Hot Wheels: 5 States Top the List for Stolen Cars Colorado
led the nation in 2021 with the highest overall vehicle theft rate but California once again held the top spot for the number of cars stolen overall.
That’s according to the National Insurance Crime Bureau’s Hot Spots Report which found that vehicle thefts continue to skyrocket in many areas across the U.S.
Colorado’s rate came in at 661.21 thefts per 100,000 people, up from 502.12 in 2020, an increase of 32%.
California led the other states with the highest number of vehicle thefts by volume once again in 2021 with 200,524 vehicles stolen, over 100,000 more thefts than second place Texas.
“For many of us, cars are essential to our livelihoods and the welfare of our families,” said NICB President and CEO David Glawe. “NICB, along with our partners in law enforcement, are proactively working to prevent and deter vehicle theft, but vehicle owners can take simple steps to empower themselves. No matter who you are or where you live, theft prevention starts with good security hygiene. Lock your doors and keep your keys with you at all times.”
The top five states with the most thefts by volume include Illinois, Florida, Colorado, California and Texas. In total, those five states account for 412,008 vehicle thefts, or 44% of all vehicle thefts nationwide. Of these states, only Florida saw a slight decrease in vehicle thefts with 42,808, down from 44,940 in 2020.
In addition to having the most overall thefts by volume, California was also home to high est theft rate by Metropolitan Statistical Area (MSA) and Core-Based Statistical Area (CBSA). The highest theft rate in the United States was in Bakersfield, California, where its CBSA yielded 1,024 thefts per 100,000 people. With a rate of 964.92 thefts per 100,000 people, the Denver-Aurora-Lakewood, Colorado, CBSA was second overall in theft rate.
Some good news — not all states experienced an increase in thefts in 2021. Since the release of the 2020 Hot Spots report, 22 states have seen decreases in vehicle thefts.

Man-Made Crises Threaten P/C Markets, Says Joint Report From Trade Associations

Severalinsurance industry trade asso ciations used the 30th anniversary of Hurricane Andrew — a storm that upended and transformed insurance and the manner in which communities prepare for natural disasters — to broadcast their conclusion that man-made threats are today the “root causes of most market instability.”
A paper, It’s Not Just the Weather: The Man-Made Crises Roiling Property Insurance Markets, jointly published by the American Property Casualty Insurance Association (APCIA), the Reinsurance Association of America (RAA), the Association of Bermuda Insurers and Reinsurers (ABIR), and former Insurance Information Institute president and economist Robert Hartwig, said costs to insurers from legal-system abuse, claims fraud, and regulatory inter reference have created volatile market conditions.
“These unmodeled and largely uncontained risks are in some cases sol vency-threatening, obligating insurers to take drastic steps to protect and conserve capital, with predictably adverse conse quences on price, coverage availability, and competition,” according to the paper, which singled out Florida, Louisiana and California for “having failed to learn from their past mistakes” by enacting legislation and regulation that hinder insurance markets.
The paper details the crises in each state.
The authors conclude that legal-system abuse is rampant across the country but is particularly evident in catastrophe-prone states. Claims involving litigation are “increasing at previously unseen rates.”
The average personal-injury verdict was $125,366 in 2020, up nearly 320% from $39,300 in 2010. Billion-dollar verdicts are becoming more common. Furthermore, the median cost of a single-fatality claim has increased over 240% in the last 17 years, according to data within the paper.
In addition, fraudulent property insur ance claims represents a growing amount of insurance fraud in the U.S., resulting in additional premiums for families. The Coalition Against Insurance Fraud estimates fraud occurs in about 10% of P/C insurance losses.
Meanwhile, state regulators and legis lators “too often fail to recognize the real underlying issues, and their actions often unintentionally exacerbate the symptoms and throw markets into further chaos,” the groups said. “To fix broken property insurance markets, insurers have urged state lawmakers and regulators to focus on addressing the underlying issues roiling those markets. Legal system reform, antifraud measures, and promoting regulatory stability and mitigation to help reduce future losses are imperative to restoring market health in catastrophe-prone markets.”
The associations said they included within the report recommendations to form an action plan.

The number of reported incidents involving aiming of lasers at U.S. airplanes in 2021, a 42% rise over the previous year, according to the Government Accountability Office, which said the Federal Aviation Administration (FAA) should strengthen its efforts to address the practice. Intentionally aiming lasers at aircraft poses a safety threat to pilots and violates federal law. The FAA can issue fines of up to $11,000 per violation and $30,800 for multiple laser incidents. The agency said it issued $120,000 in fines for laser strikes in 2021.
The amount an Ohio contractor with a long history of federal workplace safety violations must pay in addition to $108,318 in unpaid penalties with the U.S. Occupational Safety and Health Administration (OSHA). Dundee-based Benny Troyer Roofing and Trail Roofing LLC was again found to have exposed workers to potential deadly fall haz ards, this time at an Akron job site. OSHA said inspectors observed two employees working at heights of up to 20 feet without adequate fall protection. Inspectors also found the employer allowed workers to use ladders improperly and failed to enforce the use of head, face and eye protection.

