the preferred location, as compared to company premises.

These can be divided into three main areas: administrative controls, jobsite physical controls and equipment physical controls. While it is unrealistic to expect small operators to implement every type of mitigation tactic available, there are many simple, low-cost prevention controls that can lessen the chance of loss.

Administrative Controls
With small and large commercial projects showing no signs of slowing down any time soon, tools and equipment are in high demand, and contractors may be inclined to ask fewer questions when purchasing used equipment, even if the deal seems too good to be true. It also has become easier in recent years to sell equipment outside the country, making it difficult or impossible to trace and recover stolen items. Add

Management practices are as important as physical security controls in preventing theft. Topping the administrative list is management’s commitment to theft prevention and zero tolerance for losses. Companies whose leaders adopt this philosophy are more likely to succeed with their loss prevention efforts because employees take them more seriously. Designating an individual with overall accountability for security and theft prevention, such as a site supervisor or operations manager, further reinforces this message. Hiring practices, screening, reducing turnover and implementing substance abuse testing programs are very important tools in reducing theft, particularly “inside jobs” where dishonest employees provide the knowledge, skill or access to carry out criminal acts. Employee and visitor access to job sites should be carefully controlled and logged. Implementing theft prevention policies and procedures, and unannounced site visits and inspections by company managers, also can go a long way toward controlling the theft of equipment and tools. Additionally, companies should consider including an educational segment on security and theft prevention during new employee orientations and annual refresher training. Additional tips to deter criminal activity include: using high security locks and changing them frequently; mounting security bars and grates on office trailers and containers; posting “No Trespassing” signage; and requesting additional police patrols. 5 Ways to Put Customers First and Ice the Cake with Insurtech

I
was surprised to learn I was named one of the 50 most influential people in the United States/Western Europe for Insurtech. The fact that I was the only person, I believe, listed who makes their living on their own name (not working for some large organization) and who works with traditional insurance companies and traditional agencies was an honor, but eye opening. I can understand why traditional companies and agencies feel like they are being written off because few other people on that list focus on the traditional insurance world. Being the person working in both venues, traditional and insurtech, gives me more hope. The key element for thriving success in this new world has little to do with technology. Technology is simply the means to the end. Technology is simply the tool, but without the right plan and thought process, that technology is meaningless. Technology is not even the only solution for thriving success. Therefore, Luddites do not have to plan their funerals, necessarily. Older generations don’t have to take a sabbatical and get a degree in IT to thrive going forward, or even necessarily hire a chief information officer (CIO). These solutions are useless until the base issue that makes technology so sexy is proactively addressed. The fundamental issue is customer
focus. Insurtech, at least a large portion, is about placing the customer at the center focus of the relationship, and insurtech organizations use technology to do so (maybe as some “insurtech” has considerable behind the scenes manual work, meaning its promise really has little to do with fancy technology and almost everything to do with a customer-centric focus). All the insurtech in the world will not save a distributor who fails to put customers first. Every agency/broker/producer I have ever met claims to put customers first, so I know intentions are good. Although, few distributors actually do so. Here is factual, damning evidence.
Renew as Is
Most agencies and brokers have a strong “Renew as Is” program. How can an agency claim to be customer-centric when 25 percent, 50 percent or maybe 75 percent of its policies are renewed as is because the rate did not increase more than X-percent and the customer did not call the agency to report changes? That is passive-to-lazy, but it is absolutely not customer-centric. Customer-centric is reaching out to the clients, at least annually, inquiring about changes, new needs, improvements, successes in their families and businesses. It is about proactive communication to engage the client. Absolutely nothing is engaging with a 'renew as is' philosophy, and going forward, customers and carriers really do not need to pay renewal commissions to agencies that use this methodology.

