A

gency partnerships have grown tremendously. Since 2013 when Insurance Journal began tracking the Top 20 Agency Partnerships, the total combined property/casualty revenue for all 20 agency networks has more than doubled. In 2013, the combined total P/C revenue for all 20 agency partnerships totaled $1,647,936,120. In 2019’s Top 20 Agency Partnership ranking (see the Aug. 5, 2019 issue of Insurance Journal), that figure reached $3,815,161,620. “Agency networks are experiencing strong growth and have not reached their full potential,” believes Steve Pearson, president of ISU Network, which ranks #2 on the list. Agencies of all sizes continue to seek out the services and clout of agency networks. “Small agencies or startups are looking for market access. Meanwhile, larger agencies have all the markets they need but often seek to join a community of sophisticated agencies similar to their own,” Pearson told Insurance Journal. Matt Masiello, CEO of SIAA, the largest agency partnership in Insurance Journal’s ranking, says networks are here to stay. But he and others know, not every one of them will make it. Networks, like agencies, are being pushed to offer more and more every day. “Simply providing market access and some local profit-sharing aggregation is now the ‘price of admission,’” Masiello told Insurance Journal. (see Special Report on page 24) “Anyone can do aggregation and agents can access markets in dozens of different models – it just depends on the model that works best for them.” Pearson says that smaller networks and clusters are finding they can’t match the results and benefits of larger professionally managed networks. “Smaller groups often have static membership and are self-managed by participating agencies - often rotating part-time management roles each year,” he said. “Often the largest agencies in these groups contribute the most premium, pay more of the expenses, contributes more of their time, and brings the majority of benefits other members enjoy.” He sees principals of larger agencies joining bigger networks where they can earn the same or more revenue without the management headaches. Whatever the case, networks are numerous and offer value and benefits that go far beyond the early days of market access. Networks have become permanently woven into the fabric of the independent agency system and the system is stronger for them.

News & Markets First-Half 2019 Records Drop in P/C Insurers’ Underwriting Income; Downgrades Outpace Upgrades: A.M. Best

T

he U.S. property/casualty industry’s net underwriting income declined by 9.6% to $4.8 billion in the first half of 2019, compared with $5.3 billion in the same prior-year period, A.M. Best reports. Also, ongoing negative effects from the 2017-2018 catastrophes led to more P/C insurer rating downgrades during the first half than rating upgrades for the first time in five years, according to the rating organization. Net earned premiums grew by 3.8% in first-half 2019, and underwriting expenses and policyholder dividends were stable. However, this was offset by a 5.6% increase in losses and loss adjustment expenses (LAE) incurred. As a result, the combined ratio for the P/C industry weakened by one percentage point from the prior-year period to 97.4. A.M. Best estimates catastrophe losses accounted for 4.5 percentage points on the six-month 2019 combined ratio, up from an estimated 4.2 percentage points in the prior-year period. The Best’s Special Report titled, “First Look: Six-Month 2019 Property/Casualty Financial Results,” used data from companies’ six-month 2019 interim statutory statements representing an estimated 97% of the total P/C industry’s net premiums written. A $432 million increase in net investment income during first-half 2019 offset most of the underwriting decline, resulting 8 | INSURANCE JOURNAL | SEPTEMBER 2, 2019

in pre-tax operating income remaining unchanged at $33.1 billion. Due to a $1.2 billion reduction in realized capital gains, industry net income declined 2.4% from the prior-year period to $32.7 billion.

Rating Actions

In terms of ratings during the first half of this year, the commercial lines segment recorded 11 upgrades and 13 downgrades, while in the personal lines segment, upgrades totaled 10 compared with 9 downgrades. The second Best’s Special Report, “Downgrades Outpace Upgrades for the First Time in Five Years,” notes that loss-affected companies saw declines in risk-adjusted capitalization, volatility in operating performance and reassessments of the appropriateness of their enterprise risk management. Positive rating actions were driven by tighter underwriting standards that led to favorable results over several years and improved risk-adjusted capitalization. Additional factors that led to rating upgrades included recognition of a company’s enhanced importance within its organization, increased parental support and merger and acquisition (M&A) activity. Downgrades of Long-Term Issuer Credit Ratings (Long-Term ICR), as a percentage of all rating actions on U.S. P/C carriers, increased to 7.1% of total actions, up from 6.3% in the first half of 2018. Conversely,

Long-Term ICR upgrades were 6.2% of total actions, compared with 7.1% in the same prior-year period. A.M. Best took action in the first half of 2019 on the Long-Term ICRs of 680 rating units, which describes either an individual insurer or a consolidation of companies and is the financial basis on which A.M. Best performs its credit rating evaluations. The rating agency said the overwhelming majority of the rating actions were affirmations (81.7%), reflecting the overall stability of the U.S. P/C industry. The following are other findings from the report: • Included in the total number of rating changes in the first half of 2019 were the assignment of 10 P/C ratings, or 3.0% of total rating changes. Nine of the initial assigned ratings were in the commercial lines segment and involved new or recently formed companies; • The number of ratings placed under review in first-half 2019 dropped to nine from 21 in the previous year, although the number of companies placed under review in first-half 2018 was elevated due to the implementation of the updated Best’s Credit Rating Methodology; • In first-half 2019, 81.3% of the U.S. P/C industry’s credit ratings carried a stable outlook, a modest increase from the first half of 2018. A.M. Best said it has a stable market segment outlook on the personal and commercial lines segments of the U.S. P/C industry, although the analysts note that industry continues to face challenges including elevated catastrophic weather activity; rising frequency, severity and competitive issues in the automobile segment; system implementations and, in the reinsurance segment, the push for diversification and scale as M&A continues. A.M. Best also maintains a stable outlook on the reinsurance segment. INSURANCEJOURNAL.COM



