Food For Thought “Oil prices rise again on further Libyan fighting”, prompting warnings of a 1970s-style oil shock. This couldn’t have come at a worse time for Malaysia as it braces for a general election around the corner. To raise or not the petrol price at this point in time is a question that many are eager to know as it has wide repercussions. While the incumbent government struggles with this dilemma, confidence is slightly dented compared to the beginning of the year when no such problem was in sight and developers were reporting record profits for 2010.

Combine this with the controversy surrounding the proposed MRT project which is attracting a fair amount of detractors who quibbled not so much with regards to its existence but more to the positioning of the stations. Comparisons were made, justifiably so, to the logicdefying positioning of the present LRT stations. As usual, there were calls that the MRT should not be rushed without proper traffic impact assessments done and proper consideration of the impact of its positioning.

Such being the current scenario, how would this impact the property market going forward? I would be a very rich property guru or investor if I knew exactly what the answer is. Suffice to say, the market is currently flushed with a lot liquidity and it would take some time before the effects of increasing oil price take its toll. Some food for thought here. Meanwhile, it’s interesting to note that visits to online banking sites across Southeast Asia experienced double-digit growth last year with Malaysia climbing 16% to 2.7 mil visitors in Jan 2011. At the same time, visits to iProperty.com network of local websites reached an all-time high traffic of over 750,000 visits, double the numbers for January 2010. A possible conclusion is that more Malaysians are relying on the Internet for their banking and house-hunting needs. Some more food for thought here.

Mah Sing – Rise of an Icon In an exclusive interview with iProperty.com.my, Mah Sing Group Bhd’s Group Chief Executive and Group MD Tan Sri Dato’ Sri Leong Hoy Kum gives an account of Mah Sing’s meteoric rise from a plastic trading house to one of the most admired developers in Malaysia, winning numerous accolades.

iProperty: Tell us how you came to the decision to venture into property development? What inspired you or was it a purely business decision? LeongHoyKum: Mah Sing Group Berhad started out as a plastic trading house, went on to be listed on the Second Board of the Kuala Lumpur Stock Exchange in 1992, re-designated to the property sector in 2000 culminating in its transfer to the Main Board of Bursa Malaysia Securities in 2004. I’ve always had the vision to grow the company into one of the top in the business. After establishing Mah Sing as an industry leader in the plastics business, I looked for ways and means to increase and enhance shareholders’ value. Through my satisfaction in personal investments and passion in designing my own home, I decided to venture into property development in 1994. At that time, the property sector was going through an up cycle and I saw the potential of improving shareholders’ value through property development. The company emphasizes on maximizing returns to the shareholders and it is through this philosophy that Mah Sing has grown from strength to strength since 1994. The initial years were learning years for us and our capital base was small. We have performed especially well in the past seven years where our revenue rose by more than 4 folds to RM701.6 mil, and net profit grew nearly 18 folds to RM94.3 mil up to 31 December 2009. This is a healthy compounded annual net profit growth rate of 51%. Since we ventured into property development, we have received over 30 international and domestic awards in recognition of our outstanding corporate performance and products. It has taken us years to be what we are today and our success is a collective effort. It may sound simple, but a lot of research and commitment are needed to ensure that the product fits buyers’ needs and aspirations, at a price tag that they can afford.

An important lesson learnt is to continuously strive for better results. We must always remind ourselves to be humble so that we do not get carried away during our voyage. This is how we have grown from strength to strength and our balance sheet has stayed very healthy for further expansion.

We have also moved from Johor Bahru to Klang Valley (Greater KL) and now Penang island, as we wanted to establish ourselves in the 3 property hotspots in Malaysia. Most of the property transactions take place in these locations and we want to capture the market share.

iP: What were your initial difficulties and how did you overcome them? LHK: We had a steep learning curve in the beginning. When we first started, we did not have a strong balance sheet, nor a large landbank. To overcome this, we adopted a quick turnaround strategy which helped us to be capital efficient as we rolled over our capital and balance sheet and this helped us to grow our balance sheet quite quickly to take on larger projects. With a stronger financial standing, banks were willing to give us a more favourable borrowing rate compared to when we first started.

Another challenge that the company faced as a developer was during the Asian financial crisis of 1997. At that time, consumer sentiment was low, however, our Group was still profitable because of our quick turnaround business model which has been the backbone of our success over the past decade.

