HAPPENINGS WB Land’s Frontier 2 Sees Brisk Sales: Types A and B Sold Out As Menteri Besar of Johor Dato’ Mohamed Khaled Nordin launched WB Land Sdn Bhd’s Frontier Industrial Park near Desa Cemerlang, Ulu Tiram in Johor Bahru on 19th July
2014, the developer reported brisk pre-launch sales which led to all Type A and Type B factories being sold out. At present, the company has 24 units of Type D semidetached factories for sale priced at RM4.312 million to RM4.768 million with a built-up area of 13,395 sq ft on a 19,043 sq ft plot. There are only four units of Type E detached factories for sale at RM7.116 million to RM8.128 million for a built-up size of 23,409 sq ft on a plot of 39,494 sq ft. Gated and guarded with mobile patrols and CCTV coverage, Frontier also features a two-acre central park, making it a ‘home for industries’. This gave WB Land the edge as the project won the Five-Star Best in Malaysia award for industrial development at the recent Asia Pacific Property Awards 2014. WB Land launched Phase 1 of Frontier Industrial Park last year and all 10 of its units have been sold. Meanwhile, the 62-acre Frontier 2 has a gross development value of approximately RM354 million. With 95% earthwork completed thus far, it will be completed in the fourth quarter of 2015.

The Z Residence’s Completion Sets New Benchmark for Trinity Group Trinity Group recently announced the successful completion and handover of The Z Residence, its most ambitious project to date, in a media briefing held at the newly completed condominium. The development which managed to achieve 100% capital appreciation in the three years since its launch in 2011 has a total gross development value of RM580 million. Comprising 1,136 units spread across two 26-floor and two 27-floor blocks, construction was officially completed on schedule in June with the owners receiving their keys in batches that same month. Walkability: What Malaysians Overlook When Buying Property Easy accessibility is a major concern which most prospective property purchasers have, but many tend to overlook walking as one of the possible modes of transportation in question. - BY KHAI YIN
When buying properties, the average Malaysian would think of two things: location and price. Due to the nature of my work as the founder of GoodPlace.my, an advisory blog on Malaysia property, I get questioned via email on topics such as “What is the next property hotspot?”, “Is the price of this property fair?” and many more. It is seldom – by which I mean never – that I get questions regarding how ‘walkable’ a property is or how accessible amenities are from the property’s location. Traffic jams are already a given in Klang Valley and the situation is not going to get any better any time soon, although one only hopes that things do not go from bad to worse and our streets begin to resemble those of Bangkok’s or Jakarta’s. Commuting to and from work is becoming a real pain and most Malaysians would rather live where it is convenient if given a choice. In fact, my wife has been telling me that she would be willing to take a 10% pay cut just to be able to work from home.

It is of no coincidence therefore that new projects in Klang Valley are now trending towards being ‘integrated developments’ – the ‘everything under one roof’ concept is a major selling point which appeals to many Malaysians, both to first time homebuyers as well as investors. After all, if I am willing to bet my daughter’s college funds on properties, I will undoubtedly invest in those without a second thought. We do a lot of number crunching as part of our service to homebuyers and as such we have noticed a strong correlation between a property’s walkability and its medium-term capital appreciation. Interestingly, this also means that the walkability ‘score’ can be used as a factor to predict future pricing trends. WALKABILITY: A DEFINITION Walkability, to put it simply, is a metric which quantifies how friendly an area is to walking. In practical terms, it
is a measure of the accessibility of important amenities such as offices, retail outlets, eateries, schools, colleges, police stations, taxi stands, bus stops and parks from a specific property. As such, walkability is impacted by the following:
measuring walkability is now not as laborious as before, making it easier for companies such as WalkScore which completely rely on online data to calculate walkability. At GoodPlace.my, we devise computer algorithms which pull data from Google Maps and calculate the walkability score based on walking distances to three groups of facilities:

• Transportation (bus stops, train stations, taxi stands, transportation hubs) • Primary amenities (hospitals, schools, colleges, police stations) • Secondary amenities (commercial areas, offices, retail, F&B outlets)
Distances between the property and amenity Pedestrian density Quality of footpaths (with signage and directions) Traffic conditions Environmental conditions
Walkability can typically be measured using a process called the “walkability audit” where the auditor would audit pedestrian routes through an elaborate framework which scores (on a seven point scale) the street facilities as well as open spaces and public transportation points. This is done aided by a tool called the Geographic Information System (GIS) which automatically track the measurements and present the walkability score upon further processing. With mapping data already readily available either on Google Maps or Open Street Map,
Internally, we collect data from Google which is available publicly through the API (application programming interface) to compute the walkability scores which range from 0 (worst) to 100 (best). As these scores change due to new pathways and amenities being built, we populate our index with new scores approximately once every four to six months. Below is a sample of some walkability scores for selected KLCC and Mont Kiara condominiums.

Based on the sample walkability scores above, it should not be surprising to see that integrated developments or condominiums located near shopping malls score well on the walkability chart. As you will see, many of the upmarket condominiums in the KLCC area are near commercial areas as well as public transportation options, resulting in the high walkability scores. Comparatively, Mont Kiara condominiums have lower walkability scores across the board although some properties such as the older Sunrise condominiums clustered around the Jalan Kiara 1 area have high scores due to their proximity to the Mont Kiara International School as well as One Mont Kiara and Plaza Mont Kiara. This is evident with ‘North Kiara’ properties such as Anggun Puri and Menara Duta where one would need to drive to reach any of the nearest commercial areas which include Solaris Dutamas and Solaris Mont Kiara. From our internal data, we have also noticed that residential enclaves tend to have lower walkability scores. For example, those located in USJ Heights typically have scores below 50 as the nearest major commercial area is about 5km away in USJ Taipan.