PFAS chemicals — widely used to make household products from nonstick cookware to food packaging — have in recent years been found in dangerous concentrations in drinking water, soils and foods across the country.
Ghost Car Battles
“Ghost cars are by design unsafe and untraceable, so in addition to finding and towing them, we’re going to stop them from appearing in the first place. Amazon has been a willing partner in the battle for street safety and we thank them for working with us to keep New York City streets safe. We expect all e-commerce platforms and other sellers to follow their lead, comply with the law, and keep these products out of New York.”
— New York City Mayor Eric Adams said of a collab oration with Amazon, which promised to proactively restrict the sale of smokescreen license plate covers and tinted license plate covers to customers with a New York state address. It also will automatically display notices that these products cannot be shipped to New York locations. The arrangement is part of a crackdown on so-called ghost vehicles that use camera blockers to cover license plates.

“Rather than addressing an employee’s concerns about the safety and health of their workplace, the Killeen Daily Herald terminated their reporter who sought to prevent workplace exposure to unknown diseases carried by the insects.”

Harbin, OSHA Regional Administrator in Dallas, said of an investigation that found a Texas newspaper fired a reporter when they complained to management that they believed fleas had infested their workplace, leaving them with bug bites. Following an investigation, the U.S. Department of Labor sued the Killeen Daily Herald for violating fed eral laws protecting workers who report workplace safety and health issues. OSHA determined that in May and June 2021, the reporter sent messages to company management complaining about the infestation — and the bug bites. After sharing this additional information with management, the reporter was fired.

Record-High Direct Premiums Written for the U.S. Surplus Lines Segment in 2021
TotalU.S. surplus lines direct premiums written (DPW) reached a record $82.6 billion in 2021, with momentum continuing through mid-year 2022, according to a new AM Best report. In the first six months of 2022, premiums topped $31 billion, and premium bearing transactions pushed 2.8 million. Premiums in the E&S sector rose 32.4% and transac tions were up 9.4% over numbers reported through the same period in 2021, according to the 2022 Midyear Report of the U.S. Surplus Lines Service and Stamping Offices released in July.
The Best’s Market Segment Report, titled, “Record-High Direct Premiums Written for the U.S. Surplus Lines Segment in 2021,” states that the U.S. surplus lines companies reported improved underwrit ing and operating results, and notched their largest year-over-year premium growth since 2003.
In 2021, the surplus lines market grew by nearly 25%, including U.S. domestic surplus lines insurers, the (90) Lloyd’s syn dicates writing U.S. surplus lines business, and through regulated non-Lloyd’s alien insurers, David Blades, associate director at AM Best, told Insurance Journal.
“The 2021 surplus lines direct premiums written total we aggregated was $82.653 billion, compared to $66.102 billion in 2020,” Blades said. The key drivers of that growth were the companies identified in the report as “Domestic Professional”
surplus lines writers, or those insurers that write more than 50% of their total DPW on a nonadmitted or surplus lines basis.
“The Domestic Professionals wrote $61.2 billion in 2021, up from $46.9 billion, a 30% increase,” Blades said.
In terms of admitted versus non-ad mitted, or surplus lines, the surplus lines market comprised 10.1% of the total U.S. property/casualty insurance market (in terms of DPW), in 2021, the highest percentage yet, Blades added.
The surplus lines insurers’ market share of total P/C DPW has more than doubled over the last 20 years, to 10.1% at the end of 2021, up from 4.3% in 2001. The surplus lines insurers’ share of the commercial lines’ DPW grew to 20.4% at the end of 2021, from 8.3% at the end of 2001.
The report notes that in the first quarter of 2020 through mid-2022, U.S. property/ casualty (P/C) companies and their distri bution partners have dealt with myriad challenges, including the wide-ranging effects of a pandemic, a supply chain crisis and rising inflation, while withstanding above average losses from natural catastro phes and substantial investment market volatility. As a result, loss costs continue to rise and price adequacy remains a serious concern for several lines of coverage.
Despite these challenges, the P/C indus try has been able to limit underwriting losses and generate surplus growth. AM Best expects surplus lines insurers will
continue to benefit from underwriting results, organic capital generation and intelligent management of balance sheet factors, as they have throughout the pandemic. Volatility in the investment markets, however, could constrain overall operating earnings.
U.S. P/C Records $6.3 Billion First-Half Underwriting Loss: AM Best Growth
in net premiums and a decline in policyholder dividends were eclipsed by losses and expenses to result in a $6.3 billion net underwriting loss for the U.S. property/casualty industry at the half-way mark of 2022.
According to a special report from AM Best, the underwriting losses booked by the U.S. industry during the first half 2022 was down $11.4 billion from the same time period in 2021.
“The personal lines segment, specifically the auto lines of business, were responsible for the decline in underwriting results,” AM Best said. U.S. P/C industry net income at June 30 was $31.4 billion, down 17.7% compared with the first six months of 2021.
The combined ratio worsened to 100 compared with 97 a year ago. Excluding favorable reserve development during the first six months, the accident-year combined ratio was 101.9.
According to AM Best, the industry saw a 9.3% growth in net premiums earned to $359.2 billion and decreased policyholder dividends by 27.7%. However, losses and loss adjustment expenses increased 15.8% to $264.5 billion and underwriting expenses went up over 7% to $99.3 billion.

