Property financing question How do I know what is the maximum loan I can get based on my monthly income? Let’s assume that my gross income is RM2,500 and I would like to plan to buy a residential property in the near future but do not know what I can afford. With an average monthly income of RM2,500, monthly repayment instalment would be something like RM850 per month and you would qualified for a RM130,000 loan amount for financing purchase of the property, the MRTA premium and/or any other related expenses. With assumption no other commitments and the Margin of Repayment is 35% of gross monthly income. Repayment amount should generally not exceed 1/3 of gross monthly income. As the general rules, most house buyers will budget a purchase cost between 1.5-2.5 times their annual incomes. For example, a house buyer earning RM40,000 a year would buy a house that cost between RM60k to RM100k. I recently took a home loan of RM183,000 for 30 years to buy a new condominium. I am currently paying the loan interest while waiting for the development to be completed. Once completed, I need to make monthly loan repayments of RM850. What happens if I should pay more every month, maybe RM1,000 instead of RM850? Does it reduce the loan interest and does it mean that I am saving money? For normal home loan, interest is calculated based on the daily outstanding in the loan account and it is compounded or rested into the principal balance at the last day of each month. If you are paying more or extra every month, you should save the loan interest that charged into loan account as the low balance outstanding will be compounded daily. Therefore, if you pay extra, ultimately there is saving element in interest rate calculation. What are the differences between BLR, KLIBOR and Fixed Rate home mortgages and how does it affect my loan repayment in the future? BLR is more stable as compared to KLIBOR which fluctuates every day is more volatile and subject to market forces as the KLIBOR is change for every three months. Fixed rate is suitable for customer who looks for rate stability and sustainable cash flow during the initial years of property purchase/new business start-up. I find the articles by the House Buyers Association (HBA) thought provoking and yet frustrating at the same time. I firmly believe that the law should protect property buyers better from errant developers. Escalating property prices and laggard income levels makes it hard enough for us to buy our first property, and many of us can ill afford to lose our hard-earned savings due to abandoned projects. It makes it even harder to swallow that these developers get off scott-free. I think that the Build-then-Sell (BTS) scheme should be made mandatory so that us house buyers will never need to subscribe to empty promises by developers ever again. - Richard Loo Let us hope that the government will listen to this call and make it more favourable for property buyers.

SELLING SHAH ALAM Lebar Daun Development Sdn Bhd has a solid foothold in Shah Alam, being the developer of Bukit Bandaraya and D’Kayangan townships. Their properties have enjoyed fair success helped by a location that was described as peaceful and highly desirable by the developer. iProperty.com speaks to Lebar Daun Development’s executive director Noorazhar bin Mohamed Nurdin as well as senior manager (Sales and Marketing) Arman Putera bin Asmuni. “People who fall in love with Shah Alam will buy a property Shah Alam,” said Noorazhar bin Mohamed Nurdin, executive director of Lebar Daun Development Sdn Bhd. He opined that Shah Alam is for those who love living in a peaceful environment, away from the hustle and bustle of the city but yet still close enough. Malaysia’s first planned city after independence, Shah Alam is described by Noorazhar as a place free from unsavoury elements like bad traffic as there are no entertainment centres there. “There are no clubs, bars or even cinemas in Shah Alam but should there be ever a need to catch a movie, one could still find them in nearby Subang, Sunway or even Klang which are just a few minutes away. D’Kayangan The developer’s flagship township, D’Kayangan will offer its final residential offerings by end of 2010. Occupying a land area of 163 acres, the township’s residential offerings are designed with a fusion of both modern and practical elements to create a modern living environment. The residential mix in D’Kayangan comprises of superlink houses, semi-detached houses, cluster homes, a retail mall and shop offices. Once all the residential projects are launched, the developer will start on the commercial products there. Firstly, D’Kayangan is located right smack in the middle of the commercial city centre of Shah Alam. There were property launches in D’Kayangan in January and February this year and both saw a take-up of more than 50 per cent. The February launch was Casa Arianna lakefront twin villas which according to Arman, look like bungalows as they are only connected at the back. The twin villas are priced from RM1.5 million onwards. Arman said, “In January we launched Arabella hyperlink homes. We call them hyperlink because the homes are built on lot sizes of 28ft x 80ft. Superlink homes are only 24ft wide. Apart from its luxurious width, another unique feature is that type A of Arabella looks like a semi-detached with a garden courtyard at the side, even for intermediate units. The homes are only linked at the back portion, so we can do that. “In regular link homes, usually the dining and upper living areas do not get natural lighting. This is not the case for Arabella type A homes as the side garden courtyard lets in direct sunlight and ventilation which makes it a better living environment.” There are four more residential launches slated for D’Kayangan this year and after that there will only be commercial offerings. According to Arman, 30 acres of the commercial plot of D’Kayangan has been purchased by a major lifestyle retailer. To attract property buyers, Lebar Daun Development is working with banks to offer a special deal that allows purchasers to pay only three per cent of the purchase price until the property is handed over. “This promotional package gives buyers, especially upgraders the flexibility of not having to service two payments (rental or loan) at the same time. When their new home at D’Kayangan is ready, they can sell off or stop renting their old home and have only one loan to pay for,” said Arman.

Leasehold versus freehold D’Kayangan is a leasehold township and Arman said that this only proves to show that the land value is recognised. “Leasehold land is worth more as they are located in prime location and in D’Kayangan’s case, it is the city centre. Freehold property prices are higher, but I say that leasehold property has more value due to its location,” opined Arman. He added, “At the end of the lease, there is a chance that it can be renewed. If the state government wants to take it back, there is compensation, so buyers do not lose out.”