We made a conscious decision to go medium, medium-high and high end with our properties, and our mantra was “location, quality and branding”. iP: What are the factors contributing to Mah Sing’s success? LHK: I would attribute our achievement to the right business model, dedicated staff, good and experienced pool of contractors, architects, consultants and suppliers, and last but not least our supportive customers. Our key success factor is our business model for the past 10 years which hinged on fast turnaround. Land acquisition in multiple locations and quick launches allowed us to tap immediate market demand and enjoy

good take up rates. We invest in research and development to ensure the projects meet buyers’ needs and complement their lifestyles. Timely delivery is key and we are proud of our good track record. We have extended our strategy in recent years to reflect our current scale of operations. We are ready to acquire and develop large tracts of strategic land and look to venture overseas for new sources of earnings growth in the longer term, but the core of speed, discipline and innovation remains the same. Of course, nobody can do all this alone, and I attribute our success today to our great team who are dedicated, skilled and loyal professionals. I can rely on them to execute what has been planned. Trust is very important and my management team knows that I trust them to do their job. When everyone is efficient, the whole organization benefits and people get to spend more quality time at home as well. Over the years we have also cultivated a panel of trusted contractors. We engage good and experienced contractors, architects, consultants and other suppliers who can deliver our vision. LHK: We are continuously scouting for land and we have a successful track record of acquiring prime land year after year. In 2010, we entered into 10 land deals with potential GDV totalling RM4 billion as part of our ongoing expansion plans. In line with our quick turnaround business model, we managed to launch and preview some of our projects for some of our land acquired in 2010 such as Kinrara Residence (Puchong), M Suites (Jalan Ampang), Star Avenue (Shah Alam), Garden Plaza (Cyberjaya), i-Parc2@ Shah Alam and i-Parc 3 @Bukit Jelutong and the response has been very good. We emphasize on value creation, namely the value that can be extracted from our land rather than the land size per se. We believe we can extract more through value enhancement. Our lands are able to yield high development values as they are sited in prime sites and mature for development. iP: Name a few up-and-coming hotspots in Malaysia. LHK: Locations with excellent accessibility as well as potential for growth will continue to attract buyers and investors. The Government’s initiative for Greater KL to be a National Key Economic Area would boost demand for properties in the area, especially since 24 of our 33 projects are located within Greater KL. Projects and properties near the proposed MRT alignments will be in high demand, and some of our projects such as M City, Icon Residence Mont’ Kiara, Star Avenue, M Suites, Hijauan Residence and One Legenda wil be the beneficiaries.

Mah Sing Group was one of the first developers to set foot in Cyberjaya to launch a landed residential development there - Garden Residence - which comprises superlink, semi-detached houses and bungalows. Our Garden Plaza, a mixed residential project has also received overwhelming response. Both our projects are doing very well, and we have acquired more land late last yea r to cater to the growing demand. iP: Which is your most successful development so far in terms of appreciation value? Sales? LHK: As a premier lifestyle developer, we strive to provide value enhancement to our customers, and this is reflected in the value appreciation of our properties Our landed residential developments such as Perdana Residence 2, Garden Residence and Residence@Southbay have done especially well, registering capital appreciation of between 25 to 50% in Compounded Annual Growth Rate. Perdana Residence 2 and Residence@Southbay have posted more than 95% take-up rate while Garden Residence has a take-up rate of about 83% on launched products. We have set an ambitious sales target of more than RM 2 billion for 2011 as we believe the confluence of strong fundamentals such as low unemployment rate, high savings rate, strong economic growth and our branding, locations, concepts and products will make 2011 another good year for Mah Sing. iP: If there are 3 things you want to change about property development in Malaysia, what would they be? LHK: We would like to see greater foreign participation in our property sector and both the private and public sectors work towards this direction, and we shall capitalize on our experience in value creation to enrich and improve the standard of living of not just the locals but foreign investors.

High profile, high value initiatives like the new Kuala Lumpur International Financial District, Sungai Besi Airport area and the new Sungai Buloh township also bode well for the surrounding areas. In fact, we recently launched Phase 1 of our commercial project, Star Avenue located near the RRIM project and the response has been very encouraging.

We hope the country can attract more talents, for example architects and other property sector professionals to contribute their skills and infuse Malaysia’s real estate landscape with more excitement. This will allow more industry benchmarks to be set, not only in terms of innovation and design but also quality service.

Cyberjaya is also gaining popularity with many MNCs setting up their base there and accessibility has improved significantly with major expressways.

iP: Which areas will you be eyeing next in terms of land acquisition? LHK: We will continue to focus on the nation’s three economic hotspots where we have established a strong foothold, namely Klang Valley, Johor and Penang. Currently, we have total gross development value and unbilled sales of approximately RM11.35 billion from our remaining undeveloped landbank of 747 acres. Although our landbank is enough to sustain us for the next 7 years, we are still on the lookout for good land, and we have the balance sheet to fund the acquisition. Besides outright purchase, we are also open to joint ventures with land owners as we should be able to value enhance the land. iP: What is your vision for Mah Sing? LHK: Mah Sing’s vision is to be a regional world-class developer and over the long term, we are also evaluating opportunities in highgrowth countries like China, Australia, Vietnam, Indonesia, and Singapore. iP: How are your overseas ventures in Vietnam, China, Singapore and Australia doing? LHK: We have done very well in Malaysia and we want to bring our awardwinning concepts overseas. We want to broaden our earnings base but are very selective in our overseas ventures. iP: How much does your plastics business contribute overall to the Group’s earnings? LHK: Our plastics business contributes less than 10% of our total net profit for the nine months financial period ended 30 September 2010. Nonetheless, it remains profitable and cash generative.