News & Markets AJG Not Liable for Late Notice that Cost Illinois Firm $1.34M

A

n Illinois construction company that waited six years to inform its excess insurer it had been sued cannot expect coverage from that carrier, and it can’t go after the insurance brokerage that sold it the policy, a federal appellate court ruled. “Waiting five to seven years before telling an insurance company that its policy may be implicated in a suit is too long,” the U.S. Seventh Circuit Court of Appeals said. The court affirmed a ruling by the U.S. District Court in Chicago in a case titled Landmark American Insurance Co. v. Deerfield Construction. Deerfield is an Illinois construction company with 55 employees that specializes in telecommunications projects. It hired a consultant, Laurus Strategies, to ensure it complied with the insurance coverage requirements in its contracts with construction clients. Laurus referred the company to Arthur J. Gallagher Risk Management Services, which helped Deerfield purchase a $1 million commercial auto policy from American States Insurance Co. and an excess policy from Landmark with up to $10 million in coverage. 10 | INSURANCE JOURNAL | SEPTEMBER 2, 2019

A coverage dispute arose after a January 2008 accident involving Deerfield employee Sean Graff and truck driver Ryan Keeping. American States refused Keeping’s demand to settle the case for $1.25 million and counter-offered $75,000. For years, neither Deerfield, Laurus, Arthur J. Gallagher nor American States notified Landmark it might be called upon to pay damages while those negotiations were underway. The appellate court made light of American States’ “gambler spirit” by relying on its own evaluation of Keeping’s lawsuit. The carrier thought Keeping’s claim was without merit. Arthur J. Gallagher did not inform Landmark about the suit until December 2014, six weeks before the case went to trial. Landmark sent a reservation of rights letter to Deerfield. After a jury returned a $2.37 million verdict in Keeping’s favor, Landmark denied coverage because Deerfield had not reported the accident promptly as required by the policy. The court later reduced the award to $2.34 million, but that still left Deerfield owing $1.34 million. Deerfield filed suit against Landmark seeking a court order requiring it to pay for the remaining damages. It also filed suit against Arthur J. Gallagher alleging negligence and a malpractice

claim against the lawyer and law firm that American States had assigned to defend the claim, David Olmstead of the Law Offices of Meachum, Starck, Boyle & Trafman. District Court Judge Ruben Castillo dismissed the malpractice suit against the law firm and the complaint against Arthur J. Gallagher. The judge found the brokerage had no duty under Illinois law to notify Landmark of the lawsuit. Castillo declined to rule on the malpractice claim against the Meachum law firm. Since both Deerfield and the law firm are Illinois corporations, that complaint should be decided in state court, the judge ruled. Castillo noted the statute of repose in Deerfield’s complaint against the Meachum firm won’t lapse until 2020 at the earliest. Deerfield appealed to the Seventh Circuit seeking reversal of the rulings in favor of Landmark and Arthur Gallagher. But the appellate court found the district court made the right call. According to the opinion written by Chief Judge Diane P. Wood, insurance brokers have a very limited fiduciary duty to their clients under Illinois law: “The broker is liable only if negligent or when dealing with the ‘wrongful retention or misappropriation’ of certain funds,” the opinion states. The circuit court also rejected Deerfield’s argument that Landmark cannot assert a late notice defense because Arthur J. Gallagher was its agent. Under Illinois law, a brokerage is not an insurer’s agent if it performs traditional brokerage activities, such as sending bills and collecting payments, the opinion says. Deerfield had argued that if Arthur J. Gallagher was not Landmarks’ agent then it must be its agent, and if that’s so, the brokerage is liable because it failed to give proper notice to Landmark. “Deerfield has identified no Illinois cases establishing that insurance brokers have a duty to deliver notice of claims on behalf of an insured, and so its negligence claim fails,” the court said. Wildfires Making Insurance Harder to Find, California Department of Insurance Says By Don Jergler

S

evere wildfire seasons have made it harder for homeowners to find insurance in high wildfire-risk areas, according to new data collected by the California Department of Insurance. The data released in late-August from the CDI shows a 6% increase in insurer-initiated homeowner policy non-re-

newals in Cal-Fire State Responsibility Areas from 2017 to 2018, while ZIP codes affected by the devastating fires from 2015 and 2017 experienced a 10% increase in insurer-initiated non-renewals last year. Wildfires in November 2018 were the most destructive in state history, topping more than $12 billion in insured losses. Most of the damages relate to the

Mark Sektnan, vice president for the American Property Casualty Insurance Association, and Rex Frazier, president of the Personal Insurance Federation of California, issued a joint statement in response to the release of the department’s data: “Recent data released by the California Department of Insurance shows a slight increase in the number of homeowners policies being non-renewed in the areas impacted by recent wildfires and in those areas with the highest risk of devastating wildfire,” the statement reads. “The data, however, does not address the most important question — was the homeowner able to obtain insurance from another carrier?”

