IJM LAND REVEALS THE ARC @ BANDAR RIMBAYU Future residents of Bandar Rimbayu and other members of the public can now appreciate The ARC, the township’s main centrepiece, up close with the official launch of The ARC together with the Bandar Rimbayu show gallery. The ARC is Bandar Rimbayu’s private park and forms the focal point of this 1,879acre township. The ARC encompasses an elevated green roof deck, Bandar Rimbayu’s Show Gallery and offices. THE BELT TIGHTENS The 2014 Budget has gained an ally in Bank Negara Malaysia to further battle speculation in Malaysia’s property market.

Over the past few months analysts and government officials have been sharing their thoughts on the central bank, Bank Negara Malaysia’s (BNM) 2014 changes in property policies to the media. The main policies detailed in BNM’s 15th November 2013 circular, effective immediately, include:

• The prohibition of financial institutions granting end-financing facilities to individuals or non-individuals for the purchase of property offered under an Interest Capitalisation Scheme (ICS), including the Developers Interest Bearing Scheme (DIBS).
iP: Will BNM’s new LTV policy have a positive or negative effect on the real estate market? Eunice Koe (EK) (Homebuyer): As far as effects go, I cannot say for certain. The fact that the new LTV calculation now results in a higher down payment may cause adverse effects. Taking into account that discounts and rebates by the developer are no longer calculated, a property that is priced at RM600,000 in its Sales & Purchase Agreement (SPA) will now require a down payment of RM55,800 instead of RM18,000.
• Banks must calculate the loan-to-value (LTV) ratio based on the net price of a property instead of its gross price. iProperty.com, flipping the other side of the coin, sought the opinions of some people from the other end of the spectrum who will be affected by these policies.

Young and genuine homebuyers cannot afford such high down payments as the
present day cost of living is significantly higher than it was 10 years ago. I think this may cause the market to slow down just a little bit, at least in less prime areas as first time homebuyers can only afford properties there. Christopher Chan (CC) (Realtor): This policy affects only the primary real estate market, as purchasers have previously been able to obtain a higher margin of finance based on the gross price instead of the net price. This means that the purchaser is able to obtain a higher loan from the bank than he would be eligible for. BNM’s purpose of implementing this is to instil a culture of responsible lending by the banks. BNM is essentially unveiling a series of prudent measures such as the earlier limiting of the tenure of personal loans to 10 years, properties financing to 35 years and the prohibition on the offering of pre-approved personal financing products.
This was done due to the worrying fact that Malaysia’s ratio of household debt to gross domestic product (GDP) grew by 13% to 83% compared to 70% in 2009 - the highest level for developing countries in Asia. Our neighbour Singapore’s household debt to GDP ratio is 67% while it is at 30% for Thailand. I don’t think this policy will have negative repercussions on the real estate market. This is because buyers will now be obtaining the correct loan amount rather than an inflated one of which they were not entitled to in the first place. iP: Will the new rulings affect realtors and real estate agents? CC: The business of real estate agents involves such a wide field, from the marketing and selling of new projects by developers to the secondary real estate market. Moreover, we are in the rental real estate market as well. This serves as a buffer for us

in challenging times. The rental market at the moment is doing very well. iP: Will this put the brakes on the purchasing of new properties by first-time homebuyers? EK: As a first-time homebuyer, I am definitely contemplating purchasing a property now but it is almost like a lose-lose situation. If I were to purchase a property at this point in time, with the higher down payment, I would have to find alternative means of sourcing for funds. However, if I put my plans on hold until the following year, I will have to deal with the implementation of the Goods & Services Tax (GST) in April 2015. That in itself incorporates a higher cost. It is now a matter of weighing which of the two would be a cheaper option. CC: While the first time buyers (as well as the non-first time homebuyers) will be affected by these measures, the demand for new projects is still going strong. The DIBS is only one way to offer rebates to the purchasers. There are many other goodies that a developer can also offer to the buyers such as free legal fees (including