HOW TO USE WALKABILITY SCORES From the investor’s point of view, walkability scores are useful because they link well with the pricing trend of residential properties in the sub-sale market. Intuitively, this makes sense because easy access to amenities is an important criterion for the buyers of today as well as a driving force in the mushrooming of integrated developments in Klang Valley where amenities can be reached without the need to drive far. Our internal analysis shows that there is a strong correlation between a property’s walkability score and its price appreciation based on our data set which is collected over a period of twelve months. While this data set is limited in scope due to the fact that the data is collected from public sources and we are thus unable to verify its accuracy, the results are directionally conclusive. This means that we are able to use the score as another factor to predict price movements in the future. Of course, there are macro factors which impact the prices of property such as overall market conditions, macroeconomic factors and infrastructure development,
but with all things the same, a property with superior walkability score will almost always outperform the market. Independently, the Commission for Architecture and Built Environment (CABE) in the UK has formally established a correlation between walkability score and the prices of residential properties in a study it conducted in 2007 titled ‘Paved In Gold: The Real Value of Good Street Design’. If you have not purchased a property yet, consider walkability as one of your decision criteria when you buy a new piece of property. You may not have access to the technology that professional walkability scorers do but you can start with carrying out your own qualitative evaluation by going to the ground and looking out for
amenities and pathways. Another step you can take is to ask the developer about any future infrastructure developments which will positively impact the walkability of the project. You can use a simple table which will help you make a side-by-side comparison between every property that you are considering in terms of walkability, but with enough experience you will eventually be able to tell which the better ones are intuitively. While many people directly link Bank Negara Malaysia with the Base Lending Rate, the actual situation is a little more complicated.
Property owners and potential home buyers have been known to partake in coffee shop discussions about the Base Lending Rate (BLR) and how the government should lower it to make property ownership more affordable. Before you start ranting about how the government is to blame, there are two essential things to understand – firstly, what is BLR and how it is determined, and secondly, that effective 2015, BLR will be replaced by a whole new reference rate framework for pricing loans. To gain a better understanding on the whole matter, we have to get a little technical. WHAT IS BASE LENDING RATE? Most property owners out there should already have a pretty solid understanding of BLR and its inner workings, so this is just a nutshell explanation for those who are not in the know. something called the Overnight Policy Rate (OPR) which BNM determines. Here is where you need to understand that setting this OPR is not arbitrary but takes into account various economic indicative factors such as inflation, economic growth and possible risks which basically comprise the overall economic outlook. BNM adjusts the rate according to how much money they want in circulation versus how much is tied up in savings. One interesting thing to note is that OPR does not only influence BLR but also a whole myriad of other variables such as fixed deposit rate, foreign exchange rate as well as short and long term interest rates which, by extension, affect prices of goods and services, employment, output and other elements that play a part in our economy. CHANGES IN 2015 In March this year, BNM announced that a new interest rate framework known as the Base Rate would replace
the BLR in 2015. The major difference is that this new rate will be determined by different factors which include banks’ cost of funds, their Statutory Reserve Requirement (SRR) account balances which refers to how much they have in their reserve accounts with BNM proportionate to their eligible liabilities, borrower credit risk, liquidity risk premium, operating costs and profit margin. As such, this new framework would ideally bring about increased transparency for consumers out there which will in turn result in a higher level of efficiency, discipline and adherence to individual banks’ performances compared to the BLR system. Ultimately, if all goes according to plan, the market will be thrown into an environment of healthy competition, providing borrowers with more attractive and competitive rates so they can in essence go shopping from bank to bank to find the best rate. THE EFFECT ON EXISTING BLR-BASED LOANS If you already have a loan in place, there is no need to panic; after the new framework’s effective date of 2 January 2015, prior BLR-based loans will continue to be referenced against the BLR. This is because even though it has been replaced in terms of loan pricing, it will still exist as its key influence, the OPR, is used for other economic variables.
However, when a bank makes any adjustment to its Base Rate, a corresponding adjustment to its BLR will also be made. Because of this, BNM will require all banks to display both Base Rate and BLR at all branches and websites. Additionally, the new rate will be used for the refinancing of existing loans after it takes effect. CONCLUSION Having said all that, this new move by BNM which heavily affects loan pricing could still differ in reality from the ideal when it comes into play. As with any major economic initiative, it could bring about ripples in the financial market, implying unpredictability in the interest rates in the future. As a consumer, what you can do if you are planning to buy property is to make your move before the year ends. That way, when the new Base Rate comes into play and somehow raises interest rates, you would still enjoy yours as it was. In Malaysia, if you build a house, you need to get the Certificate of Completion and Compliance (CCC) signed off by various parties to say that they have developed according to certain standards and specifications. Prior to this it was the Certificate of Fitness (CF) but they have now done away with that, and it has been replaced by the CCC. Parties involved in a development’s sign off include contractors, engineers, architects and in some cases, supervisors.

For most of us – especially those from generation Y – the idea of owning a home is moving farther away with every new development. Whether it is affordability, the job market or simple commitments, not all of us can take pride in being able to afford a home. When one finally does decide to invest a bulk of their life savings in real estate, can quality be assured? We have all heard tales of terror about leaky pipes and uneven floors, so how can we sleep at night knowing our money has been put into the right place? The Construction Industry Development Board (CIDB) Malaysia may just have the solution we’ve all been waiting for. In 2007 they embarked upon QLASSIC – Quality Assessment System in Construction – a project that assesses developments from all aspects. The aim is to not only give homebuyers peace of mind, but to also motivate developers to continue working on a quality-laden portfolio. Dato’ Sri Ir Dr Judin Bin Abdul Karim, CEO of CIDB, sat down with iProperty.com Malaysia to shed some light on this unique and potentially benchmark project. Tell us a little bit about QLASSIC. Simply put, QLASSIC is a tool to measure quality. At CIDB we aspire towards an industry that is built from