iProperty: Tell us a bit of your company’s history, how it came about, who were the founders etc. C.T. Lim: Lokasi Canggih initially was just a small sized company and has grown to a certain size 10 years later under a very solid management team comprising of Mr Lim and three other key personnel with construction and development background. iP: How has response been for your current projects? CTL: This so-called industrial area has been transformed into becoming an urban area ever since Kota Kemuning development started about 15 years ago. There are many middle high-end housing schemes as well as commercial schemes consistently coming up during the past 10 years by major developers within this vicinity. We strongly believe that there is a need for commercial developments like Tigaman Square to serve this vicinity. We expect the spending power in this so-called industrial area would be better than some residential areas due to the fact that the income per factory is much higher than income per household. Furthermore, hundreds of visitors comprising of investors, business associates, transporters, and sales personnel are coming to this area for business purpose on a daily basis and this would definitely generate high business volume. We are now open for registration and we have managed to get more than 50% of our available units booked by interested registrants.

Talk Point iP: What are your expectations for your new projects? What new offerings can we expect for this year (2011)? CTL: We would be launching our 1st project, namely Tigaman Square, this year and we expect Tigaman Square with its new commercial concept would create an impact to this vicinity and make itself a landmark for Bukit Kemuning area. We are following up closely with the authorities regarding introducing a new access road based on the existing road reserved approved plan from Alam Impian main access road to Tigaman Square vicinity. We hope to get it done by this year. iP: What are some of your notable upcoming projects in the pipeline? CTL: Our upcoming project tentatively would be the Tigaman Park, a one-stop commercial centre comprising of 1 mil sq ft of retail area shopping mall, an exhibition hall, a hotel tower with SOHO suit, an office tower plus a residential tower. This project would be located just a walking distance from our Tigaman Square. iP: What are the special features that deserve mention about your projects? CTL: We are in the midst of finalizing our conceptual design for the mall. The special features are not being finalized yet but the idea is to build something that would make this area unique and worth paying a visit even for KL-lites. A tourist centre such as a theme park like Sunway Pyramid would be our ultimate aim for Tigaman Park. We are ambitious to build a one-stop commercial centre to serve this mature industrial area as we believe this centre would help make this vicinity a complete township. iP: What are the ‘green’ features that have been or will be incorporated in your projects? CTL: We are considering using solar energy to power part of the mall facilities. We aim to incorporate as much greenery as possible compared with other KL malls. iP: What can we expect to see in terms of your landbank acquisition this year? CTL: It’s an ongoing thing for us to look for land. We are open for joint ventures with any landowner.

iP: How do you foresee the property market outlook in the 2nd Q of 2011? CTL: Very good. The bad times should be over. iP: Are there any plans to develop properties overseas? CTL: No. Our focus is on Malaysia. iP: Q: What sort of appreciation can investors expect from Tigaman properties? CTL: Take for example, if the market economy is very bad, even a small retail lot of 538 sq ft is difficult to be rented out at a good rate. However, the investor can do the following: Sub-divide the lot into 4 smaller lots of about 100 sq ft each. Rent each one out for RM1,000 per month. (Not difficult as even a small booth of less than 50 sq ft in a coffee shop can fetch rental of between RM600 – RM900 per month.) Total rental will thus come up to 4 x RM1,000 = RM4,000/month - RM48,000/year and 6% rental return - RM800,000 (Asset value) Investor buy RM250,000 and can expect to sell at RM800,000.

iProperty: With several mega projects such as the MRT and the 100-storey Warisan Merdeka due to commence this year, how would this affect the property market specifically in the Klang Valley? TimMurphy: These initiatives are clear signals that the Malaysian government has long-term plans to transform Klang Valley into the next Kuala Lumpur. Increased accessibility and another iconic skyscraper – parodying the Petronas Twin Towers – are evidence of a metropolitan emergence. The picture looks promising for the property market in Klang but it’s still too early to tell. From an investor’s point of view, the government has its work cut out to convince us of the area’s business potential. We don’t want to have a situation where we have an oversupply of vacant spaces. iP: How do you think the coming elections would impact the Malaysian property market this year? TM: The coming elections will be a major test of unity within the current ruling Barisan National (BN) party. A strong showing of rapport will help deter any form of widespread “panic” which would inevitably lead to undesired speculation in the property market. We don’t want to replicate the situation where internal disputes caused the BN dearly.