disbursements) on the Sale and Purchase Agreement (SPA) and Loan Agreement, provision of furniture and air-conditioners and free maintenance fees for a certain time period. Some developers even pay for the stamp duty on the transfer of the property once the individual’s title is issued. iP: Will this affect the house prices in any way? EK: I expect that house prices will definitely go up. With the banning of the ICS and DIBS, developers will not be able to absorb some of the costs they could previously. With the additional costs trickling down to the purchaser, I think a significant increase in house prices can be anticipated. The best option for someone like me would be to resort to the secondary property market.
Some of the additional costs that come with a new development do not affect homes in this market. CC: This only affects the primary real estate market. In view of these measures, developers will have to price their properties at a more realistic price. In the secondary property market, houses in strategic locations such as Damansara Utama, Bandar Utama, Setia Alam, Subang Jaya, Ara Damansara and Bangsar, to name a few, are still in great demand as these are well established areas with good infrastructures and amenities supported by a strong growing population. The property prices in these areas will not go down but instead stabilise. I expect demand for properties to surge during the period prior to the implementation of the GST in April 2015. While the new residential properties will be tax-exempted, developers will not be able to claim back the GST incurred on costs (e.g. labour costs, building materials etc) and thus, will pass the costs on to the buyers. The non-residential properties will be levied with the GST. Either way, the purchasers will be buying properties at a higher price. Countries such as Australia and New Zealand that have implemented the GST witnessed the same pattern: there was a marked increase in demand for properties prior to the implementation of the GST as buyers rushed to buy properties before they become more expensive once the GST hits the ground. In a similar manner, we would expect property developers to hasten their action plans and launch their new projects prior to the introduction of the GST. iP: In your opinion, what are some alternative measures that could have been
implemented by either BNM or the Budget to have a similar effect, but without taking as big a toll on consumers? EK: The measures aimed at curbing speculation are fantastic. Speculators are the primary cause for the skyrocketing property prices. Take them out of the picture and houses will be a lot more affordable. However, it may be too little too late, as prices are not going to decrease significantly. If I were to buy a house in a prime area such as Bangsar for instance, I cannot expect the price to drop by even RM1,000. However, there should have been more case-by-case measures by both BNM and the government. For example, the DIBS

could have been allowed for first-time homebuyers, or perhaps a whole mass housing project that caters exclusively to first-time homebuyers could be introduced. There could have been rules to ascertain genuine investors so as to prevent the ‘flipping’ of these properties. Rent-control policies are also an option, whereby rent in certain areas cannot be increased on impulse. That, in my opinion, might help curb speculation as well. CC: The increase in the RPGT rate is a bit high. A lower rate at between 20 to 25% as compared to 30% in the initial years would be much better, as it provides for a more gradual adjustment. There should be a preferential treatment for foreigners under the Malaysia My Second Home Programme (MM2H) as they have greatly benefitted Malaysia by coming here. Together with the money they have brought in, they have created a positive multiplier effect as they spend their money here buying properties. Nevertheless, we are still fortunate as there could have been more drastic actions taken by the government. When we compare ourselves with Singapore, the steps undertaken by our government are relatively mild. Singapore’s progressive tax rates or ‘assessment’ for residential

properties (excluding residential land) are from 10% -19%, effective 1st January 2014 and a scale from 10% - 20% effective 1st January 2015 depending on the annual value range. In Malaysia we are charged with just a single percentage rate depending on the classification of the type of property. iP: What is your prediction on the potential pattern of first-time homebuyers in 2014? CC: The demand for properties in good locations will be strong, especially in areas where it is priced below the RM1 million mark. The fact remains that Malaysia’s saving rate is one of the highest in the world at 34% of Gross National Product (GNP). This includes the forced savings from the Employee’s Provident Fund (EPF) that all would have to contribute to while working. The first-time homebuyers (as well as non-first time purchasers) are entitled to withdraw money to purchase a house under the EPF. REFLECTING ON 2013 With various changes being implemented by the government and Bank Negara Malaysia, the 2014 property market is in for some fundamental changes. Many policies and rules were revised in 2013, gearing 2014 to be a year on a much tighter leash. From multiple policies tabled at the 2014 Budget to the revamping of Bank Negara Malaysia’s (BNM) stringent lending rules, the property market is preparing for the biggest change it seen in recent times. iProperty.com takes a look back at some of 2013’s game-changing revisions.