In some aspect this is a sort of comfort that allows buyers to believe that a building is okay. At CIDB we have observed that there are still problems in the industry resulting in people being unhappy. For most people a home is a lifetime investment that costs lifetime savings. Sometimes you get the keys to your new home; you find that you are unhappy with it despite it being signed off by all the aforementioned people. Like with most places Malaysia has its fair share of excellent buildings and less-than-excellent ones. Not all of it is up to mark. This is one of the primary reasons behind QLASSIC. It is a third-party assessment tool. If a development gets a good score from QLASSIC, it would mean that this building has been built better than some of its contemporaries. Some developers have already adopted QLASSIC scores as a marketing tool, exhibiting their high-scores. The idea is to have these developments assessed by a third party to cultivate trust in a development by the public. QLASSIC can be considered a badge that sets developers apart from one another. To maintain your brand, you have to maintain your standards. Big developers have been very supportive of this initiative and we are hoping that this produces potential for a healthy industry. Bottom line is that the property business is run to make money. With such constraints, quality sometimes suffers. QLASSIC hopes to be the tool that changes that. What is the assessment process? At the moment the QLASSIC procedure is not fully comprehensive as we now mainly assess architectural finishing upon the completion of a project. We make sure walls are smooth, floors are levelled and that the external work is commendable. We have plans to expand this to include all aspects of a development and ideally, we would like to be able to produce a document for independent assessment. If developers know that an independent audit beckons, serious deviations will be accounted for.
We currently have drafts for structural and mechanical procedures, and are in the midst of deciding the best way to implement it. Making this tool public will hopefully change behaviour, which is our ultimate target. If people realise that quality is beneficial for business, quality will be assured. Currently in the industry, who uses QLASSIC? QLASSIC has been adopted and supported by a number of big names including MKH Berhad, the Sunway Group, IJM Land and Sime Darby. You can tell these are serious players as they are exhibiting, openly, what they are producing. This is why it’s important for homebuyers to demand for an assessment. If the public demands it, businesses will respond. Is QLASSIC only suitable for residential construction? At CIDB we always look at the bigger picture. Quality is one, but we also have to consider sustainability, safety and comfort. These are all elements of a robust industry. Here, we tackle it from various angles.
In Malaysia we work according to the Green Building Index (GBI). But consider government buildings. The GBI may not be the best tool for it as they have many buildings. Rather than focus on green buildings, there should be emphasis on energy efficiency. These are all things we want to take into account with expansion of any kind.

This is cumbersome, time-consuming and involves expending money,” said Deputy Director General of Valuation Faizan Abdul Rahman. Every REN is assigned a name tag printed with a personal REN number which must be worn at all times while they are carrying out their real estate work. The public can scan the QR code on this identification tag with their mobile phone to see the full details of the REN. Alternatively, they can call the Board or browse the official website to check and verify the status of the negotiators. “Despite the strict punishment, the booming property market continues to attract brokers who have limited knowledge of property transactions and who cheat buyers and sellers out of thousands of Ringgit. In an effort to prevent such cases from escalating further and to promote professionalism in this industry, the Board has embarked on this registration and identification exercise which began last October,” said BOVAEA board member Eric Lim.
The Board of Valuers, Appraisers and Estate Agents (BOVAEA) has embarked on an exercise to register Real Estate Negotiators (REN) by issuing identification tags to all those who are employed by registered estate agents. This is in line with its goal of enhancing the industry’s level of transparency as well as instilling integrity and upholding the standards of practice among the professionals that represent the industry. It is envisaged that with the new system in place, cases related to brokers will decrease significantly as this will help stop brokers’ illegal representation and misdeeds as well as inadvertently curtail the blossoming of brokers. The registration exercise and new identification tags will also help improve the level of professionalism among industry practitioners and deter the public from wrongfully appointing brokers who are in it for the easy money. WHY IT IS NECESSARY “One of the main priorities of the Board is to protect the public at large and the Act makes the necessary provisions to do that. When a REN or an estate agent during the course of their work does anything contrary to public interest the Board can act against them but if a broker does the same the Board’s powers are limited

IT TAKES A VILLAGE BOVAEA stressed that the public has an equally important role to play which is to insist on seeing the identification tag of the REN and scan the QR code printed there for verification purposes when engaging the services of a real estate firm. It is important that people appoint an authorised REN or registered estate agent so as to ensure that their interests and rights are protected. “The aim is to eventually encourage more negotiators to register themselves so that effective monitoring can be implemented which will deter perpetrators from cheating sincere buyers and sellers out of their hard-earned money. The government is confident that this latest initiative from BOVAEA will reap huge benefits for the real estate industry and improve the professionalism of the practitioners. I ask of the Malaysian public to check who you are appointing as your agent and always ‘Ask for the Tag’,” added Deputy Minister of Finance YB Datuk Ahmad Haji Maslan. Please tell us about your company. We were listed on the Main Board of the Hong Kong Stock Exchange in 2005 on our first try, breaking a number of records in the process. Over the past 20 years, we have developed more than 100 city landmark projects including the Tianjin R&F Guangdong Tower which is officially recognised as one of the 10 tallest buildings in China, Beijing R&F Centre, Guangzhou R&F Centre and Shanghai R&F Peach Garden.

Why did you decide to develop a project in Iskandar Malaysia and what are your future plans for its property market? Since its establishment in 2006, Iskandar Malaysia has become the fastest growing economic corridor in Malaysia due to the combined efforts of the Malaysian and Singaporean governments. We believe that Iskandar Malaysia’s relationship with Singapore will eventually mirror how tightly integrated and economically important Shenzhen is to Hong Kong and vice versa. With that in mind, we are more than willing to participate should there be any other available development projects here in the future. We are very confident in the potential of the local property market as it is developing economically at a rapid pace. Additionally, with more international brands and companies coming in, property prices here are expected to rise in response to the increased demand for both commercial and residential developments.
Phase 1 of R&F Princess Cove is a high-end freehold residential development facing Singapore which comprises 15 towers with 35 floors each that are serviced by four lifts fitted with a multi-tier security system. Promoting Bilateral Relations in the Property Industry A visit from the China Real Estate Research Association may mean more joint ventures between China-based developers and local developers such as Nadayu Properties Berhad. - BY ONG XIN YING Malaysia is steadily cementing itself as a preferred investment destination for foreign parties as evidenced by its jump to the 15th spot from last year’s 25th position in the 2014 Foreign Direct Investment Confidence Index by global management consulting firm A.T. Kearney. The local property market in particular is one of the primary magnets for these investors of which a growing number hail from China. In light of this, Nadayu Properties Berhad recently welcomed an entourage from China which was led by the vice president of the China Real Estate Research Association (CRERA) and included the deputy chief editor of a top business newspaper in China who came to visit Nadayu Properties’ projects as well as explore Klang Valley’s development potential. iProperty.com was fortunate enough to meet with both Nadayu Properties’