Talk Point iP: What are the factors that could potentially derail the Malaysian property market this year? TM: There is a danger that current inflationary prices in Hong Kong and Singapore might cause property investors to flock to Malaysia. In fact, there is a high possibility that it will happen given its relatively low prices. iP: What do you think is the cause of the lack of “bubble” in the Malaysian property market while its surrounding neighbours such as Singapore and even Thailand experience property bubbles? TM: Both Singapore and Thailand have unique positioning of its markets. Singapore is Southeast Asia’s financial hub, equipped with sound policy and infrastructure to support investor interests. Thailand’s touristfriendly economy caters to high networth individuals who seek a work-life balance. As such, complementing residential developments have sprout up to meet these demands. For example, there has been an increase in the number of luxury apartments sprouting up in Singapore, while Thailand on the other hand, has seen a rise in the number of private home villas within popular tourist hotspots like Phuket. Until Malaysia’s new Economic Transformation Programme (ETP) was announced, there were little clear determinants to credibly make the country more attractive than its neighbouring counterparts.

iP: Do you see hot money coming into the Malaysian property market this year? If yes, where are they from and which types of properties are they going for? TM: Definitely. There is a growing class of affluent middle-aged adults who have the financial capital to live independently – away from their families. The current high ratio of 6.5 people per housing unit is a statistic that reeks of an untapped market. iP: Where do you think are the potential property hot spots in Malaysia? TM: Most of our investment portfolio is still very much centred within Kuala Kumpur. All eyes are now on Klang Valley. iP: What is your opinion of the Iskandar Economic Region? TM: I think it looks promising. Given the extent of plans put in place, there is no doubt that a lot of thought went into it. What needs to be done now is to ensure

that measures are taken to keep the region sustainable once it fully opens. If that can be done, the Iskandar Economic Region will undoubtedly pose serious competition to neighbouring Singapore. iP: What measures could the Malaysian government take to attract more foreign investors into our property market? TM: • Inflation figures should be kept in check • Infrastructure expansion to increase accessibility in suburban areas • Laws that protect property owners should be strictly adhered to and enforced fairly. iP: What steps should Penang Island take in order for its development to be sustainable over the long-term? TM: Penang Island needs to gradually move away from a manufacturing-driven economy to a more services-oriented one. In my opinion, banking and tourism should be the new focus. iP: Should Malaysian developers switch to Build-Then Sell (BTS) concept instead of the present system where buyers finance the construction of the properties? TM: At a modest 5.3% price growth per annum, Malaysian developers might run the risk of having to reduce their prices under a BTS scheme if units don’t sell as quickly as they expect them to. Preconstruction financing is safer, it stimulates demand, and provides a preemptive risk filter for potential mortgage defaults. iP: Do you think interest rates will go up this year? TM: The Klang Valley injection and Iskandar Economic Region will churn billions in the construction industry. Given that these are state driven initiatives, interest rates will remain low to encourage the much needed lending capital for banks to offer building loans to constructionrelated firms. iP: What are the usual complaints by foreign investors about the Malaysian property market? TM: The past few years have seen near stagnant or sluggish growth in the Malaysian property market which has been relatively unattractive compared with other markets in the region.

Challenges Ahead for Iskandar The year 2011 marks the beginning of an important phase for Iskandar Malaysia. The focus for the next few years will be to follow through and to see full completion of the early projects. While the first three years after Iskandar Malaysia’s launch in November 2006 were devoted towards courting investors and introducing basic infrastructure, the corridor is now entering its all-important second phase. Projects like LEGOLAND, the Premium Outlets, EduCity and the Danga Bay Waterfront Development are expected to accelerate towards completion in 2012.

Striving Harder Despite having their hands full with such responsibilities, organisations involved in Iskandar Malaysia have to persevere in promoting the megaproject to potential overseas investors. One of these organisations is the Iskandar Regional Development Authority (Irda), which is the regulatory body tasked with planning, promoting and facilitating Iskandar Malaysia’s development. Like many large developments, it has not been smooth sailing all the way for Iskandar Malaysia, which has seen its fair share of external challenges. The uncertain global economy, for one, has driven Irda to strive harder in its efforts.

Maintaining Investment Momentum Irda chief executive officer Ismail Ibrahim is mindful of the challenges ahead, one of which, he says, is the growing competition from the Asia Pacific region. “There is the need to come out with more programmes to attract investments from China, India, Indonesia and Singapore. Irda will also continue to work closely with the Malaysian Industrial Development Authority

(MIDA) and the Malaysia External Trade Development Corporation, as they have done in the past,” he says. More personal and one-on-one outreach programmes will be held in the months to come to maintain the momentum of private sector investments. Irda will also be targeting more impactful promotions and marketing activities. Ismail adds that Irda will intensify its involvement in events similar to those which it attended in the past such as Cityscape Abu Dhabi and Cityscape Asia. Both events attracted regional and international investors, property developers, government and development authorities, consultants and other professionals in the property sector.