4 Issues Facing Contractors That Agents Must Know

Shortage, Higher Costs of Materials

Despite the plethora of construction work currently available thanks to state and federal infrastruc ture invest ments and the pent-up demand for new housing it’s a challenging time for contractors.
Several factors beyond con tractors’ control are negatively impacting the construction industry and increasing expo sures, particularly for smaller trade contractors. Insurance rates are also rising at the same time, making the cost of doing business more expensive.
Here are four of the biggest issues facing contractors that agents should be aware of and how they can help their clients
The worldwide shutdown caused by the COVID-19 pan demic brought the production of construction materials like steel, lumber and appliances to a screeching halt, which has seriously disrupted global supply chains over the last 18 to 24 months.
More than 90% of builders reported some type of material shortage last year, which was the most widespread shortage since the National Association of Home Builders (NAHB) began tracking shortages in the 1990s.
Contractors are paying higher costs for construction materials and experiencing significant project delays.
Construction input prices in July 2022 were up 17.4% over the same month in 2021,
according to the Associated Builders and Contractors (ABC). Being unable to find the right or affordable materials is tough on smaller trade contractors who are already struggling to make a profit. However, there are hopeful signs that supply chain issues are easing, with prices dipping 1.8% in July compared with June 2022.
Finding and Retaining Skilled Labor
The pandemic also led to a huge exodus of skilled labor from the construction industry, and many of those who left the workforce are still reluctant to come back. ABC said in February that an estimated 1.2 million construction workers would leave their jobs to work in other industries during 2022.
While the construction industry added 32,000 con struction jobs in July, according to an ABC analysis of U.S.
Bureau of Labor and Statistics data, it wasn’t enough to fill the gap, with the association noting that “the industry’s labor supply remains severely constrained.”
Competition for good work ers is tough, forcing contractor companies to increase wages to attract or retain workers, which eats into the bottom line.
Average hourly earnings for residential construction work ers have risen consistently over the last couple of years, NAHB says, noting that “between December 2019 and December 2021, residential building work ers’ average hourly earnings increased about 12%.” That trend has continued this year with average hourly earnings in May 2022 up 5% over the same time in 2021, NAHB says.
Inflation
As the prices of goods and materials have crept up, so has inflation. This is affecting con struction demand and costs, especially for new housing starts.
New home sales fell in June to the lowest level since April 2020, NAHB said in July, “reflecting builder sentiment as construction bottlenecks continue to slow new home building and raise housing costs.”
Moody’s Analytics reported in June that inflation rose to 8.6% on an annual basis but noted there were indicators that “global supply-side inflation pressure is peaking in some areas.” The Bureau of Labor Statistics says inflation dipped to 8.5% in July after peaking at 9.1% in June.

The Federal Reserve has been steadily increasing interest rates over the last year to combat rising inflation, and that is hurting home sales. The combination of inflation and a nearly three-point jump in mortgage interest rates during the first half of 2022 sidelined potential homebuy ers, Moody’s noted in mid-July.
The Fed’s second .75% rate hike at the end of July came as the housing industry was already in a recession, accord ing to NAHB.
Helping Contractors Navigate Current Challenges
Each of these individual issues are of course intertwined and create additional
exposures and insurance costs for contractors. Agents should ensure their clients are aware and prepared for current challenges, as well as taking steps to avoid potential claims related to negligence, property damage or worker injuries due to material and/or worker shortages.
Contractors should be transparent with their clients about how these issues could affect a project, increase its cost or lead to delays. Contractors should also consider the timing of starting a project. If, for example, materials like windows won’t be available for six months, could a building project be damaged by elements like wind and rain if it is unable to be completed on schedule?
Other exposures like job site accidents or worker injuries may be more prevalent if con tractors are operating without enough workers or are hiring workers who are unqualified or not properly trained.
Contractor insurance premiums are directly related to payroll and gross receipts, so with the increase in building values and wages, policies have become more expensive. Add to that a tightening of capacity in the property market because of natural catastrophes, and contractors are looking at high single-digit rate increases or more in some areas.
It is up to agents to help their contractor clients navigate and mitigate other exposures that could lead to even higher insurance costs. Agents should
also look for insurance partners with experience in the contrac tor/construction space.
There are signs of light at the end of the tunnel for the segment. The rate of inflation appears to be slowing, and the demand for new construction is still prevalent given the current massive housing short age. With the help of trusted agent advisors, contractors can mitigate the current challenges and be positioned to take advantage of new opportuni ties in the years to come.