Upcoming launches Apart from the launches at D’Kayangan, Lebar Daun Development has another seven project launches this year valued at a total of RM500 million gross development value. In Seksyen 14 Shah Alam will be serviced apartments to be built on 7 acres. There will also be a launch in Alam Nusantara, Setia Alam. Meanwhile, another five launches are slated for their 300 acres Bukit Bandaraya township. Out of Shah Alam, there will be a launch in Taman Dato’ Demang, Puchong. Noorazhar said, “Our strategy during the economic crisis was to continue launching products when some would have deferred their launches. This has worked well for Lebar Daun Development as we now have ready products for sale when the market picks up.”

Residents are treated to a myriad of activities, from cooking classes to tea parties, free shuttle within the Mont’Kiara vicinity to road trips, round-the-clock security; that it makes one wonder why aren’t we living there yet? iProperty.com speaks to Sunrise Berhad’s assistant general manager (Branding and Community Development), Anne Tong on Mont’Kiara and the developer’s recent move to venture beyond it.

Property developer Sunrise Berhad (Sunrise) does not just build properties but is also actively involved in community development. Their engagement with its customers does not end in a trickle after the delivery of properties as the developer continues improving the lifestyle at Sunrise Mont’Kiara making it into a highly liveable environment. “Over the last four years, we have focused and invested more heavily on community enhancement. We want to consciously differentiate Sunrise Mont’Kiara from the rest of Mont’Kiara and make it the preferred residential address,” said Anne Tong, Sunrise Berhad’s assistant general manager (Branding and Community Development). She explained that apart from investing in improving infrastructure and security, Sunrise has invested heavily in its Sunrise Fun Zone and Sunrise Sports Zone community centres where there are regular scheduled activities exclusive for their residents.

At Sunrise Fun Zone, family-oriented activities and fun activities for children are a regular feature. From monthly themed birthday parties to excursions to places of interest like a recent visit to a fruit orchard, it is a place where residents can do things together and also experience diverse cultures. Anne revealed that there is a book corner, cooking zone, arts and crafts, indoor play gym for children and a few more features at the Sunrise Fun Zone. “Every three months we hold a tea party to welcome new residents. We hold an orientation service to let our residents know where they can do their shopping, dining and how to get around,” added Anne. Meanwhile, the Sunrise Sports Zone caters to under-16 youths. There are sporting facilities and activities such as football, futsal, basketball, volleyball and handball. The services offered at the community centres are free for Sunrise residents. Anne added, “Last year we launched our Sunrise free shuttle service, which runs loops all around Mont’Kiara and will include Solaris Dutamas. This is a first for a local developer, and is exclusively for the use of our residents.” Sunrise surely knows the demographics of its residents and their needs well. The launch of the free shuttle service help residents to get around Mont’Kiara for shopping, dining and visiting friends easily and it is a popular service for the expatriates that live there.

She highlighted that there are also now more locals and young families moving in as compared to last time when there were more expatriates. It was also revealed that newer units above 3,000 sq ft are favoured by Malaysians while older residential condominiums, like Palma are tenanted to expatriates. She further added that 60 per cent of Sunrise customers are repeat buyers or were referred by customers. Anne added, “The widening of product and customer range is important, as we cannot just depend on an expat or rental market. Mont’Kiara now have a wider range of products to suit different markets – from small units for singles and couples to large bungalows in the sky.” When asked about listing down the pull factor of Sunrise Mont’Kiara, Anne attributed its appeal to the good infrastructure, secure environment, easy accessibility and community effort. Interestingly enough, Sunrise has Japanese and Korean liaison persons to help serve their Japanese and Korean residents. Anne said, “There are 38 cameras installed along Jalan Kiara, Jalan Kiara 1 and Jalan Kiara 2 which are monitored round-the-clock by Sunrise. We have regular 24-hour patrols in the area and guard dogs at night, “Within the Bukit Kiara suburb, we have three international schools, a large number of national schools, parks, two golf courses, an equestrian park, and several shopping and commercial centres. Basically, we have all the facilities

and infrastructure in place for a conducive, comfortable and secured living environment. “When we first started Mont’Kiara, our focus was on residential properties. We then went on to expand our product offerings and create a more integrated community by adding commercial components, starting with Plaza Mont’Kiara in 1999 and Solaris Mont’Kiara in 2007 and our latest project, Solaris Dutamas.” Solaris Dutamas is Sunrise’s first integrated commercial-residential development comprising a retail mall, shop offices, office suites and service apartments. It is due for completion this year and is supported by an environmentally friendly district cooling system which helps create a nicer and cooler environment. Sunrise invested RM90 million in the cooling system which is also in commercial projects like the Kuala Lumpur International Airport and the Petronas Twin Towers.

Sunrise’s latest developments Sunrise’s latest residential launch is 28 Mont’Kiara. Launched in January this year, the project comprises luxury condominium units sized from 2,535 to 3,000 sq ft with private lifts. It has a financing scheme where buyers need to pay only 10 per cent down payment, and no further payment for the next five years – three years of construction and two years after completion. There are 460 units and the take-up rate so far is 50 per cent. “This is a very attractive financing scheme that we pioneered and first introduced for 11 Mont’Kiara. The extra two years after completion allows buyers to enjoy even better capital appreciation prospects or rental yields from a relatively small upfront capital outlay,” said Anne. Sunrise had also recently announced that they will be developing another two residential projects in Mont’Kiara - MK20 and MK22 (residential and mixed) but details are not available yet.

The developer has over 80 acres left in the Mont’Kiara vicinity for future development.

Anne said that there is a strong housing demand in Richmond and the area can deliver high yields with a low vacancy rate of less than five per cent. Sunrise’s project is located along Road 3, has a train line and is only about 10 minutes to Vancouver city.