“We provide consultation and information on investing in Iskandar Malaysia and act as the principal coordinating agent on behalf of relevant government agencies in relation to receiving, processing and expediting the requisite approvals for investors in Iskandar Malaysia. Irda also extends assistance to existing investors in the resolution of issues affecting their business environment,” Ismail reportedly said recently.

Strong Govt Support

Ismail, who is the former Director of the Physical Planning Division of the Rural and Town Planning Department, is confident that Irda would continue to make a difference in Iskandar Malaysia’s future.

These thoughts echo the sentiments of Prime Minister Datuk Seri Mohd Najib Tun Razak, who earlier this year pledged that in the interests of international trade, the country would continue to strengthen ties with East Asian nations, particularly China and India, in light of the increasing competition in the region. Najib, who is co-chairman of Irda together with Johor Menteri Besar Datuk Abdul Ghani Othman, said efforts should also be made to initiate inroads into Europe. Another challenge lies in the perception of Singaporeans towards Iskandar Malaysia. A long-running issue which Singapore nationals have is the safety and security in Johor, which they say is notorious for robberies. To alleviate the problem, Irda launched a special task force in charge of eradicating crime and introduced a Safety and Security Blueprint which was implemented throughout Iskandar Malaysia. As a result of these measures and the diligent Johor state police force, the state recorded a drop in the crime index. Con’t pg 48

Positive Outlook Despite the challenges and judging from 2008-2009 where, despite the global economic recession, economic and development activities continued in Iskandar Malaysia, the outlook is positive for the development corridor. In a recent report by the Malaysian Institute of Economic Research (MIER), domestic growth for 2011 is expected to be in the region of 5.2 per cent. The latest statistics for Iskandar Malaysia show that investments reached RM68 billion in November 2010. Some 58 per cent, or RM39.44 billion of the investments were domestic, while the remainder came from foreign investors.

It is also a short drive away from up-and-coming Kota Damansara. The hilly and undulating terrain is served by the Damansara-Puchong Expressway (LDP), the North Klang Valley Expressway (NKVE), and the Sprint Expressway. Due to its many obvious attractions, it is becoming a magnet for home owners

We spoke to its youthful executive director, Eric Yong Shang Ming to find out his views on the popular area.

iP: What new transportation links eg. MRT, new highways are expected to pass by Damansara Perdana? EY: Based on the latest MRT (Blue Line)’s alignment, the line is expected to cut across Persiaran Surian, not too far away from Damansara Perdana. There will be feeder buses that will serve the area. However, this would take at least the next 4-5 years before seeing its completion and operations. Based on my observations, there is not much that can be done for road transportation as the highway structure (LDP – Penchala Link) is already very advanced. Internally,

I would expect the routing and roads to be upgraded to allow for higher traffic. The current system – including the internal roads within Damansara Perdana, the U-turns and so on are quite congested already – and a re-routing needs to be done. iP: With the Rubber Research Institute (RRI) land in Sungai Buloh to be developed soon, how would this impact the Damansara Perdana area? EY: The RRI land is quite a distance from Damansara Perdana. I believe that the RRI development would directly affect the Kota Damansara and its immediate surroundings in a positive way in terms of capital appreciations and values. As for Damansara Perdana, it is unlikely that the RRI land would have any major effect as a new development would usually take time to mature and fetch ‘current prices’. The hot spot would still be at Damansara Perdana / Mutiara Damansara area due to its connectivity via the LDP. iP: What are your comments on complaints that Damansara Perdana is getting too crowded and congested with traffic jams? What steps could be taken to alleviate this? EY: As mentioned above, various steps need to be taken. Another major thing to do here is the enforcement by MBPJ (Majlis Bandaraya Petaling Jaya). I notice that the parking is quite a horrendous problem here whereby car owners park all over the place.

Keeping Your Tax Information Tidy - Why Bother?

You would not feel happy if you could not find the clothes you intended to wear because you wardrobe had become untidy or if your beautiful Jimmy Choo shoes were not fit to wear because they had been left out in the rain, would you? Tidiness, like virtue, is its own reward. In the same way, you might be severely inconvenienced if you had

not kept safely and in good order any information and documents which might be pertinent to your tax affairs. Self-assessment for tax purposes means that you are not required to submit any back up information or documents at the time when you submit an income tax return so there is no independent check to see whether those things are in order. However, this should not lead to complacency. Supporting information can be required many years after the tax return is submitted and when it is found to be missing or inadequate additional tax assessments and penalties can be imposed.