to Andrew Caldwell, president of Smart Choice based in Greensboro, North Carolina, there are major differences in everything from size and structure to location and what they’re looking for in members. “But they share the funda mental purpose of helping independent agencies connect with carriers,” he told Insurance Journal.
That there are so many successful net works operating today tells an important story, Caldwell believes. “Something is working,” he said. “Carriers want to find agencies that are a good fit and that drive organic growth, and networks are ideal at matching agencies with carrier partners to achieve these goals.”
Agency partnerships have moved well beyond market access providers. “Years ago, it was about market access,” Matt Masiello, CEO of the nation’s largest net work, SIAA. “It’s no longer about market access. Agencies can access markets anywhere.”
Agency Networks: Thriving Now and in the Future

Agencypartnerships and networks continue to grow and add value for property/casualty independent agencies, large and small, by adding great er market access, offering services and technology, and the sharing of ideas that are helping them build their businesses.
For nine years Insurance Journal has recognized the nation’s largest agency partnerships and networks in its annual Top 20 ranking. This year, the Top 20 Agency Partnerships again showed considerable growth in both total property/ casualty revenue and property/casualty premium. The Top 20 grew by nearly $400 million in total P/C revenue in 2021 and by nearly $10.5 billion in total P/C premium
(see page 24 for the 2022 Top 20 list). That growth has continued into 2022, according to the handful of agency partnerships interviewed for this report.
Agency partnerships and networks are not new. Some have existed for decades. While the first networks started in the 1970s, these partnerships have grown in the past decade into organizations with diverse products and services.
According to the Insurance Network Alliance’s 2022 Insurance Networks Study, there are more than 150 insurance networks today and more than 22,000 agencies belong to them.
The INA study estimates that total network premiums controlled by networks and agencies is about $138 billion and total network-controlled premium is about $66 billion. Insurance agency networks’ total network-controlled premium accounted for 5% of the $1.28 trillion in U.S. insurance industry net premiums written, according to the Insurance Information Institute in 2020.
No two networks are alike. According
Today, when agencies join a network or partnership they should choose one based on their own goals and how that group can help them achieve those goals, Masiello said. Agency owners must consider how their goals will change in the future as well. “Because your goals are different tomorrow than they are today, right? So, you want to make sure you join a network that is scalable for your business as you continue to grow.”
Masiello tells prospective members to make sure they understand how the network shares dollars down to the agency before they join any organization. He advises them to be sure there is transparency in how commissions are paid to agencies and how carrier incentives are shared among members.
Perhaps most important — Masiello says agencies must review in detail all terms of any agency/network contract. “We always tell everybody they’ve got to understand, not just the business model, but they must understand the contract that they’re going to sign,” he said. “They should really take their time, and when they’re sitting with any of these groups, they should go through that contract with a fine-toothed comb and make sure they understand