Venturing beyond of Mont’Kiara During an analyst briefing early this year, Sunrise announced that it is venturing beyond Mont’Kiara as a move needed to grow the company’s sales figures. Around the same time, Sunrise revealed that it is the joint-venture partner for Sime Darby’s RM1 billion gross development value (GDV) mixed commercial project in Bukit Jelutong Shah Alam.

On Sunrise’s strategy beyond Mont’Kiara, Anne answered, “We will leverage on our experience, expertise and branding in our new ventures. Every location is different and will have different challenges. We cannot always use the same one-size fits all blueprint for all. But we will have a common guiding principal for all our projects, that is to constantly create value for our buyers.”

The developer also has lined up the Solaris Towers Kuala Lumpur, a strata office tower project off Jalan Sultan Ismail and just behind the Renaissance hotel in Kuala Lumpur. The project consists of two office towers with a net saleable area of 570,000 sq ft.

Looking Ahead On the 2010 property market, Anne shared, “The recovering economy, improving confidence and the wealth effect from the stock market rally in 2009 has boosted sentiment for properties. Homebuyers have also been attracted by attractive financing schemes and low interest rates while banks have been very supportive, as shown by the strong growth in mortgage loan approvals.

Anne revealed, “This will be a potentially exciting new product. There is currently a lack of quality strata office space in Kuala Lumpur, as opposed to purpose built offices for corporations and leasing. Thus, the project will offer a rare opportunity for businesses to own, instead of rent, their own prime office space; and there is a wide range of sizes to suit different needs. “The occupancy rates for downtown Kuala Lumpur office space remain high and rental yields here are much better than for downtown condominiums.” She added that Sunrise has already received some offers to buy the towers enbloc and is presently considering the offers. In Richmond, Canada, Sunrise will have its first major overseas venture which will be launched in the third quarter of this year. It is a 4.8 acre residential development that will be split into two phases that are three years apart. Small units of about 600 to 700 sq ft are planned and there is already a tie up with a Canadian university to take-up some of the units.

“We expect this to continue in 2010 as the economic recovery gains strength and fiscal and monetary policies remain accommodative. With the huge global fiscal and monetary expansions, one should be wary of inflation going forward, and property has historically been a good hedge.”

Is it time to buy properties near the newly proposed LRT extensions? The availability of public transportation will drive property values up. That statement is a given, but just how far up will property prices go? iProperty.com takes a quick look at property prices near the newly announced Light Rail Transit extensions to see gauge the impact. The government announced that two of Klang Valley’s light rail transit (LRT) lines, the Kelana Jaya and Ampang LRT lines, would be extended by 17km and 17.7km respectively. The proposed extensions would benefit Lembah Subang, Subang Jaya, USJ, Putra Heights, Bandar Kinrara and Puchong once it is completed, which was estimated to be by 2012. According to the proposal, the Kelana Jaya LRT extension will link the existing Kelana Jaya Station to Putra Heights, passing through Subang Jaya. The LRT advantage Properties located within the proximity of LRT stations enjoy fair capital gains and higher rental yields, as long as they are located within a fair distance away. Residential properties that directly face the stations, however, are not as desirable as the units further in. There is also concern of traffic congestion around the area. Chan Ai Cheng, general manager of S.K. Brothers Realty (M) Sdn Bhd opined that the proximity of LRT services is definitely a plus point to properties nearby as it is a convenient and fast alternative mode of transportation. She said, “Presently in Petaling Jaya (PJ), we can see the number of buyers outweighing the number of units in the market for sale at the Amcorp Service Suites. Owners there are most happy with the returns as some are as high as 15 per cent per annum based on the current rental rates and their purchase price. “Those who purchased the units in the secondary market are still enjoying above 8 per cent per annum returns. Millennium Square in Section 14 PJ has also enjoyed good occupancy. A project completing soon, Paramount View being located next to the Paramount LRT station will stand to benefit from the from the easy access to the LRT services.” Ai Cheng added that the Amcorp Service Suites had enjoyed capital appreciation. The developer’s price was RM270 per sq ft and today’s price is RM550 per sq ft. Rentals when it completed was RM1,200 per month for a fully furnished unit but today’s asking rentals are RM1,800 per month.

Ai Cheng advised that property buyers having LRT service close by will enhance values but the property must be the right distance away. “Should the property be located too close, then the noise factor and aesthetics may be affected. You want to be just the right distance away,” she added. She further added that the main factors property buyers look for always come back to location, affordability and the type of property. She opined that public transportation is important to a select group of people as not all use public transportation to commute, whether they are owners themselves or potential tenants. Joseph Kong, real estate agent from Putra Realty shared the same view that properties near LRT stations have its advantages.

He said, “It (LRT stations) will improve property value and rental demand. People prefer LRT service to bus service as the former is more predictable and practical. We have customers who ask about the availability of public transportation and it is an important question. Meanwhile, property investors are looking at areas with LRT stations as they generally have higher rental yields.”

Kong shared that property prices have improved like for Bangsar South’s new commercial area and the recent announcement that there will be a new walkway joining to Pantai LRT station is a boon. He added that rental rates at Amcorp now fetch RM4 to RM4.50 per sq ft, which is good as it is an old property. Kong added, “Two to three years back, PJS, which is located right next to Amcorp Mall, was selling at about RM450 to RM500 per sq ft. Now prices can go up to RM650 per sq ft. Another example would be Menara UOA in Bangsar which is located relatively close to LRT. In the last three years, there was a capital gain of 30 per cent. Back then, you can buy a unit at around RM700 per sq ft but now prices are going at about RM900 to RM950 per sq ft. As for properties located near LRT lines, their values will depend on the availability of feeder buses.” According to Kong, the announcement of LRT extensions had drawn higher interest in Putra Heights, Subang Jaya and USJ properties. He further added that prices have also gone up in those areas. “It is a good time to buy properties in the areas with the proposed LRT extensions now, barring any about turn by the authorities. By the time the stations and tracks are seen being built, property prices would have gone up much higher and it will be too late,” advised Kong. Meanwhile, prices of properties in USJ and Subang Jaya area have jumped up very much as according to Onesimus Kam, general manager of Assure Properties. USJ is one of the specialty areas of the real estate agency.