BANNING OF INTEREST CAPITALISATION SCHEMES (ICS) The government and BNM, via a circular on 15th November 2013, have issued bans on any kind of ICS, including the Developers Interest Bearing Scheme (DIBS) effective immediately. Developers are no longer allowed to offer any ICS, including DIBS to prospective buyers. Banks are also prohibited from providing end-financing to any developer’s projects that include any kind of ICS in their development plans.
KUALA LUMPUR ASSESSMENT TAX HIKE
GOODS & SERVICES TAX (GST) A 6% GST is set to be imposed starting April 2015. However basic food items, transportation services, highway tolls, water and first 200 units of electricity for domestic users per month are to be exempt from the GST. Sale, purchase and rental of residential properties as well as selected financial services are also exempted.

Previously set at 6% for residential properties and 12% for commercials ones, the Dewan Bandaraya Kuala Lumpur (DBKL) revised the assessment tax, effective 1st January 2014. The new rates that apply across the board now are at 4% for residential properties and 10% for commercial properties.
PETROL SUBSIDY On 2nd September 2013, the price of petrol went up by RM0.20 per litre for RON95 and diesel, raising it to RM2.10 and RM2.00 per litre respectively. Experts expect the subsidy to be cut further within 1H2014, following suit with the recent cut of sugar subsidy of RM0.34.
ELECTRICITY TARIFF Starting January 2014 the tariffs will be increased from 33.54 sen/kWh to 38.53 sen/kWh for the peninsula (14.89%) and in Sabah and Labuan from 29.52 sen/kWh (17%) 34.52 sen/kWh. Because of its state-run company, Sarawak Energy, tariffs in Sarawak are not affected. Consumers who use electricity amounting to equal to or less than 300kWh a month will be exempted from this increase.
PENANG SUB-SALE LAWS Starting 1st February 2014, affordable homes in Penang (RM400,000 and below on the island, RM250,000 on the mainland) will not be allowed for resale for a period of five years. Similarly, residents who fall under public housing that is purchased under RM72,500 will be barred from selling their homes for a period of 10 years. However, residents who wish to sell their properties may send their appeals to the state government for review. If approved, home owners will only be allowed to sell their homes to purchasers pre-approved and shortlisted by the state government.
BNM’S NEW POLICY The first of two new policies by BNM, released in July, capped a maximum loanto-value (LTV) ratio of 70%, which applies to the third house financing facility taken out by a borrower. The second revision by BNM comes in the form of their loan policy. Previously allowing banks to lend money based on the gross value of a property the new rules, which are ineffect immediately, calculate the LTV on the net value of a property instead.

All this was done in the hope of receiving multiple offers for him to choose from. This experience had left him wondering if there was a more efficient way of applying for a housing loan. Recounting his ‘adventure’ to his family and friends, he soon learnt of their loan applications’ adventures and misadventures. Some experiences were

PERAK: NAVIGATING THE BUDGET MAZE 2014 brings with it several changes to Malaysia’s and by extension Perak’s property market that the public should be fully aware of.
The start of a new year – 2014, to be precise – means that the many revisions and policies that are a part of Budget 2014 will soon come into effect, either immediately or in the near future. A number of these changes are directly related to the real estate industry and will undoubtedly affect property markets across Malaysia, including Perak’s. iProperty.com approached Dato’ Francis Lee Yew Hean, Real Estate and Housing Developers’ Association (REHDA) – Perak Branch’s Chairman for his insights on how these budget-related announcements will influence the growth of the state’s property market for the next 12 months. iProperty.com: The Budget 2014 detailed changes in the real property gains tax (RPGT) and the implementation of the Goods & Services Tax (GST). How will this affect existing and upcoming developments in Perak? Dato’ Francis Lee Yew Hean: The major new policies contained in the Budget 2014 are the following:-