what the contract means for them today and tomorrow, and even at the end of the relationship.”
New Partnerships
The newest agency partnership group to join IJ’s Top 20 list is The AC Companies, or The Agency Collective, which was founded “out of necessity” in 2020 by Kenny Urbania and Gary Hines following the release of all Nationwide Insurance’s exclusive agents.
Urbania, a 25-plus year Nationwide exclusive agent, said converting to the independent agency model was chal lenging for many of his Nationwide agent peers, so founding The AC seemed like a natural progression. However, as he and Hines began developing the framework for The AC they realized other agencies, those already working in the independent agen cy channel, could also benefit from the model that their network would provide.
“We formed our group to disrupt the network industry and do it better,” Hines told Insurance Journal. “Although we started with the Nationwide agents, the sky is the limit as we are rapidly growing in the independent channel.”
Urbania said that The AC currently has about 750 active members with an average size agency ranging between $4 million to $4.8 million in premium per agency. Established independent agencies repre sent about 30% of its new membership.
M&A Hits the Scene
A trend felt elsewhere in the industry hit the agency partnership sector in 2022 — consolidation.
Insurance agency network Renaissance Alliance acquired two other agency networks in January. Massachusetts-based Renaissance acquired Agency Network Exchange (ANE), a 60-member exchange based in New Jersey, and Fresno, California-based United Valley Insurance Services, with 92 member agencies. Both ANE and United Valley held spots in the Top 20 Agency Partnerships’ ranking in Insurance Journal.
Renaissance itself was purchased in 2018 by Long Arc Capital, which has invested in personnel and operations, a Long Arc
partner said. That capital investment put Renaissance in a position to expand capa bilities for agency members, said Robert Bondi, CEO of Renaissance Alliance. That also meant expanding its geographical footprint, which had traditionally been centered in the New England market.
Today, Renaissance Alliance has nearly 300 agencies in 13 states with about $3.6 billion in premium.
More recently, in September the MarshBerry Platform announced a merger with First Choice Agents Alliance (FCAA). MarshBerry Platform and FCAA, each on its own, represent two of the nation’s largest aggregators. According to Insurance Journal’s 2022 ranking, MarshBerry Connect Platform’s represent ed $917,556,522 in total 2021 P/C revenue while FCAA represented $365,512,729 in total 2021 P/C revenue. [Editor’s Note: Because the merger occurred in 2022, both firms are represented on the 2022 ranking, which uses 2021 figures.]
MarshBerry Platform and FCAA are now known as FirstChoice.
First Choice was created in 2015 as a wholesale outlet for Nationwide captive agents looking for commercial market access. In 2017, the model moved to an agency member network to provide direct carrier access, strategic planning, educa tion, and technology as well as market access.
MarshBerry, an investment banking and consulting firm serving the insurance distribution industry, initially launched the MarshBerry Platform in 2019 as an exclusive benefit for MarshBerry’s Connect members, which are typically larger agencies.
John Wepler, MarshBerry chairman and CEO, said the merger will allow the combined First Choice to serve indepen dent agencies writing less than $1 million in revenue to those with greater than $1 billion in revenue. Wepler said that the two firms’ business models fully align in that both organizations strive to develop tools, resources and capabilities to help participating firms grow while remaining independent.
Earlier this year, MarshBerry announced a partnership with Atlas Merchant
Capital, which supported efforts to grow. Combining forces with FCAA is one example of that intentional growth.
Keith Captain, FirstChoice’s president, said the ability of the combined group to help every business from a frontline retail agency all the way up to a sophisticated firm is what will set them apart.
“There is no other network or group out there that’s able to provide the breadth of support that we’re going to be able to provide. And that’s really what takes this to a whole new level for all of us,” he maintained.
Future of Agency Partnerships
Agency networks that responded to INA’s 2022 study see an optimistic future for agency networks and their agency members but caution that industry trends such as consolidation and market demands will challenge some networks going forward.
“As with other segments of the insur ance industry, networks are faced with key challenges including the continued consolidation of both carriers and agen cies, evolving demands of stakeholders, and regulatory issues,” the study said.
“On the other hand, there are tremendous opportunities to be pursued such as great er technological advances, M&A activities, and further growth.”
Renaissance’s Bondi said the future for agency networks looks good, but that success is centered around the strength and importance of the independent agency itself.
“We believe that piece of the insurance distribution channel is by far the strongest and most important,” he said. “As indepen dent agencies themselves continue their growth in the market — and representing that they are the strongest component of insurance distribution — good networks should be driving greater value to these independent agencies to allow them to outperform other parts of distribution.”
Additional investment from private equity players will help the network space to continue providing value to the independent agency system, he added.
“The future is extraordinarily bright, and I’m very optimistic.”

Can a Firm’s Culture Created by a Salesperson Be Grown Into a Business Culture?
Havinga sales culture in your agency is not synonymous with having business culture.
As so many exam ples of vaporware and internet companies and virtual providers and game changing insurance companies that never make mon ey prove, a business can have value, huge equity values even, but never really be an operationally successful business. In all of the companies that never make a profit and likely never will make a profit even though they have values far exceeding much more successful businesses, the definition of “success” gets confused. These kinds of businesses’ cultures are always based on the salesperson’s ability to sell to customers and investors (including employees) that success is just around the corner. They are always selling, and damned be the person who points out that when a business never makes a profit, that business is not successful.

In today’s world of free money, success does not mean ever making a profit. It is really no different than liberal economists believing that money is so free that people need not work but should just be given more money. Nothing is free and if it is free, you are the product. Yet thousands of com panies have been founded, including insur ance companies, on the hope that someone will buy them before they actually have to prove their business is a run like a business. Many millionaires have become millionaires by making that sale close. Maybe being a true business with functioning operations is passe’?
In the insurance industry, most distribu tors are always focused on the next sale. Eighty percent of effort is on the next sale or retaining a client that is threatening to leave. Twenty percent of effort is focused on operations. Assuming real profit is required, an effort of 20% on operations is insufficient for the following reasons.