Kam quoted a few transacted examples, “Back in June 2009, a basic non renovated 20ft x 60ft terrace unit (in USJ) was selling for RM235,000 and below. It recently transacted for RM290,000. In USJ 13, a unit with an extended kitchen was selling for RM250,000 to RM260,000, two months ago it was sold at RM310,000. A basic 22ft x 75ft unit in USJ 11 was selling for RM360,000 to RM370,000, now it is going for more than RM400,000.” He gave a few more examples of which prices generally appreciated 20 per cent and more. He further commented that the reality of the sudden increase of prices had not sunk in yet, and everyone, bankers included, were surprised. “The increase in property prices started close to Hari Raya last year which was after the announcement of the LRT extensions. Some property owners of Rhythm Avenue serviced condominium in USJ 19 have decided to hold back their sale after the announcement too.” Kam commented that while prices of properties near the proposed LRT extensions have gone up, their rental values have remained the same. He said that this is because the rental market is only affected by the current situation and the LRT extensions are not built yet. However, rental prices will go up when the stations are completed. Kam cautioned that although having an LRT service near is good, there are two sides to the coin. He said, “We want it to be near but not right in front. Properties right in front of stations are not in demand and those that are just within walking distance are ideal. Residential properties that are facing highways and LRT stations should be allowed to convert to commercial as their demand are low.”

What’s going on in the property market so far

Ai Cheng, Kong and Kam were upbeat when asked on their views of the property market in 2010. Ai Cheng said that certain locations, type of development and developer will always enjoy good take up.

She added, “In the secondary market, established neighbourhoods like Damansara Heights and Petaling Jaya will continue to hold its value and remain resilient. As for properties in the KLCC,

they appear to be on an upward trend.” Kong shares a similar view as he said, “The property market is good and it is based on location. Prime areas will always enjoy high demand for example landed properties in Petaling Jaya. Areas neighbouring Petaling Jaya like Subang 2, Sri Damansara and Kota Damansara will also benefit from this demand. He said, “Six months ago, prices of some terrace houses in Bandar Utama were about RM530,000 to RM560,000. Now they are going for about RM700,000. Hence there is a spill over effect on the neighbouring Kota Damansara and prices of similar homes are going for RM500,000 to RM600,000.” Kong also anticipated that properties in Subang Jaya, USJ and Sunway will start to pick up. He commented, “For the past 10 years, prices have not changed much, but it will now due to the many colleges in the area and the proposed LRT stations.” Meanwhile, Kam said that the reintroduction of the Real Property Gains Tax (RPGT) did not have much effect on property owners. Kam said, “Now that the guidelines are clearer, there are no more worries for property owners. They now sell higher to cover the RPGT cost. “It is a good year so far and prices of a lot of properties have gone up. There is room for pries to go up further.” Kam quoted some examples like Indah Residences where prices went up around the same time as property prices in USJ. He said that 22ft x 70ft double-storey terraces were priced about RM310,000 to RM320,000 in June last year and prices went up to RM380,000 near Hari Raya before shooting up to around RM448,000 recently. “Prices of properties near Subang Parade in Subang Jaya are also seeing good rental returns. A Subang Avenue 1021 sq ft fully furnished two-room condominium unit was just rented out for RM2,600 per month. The owner was offered RM400,000 by a buyer but did not want to sell. A medium floor unit there can range from RM360,000 to RM370,000 and if we take the rental of RM2,600, that’s a rental yield of 8.6 per cent. “Properties along the Subang Parade stretch like Subang Avenue, Saujana Residency and Empire Gallery are good helped by the colleges nearby, blue collar workers around the area and the KTM station there. Furthermore, there is a proposed LRT station to be built in the area.”

Special Focus Penang

Building Green Homes Penang was the first state to launch a plan to turn green. After a successful ‘No Plastic Bag’ campaign which was later adopted by the Selangor Government, Penang has been steadily turning its attention to Green Buildings.

‘No Plastic Mondays’ was launched by the state government to turn Penang into the country’s first green state in July last year. But little was heard then about the Green Building Index (GBI) which was officiated just two months prior to the campaign. However, the momentum has gradually increased and now more interested parties are taking the GBI seriously.

Paint it Green Talk about green buildings and the first image that comes to mind is that of a green coloured office block. Rather than a gaudily coloured block, green buildings are actually environmentally friendly structures. The concept of a green building promotes the use of energy-saving materials and fittings while building on a design that minimizes energy usage throughout the day. By integrating green buildings with several programmes introduced by the Penang state government to reduce carbon emission such as waste reduction, tree-planting, river cleaning and a transportation master plan; the state is taking yet another step towards a more environmentally friendly stand.