CEO Mohd Farid Nawawi and CRERA’s vice president Gu Yunchang to gain an insight into this unique initiative. How would you describe Nadayu Properties’ role in this initiative? Mohd Farid Nawawi: Our purpose in this endeavour is to introduce Malaysia’s property industry to potential investors in China via our contacts. As you may be aware, a growing number of China-based companies have been expanding their businesses here although that number is still relatively small compared to the number of corporations which choose other countries such as Singapore instead. Malaysia is still not a primary destination for many Chinabased property developers, so we aim to leverage on our connections to introduce these developers to the
industry, assist them should they wish to invest and do business here as well as act as a joint venture partner for their local projects where suitable.
regard as the significantly large Chinese community here means that they have many cultural similarities with this portion of the local market.
What can you tell me about CRERA’s role and responsibilities? Gu Yunchang: CRERA is a semi-government association tasked with facilitating communications between the developers and the local property market as well as providing the public with information about the market. Its members comprise real estate developers and property agents who mostly represent new developments. At present, our property market is 60%70% focused on primary developments as opposed to the sub-sale market which comprises 30%-40% of the transactions although I would like to point out that the situation is reversed in Shanghai and Beijing.
What is Malaysia’s potential as a foreign property development and investment destination? Mohd Farid Nawawi: I think there is still a great deal of interest from foreign developers to craft their own projects here and the government measures which have been implemented in order to curb speculation will not deter genuine foreign investors and homebuyers from coming into the country.

Our main objective is to act as a catalyst for the communication and cooperation between the developers in our homeland and the developers in Malaysia. To that end, we are promoting the formation of joint ventures between these two parties. What is the nature of your collaboration with CRERA? Mohd Farid Nawawi: We have not established anything specific yet as this is our first meeting, but we have a significant number of shared interests which I believe will be a strong basis for future collaborations. China’s property scene is currently plateauing which has resulted in many of their developers looking overseas for their next venture. Malaysia is an attractive option due to factors such as our real estate industry’s robust growth and high rental yields as well as the comparatively low living costs here.

These developers have also become interested in expanding their business here due to the improvements the Malaysian government is making to our transportation systems such as the High Speed Rail link connecting Kuala Lumpur and Singapore. As such, we hope to leverage on these factors as well as our expertise to establish collaborations with these China-based developers, be they in the form of land deals or joint ventures. Our aim is in fact to become the first port of call for them if and when they are seeking information on the local property market or joint venture opportunities. From your perspective, why are China-based developers interested in developing projects in Malaysia? Gu Yunchang: The China-based developers who come here and develop projects have a vested interest in selling their units to housebuyers and investors in China as these purchasers are looking for a residence which offers them a respite from the less than optimum living conditions in their home country. These prospective buyers are drawn by the many educational options available here as well as Malaysia’s attractiveness as a retirement destination. Many of these developers are looking to expand their business reach overseas and Malaysia is an appealing choice in that

2 In fact, several locations across Malaysia still suffer from shortages in property and it is our hope that this initiative will help encourage foreign developers such as from China to develop projects here. This will also hopefully trigger an influx of foreign buyers who are interested in buying properties developed by these developers from their homeland, thereby further contributing to the growth of our real estate industry. What is your opinion of Malaysia’s property market? Gu Yunchang: For the past few years, property prices in Malaysia have been much more stable compared to those in China especially in regards to the residential sub-sector. Like the Malaysian government, the Chinese government has also been implementing cooling measures - so there is a measure of uncertainty in the property market but unlike China, Malaysia’s property market is still stable despite the cooling measures which have been implemented. What are your immediate and future plans based on this visit? Mohd Farid Nawawi: We are seeing a lot of property deals such as land sales and this interest from China represents another attractive avenue for us in this aspect. This tentative future collaboration with Chinabased developers has certainly provided us with another means to develop certain land parcels, whether it is by replicating what they have done in their home country or establishing a financial collaboration of some sort.

We have a database of local developers who are interested in these endeavours and likewise CRERA has its own database of China-based developers who want the same thing. This means that if there was a large piece of land to be developed, we or another local developer will now have the option of entering a joint venture with a China-based developer to accomplish the project. As for any immediate plans, we will have to look at it on a case-to-case basis and assess both them as well as ourselves before we make any concrete decisions. Gu Yunchang: My first course of action when I return to China will be to gather the local developers and investors and bring them to Malaysia, so that they can observe the country’s property market and hopefully be interested in developing projects here. Another important step is the promotion of the Malaysia My Second Home (MM2H) programme in China to raise awareness and increase understanding of Malaysia among the masses back home. Additionally, there are 5,000 to 6,000 town planners in China who will be attending our annual conference which I will also endeavour to promote Malaysia to and convince to choose this country as a possible overseas venture destination. We mostly need Bumiputera developers to assist in these joint ventures or help in certain areas, and that is where Nadayu Properties comes in. All in all, there is a lot of promise in this endeavour that I believe will be realised to its full extent.

Construction of the MRT and LRT extensions has not even reached the halfway point and developers are already capitalising on the potential value of the upcoming upgrade of Klang Valley’s transport infrastructure. It is not hard to find flyers highlighting a development’s proximity to the nearest train station, but it is pretty difficult to really gauge what its completion means for the property market. iProperty.com Malaysia spoke to Christopher Chan, associate director of Hartamas Real Estate (Malaysia),