The statement notes that the CDI data shows that in high-to-moderate areas, the non-renewal rate held steady at 2%. “For new policies, we see that carriers continue to write a significant number of policies in these areas,” the statement continues. Despite paying out more than $26 billion in claims from the 2017 and 2018 wildfires, insurers remain committed to covering homes in rural and urban zones, according to the statement. The CDI data also revealed the availability of homeowners insurance dropped in high-risk counties. From 2015 to 2018, the number of new and renewed homeowners’ policies fell by 8,700 in the

10 counties with the most homes in high or very high-risk areas. These same counties saw a steady increase in new FAIR Plan policies during that timeframe, growing 177 percent, compared to only a 4 percent increase for the five counties with the lowest risk. The FAIR Plan provides insurance coverage as a last resort for homeowners who are unable to find coverage in the voluntary market. Nearly 57 percent of new FAIR Plan policies are now written in State Responsibility Areas, which is up from 47 percent in 2015. FAIR Plan executives couldn’t be immediately reached for comment. Data also shows a 49 percent increase in surplus lines policies in State Responsibility Areas between 2015 and 2018. Wildfires have been driving more Californians into the surplus lines market, pushing up homeowners surplus premium volume to more than $122 million in 2018, according to figures the Surplus Line Association of California released in April. “We have definitely seen increases in homeowners premiums and transactions in the surplus line market over the last few years, so it is clear that some of these consumers are finding coverage through surplus lines,” said Cliston Brown, the group’s vice president of communications and government relations. “Our industry overwhelmingly covers commercial lines, and even with the uptick we have seen, homeowners’ business still accounts for less than 2.5% of all California surplus line premiums.” Brown added that “surplus line insurance can and does play an important role in filling gaps left when admitted carriers reconsider their levels of exposure.”

Spotlight: Residential Contractors Fake Claims, Price Gouging, Bogus Contractors in Times of Disaster

A

s the scale and frequency of major disasters escalate, millions of dollars in federal, state and insurance payments intended for recovery efforts are being stolen by fraudsters taking advantage of chaos and the pipeline of aid flowing into the stricken areas. Last year, Olanrewajua A. Beyioku, also known as “Papa Smith Morgan,” was charged with wire fraud after allegedly devising a scheme to defraud the American Red Cross. The Gary, Ind., resident used reference codes intended for nine households affected by Hurricane Harvey to obtain $3,600 in relief funds.

Beyioku was one of 3,300 identified cases of fraudulently collecting reference codes that resulted in a loss of more than $1.3 million to the Red Cross. After Gulf Coast flooding in 2016, Renata Foreman of Independence, La., submitted false claims from multiple locations and made more than 50 fraudulent applications using stolen identities to obtain Disaster Unemployment Assistance funds from the Louisiana Workforce Commission. In March, Foreman, 39, was sentenced to 111 months in federal prison and five years of supervised release for multiple counts of wire fraud and aggravated identity theft. In West Virginia, one woman embezzled more than $18,000 in Federal Emergency

She has paid $18,000 in restitution and was sentenced in May to 10 months in prison, two months of home confinement and a $10,000 fine. “As you can imagine, fraud follows the money,” said U.S. Attorney Brandon Fremin, the executive director of the National Center for Disaster Fraud. “So when HUD (Housing and Urban Development) or FEMA or other federal agencies start to put money into those affected areas, that’s when the bulk of the fraud seems to follow. The fraudsters know when the money arrives. So they know that it’s now time

for them to operate.” Losses to disaster fraud are estimated at 10% of disaster-related insurance payouts and FEMA spending, according to a report by the National White Collar Crime Center in West Virginia. More precise losses are difficult to quantify due to the challenges of identifying, reporting and prosecuting fraud. “It’s next to impossible to actually determine how much fraud there is,” said Richard Brody, a certified fraud examiner and professor of accounting at the University of New Mexico. Disaster fraud comes in the form of identity theft, price gouging and fake claims made to insurance companies and the federal government, including FEMA. Contractor, INSURANCEJOURNAL.COM


charity and insurance fraud also can be prolific during times of disaster. In the aftermath of a disaster, fraud against FEMA is commonly committed by submitting claim applications for disaster relief benefits, often claiming damage that did not occur. In some cases, fraudsters impersonate FEMA or other federal officials. “There should be a red flag there that nobody from FEMA is going to ask you for a check,” Fremin said. After Hurricane Michael last October, residents of Panama City say fraudulent contractors flooded the Florida Panhandle days after the storm, persuading people to sign questionable contracts that ultimately set back their recovery. Some residents say they signed over their insurance benefits believing a contractor would do the work they were hired to do, only to find months later the job was never done or that they were charged too much.