Making the State of affairs Green In May 2009, the Penang state government once again made the other states turn green with envy as it became the first to actively promote the construction of green buildings. By encouraging more developers to meet the GBI, Penang has taken yet another step towards being Malaysia’s first green state. YAB Lim Guan Eng, Chief Minister of Penang in his speech during the Malaysia Green Building Index Forum in July last year said, “Just like green rating tools in other countries, such as LEED (the United States and Canada), Energy Star (US), BREEAM (Britain), CASBEE (Japan), Green Star (Australia), Green Mark (Singapore), and Greenship which is being developed in

Indonesia, GBI is being set as a voluntary effort to keep natural resources sustainable and to combat climate change and global warming”. He also added, “The rating system will provide opportunity for developers to design and construct green, sustainable buildings that can provide energy savings, water savings, a healthier indoor environment, better connectivity to public transport and the adoption of recycling and greenery for their projects”. With better energy efficiency, Penang can then focus on using its resources to further improve other areas in the state.

Pruning New Projects Penang is constantly in a state of development. With new projects being launched almost every other month, the state is considering imposing the GBI rating as a criterion for several upcoming development projects. Chief Minister YAB Lim Guan Eng said, “There are certain prime sites that the state is planning to open for bidding and tender (for projects). We are considering adding a stipulation that these projects should be GBI accredited”. He further adds, “Personally, I support the GBI initiative to ensure that buildings are more sustainable and energy efficient”. Although the state refuses to disclose which of the upcoming projects will come under this

new initiative, it is speculated that the Bayan Mutiara medical hub and the proposed Meetings, Incentives, Convention and Exhibition (MICE) centre would be the likely targets.

Sprouting the Effort While the state debates about which project to turn green, private developers have already taken their own steps towards implementing an eco-friendly approach to their own projects. IJM Land Bhd is heading the pack with efforts to turn their celebrated The Light waterfront project into Penang’s first green development. 5% of its construction costs is said to be channeled into green-related technologies such as recycled pavers and composite timber. Other steps taken to promote a ‘greener’ workflow includes the reduction of materials instead of actively sourcing for recycled products and designing to allow for more natural lighting and cross-ventilation of structures. Rainwater harvesting is also said to be incorporated to reduce water consumption for landscape purposes. The first phase of The Light covers an area of 16.8ha which includes The Light Linear and The Light Point condominiums, both of which will be built according to GBI standards. Meanwhile, SP Setia has also taken up the green challenge by announcing that two of their upcoming projects are earmarked to be GBI-compliant. The Brook Residences development next to the Jesselton area and Ara Setia in Sungai Ara, measuring 0.8ha and 12ha respectively, are set to sprout in the near future. Boldly stepping into the green light, Penang has come far not only to promote, but to act upon making the state a much more environmentally friendly place to live and work in. Its efforts for the past year and a half has placed the state as an example of what a developing nation ought to adopt for a better quality of life.

Shopping In Johor As the world gets smaller and the people more discerning (and affluent!), Johor is only sealing its reputation even further as a shopping paradise for the 21st century.

or decades, Johor has been known as a shopping haven, and things are not changing in the Information Age. According to figures from the State’s Tourism and Domestic Trade Committee, shopping is still Johor’s secondbiggest source of revenue after accommodation, contributing RM13.3 million in 2008, compared to RM12.3 million in 2007. Says Committee chairman Hoo Seong Chang, Johor is popular with the Singaporeans, Indonesians and Chinese. In fact, Johor receives more visitors from Singapore and Indonesia than any other state in Malaysia. The Committee’s efforts include working on and supporting events aimed at increasing tourist arrivals and boosting revenue. These include the International Kite Festival, Desaru Pengerang International Triathlon, Johor-Singapore Second Link Bridge Run, Johor Baru International Orchid Festival, FIA Asia Pacific Rally Championship, World Scrabble Championship and – not to be forgotten – the Johor leg of the annual Malaysia Year End Sale.

Proud Tradition, Wide Variety By the end of last year, there were almost 50 shopping complexes and hypermarkets in the state capital of Johor Baru. “Old faithfuls” for shopping include Plaza Kotaraya, City Square, Holiday Plaza, ZON Shopping Complex, Plaza Pelangi and KOMTAR. New (Stylish) Kid on the Block These couple of years will see shopping in Johor boosted to the next level with premier new shopping centres in Johor. One highprofile outlet coming up in Iskandar Malaysia is a premium factory outlet centre targeted to attract about 4 million visitors a year. The outlet will be a joint venture between Chelsea Premium Outlets and Genting Group, and announced with much fanfare in New York by no less than the Prime Minister, Datuk Seri Najib Tun Razak. Construction will start early this year and is scheduled for completion by mid-2011. Chelsea Premium Outlets is owned by Chelsea Property Group – the world’s largest owner, developer and operator of upscale outlet centres in the United States, Japan and South Korea. “It is the first (Chelsea) centre in the (Asean) region and I’m very happy that they have chosen Malaysia,” Datuk Seri Najib said when announcing the outlet in November 2009. It was especially gratifying, given the the fact that other countries in the region had also been trying to woo the Chelsea Group. The outlet’s branch in New York offers just-off-season discounted items of designer brands like Coach, Gucci, Zegna, and Burberry, at prices between 25 per cent and 60 per cent cheaper.

Shop Till You Drop Another giant planting its foot in Iskandar Malaysia is not a shopping centre, but a 60-

acre “city” – the Asia Pacific Trade & Expo City (APTEC) in Iskandar Malaysia. This “one-stop sourcing and trade centre” is also targeted to begin construction this year, with full completion within eight years. Its developer Asia Pacific Trade & Expo City Sdn Bhd (APTEC SB) is a unit of Lakehill Resorts Development Sdn Bhd, of which 78% is owned by Malaysia Pacific Corp Bhd (MP Corp) and the remainder owned by AmanahRaya Bhd. In fact, the APTEC project will be surrounded by a mixed development undertaken by Lakehill. When complete, APTEC will have 2.5 million sq ft of exhibition space in four trade halls, retail malls, hotels (including a 50-storey five-star hotel), as well as offices and commercial units. MP Corp is now finalising joint-venture partners for APTEC, and has signed a letter of intent with a possible joint-venture partner from Thailand. Dividing up APTEC into 18-20 joint venture parcels is a move aimed at enabling different components within the project to take off simultaneously, without incurring an excessive financial burden on the company for this RM4 billion project, said MP Corp President and chief executive officer Datuk Bill C.P. Ch’ng. The entry of these and other globally renowned retail players into the market looks set to turn not just Johor, but in fact, Malaysia, into a shopping paradise for the world. Hopefully, this will also mean spillover benefits for the tourism industry industry in general and also lead to secondary business and economic activities for supporting industries.