What are some of the prime properties along the MRT, LRT extension and BRT lines? Christopher Chan (CC): Some of the key areas and projects to look out for include: • Sunway Geo’s mixed development project located next to the Sunway BRT stop
• Equine Capital Bhd’s development which is located near the BRT line and the LRT extension near Summit USJ Shopping Mall • Tropicana Gardens as it is directly linked to the Dataran Sunway elevated station • Sunway Velocity which has direct access to the underground interchange MRT stations at Cochrane and Maluri • EkoCheras, which is located next to the Cheras MRT station Warrick Singh (WS): I honestly feel that any property along any of the lines – LRT, MRT and BRT – would be a good investment for Malaysia’s young, dynamic and educated population. The main issues of any good property alongside this infrastructure would be affordability and financing. Land in the city is generally expensive and developers, to maintain margins, look at high plot ratios and densities. To ‘bridge the gap’, Kuala Lumpur may have to go the way of Singapore and build ‘shoebox’ apartments within an integrated development. James Tan (JT): I would look at places such as: • The Kelana Jaya MRT connection and its surrounding developments – H20 Residences (Titijaya Land Berhad), Pacific Place (MN Global Assets Management) and Centro (GLOMAC) • SS15, SS17 and SS18 in Subang Jaya will all benefit from the station near Summit USJ Shopping Mall • USJ 20 has a station very close to the development by One City Properties These are only some of the areas which will be directly impacted by the new system. Most of these places will benefit from the population boost and increase in daily traffic. Places such as Pusat Bandar Puchong and Sunway Southquay will definitely see a great increase in people travelling to and from the area. Once the lines are integrated, people can move from Puchong to
Klang in just a matter of minutes thanks to the linked transportation. With the Circle Line operating within the city centre as well as the upcoming mega project Bandar Malaysia and its surrounding Golden Triangle Apex, what are some concerns investors should look out for? CC: I believe that it is good to first know the confirmed alignment of the Circle Line 3 before rushing in to buy the properties there. Investing in properties next to or near MRT stations is ideal, but at the moment the exact alignment is unconfirmed. Purchasing something in the first phase of any development should be good because one can expect to get the maximum returns compared to those who purchase later as the developer usually increases the selling price over time. WS: At its core, Bandar Malaysia is a city within a city and may have features of a world-class financial centre complete with incentive tax breaks. The new High Speed Rail (HSR) system is, perhaps literally, a stone’s throw away from Bandar Malaysia which is positioned in such a way that it is able to draw the spin-offs from an already vibrant Kuala Lumpur Central Business District (CBD). There is already concern over an overhang of commercial office space in the area, but specific tax breaks and reduced assessment rates/quit rent rates could serve as crutches through this gestation period. JT: As many have mentioned, the oversupply of office space is a problem. If the Circle Line 3 does not become operational on time, this area will not survive. If it does start booming, however, it could pose stiff competition to Taman Desa due to its proximity to Kuala Lumpur’s town centre.

EXPERTS’ VIEWS | The MRT and LRT: What is in Store for Us? Do you believe that under the RRIM project by Kwasa Land Sdn Bhd, the government should intervene and take into account provisions for affordable housing? CC: The developments over the past few years have been mostly of the upper-middle price range variety, creating a vacuum in regards to properties for the sizeably large population who are in the lower and lower-middle income range. In light of this and the government’s objective to build
more affordable housing as provided in Budget 2014 under PR1MA, I am of the opinion that provisions for affordable housing must be made here to cater to this segment of the populace. WS: The country’s growing number of youths needs affordable housing and RRIM appears to be the last bastion of affordability in the area. All efforts should be made to have affordable housing as its principal theme, setting the tone for the CBD and suburb planning.

JT: Yes, no questions asked; the government needs to provide it. As per usual, however, it is how they end up managing it that will determine its success. They must manage the qualification and eligibility of buyers, prevent speculation and issue purchasing criteria. They also have to work with the banks as affordable housing stops capital appreciation, which ultimately affects the banks’ expectations. Despite claiming to alleviate traffic, most congestion takes place where current LRT stations are situated. How can this problem be rectified for the upcoming stations? CC: We would need to ensure that the overall MRT, LRT, BRT, KTM, bus and taxi services complement one another to form a successful integrated transportation system. For example, there is a real need to ensure that the feeder bus services to the stations are on time and efficiently run. This would help guarantee that the public will use the buses instead of driving their cars to the stations and parking them there, resulting in a jam in the areas surrounding the stations. WS: Bridging the gap between the lines would create an effective, reliable and punctual public transportation system. Applying expensive peak hour tolls as well as a hybrid of certification of vehicle eligibility (COVE) and public transport personal income tax breaks could be beneficial to this goal. JT: As both a value and land economist, my opinion is that sufficient parking and sufficient drop-off areas need to be provided. Sadly, this will not work in highly populated areas due to the lack of space and the costs involved. Cheap car parks would be a great option but this may not be economically viable for the operator. However, these costs need to be absorbed or subsidised for the benefit of the consumers and nation. If you look at things in the long run, traffic takes up time and time is money. Productivity hours lost will, perhaps someday, affect the country’s GDP and these costs cannot be quantified.
Integration is key when it comes to public transportation. What steps should the relevant authorities take to ensure there is a systematic integration of the public transport infrastructure in Klang Valley? CC: Ideally, the integration, planning and design should be done before the formal handover of the complete viaduct construction to the station developer at a particular station. MRT Corp and Syarikat Prasarana Negara Bhd should immediately discuss the integration of the proposed Circle Line 3 and MRT Sungai Buloh-Kajang Line in Bandar Utama for seamless connectivity so as to avoid unnecessary costs incurred by connecting the two lines at a later stage. WS: Integration is the mother of all connectivity. Town planners need to steer clear of haphazard planning and pay attention to the corresponding plot’s ratio and density. Currently, an overturned trailer in a connecting tunnel can throw the city into a traffic pandemonium. Legislation must take the form of a tiger that bites all those who run afoul of current building by-laws and other misdemeanours. JT: A one-card system across the board should be introduced. Currently, if you park your car in Petaling Jaya and later go to Klang, you cannot use the same parking ticket. Similar to the Touch ‘n’ Go smart card, there needs to be a one-card system which works for all lines and networks. Without such a card, if you stay in Putra Heights and want to get to the city, you would have to take the LRT, BRT and KTM; that is a total of three different cards when instead one would be so much more convenient.

MRT Corp, the brains behind the brawn of the upcoming Mass Rapid Transit line, is optimistic and driven. Come December 2016, Kuala Lumpur and Selangor will undergo a transport infrastructure facelift in the form of the extension of the Light Rail Transit (LRT) line and the commencement of the Mass Rapid Transit (MRT) service. Datuk Wira Azhar Abdul Hamid, CEO of MRT Corp, took some time to talk to iProperty.com via email about the progress, plans and upcoming announcements in regards to this mega transport development. iProperty.com: Can you shed some light on the BRT Line, Circle Line and Putrajaya Line as far as the MRT is concerned? Datuk Wira Azhar Abdul Hamid: In 2010, under the government’s Economic Transformation Programme, all three MRT lines were announced, including the Circle Line. The first MRT line which is the Klang Valley Sungai