Michael’s Destruction

Hurricane Michael was a Category 5 storm that swamped the northwestern tip of the Panhandle near Panama City, leaving behind shattered homes and ruined pavement along U.S. 98. Neighborhoods and homes were reduced to foundation slabs. “Bringing the physical structures back to the way they were, people recovering, that can take years,” said Fredric Kerstein, a former Florida prosecutor. “When you’ve got two out of every three homes in your community that are destroyed, you’re not going to have enough contractors to do the work properly, and that’s INSURANCEJOURNAL.COM

Recovery is a long process.” On June 1, nearly eight months after Hurricane Michael, dozens of Panama City residents met at a tent structure serving as the temporary home of St. Dominic Catholic Church, which was destroyed in the storm. Mass was not held that day. Instead, representatives from local law enforcement and insurance companies met with citizens and victims of disaster fraud. They included two locals, Ted Mahoney and Greg Dossie, who experienced drastically different outcomes. In an interview at his still-gutted and uninhabitable home, Mahoney said he and his family are the victims of fraud. In the hours before Michael, Mahoney waited out the storm in his house in Lynn Haven, just north of Panama City. His wife, Jennifer, and two children, Maria and Monica, left town to avoid the storm. He

stayed, along with the family dog, Sadie. Although first forecast as a tropical storm, Michael rapidly intensified two days before landfall, an unusually accelerated pace that left the Panhandle little time to prepare. When the storm barged in on Oct. 10, it hit hard and fast. The Category 5 wind speeds shattered windows, destroyed the power grid and hampered communication networks. Downed trees and debris made roads inaccessible. The storm opened Mahoney’s roof, allowing torrents of rain to pour into the house, damaging it throughout. “We got through the storm,” Mahoney said. “We lost the shingles. The structure withstood the storm marvelously, marvelously. But because we lost the shingles, water comes in and now you have inside water damage.” The roof has since been repaired, but inside, little else has been done, even though

Mahoney said his insurer paid a contractor for repairs. “In our situation, the contractor, unequivocally, black and white, claimed that work was done that was clearly not done,” Mahoney said, citing among other things, drywall removal that was never completed. Mahoney pays his children 5 cents for each used nail they find on the property, left behind by the contractor who gutted their home. “In general, people are good, honest people, the people that we interact with in this area,” Mahoney said. “So I think that the people expect, you know, if you say something, you’re going to do it. So that’s the expectation.”

Today’s networks are numerous and offer value and benefits that go far beyond markets — independence, growth, profit sharing, perpetuation, relationships, technology, staff support, errors and omissions coverage, and more. They are very much part of the fabric of today’s independent agency system. Insurance Journal asked the 2019 Top 20 Agency Partnerships about their value proposition for agents. He said more than 95% of business is placed directly with markets by its agents. SIAA members maintain their independent ownership in their book of business even when accessing markets through the network. “SIAA’s model serves to actually increase an agent’s independence, making them less reliant on market or carrier fluctuations or industry changes,” he said.

SIAA members can earn commissions and incentives on their books of business in multiple ways. “This includes access to the highest commissions available, local and regional incentives and profit sharing with the local master agency, national quarterly fixed compensation and national profit sharing,” Masiello said. All incentives are calculated and distributed with full transparency via the members’ portal. According to Masiello, partnerships like SIAA deliver “tremendous value” for both carriers and agencies. “The services and benefits to the agencies, combined with the portfolio work with the carriers, puts us in a proven distribution position helping to evolve and fortify independent agency distribution into the future to the benefit of our member agencies, our partner carriers and the IA channel overall.” SIAA has a five-year average premium growth with partner

carriers of 14.9%, he said. SIAA represents about 13% of independent insurance agents in the U.S. and works with partner companies in managing a portfolio of agents and books of business placed in over 50,000 agency codes. Masiello believes agency networks like SIAA are here to stay. “Which ones make it, and which don’t, will really be the question for agents and carriers to ask themselves,” Masiello said. “Simply providing market access and some local profit-sharing aggregation is now the ‘price of admission.’ Anyone can do aggregation and agents can access markets in dozens of different models — it just depends on the model that works best for them.” With a level playing field on market access, it comes down to the value proposition and operational execution of the network, he said. “Viable networks must offer proven services and benefits, not just to their agents, but also to their carriers,” he said.

Agencies have access to the management of profit-sharing contracts and have no restrictions on buying or selling other agencies. “An average agency earns over five times their monthly fees year-after-year,” Pearson said. “No matter how large an agency grows, they don’t outgrow ISU because we never take commission and never reduce agency independence.” Pearson says the ISU Network doesn’t prevent internal transitioning of ownership when the time comes to perpetuate the agency. ISU provides agents with direct carrier access for ISU accessed markets. Pearson added that ISU does not require the use of service centers, which

In total, the ISU network has 200 agencies in 32 states. “Small enough to meet with other members and have a say in network operations. Large enough to be second largest agency network by premium volume, and the clout that comes with controlling over $4 billion in premium,” Pearson said. ISU offers members various ways to earn revenue from more than 100 ISU incentives. These include fixed and variable profit-sharing contracts, enhanced commissions with certain carriers, new business incentives and “blue light specials.” Agencies decide which carriers to link for profit sharing and which to retain as standalone. Pearson said an average

ISU member receives about $80,000 in additional revenue each year through ISU incentives while larger agencies earn substantially more. “Members benefit from geographic dispersion of agencies avoiding over-exposure to weather events in a particular region,” he said. “Many contracts have a guaranteed floor payment regardless of experience with the ability to earn more with superior results. While some networks aggregate, and hope for good results, ISU actively manages performance.” ISU believes that higher volume with fewer carriers creates better outcomes for carriers and agencies than low premium with every carrier. That’s why the network only invites selected carriers to work with ISU members.