a) the revision of the RPGT effective 1st January 2014 b) the implementation of the GST effective 1st April 2015 c) the increase of the threshold price for foreign property purchasers to RM1 million
The new policies with regards to the housing industry under Budget 2014, in addition to the prevailing monetary guidelines issued by Bank Negara Malaysia, are:a) a ceiling of 70% on loan-to-value ratios (LTVs) b) lending guidelines based on a net income availability basis and a clean Central Credit Reference Information System (CCRIS) record With effect from 1st January 2014, the RPGT will be revised from the current 10% to 15% range to 15% to 30% depending on the year of disposal from the corresponding purchase date. Demand for residential properties in Perak is substantially driven by effective home ownership buying and a small percentage of investment buying. There is very little speculative buying in the residential property market as historic price increases of residential properties in Perak are not significantly higher than the cost of finance. The increase in the RPGT rate will not have a significant effect in Perak with the exception of a possible delay being experienced by a small percentage of home upgraders. The 6% GST will be implemented with effect from 1st April 2015. The government, through the implementation of the GST,
has classified the housing industry as an exempt supply and as such, it is not possible to claim back GST on any input costs. Homebuyers would be exempted from paying the GST on such a purchase. As an exempt supply industry, the 6% GST cost on inputs will need be passed off to homebuyers as an additional cost of delivery. iProperty.com: Perak Chief Minister Datuk Seri Dr Zambry Abdul Kadir recently tabled Perak’s 2014 budget of RM1.01 billion. From that amount, RM98 million has been allocated for projects by Perak’s Works Department (JKR Perak) and the Drainage and Irrigation Department (JPS Perak). Is the property market currently affected by issues of drainage and irrigation and, if so, will this budget help fix those problems? Dato’ Francis Lee Yew Hean: To put this into terms that the general public can understand, this money will be effectively used for upgrades of federal routes in Perak by JKR Perak and flood mitigation works by JPS Perak. All these works represent an infrastructural upgrading which will be positive for the housing industry in Perak on an overall level.

TEMPURUNG CAVE Arguably the largest natural limestone cave in the Malaysian peninsula, Tempurung Cave (Gua Tempurung) is located in Gopeng, which is about 24km south of Ipoh. Approximately 1.5km long, the cave is made up of five huge domes which ceilings resemble coconut shells, each with different formations of stalagmites and stalactites. It is recommended that travellers take the guided tour, which charges a nominal fee, to fully enjoy the experience of the wondrous cave. SUNGAI KLAH HOT SPRINGS Nestled in the serene and lush forest patches, surrounded by hills and clear cold mountain streams and rivers, Sungai Klah Hot Springs is a spot fit for the whole family.
7 With a free flowing hot springs swimming pool and a therapeutic park at the foothill of the Titiwangsa Range, Sungai Klah is ideal for a day out with the children. SIGNING ON ITS STRENGTHS With big changes taking place in Perak, will 2014’s new laws throw a wrench in its progress? The 2014 Budget hits the ground running with multiple new implementations set to blanket the real estate market in Malaysia. Perak, which is coming to terms with the fading traces of its former tin mining glory, is currently in the middle of a long-awaited facelift. Are the policies in the 2014 Budget bad news for the state’s development or will they help Perak move forward with its current plans? Datuk Lee Heng, Chairman of the Perak Branch of the Malaysia Institute of Estate Agents (MIEA) spoke to to iProperty.com on reasons why Perak is ideal for investments. Datuk Lee Heng, recipient of a 2013 International Property Award at a ceremony held in Germany, also shed some light on the possible effects of Perak’s recently tabled 2014 Budget. iProperty.com: The Budget 2014 detailed changes in the real property gains tax (RPGT) and the implementation of the Goods & Services Tax (GST). How will this affect existing and upcoming developments in Perak? Datuk Lee Heng (LH): The market will definitely slow down, even if just by a little, due to the purchasing of new properties being seriously affected. Developers, who will be among the first in the chain of people affected by the GST, will increase property prices to cope. This will trickle down to the end purchasers who will have to absorb all the costs. As for the RPGT, current properties in Perak are owneroccupied so the effect will not be as dire. iP: RM98 million of Perak’s recently tabled 2014 budget of RM1.01 billion was allocated for projects by Perak’s Works Department and Drainage and Irrigation Department.