Duty To Keep Documents How long you need to keep your documents depends upon whether you submit an income tax return or not. When you do, the retention period is seven years from the end of the year of assessment concerned (i.e. 31 December 2017 in the case of a tax return for 2010). If you do not submit a return for a particular year, it is seven years from the end of the year in which you do submit the missing return. Any documents relating to income in Malaysia, including income from property situated in Malaysia, are

required to be kept in Malaysia. All of this applies to companies as well as individuals. The documents referred to are: a) Statements of income and expenditure; and b) Invoices, vouchers, receipts and such other documents as are necessary to verify the particulars in the tax return. Separate details should be kept for each property owned and it would be appropriate to ensure that legal documents such as sale and purchase agreements, tenancy agreements and agency agreements are kept safely. The Inland Revenue worksheet HK-4 is a convenient form in which to keep statements of income and expenditure. The law allows for information to be stored in electronic form provided that it can be printed when required. Keeping things tidy is not only a sensible precaution but also a legal requirement. Failure to keep the records as required can be punished by a fine of up to RM10,000 or imprisonment for up to one year or both. Obviously such a harsh punishment would only be meted out in extreme cases.

Tax Audit Not everybody gets audited. The Inland Revenue selects cases for audit through the computerised system based on risk analysis criteria. In particular cases, this may arise through suspicious fluctuations in the level of income disclosed or expenses claimed by a taxpayer. However, the selection of audit cases is not confined to selection by the computerised system; cases can also be selected based on information received from various sources including agents and tenants claiming a deduction for rent paid. Desk audits are normally concerned with straightforward issues or tax adjustments which are easily dealt with via correspondence. A taxpayer may be called for an interview at the Inland Revenue’s office if further information is required. Generally, a desk audit involves checking all information on income and expenses as well as various types of claims made by a taxpayer in his income tax return. Beyond this level is the field audit which will be carried out on the taxpayer’s premises and is more stringent. However, this kind of audit is usually

only employed for company and business cases.

If you have all the information at hand, an audit should be no cause for concern but do bear in mind that memory can play tricks. After a year or two, you might have forgotten why you dealt with a particular item of income or expense in the way you did even though your treatment was justified at the time. It is a good idea to get into the habit of making and retaining explanatory notes to help jog your memory.

In addition to his statutory power to search, the Director General of Inland Revenue is empowered to require any person to give orally or by notice in writing such information or particulars as may be demanded of him for the purposes of the tax.

Access To Buildings, Documents And Information The Director General of Inland Revenue is given wide powers. He has at all times full and free access to all kinds of lands, buildings and places and to all books and documents. This applies not only to the premises of the taxpayer but to those of any other person. Needless to say, he must use his powers bona fide, reasonably, without negligence and only for the purpose for which they were conferred. Of course, it should not be necessary for him to use these powers at

Both of these powers may be used to obtain information for the purposes of real property gains tax as well as for income tax but the powers are much wider in the case of real property gains tax. The reason is that third parties such as purchasers, agents, solicitors and lenders may have relevant information about a property or share transaction which would not otherwise be forthcoming.

How Does This Affect Non-Residents? Income derived from land situated in Malaysia is liable to tax in Malaysia even if the owner is non-resident. The responsibility for making a return of income, for keeping records and providing information when it is required falls on the non-resident owner. Where he is absent or otherwise fails to comply he may be taxed in the name of any person who is in receipt of his income, such as an agent. That is why agents often prefer to retain a part of the rents they collect to cover any tax payable by them. In the case of a person who is chargeable to real property gains tax, he is initially responsible for making a return and paying any tax but, if he is absent, any other person may be appointed by the Director General as an agent and such person can be required to pay any real property gains tax due out of any monies that he holds for the principal.

The Late Damages Trick

Robert Tan, a supporter of house buyers’ rights and the author of “Buying Property From Developers: What You Need To Know And Do” reveals a common developers’ tactic to avoid paying house buyers for late delivery of houses The Sell-Then Build (“STB”) system of building and selling houses is unique and has for many years controlled the housing development industry in Malaysia. In summary, this system allows houses to be built in stages and paid for progressively after each stage of work is done. The system sounds simple. But it is ridden with a host of problems. Stories are told about house buyers being played out under the system, not once or twice but many times over and in many ways. Simply, the system is based on the business concept of using house buyers’ money to fund the housing development.