ISU said it is also very selective about accepting agencies as members. “Nine out of 10 who approach ISU are declined,” Pearson said. While ISU Network is ranked as #2 in size by Insurance Journal, it has 200 members with average agency revenue [ranging from] $3 million with several agencies over $20 million, according to the organization. Agency E&O is simple, too, Pearson said. Member agencies list “ISU Network” as additional insured on agency members' E&O policy. Agency independence is ISU’s foundational belief, Pearson says. “‘Helping Independent Agencies Remain Independent Since 1978’ is more than a slogan,” he said. “It’s why we exist.”

The network offers agencies of all sizes opportunities to build their business with limited upfront commitment. “We not only offer quality market access to a variety of different lines of business, but also offer enhanced profit sharing, training and support, and a partnership that helps agencies establish relationships with quality carriers,” said Andrew Caldwell, president at Smart Choice. “We bring the power of one of the largest networks in the country and yet still have the relationship and one-on-one attention an individual agency would look for in a partner,” Caldwell said. Smart Choice offers training and mentorships through its network of 80 territory managers and state directors, access to supplemental products

such as agency management systems and discounted E&O programs, and a Smart Start Program for assistance placing personal and commercial risks. It also offers perpetuation assistance, working with its partners to match agents ready to retire or sell with potential buyers. There is no upfront cost to join the Smart Choice network and no monthly marketing fees. “Perhaps, most importantly, agencies are not required to move any of their existing business, or business they write direct, underneath our network, nor do they have to split any commissions on their direct carrier codes,” Caldwell explained. “ Smart Choice operates off a commission split only on markets an agency obtains through its program. “We also stop taking that commission split at a certain level of earned commission, so agencies will

never have to share more than a certain amount of commission in a calendar year,” he said. Caldwell added that Smart Choice Leadership Agencies – those that reach a commission “cap” obtained by having production over a certain level on a running 12 months basis. – also share in profit-sharing. Those agencies can earn up to 75% of general profit sharing, and usually receive 100% of special short-term incentives directed to Smart Choice by its carrier partners. Smart Choice Leadership Agents can also compete for annual trips and other special incentives. Members of Smart Choice remain 100% independent owners. “Our agents’ customers are theirs, always,” Caldwell said. All carrier appointments obtained directly by the agent are maintained separately from the network.

“Smart Choice does not have any stake in those relationships and agents are not required to move any of their business to appointments under Smart Choice,” Caldwell said. There are no exit fees if an agency wishes to leave the network. Member agencies can access several discounted agency errors and omissions (E&O) markets through Smart Choice, however, they can also obtain E&O coverage on their own, through their preferred carrier. Caldwell says Smart Choice can be a great fit for agencies of any size and age. “Our network has had four straight years of record growth, both in revenue and agency partnership additions,” he said. “With a number of different programs for our partners to choose from, we are a great fit for a start-up agency, a medium sized agency, and the largest agencies in the country,” Caldwell added.

he United Valley Insurance Services is a network of independent agencies located in California and Arizona with plans for expansion. Members maintain complete control of their business and own their own books of business. “We do not retain any portion of their policy level commissions, said Rene Swan, president of United Valley Insurance Services. The organization says members like that United Valley does not appoint agencies that compete with any members. “We stand by our members and do not compromise the value of their membership by appointing their direct competitors,” said Swan. “Members don’t compete which allows

them to share ideas and connect with other quality agency owners.” United Valley is more than a place to access markets. It offers opportunities to connect, network, learn and grow. “Our members value the engagement they receive from the many webinars, workshops and practice groups that we host,” she said. Members also have access to an Emerging Leaders program, various industry practice groups, an annual conference, education and perpetuation planning. Monthly membership fees are based upon total property/ casualty revenue. There is no joining fee and no exit penalty at United Valley. Profit sharing is paid annually, based on pro rata

According to Swan, the quality captured by United Valley’s agency selection process is a differentiating factor, a benefit to members and carriers. “We vet-out members by selecting the best quality partners; that selection process gives carriers a fully qualified agency with

acific Interstate Insurance Brokers (PIIB), launched in 1994, has more than 200 member agencies in nine states today. Agency members are treated equal even when it comes to cost to join. The total cost to join is a one-time $5,000 initiation fee and $850 monthly. “There is no commission split, and our affiliates keep 100% of the commission,” said Tracy Ryan, marketing and agency relations for PIIB. Also, the monthly fee does not increase. “Simply, $850 a month,” she stressed. Cost is not the only differentiating factor PIIB likes to cite.

“Integrity and patience are what set us apart from other groups,” said Ryan. “Our contract is black and white; no one agency sees a separate contract than another.” PIIB retains 10% of the profit sharing and distributes the other 90% back to its affiliate members. “PIIB affiliates earn profit sharing on dollar one,” she added. Profit sharing is paid based on how much premium is written (with no minimum) but the most profitable PIIB agencies can gain more share. “This allows an agency to be paid on their books with PIIB regardless of if they have a bad year and to earn more for

staying profitable,” she said. And should an agency decide to leave the network, there is no fee or buyout cost. PIIB members gain access to an online portal called PIIB Connect, which houses carrier and vendor catalogs; a market search forum; and PIIB Match, a program designed to match buyers with sellers to simplify the process of M&A’s through confidential, no-pressure ‘match-making’ of affiliates. Ryan says all members are pre-vetted by PIIB prior to being sent to carriers for an appointment. “In addition, all affiliate access to the carriers is direct so the carrier knows

exactly who is submitting business and has a relationship with them,” she said. Profitability is the number one concern. “We monitor profitability meticulously and coach our affiliates on agency practices to reestablish profitability if it’s ever lost.” Ryan sees consolidation of networks in the future. “We believe that networks will begin to merge because there are an endless number of small networks who will eventually be best off to partner with the larger, veteran networks.” Choosing the right agency partnership will be even more critical, she added. Network Exchange # 11 Agency