I am quite happy with. However, apart from the loan, she told me that some of the banks required me to buy MRTA from them. Is this the usual practice? A: No, it is not necessary to buy MRTA or MLTA. Some banks highly recommend it as it ensures them that should anything untoward happen to the borrower, the mortgage can still be repaid. This not only protects the banks, but also protects the borrower from having to worry about repayments if they are unable to work due to serious injury or major illnesses. It also protects the borrower’s family as the mortgage can still be repaid and the property is protected. In your case, if you are not comfortable with the mortgage offer from the banks that attaches MRTA to the requirement, you can tell your agent to look for another that does not have that requirement. You might still want to look for a form of protection for your home though. A2: Some banks require you to take MRTA or MLTA as it reassures them that the mortgage will still be repaid should anything untoward happen to the borrower. However, before you subscribe to that, you will want to know what does the MRTA or MLTA cover as it is in actual fact, an insurance policy. But to answer your question, no, it is not compulsory to buy MRTA from the lender – you just need to shop around a little more for lenders without that requirement. A3: MRTA can be negotiated with the bank as what they want is really just collateral so that they can get paid if anything happens to you. If looked from another point-of-view, this form of insurance can be beneficial as it takes care of your mortgage should anything happen to you, at least leaving you or your family a possibly fully-paid for home. I am saying possibly because you must read your MRTA coverage carefully and see if it truly help protects you from the risks you are exposed to (it is like buying insurance) or if it can fully cover the mortgage plus interests. An alternative to MRTA is by having substantial life insurance that could cover all your liabilities in the event of death, disability, critical illnesses, accidents and such. You would not want your family end up without a home. I again stress, read the fine prints and make sure the cover say it does.



Back to Basics: Selling Your Property Selling your property can be complicated and time consuming. Problems can arise at any stage in the process, and may cause long delays. For example, the buyer may reduce their offer at the eleventh hour or even pull out before the signing of the Sale & Purchase Agreement, the conditions of the sale may not be agreeable to you, the buyer faces problems securing property financing or the property may be damaged before the completion date. Below is a quick step by step guide to selling your property: Step 1: Determine the price of your property There are a number of quick ways to determine the going price for your property. The quickest and easiest way is to check for asking prices of similar properties in your locality from classified advertisements in the daily newspapers or on the internet at popular property websites. The increasing numbers of property search websites have made it easier to secure asking prices data for comparison. There is a difference, however, between asking prices and what that property will eventually transact at. In most instances asking prices are higher than transacted prices. Property valuers are professionals in their field, authorised to produce reports on the rationale behind the value of your property at a particular time. You can use their service to determine the price of your property. Step 2: Choosing to work with an estate agent You have the option here to either market and sell the property on your own or to appoint a professional whose principal business is in assisting sellers to sell their property and to source for suitable premises for buyers or tenants. It is important to pick the right professional to undertake the marketing and sale of your property. Criteria should be based on the firm’s track record, the individual estate agent’s track record and their familiarity with the type of property and location where your property is located. It is always most effective to work with a local estate agent who specialises in a particular type of property or who focuses on a certain location. 58 |

Step 3: Appointing your solicitors It is advisable to appoint your solicitor at the same time as choosing your agent. In most instances, sellers only appoint a solicitor when they have secured an offer. Appointing one at the onset will help to avoid delays and allow time for the collection of necessary documentation involved in transferring ownership of your property to the new buyer. Whichever the timing, it is important that a solicitor is appointed by you to represent you in the transaction in case of any eventuality. Step 4: Marketing your property Get involved in the marketing of your property with your agent. This will include signboards, advertisements, flyers and the likes. Property search websites today prove to be new means of advertising at much reduced rates. Slowly and steadily the popularity of this option will increase as the computer literacy of the population increases. Signboards are one of the most effective tools to generate enquiries as interested parties who are looking at properties in the locality will contact you. Step 5: Viewings Most viewings are conducted in the evenings and on weekends as this is the time when prospective buyers are available. It is important that you prepare yourself and your property for viewings. Your property should be clean and neat, where possible to attract prospective buyers. Step 6: Accepting an offer If a buyer is interested in your property, the buyer may decide to make an offer to buy it. This is normally done through negotiation with your estate agent. The buyer does not necessarily have to offer the asking price, and the price you get when the sale is final may be different. If you are selling your property privately, the buyer will probably make the offer to you directly.