Buloh-Kajang Line runs from the West to the East whereas the second line will be from the West to the North to down South and the third line, also known as the Circle Line, will connect all urban rail networks in the Klang Valley. These lines, together with the existing urban rail systems, are envisioned to form the backbone of the city’s public transportation system. However, we are unable to elaborate further on MRT Lines 2 and 3 as the government has yet to make an official announcement on them. Has the construction of the MRT been on track so far? Have you experienced any unexpected challenges? Datuk Wira Azhar Abdul Hamid: Construction of the MRT is on track and on schedule. As of 30 June 2014,
overall progress of both the elevated and underground construction works is at 47.63%, which actually puts us slightly ahead of schedule. As for the progress of the underground construction of the MRT, some significant challenges have been encountered particularly in the Bukit Bintang area. The underground formation beneath Kuala Lumpur is made up of the Kenny Hill Geological Formation and the Kuala Lumpur Limestone Geological Formation which pose a lot of challenges as it consists of hard rock with a soft overlaying material. Additionally, there can be large void chambers and cavities filled with water or slurry. Due to the presence of this type of soil in the Kuala Lumpur Limestone Formation, sinkholes and/or depressions could occur. Additionally, the Bukit Bintang area is the transition zone between these two geological formations, which creates problems when it comes to tunnelling. Progress for the underground construction work as of 30 June 2014 is at 63.34%. For the elevated section, which is 37.24% complete, most of the challenges come in the form of small work sites. As you may be aware, we are building in a built-up city which is heavily populated and this brings about many challenges, including social ones. However, we continue to work together with our contractors and the communities to overcome these challenges and our progress rate is a testament to this.
MRT factor as the easy accessibility provided will make the property more attractive to both homebuyers and potential tenants. What is the nature of the relationship between MRT Corp and property developers? Datuk Wira Azhar Abdul Hamid: MRT Corp has entered into integration agreements with developers where they are allowed to directly link their properties, be they newly-developed or existing buildings, to a MRT station via a walkway. Aside from direct linkage to the MRT stations, developers have also expressed their intentions to build covered walkways from the station to their buildings located 200 metres away. This will be a boon to the said property and of course, to the MRT system itself. Are there any further railway expansion plans in the works? Datuk Wira Azhar Abdul Hamid: MRT Corp is now awaiting the government’s official announcement on Line 2. For more information on further expansion plans for the railway industry, the Land Public Transport Commission (SPAD) would be the best party to contact. What is the expected date of completion? Datuk Wira Azhar Abdul Hamid: We are slightly ahead of schedule and confident that the first phase of the project (from Sungai Buloh to Semantan) will be operational by July 2016, whereas the second phase (from Semantan to Kajang) will be operational by December 2017. These are operation dates, so construction per se will finish earlier for testing and commissioning to be carried out. Property developers are already advertising the upcoming stations and prices are beginning to soar. Do you think these prices will further increase when the stations are completed and running? Datuk Wira Azhar Abdul Hamid: Historically, the availability of urban rail or any form of mass public transport in any part of the world will positively influence the property values of its surrounding areas. As such, we believe that property values will appreciate with the

With MRT Corp saying that most of the work for its Line 1 is ahead of schedule, investors and developers are excited about the prospect of the trains commencing before its expected completion date. While Line 2 and the Circle Line are still shrouded in mystery, many developers are using the announcement of the first MRT line as a marketing tool. It is no secret that close proximity to a major public transport infrastructure is a major selling point, but what should investors bear in mind before putting their money into just potential? Ho Chin Soon and Ishmael Ho, directors of Ho Chin Soon Research, a property information company which provides data on land use and ownership to those in the real estate industry, took time off their busy schedules to sit down with iProperty.com to discuss some of the key ideas behind investing in the name of public transport and its potential capital appreciation.

WHERE DO YOU LOOK? Ho opined that anyone looking to capitalise on the property appreciation courtesy of the MRT and LRT extensions should simply just ‘follow the infrastructure’. The second line of the MRT, while approved, has yet to be officially announced. OVERSUPPLY MAY BE A GOOD THING While many experts constantly express concern over the oversupply in high-rise residential buildings, the potential oversupply of commercial space within the upcoming TRAX @ Chan Sow Lin, Bandar Malaysia and Kwasa Damansara will possibly work in the favour of its investors. “An example would be the 88-storey Bukit Bintang City Centre by UDA Holdings, Employees Provident Fund and EcoWorld Development,” said Ho. “At the end of the day, it is best to let the big guys fight it out because it is the consumers and investors who will have a lot
to gain. If competition is stiff, prices will become even more competitive. In Bandar Malaysia, for example, Singaporeans can set up their back offices there and their front offices in Singapore. Those are some of the benefits of the upcoming High Speed Rail (HSR) linking Kuala Lumpur to Singapore.” The Circle Line, the third of the three new lines proposed in the MRT/LRT extension, is expected to commence concurrently with the HSR in 2020. Dubbed optimistic by many spectators, Ho also highlighted the importance of the Circle Line’s progress due to its close relationship to the HSR’s terminal and centre of operation, Bandar Malaysia.
In a statement released on 30th July 2014, Kwasa Land managing director Mohd Lofty Mohd Noh said, “On the whole, this has been a comprehensive bid on an open competitive basis. We would like to thank all the tenderers for their enthusiasm and commitment in their submissions. We truly appreciate the effort and the resources that they have put in.” Ishmael suggests that Kwasa Land Sdn Bhd work on a similar tangent to help the creation of more affordable housing options for Malaysians.
“The biggest reason the Circle Line needs to be approved is the access to the former Sungai Besi Military Airport. With the congestion and lack of accessibility in Sungai Besi at the moment, train commuters might end up missing their trains.” AFFORDABLE HOUSING Kwasa Land Sdn Bhd’s Kwasa Damansara township has taken a page out of Cyberjaya’s books and is being parcelled out in tenders while the company acts as the master developer for the upcoming area. Malaysian Resources Corp Bhd (MRCB) scored the tender for the MX-1 project which is estimated to hold a gross development value (GDV) of RM7 billion. The development, which comprises 70% commercial and 30% residential developments, boasts two MRT stops - the Kota Damansara and Taman Industry Sungai Buloh stations – which will be accessible via multiple entry points including the New Klang Valley Expressway (NKVE), Guthrie Corridor Expressway (GCE) and the upcoming Damansara-Shah Alam (DASH) Highway.
“You have so many tenders coming in, hoping to develop in the area, that the best way to try and create a system for affordable housing is to parcel out a particular acreage of land and put a price cap on it. Gather developers who are interested in an affordable housing project and get them to brainstorm concepts. That way, developers would have to calculate in reverse; they would have to consider their maximum selling price, the minimum size requirements of each unit as well as their profit margins. Then, simply put, the developer who presents the best concept for the project wins the tender.” WILL WE GET THERE? Ho said that the work put into the MRT now is commendable. “Provided that they start operating on single-card systems such as the Touch ‘n Go, I think they are on the right track. One of the most prominent features is that most stations are being integrated with new developments, both residential and commercial.”