E

stablished in 2009, Agency Network Exchange LLC (ANE) is a network of more than 70 independent insurance agencies in New Jersey, Pennsylvania and Maryland that place more than $750 million in written premium. Members maintain independent ownership in their book of business as all business is written with their agency name on the policy, according to Elizabeth Schenk, CEO, who added that members own the book of business, even if they decide to leave. Members maintain carrier relationships and are licensed directly with each of the carriers. The cost to join ANE is about

$12,000 a year in fees, with no start-up cost or exit penalty should a member choose to leave. All members participate in profit sharing as well regardless of the size of their book. Schenk believes organic growth opportunities are a critical component for any successful network. “This will not occur by merely adding more agencies,” she said. “Each agency must have the ability to grow or else they will hinder the success of the group.” That’s why ANE chooses to be “large enough to be strong, but small enough to be nimble,” she said. “In this ever-changing industry, you have to be able to react quickly and adjust,”

Members are offered a number of additional services including coaching, training, exclusive vendor deals, technology offerings, marketing, perpetuation planning, agency valuations, business planning and dedicated field staff who

Outside of access to markets, GAP member agencies benefit from preferred compensation contracts, expense reduction through vendor consolidation, sales and service training, consolidated operations and technology platforms, and perpetuation training, she said. Agency networks will continue to grow as a strategy for carrier growth and success, Rominger said. “There may be consolidation, but carriers look for groups that have members with similar culture and growth strategies,” she said.

They get bitten by that.” Dossie and Mahoney said they weren’t prepared for the destruction and fraud following Hurricane Michael. “People are thinking we’re going to be back to normal, two, three, four, five years,” Dossie said. “It’s not going to happen. There’s going to be a new normalcy. Neighborhoods are changing. Houses are being destroyed . the whole landscape is going to change.” The lack of experience and knowledge in dealing with post-disaster fraud meant many Panhandle residents didn’t know the risks of signing over an assignment of benefits to dishonest contractors or how to deal with their insurance claims. Many contractors either overcharged or collected down payments and vanished, leaving families stuck with a contract they couldn’t get out of.

Reporting Complaints

The National Center for Disaster Fraud in Baton Rouge was formed after Hurricane Katrina in 2005, when fraudsters capitalized on the billions of dollars in federal disaster relief that poured into the devastated Gulf Coast. The center does not prosecute cases but instead reports fraud to state and federal jurisdictions. Since 2005, it has received more than 95,000 complaints relating to disaster fraud. “Unfortunately, we expect to see (fraud) after just about every incident of disaster,” said Fremin, who leads the national center. Complaints are filed into a database maintained by the center to determine recurring fraud schemes and perpetrators. “We want to make sure we get the best possible information that we can give to the potential investigator and, hopefully, to the prosecutor in order to make a successful investigation,” Fremin said. Many people, he said, didn’t know the center existed in 2016 – even when an unnamed storm flooded at least 21 parishes in southern Louisiana and led to 13 deaths. Since then, disaster fraud has become an important strategy for preventing post-disaster fraud, Fremin said. The center is in contact with every U.S. Attorney’s Office

and state attorneys general, and letters and emails are sent to areas expecting disasters, reminding them to contact the center with allegations of fraud. “We want them to know that rather than spending time on the phone taking complaints, (we would rather) have them out on the street helping the people who need it most and allow us to take those complaints,” Fremin said. Still, it’s difficult to identify and prosecute on local and federal levels. “What good does it do if the local law enforcement and the local prosecutors don’t know how to handle the problem?” asked Kerstein, who prosecuted disaster fraud cases after Hurricane Andrew hit Miami in 1992. “It’s very clear to me that when you’re a department, a police department, a local prosecutor who has never experienced this kind of disaster before, and all of a sudden you’re facing this – you need an education as well as the victims need an education.”

Trey Hutt, president of Hutt Insurance Agency in Panama City, said homeowners who are diligent in chasing down contractors and communicating with their insurance company are better prepared to avoid fraud and get the best results. “This is not a sprint, it’s a marathon,” Hutt said. “The speed with which you move is less important than the idea that you keep your wheels in motion.” David LeBlanc, who lives in southern Louisiana’s Ascension Parish, was defrauded after an unnamed storm in 2016 left nearly 2 feet of flooding in his home. He said his contractor did not complete the work, and then placed two liens on LeBlanc’s home, which prevents homeowners from receiving insurance payments. The contractor, Matthew Morris, owner of Complete Construction Contractors, was arrested in 2017 on multiple counts of fraud. Morris has since been convicted, and his license was revoked after it was discovered Morris had previous criminal convictions. LeBlanc navigated the process himself, but victims of fraud in similar situations INSURANCEJOURNAL.COM

The National Center for Disaster Fraud call center hopes to simplify the process. “The problem with a lot of this is that the citizens don’t know what constitutes illegal activity or what’s a civil issue or what’s just an inconvenience to them,” said Rozier. “A lot of this is educating the

profit sharing with the carriers,” he said. Members of DAIS operate without minimum carrier volumes or profit-sharing thresholds to meet in order to be eligible. They retain 100% of commission dollars beginning with their first dollar earned. The DAIS cluster provides members the opportunity to earn up to 80% of profit-sharing and override earnings. The other option, Networked, operates similar to a wholesaler, serving as the middle-man and becomes the carrier-facing arm for each member – obtaining quotes and servicing policies via requests to the carriers. Networked advocates for its members on policy servicing, standard and promotional commissions and account placement. “Our commission splits are fair, market-dependent and tiered to increase as members grow with us,” Oslie said.