The carriers that have written the most net new business over the last five years have the best expense ratios, which is a proxy measure for operational focus. This fact, of course, excludes gains that are made simply by foregoing reinsurance as many carriers did in 2018 and have not yet purchased insurance back to the same level. Just think for a moment: If operations creates 10% more efficiency and the savings is converted to lower prices, is it easier or harder to sell these lower prices? This is not rocket science.
Perplexingly, most sales focused people and cultures can make the connection but cannot manage to accomplish the execution. They just cannot mentally make
The sales culture’s premise is that more sales will solve the profit problem. Just a little more scale is always the solution. Little substantive attention is given to oper ational profit. I should note here that many long-established insurance companies and agencies have the same issue where sales, even unprofitable sales, take precedence.
I know lots of people will disagree, and exceptions do exist, but a sales culture focuses on sales, the top line and not the bottom line. A business culture treats both equally.
I have worked with and analyzed far too many companies to fall for the wishful thinking that sales cultures are business cultures.
Salespeople can’t take their focus off the next sale long enough to consider the bottom line. If the salesperson is the leader, they need to focus on operations too but cannot find the will to do it.
First, high quality operations mean more profit. That profit can be used to employ more salespeople. It can be used for better sales training or higher dividends. Higher profits mean higher value, all else being equal. Just focusing on the next sale does not achieve any of these goals.
Second, low cost/high quality operations enhance sales. If one can sell the same product/service at a lower price, the low price wins. This industry has focused hard on convincing people low price insurance equals high quality. Billions are spent annually on advertising in an effort to achieve just this purpose and regardless that it is 100% duplicitous — it works. Imagine if it was real!
Third, the great economist Carl Shapiro initially analyzed and has been proven correct over the last 40 years that low cost ultimately wins in every industry other than extreme niches. To be low cost, operations must be 50/50 with sales. The sales focus fails when costs are too high. The sales focus gains steam when costs are low. Costs need to be strategically low, not just cheap

California OKs Bill Protecting Workers Who Use Marijuana at Home

could soon become the seventh state to make sure people won’t lose their jobs if they smoke marijuana when they’re off the clock.
State lawmakers in late August passed a bill to stop companies from punishing workers who fail a certain type of drug test that detects not whether a person is high, but whether the person has used marijuana at all in recent days.
These tests, which rely on urine or hair samples, look for a substance that the body makes when it breaks down THC, the main psychoactive compound in marijuana. But that substance, called metabolites, can remain in a person’s body for weeks after using marijuana, according to the Mayo Clinic, meaning people can fail a drug test even though they are not impaired.
The legislation would prevent workers from being punished from failing these types of drug tests. Companies could still punish employees for failing other types of tests that use saliva and are better at determining if a person is currently high.
The bill now goes to the desk of Democratic Gov. Gavin Newsom, who has until the end of September to decide whether to sign it into law. It would take effect on Jan. 1, 2024.
“Nothing in this bill would allow someone to come (to work) high,” said Assemblymember Bill Quirk, a Democrat from Hayward and the author of the bill.
California was the first state to legalize medical marijuana in 1996, and it was one of the first states to legalize recreational marijuana in 2016. But the state has been
slow to pass laws protecting workers who use marijuana on their own time.
Six other states – Nevada, New York, New Jersey, Connecticut, Montana and Rhode Island –have laws protect ing workers’ rights to use recreational marijuana, accord ing to the National Organization for the Reform of Marijuana Laws. Twenty-one states have laws protecting workers who use medical marijuana from discrimination.
Labor unions argue it isn’t fair to punish employees for doing something that is legal outside of their job and doesn’t inter fere with their responsibilities at work.

California Lawmakers Pass Landmark Fast Food Workers Bill

Californialawmakers approved a nation-leading measure that would give more than a half-million fast food workers more power and protections, over the objections of restaurant owners who warn it would drive up consumers’ costs.
The bill will create a new Fast Food Council with equal numbers of workers’ delegates and employers’ representatives, along with two state officials, empowered to set minimum standards for wages, hours and working conditions in California.
A late amendment would cap any min imum wage increase for fast food workers at chains with more than 100 restaurants
at $22 an hour next year, compared to the statewide minimum of $15.50 an hour, with cost of living increases thereafter.
The Senate approved the measure on a 21-12 vote, over bipartisan opposition. Hours later the Assembly sent it to Gov. Gavin Newsom on a final 41-16 vote, both chambers acting with no votes to spare.
Debate split along party lines, with Republicans opposed, although three Democratic senators voted against the measure and several did not vote.
Restaurant owners and franchisers cited an anal ysis they commissioned by the UC Riverside Center for Economic Forecast and Development saying that the legislation would increase consumers’ costs. Gov. Gavin Newsom’s administration also fears the measure would create “a
fragmented regulatory and legal environ ment.”
The debate has drawn attention nation wide.