One reason staff and producers use these terms is they want to be accurate, but they do not understand the coverages themselves. So, they figure that if they just use the technical terms, they are safe. The better solution, of course, is to learn the coverages and then explain the coverages in normal English rather than insurance language. Using industry terminology is a power play. Power plays are not customer-centric.
Tracking Customer Claims
Not tracking claims is another spotlight example of not being customer-focused. Customers buy insurance because insurance’s purpose is to restore policyholder’s

More subtly but importantly, agencies use insurance terminology to explain coverages. We talk about “blanket” coverage (really, do you

wealth to what it was immediately prior to the claim. But if agencies, and even many insurance companies, do not even track how quickly claims are paid, which is an extremely true statement, then how customer-centric is the industry, really? Every agency and carrier should report how quickly the average claim is paid, or at least how quickly the average property claim is paid. It is not, like all of these points, rocket science. The systems exist, and the only reason these numbers are not available is because agencies - and often companies - do not use their systems well. New technology does not solve this problem because this is a people and leadership problem.
Loss Prevention Tools
Few loss prevention tools, including advice, are employed. Here is another simple fact: 99.9 percent of people prefer never having a claim to having a claim. So, does it not make sense to help customers avoid claims on a proactive basis? Customer-centric firms do this, and so much of insurtech is focused on this point. Again, a customer-centric focus is required first and foremost. Technology is just a means for delivering the service.
can’t provide adequate coverage options. So what? I’ve only completed hundreds of E&O audits and 90 percent of producers do not offer adequate coverages either. The only difference is - arguably, let’s say insurtech can’t and humans won’t. As Mark Twain wrote, “What is the difference between a man who can read but does not and a man who can’t read? The former is lazy." What is the difference when a human can offer the right coverages but doesn’t? He/she is lazy. Lazy is not a characteristic of a customer-centric approach. That last statement is strong but 100 percent accurate, and it is key to thriving success. Customers do not need and now will not have to pay (nor will companies need to pay) agencies that are too lazy to offer correct coverages, renew as is, hide behind insurance terms and not help clients avoid losses. I am positive this angers some readers because they are scared. They have never really been customer-centric, and

The very best example of being customer-centric is selling clients the coverages they actually need (which is not the same as selling them the coverages you think they will buy or the coverages they request, because they are likely not experts, so absolutely zero reason exists to believe they know which coverages to request). The only tool that exists to ensure customers are offered the coverages they actually need is a coverage checklist. Absolutely nothing could be more not technology based than a paper coverage checklist. Technology is not required. A customer-centric approach is required. Last week at a conference, the audience advised me that insurtech automated approaches could not provide customers the coverages they truly need. That point is debatable because some programs can. But that is a moot point. Assume insurtech INSURANCEJOURNAL.COM
they do not know how to become customer-centric. Some readers will claim these points are invalid, but after all the valuation due diligence, E&O audits and serving in positions where I get to see how little so many agents know, no other conclusions are possible. Conversely, my clients and others I see in the industry that are customer-centric, within and outside of insurtech, are achieving phenomenal organic growth and profit. This makes complete sense too because customers tend to like to do business with entities that make them the center of attention. This really is not rocket science. he wave of innovation has taken the insurance industry by storm, forever changing organizations, processes and people alike. Risk management telematics are calculating accurate policies for underwriters, big data is helping
employees analyze customer feedback to improve services, and drones are speeding up the claims process. These changes and more have left a very different industry and workplace in its wake - one that will undoubtedly look vastly different from now on. As automation, data analytics and other technological transformations streamline everyday, time-consuming
tasks, individual employees will have the opportunity to work more closely with core organizational values and perform more decision-oriented functions. These roles will require well-rounded individuals with a blend of technical and soft skills ready to support data-driven initiatives and business mindsets. Recruiting and retaining these renaissance employees will position organizations to succeed in the future of work. The future workplace will also demand team-based, flexible workflows. Collaboration is becoming more important as technology redefines employees’ tasks, allowing for more creativity and discus-
sion. At the same time, professionals are working beyond the traditional office space and hours as organizations strive to cultivate the highest productivity. In this age of innovation, improving, and even maintaining, retention rates can be challenging. Many employees associate technological innovations with staff reductions and worry robots and computers will take over their jobs and replace them. They are concerned that their employers are painting the picture of a future work reality without them. To ease these concerns, leaders should be transparent and consistently communicate upcoming changes and initiatives.