In business jargon, it is about using other people’s money (OPM) to make profits. In other words, developers under the system leverage on OPM to make business plan and profit goals. The obvious pitfall of the system is the potential risk of a housing project being stalled or abandoned. Project abandonment is a serious problem to the country such that the Government has had to intervene and pour in big funds to revive abandoned projects for the rakyat’s sake. Apart from such problems, the STB system exposes house buyers to manipulation and tricks of greedy developers. This article seeks to highlight one trick greedy developers use to hoodwink buyers into giving up their rights under the law. It’s called “The Late Damages Trick”.

Late Damages Late damages are about giving the house buyer damages when the developer delays delivering vacant possession of the house to the buyer. The damages are calculated at the rate of 10% per annum of the purchase price on a daily basis from the day of expected delivery to the day of actual delivery.

Feature The damages are claimable when they accrue i.e. when actual delivery of vacant possession happens. The problem with late damages is that the developer would often seek to avoid paying it. The following story illustrates the point.

The Story Mr & Mrs Nice bought an apartment from a housing developer. Under the STB system, the housing developer was to deliver vacant possession of the apartment within 36 months. The developer failed to do so. When the house was finally delivered to them, Mr & Mrs Nice claimed for the late damages. They set-off the damages against the outstanding progressive payment. Furious, the developer rejected the setoff and asked the couple to pay the full progressive payment.

Why have things gone so wrong? Are the authorities blind? Some greedy developers get bolder and possibly trickier when they realise that it is fairly simple to play the Late Damages Trick. For the education of house buyers, here is one way the trick is played.

The Trick The basis of the trick is in a mantra. To be effective, the mantra would be repeated by the developer’s employees. When said in unison, it would materialise into reality. The mantra is: Delay paying damages. Get a discount for them. How does the mantra materialise? Here is the process.

The Process

Further, it charged them interest on the progressive payment and threatened to terminate the agreement, forfeit the deposit and take back the house if they didn’t make the payments.

The developer delivers vacant possession of the property to the buyer and demands the buyer to pay the full progressive installment.

Now the couple were retirees. Fighting the developer in their golden years was far from their minds.

Because of delay in the delivery of vacant possession, the developer knows that late damages are to be paid. But it keeps silent.

After all, they had earlier spoken to the developer’s managing director who was on his way out of the office, possibly to play golf, and had assured them that things would be all right.

If the buyer exercises the right to the set-off, the developer would reject it. It would demand that the buyer pay the full progressive payment first.

Sadly, things went all wrong. The sale manager harassed them and wrote a letter filled with legal gibberish. The message in the letter was that Mr & Mrs Nice are to make the payments and was asked to forgo 50% of the late damages. These were the developer’s terms for the couple to get the keys and move into the apartment. To make peace, Mr & Mrs Nice relented. They withdrew the set-off, paid the full progressive installment and waived their entitlement to the full amount of the late damages. Quietly, the old couple moved into their new apartment to enjoy the rest of their golden years.

The buyer fully pays the amount. The buyer then asks the developer to pay the late damages. Shrewdly, the developer offers to pay the buyer a lesser amount on the late damages sometimes up to 70% lesser of the total damages. The developer may remind the buyer about the long delay, inconvenience

Occasionally, the developer may mock the buyer for going to the homebuyers’ tribunal although the tribunal has commendably and generally offered fast, cheap and efficient legal redress to house buyers. The developer may seem arrogant possibly because the tribunal’s award may be a mere show. For example, some tribunal awards for late damages have been set aside for unprecedented reasons when the developer applies for judicial review of the awards. So, the buyer is hard-pressed. He or she relents. The mantra materialises with a homerun in malpractice for the greedy developer.

Enforcement Many years ago, a now retired engineer who worked in Singapore told me that while Singapore was growing her city, her ex-Prime Minister, Mr Lee Kuan Yew, was asked what ought to be done to developers who flout the law. The honourable Minister said, “Whip them!” In Malaysia, the laws allow for strict enforcement against errant developers. Even directors of errant developers can be personally charged and sent to jail for misconduct. But whether there has been any successful prosecution and deterrent sentence given to errant developers and their directors seems to be a moot point. While this seems to be the state of things now, house buyers at the grassroot level ought to be aware of the Late Damages Trick. When it happens, hopefully they would recognise it as they have been educated about it here.

When scouting for a dream home, it is a good idea to observe its surrounding area, its neighbourhood. Though this doesn’t literally mean the people who live next door to you, but rather, what is next door or in close proximity to your property. Similar to suffering the pain of having noisy real-life neighbours, having a negative ‘neighbour’ can negatively impact your property. Here is what you need to look out for:

Petrol/Gas Station

Power Substation

Petrol/gas stations are considered to be of Fire element. Much like temples, you need to check if the Fire element is beneficial to your property according to Xuan Kong or other Feng Shui calculations. In general, basic Feng Shui dictates that living too close to an overly strong Fire element denotes loneliness and lack of progress. The solution? Employ appropriate positioning of Water within the property’s compound.