1 What is your opinion on this budget allocation? LH: This is a great move by the state government which will hopefully sort out the roads and drainage systems in low-rise areas such as Teluk Intan and certain places in Ipoh which have been experiencing frequent flash floods due to the recent slew of downpours. The Works Department’s plans to widen roads around Perak, which will allow for more drainage space as well as make traveling by road more convenient, will greatly benefit densely populated areas and potential developments all around Perak. iP: Perak, particularly Ipoh, is a popular destination for second homes for both locals and foreigners. Why is this so? LH: One of the primary reasons behind this phenomenon is the comparatively affordable property prices in Perak compared to Johor Bahru, Penang and Klang Valley. Cost of living is also a huge factor as Ipoh’s remains relatively low. Additionally, Perak has a lot to offer in its surroundings. Surrounded by hills and full of fresh air and sunshine, the local atmosphere is very relaxed and not congested in most areas.
iP: Media reports suggest that Perak’s foreign investment numbers are slowly rising. Will the implementation of the revised minimum floor price for foreigners from RM500,000 to RM1 million affect the state’s foreign investment market? LH: Most definitely, as the majority of foreigners who invest in Perak are retirees seeking to enjoy the peaceful life the state has to offer. Potential investors could be drawn to cheaper alternatives if the floor price remains this high, as large properties such as bungalows, semi-detached houses and super-link homes in Perak are still priced under RM1 million. Developers will have to find ways to sweeten the deal for homebuyers if Perak is to stay a competitive player in the Malaysia My Second Home (MM2H) programme, such as improve the quality of life their development has to offer and expand on things such as their built-up areas so as to justifiably charge purchasers RM1 million and above. However, the currency values of some of the developed countries are seeing an increase and investors from places like Europe, Singapore, China, Japan, Taiwan, Hong Kong and Korea will still find Perak a good choice.
iP: Does Perak have the potential to become a prime area of investment in Malaysia like Iskandar Malaysia? LH: At the moment, there are not many ways that Perak can compete with Iskandar, Penang and Klang Valley, but the state’s abundant greenery is a strength that should be given more focus. Perak’s status as a tourist hotspot should be solidified as tourist traffic has a chance of translating into potential investors, and with 2014 being ‘Visit Malaysia Year’ I hope the government has some creative plans to uplift this sector. Perak’s real estate market also has the potential to grow through education. Kampar, which was pretty much a ghost town several years ago, has become a bustling township thanks to the opening of Universiti Tunku Abdul Rahman (UTAR). Investors will purchase homes to be rented out to students and parents visiting their children on weekends will contribute to the state’s traffic. Instead of competing with developers who focus on Penang and Klang Valley, Perak should capitalise on its unique points instead.

WANGSA MAJU While relatively small compared to its neighbours, the township of Wangsa Maju has seen a lot of development in recent years. Wangsa Maju is surrounded by several established neighbourhoods such as Setapak, Ampang, Sentul, Gombak and Taman Melawati. It is dominantly residential in character with most of its developments ranging from landed homes to high-rise apartments and flats to bungalows. The most significant landmark here is the Wangsa Walk Mall which comprises shopping, leisure and entertainment elements while still catering to the daily needs of the locals. Hypermarkets such as AEON Big and Giant can be found within the township while several other commercial/retail centres such as PV128 and Festival City are also located a short distance away across Jalan Genting Klang.

The township is serviced by Jalan Genting Klang, Jalan Lingkaran Tengah 2 (MRR II) and Duta-Ulu Kelang Expressway (DUKE), making it accessible to all other townships within Klang Valley. From the tables, it is obvious that the transactions involving selected condominium/apartment schemes are more active compared to the selected terraced house schemes. Transacted prices increased constantly every year; however, the number of transactions for condominiums/apartments has shown a significant decrease since 2010, with 2013 recording the lowest amount of transactions
(64 transactions out of 686 transactions since 2010). On the other hand, lately terraced houses seem to be less preferred by purchasers; the total amount of transactions recorded in regards to terraced houses from the selected schemes stands at merely 50 and there were no transactions in 2013. With the advantageous location of being surrounded by several established schemes and a rather close proximity to KLCC, there are plenty of reasons for developers to launch their projects here, some notable ones being as follows:From the table, it is clear that high-rise homes (condominiums and serviced apartments) and high-end landed houses (bungalows) are developers’ favoured type of developments – not so different from many of the residential schemes nearby. By building more high-rise homes,