Koppenheffer, president, while agency members enjoy the benefits of carrier access, enhanced compensation and additional resources, members often cite the ability to have a “board of peers” to discuss agency operational and strategic issues as the top benefit. To “facilitate this deep sharing and learning atmosphere,” the Insurance Alliance Network has remained intentionally small with only 10 current members, Koppenheffer said. “The size and collaborative nature of our group makes it great option for agencies with similar values looking to join an agency partnership group,” she said. The strategic small size is one of two main distinctions of the Insurance Alliance

Network compared to other agency partnerships, according to Koppenheffer. The other is the strength of being owned by the Alera Group, a $350 million revenue organization. As a former regional carrier executive, Koppenheffer understands both the advantages and disadvantages of agency partnerships from a carrier’s perspective. “If the group is cohesive in their planning and are able to develop specific initiatives with the carrier, the carrier will see a higher degree of goal attainment and growth,” she said. “If the agency partnership group has standards for professionalism and business processes, the carrier will be able to work with higher-quality agencies. One thing she’s sure about: “Agencies that are able to remain independent and not feel pressured to sell to larger

organizations in order to preserve market access typically have better relationships and performance with regional carriers than the larger brokers and agencies.” Koppenheffer believes agency networks will continue to grow and be an important component of the agency distribution landscape. “While there is heavy acquisition activity, there are also many new independent agencies being created – some from employees who leave acquired or larger firms to go out on their own, or captive agents becoming independent,” she said. Networks are themselves not immune to consolidation. “To the degree that agencies specialize more in the future, you may see that networks begin to specialize, as well,” she said. “Mergers of groups will be most prevalent among the smaller, more informal networks that exist.”

oday is a great time to be an independent agent, but running an independent agency is not easy. Without an awareness of By Matt Masiello how the industry is evolving, and having access to ongoing training and education, you may not be adequately preparing for the future. If you are too busy handling day-to-day business so there is no time to work on growth simultaneously, you could lose your current and potential clients in a hurry. Whether you are a captive or independent agent you need a solid foundation. Ask yourself: Are you a well-known professional in your community? Are you working with carriers that meet your clients’ needs? Are you technologically savvy with a fully automated office? How about a year from now? You need to know how you will drive growth and profitable results in the long term and, with the prevalence of innovation and technology impacting the industry, how to evolve as the industry does. In this context, you may do better as part of a larger team. Many independent agents are joining alliances/networks, clusters and aggregators to generate more revenue, while experienced producers may join to follow their dreams of opening their own independent agency. ering joining one of these organizations, remember the saying, “Only fools rush in.” If you don’t have the answers before joining, you may regret it in the long run. That’s why it’s important to thoroughly research the differences between the options you’re considering. Here, I will focus on the questions you should ask to make the best choice and to understand the majority of services available to an agent today.

Networks

Networks are valuable in many ways. They can provide a path to building your business, help insurance professionals to own and operate their own independent agency, provide extensive training and education to build personal, commercial and specialty income, and help carriers and independent agents grow, helping the distribution system overall. When evaluating networks, first, understand where your business is today. Before you sign any contract, get granular and review your agency by examining your Strengths, Weaknesses, Opportunities, and Threats (SWOT analysis): • Is your book of business solid? • Have you built a recognizable local brand? • Do you have the technology to interact with clients through multiple channels? • Are there weaknesses that stand out and how are you addressing them?

What opportunities do you have that you have not yet explored? Are there threats to your agency’s survival such as increased competition or high turnover?

Remember, any worthwhile network/ alliance will also perform their due diligence on you and your agency. Recruiters of a quality network will examine your history and production to ensure you have the skills, experience, etc., to succeed. If they don’t, you should question the potential impact of their other members on the organization as a whole and your agency. They should also work with you to identify areas where their organization can help you meet your needs and goals.

Understanding the Fine Print

The network you join should align with your branding and reflect the quality you seek. Without vetting the network properly, you will bring tension to yourself and your team. Here are questions to ask a network before joining. The answers will bring transparency to the relationship and should remove any unpleasant surprises.

1. Short/Long-Term Goals: How will

the network help you obtain your goals in the short and long term? Can they help you become sustainable for the long term? Does the network have a proven track record, service and benefits for the life cycle of your agency? How exactly will you INSURANCEJOURNAL.COM


have access to insurance companies? Will you have access to preferred, standard, E&S and specialty markets and at what compensation levels?

2. Other Services: What are the other

services offered; how are they delivered? Today, just gaining access to markets or aggregating some premiums is not enough for success. Do they have field representatives to act as a go-to resource for a startup agency or existing agency to continue to grow? Is access to services and benefits available 24/7? Will the network help your business grow through training in new markets such as cyber, commercial and niche markets? Will they show you how to become fully automated so your business runs efficiently and creates a seamless experience for your clients? Get specifics on agency development tools, services and training. Meet the people who will provide these services. Ask them to show you their results.