If you get a private offer but you have signed a contract with an estate agent, you may still have to pay professional fees depending on the kind of contract you have. If you are using an estate agent, the buyer will probably make an offer through the agent. You should be told about any realistic offer that is made. The estate agent may give you advice about whether the offer is reasonable, but it is up to you do decide whether to accept it or not. Many buyers will make an initial offer below the asking price, so you should expect to negotiate. However, when there is a lot of demand, some properties may eventually sell for more than the original asking price. The price you are likely to get usually depends on: • Whether property prices are rising • Whether your property is in a popular area • Whether the asking price is realistic compared to similar properties • How quickly the buyer wants to move Your estate agent should be able to give you an idea of what you have been offered is reasonable. However, it may also be worth doing some research to find out what similar properties in the area are selling for. If you do not want to sell for the price you are offered, you can ask the buyer if they are willing to make a higher offer, wait for another buyer, or make a ‘counter offer’ saying the minimum price you are prepared to accept. You can negotiate offers from more than one buyer, but you have to inform both buyers if you decide to do this. The buyers may be willing to compete for the property but there is also risk that one or more of them may pull out. Some estate agents ask buyers to pay an earnest deposit of between two to three per cent of the offered sum when they make an

offer and signs a Letter Of Offer to Purchase or an Agreement To Purchase. The estate agent normally keeps the earnest deposit in their clients account as stakeholders from the date the offer is made until the execution of the Sale & Purchase Agreement. Step 7: Drafting of the Sale & Purchase Agreement After accepting an offer, you (or your estate agent) will need to give your solicitor certain information to begin the legal preparation for the sale. You will need to confirm: • Your Details • Your Property Details • The buyer’s name, address and phone number • Contact details for the buyer’s solicitor • The price agreed • A list of any fixtures and fittings included in the price • And any other conditions of the sale

Step 8: Execution of the Sale & Purchase Agreement When the buyer executes the Sale & Purchase Agreement, the buyer will pay the balance of the first 10 per cent of the Purchase Price (less the earnest deposit). The documents will then be forwarded to you for execution and then stamped. Based on the standard terms in the Sale & Purchase Agreement, the balance 90 per

cent will be payable to you within three months from the date of the Sale & Purchase Agreement or three months from the date the Sale & Purchase Agreement becomes unconditional. The above is a quick summary of the selling process. There are a lot of other matters and details to each of the steps that you need to be aware of which we will cover in future articles.

Taking Risks in Investments and in Life There is a popular saying that you bring a horse to the water, but you cannot force it to drink. The horse will only drink when it wants to, especially when it is thirsty. Likewise, there are many people out there who are so afraid of taking a little risk to invest in properties that it can often be mind boggling at times. Even if you were to offer to bear all the risks on their behalf so that it becomes a zero risk investment for them, they will still decline the opportunity. My only guess is that they have not become hungry or thirsty for success. Let me share two real life cases I have come personally encountered. I have intentionally changed some details.

Lumpur through an agent who was very close to me. The location was great, the condominium was enjoying close to 100% occupancy with yields of over 8% per annum and the seller was willing to sell slightly below the going market rate. Being risk averse and I guess, not ‘thirsty’ at that time, Mr. A took a pass on it even when both me and my wife verbally ‘guaranteed’ the deal by telling him we were prepared to take over the property at any time. Our noble intention was to help get them started on the road to property investments as they did not even have a single property to their name. I hate to admit it but we were also afraid that they might approach us in future for financial help to educate their son.

Had Mr. A invested in that condominium, today he would have been enjoying a passive income of at least RM500 per month and he would not need to give tuition every night. Also the property value today less the outstanding loan would be around RM100,000. In another 10 years once the loan is fully settled, his passive income would be around RM1,500 per month and the property might easily be worth more than RM300,000. All Mr. A needed to do more than 10 years ago was come up with the small downpayment of around RM25,000 (which my friend had) and take a little risk by borrowing the rest (which he qualified for at that time). In fact, there was

Case 1 A childhood friend of mine, Mr. A and his wife run a small business and they barely make enough to makes ends meet. Every night they have to give tuition to supplement their income. They make around RM1,000 per month from tuition as the area they are staying is a poor neighbourhood. I don’t think they have more than RM20,000 in savings for their old age. Luckily for them, their 18 year old son who is their only child recently won a government scholarship to study overseas. Hopefully upon completion of his studies, their son will come back to Malaysia to take care of them financially in their old age. Until today, Mr. A and his wife have not even purchased their own home as they have been enjoying cheap rentals of RM300-500 per month for the last 30 plus years. Their logic was that it was always cheaper to rent than purchase their own home. Also, they did not want to have a burden of a housing loan over their heads. Had they bought a home and made additional payments to the bank, it would have been fully paid off by now. More than 10 years ago when Mr. A’s business was doing well, I gave him an opportunity to invest in a medium cost condominium in Kuala 60 |

actually no risk to him as I was prepared to take over in case he felt uncomfortable at any time. Today, my friend is over 50 years old and he can not borrow to the maximum like what he could have done more than 10 years ago. Had Mr. A tasted the fruits of one property investment, it is very likely that he will want more and more. For instance, a lot of my students are enjoying a passive income of more than RM10,000 per month on their property investments. And many of them are less than 45 years old!

Case 2 Another good friend of mine, Mr. B, recently bought a semi-detached bungalow in a gated and guarded community in the Klang valley for RM1.8 million. It was a great deal he could not turn down. He was extremely confident of being able to sell it for more than RM2.5 million within two years once the construction completed as similar properties in the neighbourhood were currently being transacted for around RM2.2 million. The expected net profit was estimated to be RM500,000. Since he had ‘max-ed’ out his property loans, instead of inviting his other friends in Malaysia, Mr. B decided to invite his younger brother (aged 35 years) who was working in Singapore to come in as a co-investor. His brother needed to standin as a guarantor for the property loan under Mr. B’s name. Mr. B was willing to pay for everything,