less of the already limited land will be used and there will be enough homes for everyone.Additionally, these developments which have their own security system provide a safer living environment – an important deciding factor among today’s homebuyers. Other than those mentioned in the table, there are also a few upcoming high-rise projects although information on them has yet to be revealed. Most high-rise projects in the area are priced at RM600 per sq ft and above. Wangsa Maju has numerous flats which have been found to be well-organised and possess a tidy and clean image, although some may be in need of a touch-up. The establishment of Kolej Universiti Tunku Abdul Rahman has also caused some changes in the township’s rental yield due to the increase in demand

MALAYSIA: THE PROPERTY OUTLOOK FOR 2014 The National House Buyers Association provides its perspective on what 2014 holds in store for Malaysia’s property market.
1) What is your 2014 local property market outlook in terms of supply and demand as well as pricing? Overall, we believe that the 2014 outlook for the property market remains positive. There will always be genuine demand for properties and measures such as the higher Real Property Gains Tax (RPGT) will not affect homebuyers buying for their own occupation or for long-term investments. Such measures will hopefully reduce speculation in the property market which has inflated prices to levels no longer deemed affordable by majority of the population. A subsidy scheme of up to RM30,000 is being offered to private developers to build more low- and middle-cost housing, with the maximum prices for low- and medium-cost houses set at RM45,000 and RM170,000 respectively. We hope that the threshold for middle-income properties can be raised up to approximately RM300,000 to capture a wider segment of the population and to encourage more developers to participate in this scheme. However, it could take about three years for results to be seen and for the units to be ready for occupation.

We also hope that the Government will continue to monitor the situation and take proactive measures where necessary such as increase the entry cost for buying properties in the form of higher stamp duties for transfers of titles for people who hold/ buy multiple properties as such measures are deemed more effective and can yield more immediate results. 2) In your opinion, how have the budget measures impacted the market sentiments of potential homebuyers, sellers and developers in general? Many potential homebuyers will be hoping that property prices will stabilise or even come down; as such, those who are not in a hurry to get their own homes will adopt a wait-and-see approach. With luck, this will cause sellers and developers to eventually lower their selling prices to capture these buyers, resulting in a self-fulfilling prophecy. The higher RPGT will greatly affect those who buy properties directly from developers to sell them upon completion. Known as ‘flippers’, these individuals will try to increase their selling price to recoup their RPGT-
3) How do you see homebuyers faring next year? Homebuyers will be better off due to the new measures, but they must be aware that freebies such as ‘free legal fees’ advertised by developers have already been factored into the property’s selling price. With Budget 2014 banning the Developers Interest Bearing Scheme (DIBS) and introducing greater transparency in house prices as well as Bank Negara Malaysia (BNM) instructing banks to only lend based on the property’s net selling price, they may not necessarily be able look forward to such freebies anymore.

However, until the Government comes up with a proper guideline on what exactly the GST will affect, it remains to be seen whether it will lead to a drastic increase in house prices. We also hope that the Government will exempt building materials meant for the construction of affordable homes from the GST.
These measures will hopefully put off speculators and cause property prices to stabilise or maybe even come down. Additionally, we have always stressed that homebuyers must set aside up to 10% of the house price to pay for ancillary costs such as legal fees and stamp duty, and do not expect them to be burdened by these things as it is part and parcel of buying a house. 4) What will be popular among property buyers and sellers next year? The key factor will always be ‘location’ with the next hotspots being places with good connectivity to public transportation hubs such as the upcoming Mass Rapid Transit (MRT) stations. An efficient and reliable public transportation system means living further away from the city centre will become more feasible. Capable homebuyers should do their research and buy into such areas now if they can afford it as the house prices there will go up again after such works have been completed.