3. Carrier Access and Commissions:

How are carriers accessed and commissions paid? How is new business placed; whose name is on the policies? Do you have the ability to earn direct codes? If you do, are all commissions paid directly to the producing agent by the writing company? How will you qualify for additional profit sharing, bonuses and overrides? How and when are these payments distributed? Does the network measure key performance indicators with you?

4. Contract Details: Does the contract take into account the short and long term, including the ability to leave with clients and carriers? Make sure the contract addresses the beginning, middle and end of the relationship. Understand who owns the business. Make sure that if the affiliation fails, you not only own your clients and accounts, but you also can take your commissions and the ability to represent your insurance companies without restrictions. Some organizations say they don’t have any non-compete restrictions, but they prohibit you from representing your carriers in the event of an exit and provide no alternative path. business will be transferred in the event you terminate.

5. Financial Performance: How has

the network performed financially, with carriers, member agencies and profitability (loss-ratios)? Do they work with successful carriers? How will they help you drive down operating costs and improve your margins? Many new organizations are moving into the market access and insurance distribution business. Make sure you’re not joining a flash-in-the-pan option that is not sustainable for the long-term with proven results.

6. Profitability and Benchmarks: How is the profitability (loss-ratio) and experience of other members monitored to assure that you have income and carrier access down the road? What benchmarks are set for new business, loss-ratios and total premium? Does the network give attention to book quality? For profit sharing, incentives and overrides, how is compensation earned and distributed? Ask for complete transparency and examples.

Comparing Other Distribution Models?

Aggregators and clusters may boost profits without providing any ongoing training and education. Make sure you are confident that you have everything you need before choosing an aggregator or cluster vs. a network. Understand the advantages and disadvantages of each before you decide. With aggregators, agents get access to insurance carriers’ contracts. Aggregators provide market access and aggregate premium, sometimes adding compensation but without support services or tools. They tend to be transaction-oriented, based on writing and placing policies, not focused on helping you grow your overall agency. Clusters can be a formal joint venture or a loose affiliation to combine books in order to receive higher commissions or profit sharing. Members maintain ownership of their accounts and agency and operate individually. Generally, clusters are formed to increase income by combining carrier volumes. If you opt for this route, make sure you understand how premiums

with carriers will be replaced, to prevent reductions in contingencies, if members sell or leave. Whether you want to move from an exclusive agency model and open an independent agency, or you’re an independent agent who wants to increase stability long-term, joining a network can ensure you maintain your competitive edge. Quality agency networks offer not only increased carrier access, but also the ongoing training and education, as well as additional support services your agency needs to thrive well into the future. At the end of your research on a potential network partner, ask yourself: “Through this process, does it seem that my overall agency’s success is as important to the alliance as it is to me, or are they just focused on placing business and receiving fees or commissions?” Your response to that speaks volumes about what you really learned. Insurance products have developed in recent years to combine traditional risk transfer with crisis response and risk management provided by experts in the field.

he shooting in Dayton, Ohio, August 4, became the 247th mass shooting in the U.S. in 2019. At an average of more than one mass shooting per day, statistics highlight the need for awareness among organizations of all sizes about how to protect people and assets and, where possible, reduce risks of an attack. While some perpetrators of mass shootings publicize their motive, often using social media to espouse extreme beliefs or identify targets, such media-grabbing behavior is not typical. (As defined by gunviolencearchive.org, a mass shooting incident is considered an event where four or more people are shot or killed, excluding the assailant.) Terrorism has changed in terms of perpetrators and their beliefs. The frequency and methods of attack have also changed. This makes risk more complex and emphasizes the importance of organizations being prepared. Failure to handle a situation professionally and with due care can have consequences for individuals’ safety and cause damage to an organization’s reputation. Ensuring staff are educated on the risks and having a clear risk management and crisis response plan could make the difference in an incident and in dealing with the aftermath. For these reasons, insurance products have developed to combine traditional risk transfer with crisis response and risk management provided by experts in the field. Today, the market offers deadly

weapon protection policies that also combine crisis response services. Through service-led policies, response experts will audit organizations’ premises and crisis planning, and offer educational training and resources that can be shared with employees. Should an attack take place, they will provide security as well as services including crisis PR and counseling for victims and families. In a live crisis, one of the first things the response team will do is identify who the stakeholders are, what communications need to go to them, who is responsible for communication and through which channels. By combining these crisis management services with a strong insurance indemnification pillar, carriers have created robust offerings designed to respond to incidents involving deadly weapons on a primary basis. Coverage can be purchased for third-party liability as well as first-party property damage and business interruption. The definition of a deadly weapon is at times deliberately broad, and in response to the increase in incidents involving

vehicles and other items that have been repurposed as weapons. Policies can be triggered merely by a weapon being brandished. Today, coverage can be adapted depending on the insured’s need, with extensions including loss of attraction, loss of tuition fees for schools, and demolition, clearance and memorialization. As risks become more complex, it is important for the broker and client to be aware of the availability of specialist products and the limitations of a general liability policy. GL policies were not designed to respond to shootings and, for clients, having the correct coverage is becoming an issue of good corporate governance. As we have seen in recent months, these incidents can occur anywhere at any time, and it is vital that risk managers and business owners have a clear plan in place and are aware of how their insurance will respond should they fall victim to an attack.