bear all the risks and give his brother profit sharing of 50 per cent. He did not mind giving away such a big share as he wanted to team up with his brother to invest in Singapore properties in the near future. Also, Mr. B wanted to help his younger brother get started in property investments as he was still single and staying alone in a rented apartment. Mr. B expected his brother to say yes because: • His brother had no intention to purchase any properties in Malaysia in the near future • There was little risk considering Mr. B already had over RM7 million in property loans. It was highly unlikely Mr. B, being a professional real estate investor, would default on any existing or new loans. • The time period of two to a maximum three years was not very long. • The 50 per cent profit sharing offered was very attractive. Guess what Mr. B’s brother said? He said, “I will give it a miss this time”! In a way, it was a blessing in disguise as Mr. B was able to invite another close friend based overseas into the deal at a much lower profit sharing rate. For Mr. B’s brother, I personally do not think there will be another time. Often when low-risk

high-return opportunities such as these come especially from your own family members or close trustworthy friends, you have to be daring and grab them. Assuming Mr. B does make a net profit of RM500,000 within two years, that money could have been used to start off their joint Singapore property investing journey or be reinvested into other Malaysian properties. After I related the story of Mr. A to Mr. B, Mr. B frankly told me that he sincerely hopes that his brother does not end up like Mr. A. For those of you who are in Mr. A or Mr. B’s brother position, my strong suggestion is to start taking some investment risks in your life preferably when you are still young and able to borrow for more than 20 years. Badly Flawed Argument by Minister (of Housing) by The National House Buyers Association

The Minister of Housing and Local Government, YB Dato Seri Kong Cho Ha was recently reported to have stated, “1345 developers and more than 5000 directors of such companies involved in problematic projects have been blacklisted.” The Minister further stated that many developers were fined for not conforming to the Housing Development Act. Our questions are: 1. How many cases are there where such fines were imposed? 2. What good is it to those hundreds of thousands of innocent house buyers who have paid a lot of money and who have not been delivered their dream houses due to project abandonment? Would it alleviate their problem with their Banks? and 3. Has prosecution of every one of those errant developers, where their projects have been abandoned, been initiated? The Minister also stated that there are 135 abandoned projects in the country and thinks that the number is not high. It is because the figure is down played and is not reflective of the prevailing conditions. Perhaps, it is done to achieve their Key Performing Index (KPI). What about those presently ‘problematic’? How many of these 1345 problematic projects are likely to ‘mature’ into abandonment? How many buyers are involved? The figures will obviously haunt and shock us all.

Empowering buyers with information Recent revelations has shown that despite the stringent Housing Development Act, the industry is still flushed with 1345 rogue developers (as compared to 695 rogue ones, some four years ago) posing 62 |

serious threats to naïve and unwary house buyers. This figure is of quite a magnitude in relation to the number of developers. Hence, there is a crucial need for an avenue where potential house buyers can check on developers before they embark on any purchase. The HBA has suggested that the Ministry’s elaborate website seems to be the best avenue to post such information of those errant developers that have defied the Awards of the Housing Tribunal; those taken to task and under the process of prosecution; those having breached the housing act and its regulations and the worst of which those who leave behind

a trial of abandoned housing projects. However, differing views on the legality aspect prevented so. The other issues also entail the extent of publication that should be made available to the public at large. The compilation of a database will keep the public informed about rogue developers taken to task by the Ministry and the house buyers will be able to stay clear of such errant developers with defaulting records. BTS 10:90 Concept There is a hybrid system called the Build-ThenSell 10-90 (BTS 10-90) system. In the BTS 10-90, buyers pay 10 per cent upon signing the Sales and Purchase Agreements. The balance 90 per cent is payable when the houses are completed. United Kingdom, Singapore, New Zealand, Australia and even Thailand have successfully adopted various variations of this mode. The common criteria being developers are not paid before they deliver their houses. This is the system that the government is encouraging and of which developers are reluctant to adopt. This shows that mere encouragement is simply not enough. Developers would naturally insist on continuing with the present Sell-Then-Build (Progressive payment method) to stay in the comfort zone. This is because house buyers’ funds (mainly through their housing loans) are being utilized for the construction. House buyers also carry the business risks which they should not. Business risks should be totally shouldered by business proprietors and not their customers. House buyers are merely customers.

Minister’s flawed argument The Minister seems to think that the big boys use their own funds to build houses and that only the small developers rely on bank loans to support their business. In reality, it is the banks that finance the building industry. Few developers big or small utilise their own in house funds to

build houses to sell. This has to do with taxation, leveraging, etc. In the present scenario, the banks are lending to house buyers (through the housing loans) and these housing loans are used to pay developers as they build (ie, the progressive payments). There seems to be a muddle up

Developers and more than 5000 directors of such companies involved in problematic projects have been between corporate financing and retail financing and this is the root cause of the problem. When a project (business) fails, everybody is in trouble, the worst being the customers (house buyers). The bridging financing banks are in trouble

because the collaterals are fragmented when the liens are being progressively transferred to the end-financing banks after sales. The end-financing banks are in trouble because the abandoned houses have no cashable value when the buyers default in payment. The premise that only big developers are cashrich and can adopt the BTS 10-90 by the use their in house funds to build houses and that small developers must rely on banks to support their construction, is badly flawed. Both parties rely on bank financing for their businesses and the Association of Bankers have repeated stressed that banks do not simply look at the mode of delivery (either BTS or STB 10-90) but more on viability. Thus it is not true that if the BTS 10-90 is implemented, the property market will be limited to the big boys or that they will monopolise the business. Big boys can do big projects whilst small boys should do small projects or they can simply phase out their big projects. We conclude that the Minister is ill advised.

When will they learn? Our caring government of the day should adopt a time-line for the phasing out of the disorderly and hazardous Sell-Then-Build system and the adoption of the orderly Build-Then-Sell 10-90 system. Short of that, there will be no end to the problem of innocent house buyers being caught in situations of paying and not getting their houses. This abandoned housing projects issue will continue to haunt us all until and unless the government closes the floodgate by imposing BTS 10:90 mandatorily.