I have failed to convince many carriers and agents to give more emphasis to operations. The logic of doing so was and has been obvious, yet outside of serious E&O issues which force the leaders’ hands, nothing changes. I get it. Continuing to focus within the leader’s comfort zone is much easier. Changing focus is emotionally draining. No matter how right I am, the emotional price is too high.
The best solution I know is based on leadership rather than logic. Leadership means leading the entire enterprise, not just sales.
As Dirty Harry said, “A man must know his limitations.” The best leaders know their limitations. The best leaders focus on the whole health of what they are leading, rather than individual parts. This means having the confidence to hire a strong oper ational leader and empowering them to take

A failure of aggregators and networks is lack of organic growth. It is almost sad that sales-focused brokers and networks have the worst overall organic growth rates. All these agencies join networks so they can have more products/carriers to sell and yet the organic growth rate is effectively 0%. One reason is lack of operational leadership. It is only about sales.
A great example involves an agency where the owner led producers and staff to achieve significant operational success. They led with operations; increased sales followed, which resulted
The agency eventually was sold to one of the big buyers who relented on day one to the producers’ whining about having to follow procedures. The new leaders understood that operations was the driver of the agency’s success, and to their credit, they admitted they did not possess the leadership required to adopt the better pro cedures or require the producers to adhere to the rules. The profit margin decreased by almost half overnight — 100% due to lack of operational leadership.
The buyer justified their lack of spine by suggesting the producers would quit if the rules were enforced. This is shallow reasoning. The producers had not quit while working for a smaller agency with fewer resources, so why would they quit now? Even if they did, the good producers would not be the ones who quit.
Leadership is hiring a strong operational leader and walking away from overseeing operations. These are the steps required if you want your agency to grow into a true business. One hundred percent delegation is required. It is a complimentary skill set. Paired, the leaders become unbeatable.
The carriers (I used carriers because their results are public but the same applies to agencies/brokers) that have built operation al leadership are the same ones adding $10 billion — $10,000,000,000 — in new sales every single year.
If you are emotionally solid and focused on your agency rather than your feelings, you will recognize your leadership skills are limited in one way or the other. The greatest next step of the best leaders is to hire someone with complimentary skills. Don’t be afraid of the operational leader taking over. That can be managed if it becomes a real issue.
Your days will become less stressful because someone else is doing the work you don’t like to do. Sales will increase because you are less distracted by operations.
A business culture has the best of both worlds. If you have a sales culture, can you lead your firm into a business culture?

In2004, almost 18 years ago, I began an initiative to expose one of the most onerous and egregious provisions of any mainstream personal lines policy I had ever seen. The article was entitled “Rent Your Home, Void Your Insurance Policy?” I followed it up with 15 other articles related to the issue.

In 2005, the national technical affairs committee of the Independent Insurance Agents & Brokers of America (IIABA or the Big “I”) first presented this issue to Insurance Services Office (ISO) at our annual meeting. In 2009, these articles and this advocacy formed the basis of a 29-page white paper entitled “‘Where You Reside’ — The Where’s Waldo? Catastrophic Homeowners Policy ‘Exclusion’ That Could Bankrupt Your Insureds” published by the IIABA. You can still access that white paper and related resources for free at the Big “I” website (www.independentagent.com) by searching for “where you reside.”
In 2015, ISO produced a series of
endorsements designed to resolve or at least mitigate this potentially catastrophic coverage gap in their homeowners policies. My research indicated that this problem also existed in the vast majority of non-ISO homeowners policies in the marketplace. At least one carrier solved the problem by eliminating the offending language from their homeowners policies at that time.
After almost two decades of writing and speaking about this issue, I had hoped it had been resolved. Recently, however, I learned of a September 2021 Michigan Court of Appeals decision, Mohamed A. Hassanein and Ebtisam Khalifa v. Encompass Indemnity Company, et al. The court ruled that the fire damage to the home owned by this couple was not covered, citing a 1995 Michigan court case from my original white paper, Heniser v. Frankenmuth Mut. Ins. Co.
Here is the crux of the coverage gap. Most homeowners policies cover the dwelling on the “residence premises” shown on the policy’s declarations page. The term “residence premises” is defined to include the dwelling “where you reside,” with “you” referring to the named insured and, even if not named, resident spouse.
According to one interpretation, the insuring agreement that applies to the dwelling is not triggered unless the named insured and/or resident spouse live there. In other words, if you don’t reside in your home, for whatever reason, at the time of a loss, you have no coverage on the dwelling.
As the original white paper discusses, courts are split on this. But, even in the Heniser case, a dissenting judge opined, “[T]he mere statement that the insured property is a dwelling used principally for dwelling purposes is not clear and explicit enough to create a warranty.” Most courts finding coverage concur with that opinion that the “where you reside” language is simply descriptive and does not warrant continuing occupancy past the policy inception date. And most courts require that, to be enforceable, an exclusion must be clear and conspicuous in a policy. Apparently this principle in some states does not apply to a claim denial that does not technically involve an exclusion.
Many of these cases involve homes where the owners moved and temporarily held the property out for rental. But the white paper identifies well over a dozen

other scenarios such as sudden work relocations, extended rehabilitation stays following illness, a parent that moves out and a child moves in (or vice versa), divorce, foreclosure, death, ownership transfers to trusts, a home buyer who takes possession and moves in prior to final closing or a home seller who remains after closing but coverage is now provided by the purchaser, temporary vacancies due to home renovations, and the list goes on.
If you write any significant homeowners business, you have customers at this moment with homeowners policies on homes where they no longer live in. Many of these homes are insured by carriers who will deny a claim based not on an exclu sion, but on three words in a definition referenced from an insuring agreement. Do you know who these carriers are? Do you know who these insureds are? Have you ever discussed this issue with your insurers or customers?