Bandar Sungai Long Of the many areas poised to benefit from the government’s transformation plan, Bandar Sungai Long is ahead of the pack.
Bandar Sungai Long is located to the very east of the Klang Valley, lined between Cheras and Kajang, and is under the jurisdiction of the Majlis Perbandaran Kajang (MPKJ). It may not be the biggest township but it is well-equipped with many facilities and amenities that a self-contained city needs, such as schools, commercial centres, hospitals and more. In the middle of the township is an 18-hole golf course – the Sungai Long Golf & Country Club – as well the Tunku Abdul Rahman University, which has contributed to the increasing population and rental opportunities in the area. Developments are
mostly residential, followed by commercial. This includes terraced houses, semi-detached houses, bungalows, low and high-rise apartments and condominiums, and shops. Despite being small in size the township has ample space for expansion eastwards, while keeping in mind the costs of developing land that is hilly. The major roads and highways that lead to the township are the Cheras-Kajang Highway and the SILK highway. Access is also possible from Bandar Mahkota Cheras via Persiaran Mahkota Cheras 2, or internal roads linking the two townships. The main internal road within Bandar Sungai Long is called Jalan Sungai Long. It forms a trapezoidal-shaped border around the golf club, serving as the main internal road connecting many of the houses within the area. Currently, there is no integrated public transport service available within the township. It merely uses buses and taxis to commute. The nearest train services that possibly benefit the residents are the KTM and the upcoming MRT, located at Bandar Mahkota Cheras and Kajang, respectively.

The actual recorded transactions revealed that the transacted prices for semi-detached houses are inconsistent, while the ones for terraced houses and condominiums are increasing at a steady pace. Terraced houses in Twin Palms have stepped over the threshold of RM1 million in 2014; while condominiums recorded the highest transactions (684 units) compared to semidetached houses (118 units) and terraced houses (325

units). This is possibly due to the lower entry prices. One common factor tying these property types is that between January and end-March 2014, these properties recorded extremely low transacted units compared to previous years. This is possibly due to the high entry prices and competition from new products that have further enhanced on the living quality and safety.

From the list above it is noted that most of the new developments in Bandar Sungai Long are residential, from low-cost houses to luxurious bungalows, most of which are landed properties. The new developments are mostly scattered around the east of the township as there are more undeveloped areas to explore. The land’s limit, or lack thereof, does not urge developers to develop more high-rise strata properties just yet. Prices have not
been cheap in the township with double-storey terraced houses in Desa Budiman launched at a minimum price of RM458,800; three-storey superlink houses in Taming Indah 2 asking for at least RM1,430,000 and terraced houses in Palm Walk at a minimum of RM600,000. Located within several established schemes no doubt brings a certain split effect and facilities to Bandar Sungai Long. However, like with everything this, too has its pros and cons. The great location of being sandwiched between Cheras and Kajang causes traffic and increases travel time depending on the destination. Hopefully the MRT project will effectively ease the congestion in Cheras and Kajang, thereby eliminating the obstacle for development in Bandar Sungai Long.

Strata Management Tribunal: Scope, Jurisdiction and Powers In Part 6 of the Strata Management Act, 2013 series, the authorities and governance are explained in detail.
You have the Consumer Tribunal under the Consumer Protection Act, then the Tribunal for Homebuyers Claims under the Housing Development (Control & Licensing) Act and now we present to you an easy, cheap and speedy justice which an aggrieved party may seek legal recourse through without having to litigate in Courts: The Strata Management Tribunal. One of the eye-opening highlights of the Strata Management Act, 2013 (Act 757) (SMA) is that it has been passed through both Houses of Parliament and is the formation of the Strata Management Tribunal, as spelt out under Part IX of said legislation. For the benefit of those who want to know how much power it wields, this month’s column is dedicated to you. Who are ‘parcel owners’ and what is a ‘Joint Management Body’ and ‘Management Corporation’? Before moving any further, we have to define these three terms which are commonly used when it comes to stratified properties. A ‘parcel owner’ is the owner of an individual unit contained within a sub-divided building which is held under a separate strata title. A ‘Joint Management Body’ or JMB refers to the body established under section 17 of the SMA. A ‘Management Corporation or MC is, similarly, a body corporate but one which is established under the Strata Titles Act 1985.