It is not simple, though, to ease the suspicion and fear employees are harboring as their workplace changes at an unprecedented pace. Insurance organizations must offer more than “lip service” to improve employee engagement and retention. This starts with fully embracing workplace modernization. Change is exciting, and employers need to put innovation in a positive light to ensure their organizations truly step into the 21st century. We often associate technological improvements with “disrupters.” Although the term may accurately refer to potential risks stemming from the future of work, it does not reveal how modernizing provides promising opportunities for the industry and its workforce. Artificial intelligence and data analytics may indeed replace some jobs, but at the same time, they will generate newly-created positions, putting more people to work. Leaders should offer opportunities for individual growth by providing transition programs and supporting internal mobility. As technology redefines employees’ responsibilities, insurance organizations must be intentional about helping their workers transition into the future of work.
Recruiting
Recruiting top talent is also a key to mitigating future workforce risks, but long-standing views of the industry as a rigid, old-fashioned environment often deter younger generations from considering insurance a viable career path. The INSURANCEJOURNAL.COM
insurance industry will continue to face fierce recruiting challenges stemming from this misconception. Although organizations have started to revolutionize their business models and integrate cutting-edge technology, those efforts are often buried under unchanging public perception. It is critical that the insurance industry reinvent its employer brands to attract top talent. Companies should proactively advertise their innovative corporate culture and desirable workplace features to younger generations. Many still think insurance organizations require professional attire such as full suits and ties under bureaucratic, structured authority. Dressing down, allowing flexible work arrangements, promoting a collaborative atmosphere and offering creative benefits are essential, but they mean nothing if no one knows about them.
The potential the future of work offers is exciting. Organizations must positively approach innovation alongside their employees and authentically promote their modern workplace. Only then will the industry have the talent needed to success-

A
s an insurance broker, you may have a special connection to your nonprofit clients. After all, these organizations undertake some of the most noble work in our society, serving those in need or advancing research that helps create a better world. They also typically operate on thin budgets, working to drive as much money as possible back to their missions. While staff can be significant, they may have no more than one or two employees dedicated to human resources. Clients like this rely on their brokers to help them break through the complexity of the insurance and benefits worlds while also finding cost effective ways to manage risk and provide peace of mind. One way that brokers can help their nonprofit clients is by encouraging them to look at their state unemployment tax expenditures. In fact, the Federal Unemployment Tax Act of 1972 allows 501(c)(3) nonprofits to opt out of paying
the state unemployment tax to become “reimbursable employers.” When an organization operates in this way, it reimburses the state dollar-for-dollar for unemployment benefits paid out to former employees, rather than paying taxes. Considering that nonprofits participating in the state unemployment tax system, pay, on average, $2 in unemployment taxes for every $1 in benefits paid, leaving the system to become a reimbursable employer can seem like an attractive option. However, there is also significant risk in an already overburdened organization taking on the sole responsibility of reimbursing the state in the event of layoffs. In addition, the amount of time it takes to file paperwork, attend hearings and monitor benefits paid to former employees can place a serious burden on small human resources departments.

A good unemployment insurance provider will work with you and your client to determine a fixed rate based solely on that organization’s individual claims history and future expectations. This alone can result in significant savings for the average nonprofit as the money spent applies directly to the organization’s own unemployment compensation expenditures rather than subsidizing employers with higher expenses, such as in a state unemployment pool. Insurers also typically handle all the administration that goes

They know that when it comes down to it, brokers are relationship builders who rely on the trust and goodwill of their clients.