I presented for over 10 years, I included examples of denied claims that I was personally involved in as a consultant. Four of these claims were six-figure fire losses on homes being rented in Florida and Georgia. Three others were fire claims in New York, Arizona and Pennsylvania where the owners had temporarily moved out during renovations. Another was a theft and vandalism loss in Maryland that occurred after parents moved to one of two homes they owned and allowed their daughter to move into the other.
An insured in a Kentucky nursing home suffered a total loss to her home that was denied. A rented Florida condo experienced a $100,000 fire loss, and the death of the occupant, that was denied though condo eligibility did not require owner occupancy and the HO-6 form was endorsed with the HO 17 33 – Unit Owners Rental To Others that said, “For an additional premium, this coverage applies while the ‘residence premises’
is regularly rented or held for rental to others.” A denied Pennsylvania fire loss occurred while a daughter occupied her parents’ home when they took care of her grandmother for several months at a distant location. In a Rhode Island claim, a couple bought a home and insured it on a homeowners policy but discovered after 30 days the home needed significant reno vation that required them to move out for six months, during which a fire occurred.

Zoidis will continue serving as a Kaufman executive vice president, guiding the compa ny’s London strategy as well as its international businesses that span the U.K, Europe and South America.

To Maximize Performance, Motivate the Entire Team
The insurance sector is crowded and com petitive. Products are complex and the customer journey is complicated. You need motivation to push through these potential barriers to success. Insurance isn’t sold by just one person. Everyone plays a role in business success, so it makes good business sense to motivate and reward the whole team.
Sales Are a Team Sport
On the surface, rewarding an entire team makes sense. From the marketing person to the receptionist to the underwrit ers, insurance needs a team. But motivating a group, versus only a broker or agent, adds another complication. Maybe an annual cruise for the top salesperson and their family was sufficient motivation. But now that you’re looking at an entire team, will that one item
create enough motivation? Likely not.
It’s important to create a holistic experience in which everyone can participate and be motivated. A combination of long-term incentives, like a cruise, mixed with short-term incentives, like the opportunity to select a gift of their choice, creates the variety to appeal to different personality types and different levels of achievement.
Avoid
Cash as king. It seems like it would or should be the ultimate motivator, but cash frequently goes toward everyday needs, diminishing the feeling of being rewarded.
In a study by the Incentive Research Foundation (IRF), 83% of respondents said it is a treat to receive redeemable points from work and 80% agree it feels like receiving a gift when receiving points over cash rewards.
One size fits all. A points program should be combined with other factors. Simply having one type of reward (even though points can be
redeemed for a multitude of items) will likely lose its luster over time.
Everyone gets a turn. It can be tempting to want to treat everyone in the same way. You don’t want to play favorites, but if the team sees this as a “rotation reward” then it loses its meaning. They’ll feel like they received something because it was “their turn” versus receiving something because they did an outstand ing job.
Absolutely Do!
Recognize your team for great work when you see it and tell them specifically why you’re rewarding them. Don’t wait until a service anniversary or year-end performance review. Recognition should be just as routine as checking the numbers; it should be specific and done by all members of the team (not just leaders).
Link recognition to the right behavior. Yes, your top salesperson may get rewarded more frequently but you’ll see better results when you move your mid-range performers. A top performer typically performs well from innate motivation: they’re wired to reach goals. Take a closer look at average performers and create incentives to motivate them.
Rewards aren’t just things Knowing their work was seen and appreciated can pull people into the team, instead of feeling like they’re “just” a support person. It can be harder to pay attention to an
entire team rather than one star performer, but when people feel truly appreciated, they’ll want to contribute to the firm's success.
On a more tactical level, a successful team incentive program needs three key ingredients: Strategy. Start with strategic long-term and short-term goals, then link the desired behaviors to those goals. As you create goals yearly, evalu ate the success of the reward program, too. Static strategies don’t work, and neither do static rewards.
Regular Communication. Make sure you share not just the kick-off of your program (the what, why and how), but proactively position the rewards through reminders. A leading insurer in the Midwest communicates to participants (independent agents) monthly with reminders and nudges to redeem points. Those emails are opened at rates near 40% and almost no one has opted out. That’s an incredibly high readership, considering the generally accepted open rate percentage for email campaign success is 15% – 25%.
Outsource Technology. Keeping a spreadsheet and going out to buy gift certificates is not a good use of time. People expect apps with choices and tracking, to name just a few criteria. Look for a partner who has mobile-first design that mirrors the apps we all use, in terms of ease of use and features.