We have reproduced the pertinent Sections of the laws for easy understanding of its actual formulated words and sentences. JURISDICTION OF THE TRIBUNAL Section 105 (1) The Tribunal shall have the jurisdiction to hear and determine any claims specified in Part 1 of the Fourth Schedule and where the total amount in respect of which an award of the Tribunal is sought does not exceed two hundred and fifty thousand ringgit or such other amount as may be prescribed to substitute the total amount. (3) The jurisdiction of the Tribunal shall not extend to any claim in which the title to any land, or any estate or interest in land, or any franchise, is in question. PERSONS ENTITLED TO FILE A CLAIM Section 107 No person other than the following persons shall be entitled to file a claim to the Tribunal:
(a) a developer; (b) a purchaser; (c) a proprietor, including an original proprietor; (d) a joint management body; (e) a management corporation; (f) a subsidiary management corporation; (g) a managing agent; and (h) any other interested person, with the leave of the Tribunal.
RIGHT TO APPEAR AT HEARINGS Section 110 (1) At the hearing of a claim, every party shall be entitled to attend and be heard.
(2) No party shall be represented by an advocate and solicitor at a hearing unless, in the opinion of the Tribunal, the matter in question involves complex issues of law and one party will suffer severe financial hardship if he is not represented by an advocate and solicitor. DETERMINATION OF RULES AND PROCEDURE Section 114 (1) The Tribunal may conduct the proceedings in such manner as it considers appropriate, necessary or expedient for the purpose of ascertaining the facts or law in order that it may determine a claim. (2) The powers conferred upon the Tribunal under subsection (1) shall include the following:
(a) to determine when and where any part of the proceedings is to be held; (b) to determine the language or languages to be used in the proceedings and whether translations of any relevant documents are to be supplied; (c) to make interlocutory orders; (d) to determine the relevancy, admissibility and weight of any evidence without being bound by the rules of evidence under the Evidence Act 1950 [Act 56]; (e) to draw on its own knowledge and expertise; (f) to order the provision of further particulars in a statement of claim or statement of defence; (g) to order the giving of security for costs;
(h) to make an on-site inspection of the building or land which form the subject matter of the claim; (i) to order samples to be taken from, or any observation to be made of or experiment conducted upon, any parcel or common property or limited common property which is or forms part of the subject matter of the claim; (j) to order the discovery and production of documents or materials within the possession or power of a party; (k) to order the preservation and interim custody of any evidence for the purposes of the proceedings; (l) to order the interrogatories to be answered; (m) to order that any evidence to be given on oath or affirmation; and (n) to summon the parties to the proceedings or any other person to attend before it to give evidence or to produce any document, records or other thing in his possession or otherwise to assist the Tribunal in its deliberations.
AWARDS OF THE TRIBUNAL Section 117 (1) The Tribunal shall make its award without delay and, where practicable, within sixty days from the first day the hearing before the Tribunal commences. (2) The Tribunal shall in all proceedings give its reason for its award in the proceedings. CRIMINAL PENALTY FOR FAILURE TO COMPLY Section 123 Any person who fails to comply with an award made by the Tribunal commits an offence and shall, on conviction, be liable to fine not exceeding two hundred and fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both, and in the case of a continuing offence, to a further fine not exceeding five thousand ringgit for every day or part thereof during which the offence continues after conviction. JURISDICTION OF THE TRIBUNAL Fourth Schedule Part 1 [Subsection 105(1)] 1. A dispute or complaint concerning an exercise or the performance of, or the failure to exercise or perform, a function, duty or power conferred or imposed by this Act or the by-laws, except for those specifically provided for in this Part. 2. Subject to subsection 16N(2) of the Housing Development (Control and Licensing) Act 1966 [Act 118], a dispute on costs or repairs in respect of a defect in a parcel, building or land intended for subdivision into parcels, or subdivided building or land, and its common property or limited common property. 3. A claim for the recovery of Charges, or contribution to the sinking fund, or any amount which is declared by the provisions of this Act as a debt.

4. A claim for an order to convene a general meeting. 5. A claim for an order to invalidate proceedings of meeting where any provision of the Act has been contravened. 6. A claim for an order to nullify a resolution where voting rights has been denied or where due notice has not been given.

ORDERS OF THE TRIBUNAL [Subsection 117(3)] The Tribunal may order a party to the proceedings to 1. pay a sum of money to another party. 2. The Tribunal may order the price or other consideration paid by a party to be refunded to that party. 3. The Tribunal may order the payment of compensation or damages for any loss or damage suffered by a party. 4. The Tribunal may order the rectification, setting aside or variation of a contract or additional by-laws, wholly or in part. 5. The Tribunal may order costs to or against any party to be paid. 6. The Tribunal may order interest to be paid on any sum or monetary award at a rate not exceeding eight per centum per annum. 7. The Tribunal may dismiss a claim which it considers to be frivolous or vexatious. 8. The Tribunal may make any order of which it has the jurisdiction to make under Part 1 of this Schedule or any other order as it deems just and expedient. 9. The Tribunal may make such ancillary or consequential orders or relief as may be necessary to give effect to any order made by the Tribunal. Strata unit owners are advised to get acquainted with the proposed SMA as well as its rules and by-laws governing sub-divided buildings. This is the sixth article on strata management. The Effect of Changing Interest Rates
Changes to interest rates are something borrowers need to be aware of and keep up to date on as this affects their mortgages and loans. At its monetary policy committee (MPC) meeting on 10th July 2014, Bank Negara Malaysia (BNM) decided to raise the Overnight Policy Rate (OPR) for the first time since March 2011 by 25 basis points to 3.25 percent. Real interest rates are the ones you get from your bank when you purchase a property or take out a credit card. If the real interest rate is low, the costs of living, doing business and investing are also low which stimulates the economy. Low real interest rates also generally weaken the ringgit in currency exchange terms, which in the short term can be a good thing.
However, BNM cannot simply keep interest rates or the OPR low as this also leads to inflation. When inflation increases, economic growth begins to slow and the prices of goods increase with demand for it waning as a result. Less demand leads to less production and eventually the unemployment rate will increase. To offset inflation, BNM must raise interest rates which can strengthen the ringgit and attract foreign investors looking for high-yield returns on their investments. This causes more demand for the ringgit, increasing its value, which will ultimately slow foreign investment since it takes more foreign currency to purchase a ringgit. However, a stronger ringgit has more buying power worldwide which makes it easier for Malaysians to purchase foreign goods and invest in foreign companies. The existence of interest allows borrowers to spend money immediately instead of saving money for years to make a purchase. The lower the interest rate, the more willing people are to borrow money to make big purchases such as houses or cars. When consumers pay less in interest, this gives them more money to spend which can create a ripple effect of increased spending throughout the economy.

Due to more affordable technology being available and the value of many homes nowadays, fire alarm systems are an important part of a residential security plan. Furthermore, with break-ins becoming ever so rampant, installing security systems is a measure that can prevent an extremely hostile situation. These steps may be precautionary and reliable, but where do you begin when you’re looking to enforce your home and protect it from danger? Here are a few key points to look out for when installing burglar and fire alarms. SECURITY ALARMS i) Securing the perimeter If you are living in a relatively large home, you will most definitely need extra reinforcement. While it is true that a single security alarm is enough to alert the authorities, multiple entry points make it easy for those targeting your home. If you have a backdoor that leads straight into your home, it is advisable that you hook up connecting systems from the main entrance as well as the back door.

ii) Place it wisely While it is important to place them at every entry point, it is best to fix them slightly further from the entrance to avoid damage during potential break-ins. These small but effective mechanisms are highly sensitive and even simple smoke from daily cooking may trigger them. iii) Maintenance Caring for smoke alarms is extremely simple. Be sure to check the batteries every so often and replace them every 10 years or so. iv) Find one that fits you Be sure to get smoke and fire alarms that are all connected, so you can hear the beeping no matter which part of the house you may be in at the time of the potential fire. For those who are hard of hearing, there are options that offer strobe lights to accompany the sound. In light of all this, you should stop waiting and living in fear. Simple fixtures can help elevate the level of safety and security in your home.