Similarly to petrol/gas stations, the same also applies to power substations. If all is good, then there’s nothing wrong with living next to one. In Feng Shui, the concern is more on electric pylons than substations. Of course, electromagnetic fields from the substations may well be a cause for health concerns but substations themselves have no substantial Feng Shui impact.

Temple

LRT/Monorail Line

Temples are spiritual grounds and are considered Fire Qi. Employ the appropriate use of the Water element and/or Qi mouth (Main Door or Main Gate) to easily resolve the Fire Qi issue. But if the Fire Qi is good for the property, then having the temple there may even be beneficial.

Likewise with highways, LRT/monorail lines are also of piercing merciless Qi. The main thing to consider is which sector it pierces and whether or not the station casts a shadow on your property, thereby blocking the Qi from entering. But to be on the safe side, better to avoid a property close to the LRT line or station.

Graveyard

School

Pedestrian Bridge

Burial areas are Yin areas and it is not good to have an overly Yin place near or next to your home. Though most graveyards are clean and beautiful these days, they do not necessarily embody negative Qi. Therefore, living near or next to a graveyard likely has a psychological rather than a Feng Shui effect. However, if there’s a busy road between the property and the graveyard, any Yin Qi from the graveyard will be dispersed.

Schools are considered Yang Qi because it is usually always busy and noisy. Living next to one is usually not detrimental or negative in Feng Shui but common sense will tell you that it may cause sleep disruption, which may not be good for the health of the occupants.

When a pedestrian bridge is very close to your property, it is a negative feature because the piercing Qi will hit the property. So it is best to avoid it. But no worries if it is far away. For starters when looking for property, these useful tips should be able to guide you to narrow down which area to live in. Happy house-hunting!

It’s not sexy but the Volvo S80 Turbo marries safety with understated sophistication If you have RM300,000 to splash on and you need a potent distraction from properties in the form of a mobile speedster that doesn’t just sit there in passive subordination waiting for your inspection, but reacts with your every limb movement, then I recommend testdriving the Volvo S80 Turbo. I was told before the test drive that you can only fully appreciate all the safety features of the car during a crash. Some ‘fortunate’ reviewers did emerge unscathed from an accident and lived to write about it but unfortunately yours truly did not quite have the privilege of that experience. Hence, the incomplete review where the safety features are concerned.

Safety King Be that as it may, the rest of the safety features worked perfectly well, especially when I was trailing the car in front along the LDP at 80kph and the latter stopped suddenly. All manner of sirens and lights came on alerting me to the imminent frontal impact. I stopped just on time with a gap of a few millimetres from the car in front. I was suitably impressed as the alerts had prompted an immediate response from me which saved the day. Often, life and death on the highway hangs on that few critical seconds. And the Volvo S80 passed this test with flying colours with its Collision Warning with Auto Brake (CWAB) function. For those who often find that they can’t drive in a straight line after a couple of

German beer and French liquor, fret not. The Swedish car will alert you if you trespass onto the other lane via its Lane Departure Warning (LDW) system. If the car starts behaving like you walking in a zig zag manner from the club, it will again alert you to stop the car and have coffee. Yes, it’s that friendly. Too bad, it doesn’t dispense real coffee. Another nifty safety feature that got me hooked was the Blind Spot Information System (BLIS) feature that lights up on the inside section next to the wing (side) mirrors whenever an object passes by the blind spot of the side mirror. Another one was the audio controls on the steering wheel which saves you the trouble of bending forward to adjust the sound volume or change radio stations. The keyless Personal Car Communicator (PCC) (the remote control) allows you to check whether the car is locked or even whether an intruder is lurking inside the car. This is particularly useful if you happen to park somewhere dark or quiet.

Smooth Speedster On the test drive on the highway, be prepared to leave all the cars behind as you step on the accelerator. All manner of cars will give way to you. Best of all, the auto 6-speed transmission packed enough punch whenever you crank up to higher speeds. The revolutions per minute (RPM) remained at a quiet

3,000 rpm even at higher speeds. At those speeds, the car comes across as a smooth speedster, giving a very comfortable ride. The same can’t be said if you are trailing another car in a bumper to bumper crawl. Then again, as with all cars, no matter how fantastically built they are, when there’s a traffic crawl, it’s no fun. It isn’t on too friendly terms with road bumps either. To its credit however, the 2.5 turbo car is powerful enough when going uphill on steep gradients yet on trunk roads, the road handling is better than expected giving a very relaxing ride despite the narrow roads and constant overtaking. In the final analysis, the sleek S80 generally performed to expectations except that it surpassed all others when it comes to safety features. The cover of its brochure reads: “We’ve been saving people in car accidents for more than 80 years.” Not many will dispute this although some might take it as a license to crash the machine.
