Elsewhere the reports are out on the impact of the 70% cap on LVR (Loan-toValue Ratio) from the third mortgage onwards. Most analysts think that the impact is still minimal although housing loan applications were down for 4 consecutive months since the cap was enforced in November 2010. Reasons cited had more to do with the months being traditionally slow months rather than due to the LVR cap. We would only be able to see the real impact from March onwards. PNG Beckons What have PNG and LNG got to do with local developer, Jelang Wangsa? A lot apparently. It’s because of LNG that the adventurous developer is now venturing in a big way into Papua New Guinea, an archipelago of 600 islands in the Pacific, 160kms north of Australia. Managing Director, Mr Steven Heng explains its allure in an exclusive interview with iProperty.com.my

iProperty.com: Tell us a bit of your company’s track record and projects in the pipeline. Steven Heng: We ventured into property development sometime in 2007 to diversify our earnings base and increase profitability. Prior to that, we started out as a Mechanical & Engineering company in 1985. We have just completed the first build-then-sell project in Nilai, Negeri Sembilan. Taman Murni comprises 28 units of single-storey terrace houses, semi-Ds and bungalow units. Response has been overwhelming when we did a soft launch in mid-March with 70% sales achieved to-date. We foresee that all the units will be sold within the next 2 months.

At the moment, our resources will be directed at Papua New Guinea (PNG) where we will be launching a mixed development with Gross Development Value (GDV) of 1 billion kina (1 kina = RM1.3). iP: Tell us more about your project in PNG. SH: We have been invited by a land owner there to develop a mixed leasehold development on approximately 17 acres of land. PNG is now booming due to an abundance of liquid natural gas (LNG). Exxon Mobil, Interoil of Canada and etc are developing the LNG projects there with investments valued at more than USD22.5 billion.

We are also involved in a joint-venture with ACCH Development to develop semi-D and bungalow units in Section 4, Shah Alam, So far, we have sold 12 units, with 3 left and 4 pending bank approvals.

The country is also very rich in natural resources such as gold, copper, timber and coffee. Malaysian and Singaporean companies are some of the biggest investors in the timber, mining and plantation industries there.

We are quite pleased with the success achieved in these 2 projects and are now planning our future developments. We are in negotiations to acquire a potential project in Rawang involving more than 38 acres of residential land which will take about 2 years to bring to launch.

PNG has been registering 7 to 8% GDP growth for the past few years with a significant inflow of investments especially from the oil and gas sector.

The PNG Government despite its many problems is actually putting the funds from the LNG investments to good use in promoting better infrastructure etc. We are seeing the transformation of a nation! With the booming economy, we expect that our project will be completed and sold within the next 5 years or so. We have done our research and see great potential in property development in Port Moresby where there is a significant shortage of housing for both expatriates and well-to-do locals, hence our decision to venture into PNG. We will be one of the biggest property developers in PNG for now with our project and hopefully in future as well though we understand developers from Australia, Hong Kong and Singapore are also starting to come in. Our target market comprises Australians, Koreans, Malaysians, Chinese (from China) and other foreign expatriates. The first phase, Paramount Commercial Centre (PCC) will comprise 28 units of storage office, 21 units of 3-storey shop offices, 16 units of 3 - 5 storey covered mall office, a hotel, and an office block, sited on 17 acres of undulating land. It will be a fully gated and guarded community with 3-tiered security offering 24-hour security which is linked to the local police command centres. PCC is very conveniently located – just 2kms to the biggest shopping centre in town, Vision City Shopping Centre and 10kms to downtown (heart of Port Moresby). We expect to soft launch it in the 3rd quarter of this year. The official launch is expected to be at the end of this year. Right now, the project is pending building approval and we are in the process of negotiating with the main contractor, a China company which is already based in PNG.

What this means is that it is potentially very profitable for developers in PNG. iP: What are some of your impressions of PNG? SH: It has a population of 6.7 mil comprising various ethnicities and a siginificant number of expatriates. The land there is bigger in size than Malaysia but consists mostly of mountains and jungles. Population is concentrated around coastal areas like Port Moresby.

are still in its infancy though the government there is in the process of formulating legislations to better protect house buyers – I believe their Minister of Housing came over to Malaysia a few months ago to study our model. Usually, buyers pay 30% downpayment and the full balance upon completion. PNG is actually one of the top destinations for scuba-diving. But the industry is not very developed yet at the moment. It has spectacular scenery and is a great place for ecotourism. Seriously, local travel and tour companies should really go there and have a look!

For banking needs, one would need to go downtown but there is traffic jam! There isn’t enough parking lots available as well. That’s why major banks like ANZ and BSP are now starting to move away from downtown in line with the rapid growth of Port Moresby – our project will be one of the new suburbs of Port Moresby. For recreation, you can go to the beaches, hotels or the biggest shopping centre in Port Moresby, Vision City (developed by a Malaysian affiliated company) which is very much like our Tesco hypermarket. There is no cinema there yet but it’s probably in the pipeline. More recreational facilities will be built eventually when the benefits of the booming economy trickle down. PNG’s laws are based on Australian laws and some of their legislations are better than ours. The housing guidelines

As global recovery continues to be questionable, it is possible that rates may stay where they are iP: Have you seen any increase in property loans take-up since the beginning of this year? PE: There have been no obvious changes this year, up or down. Again, primary and sub-sales are very strong in certain areas, and rather weak in others. iP: How has the 70% cap on 3rd mortgage onwards affected your property loan portfolio? PE: Not significantly at this stage. We may eventually see slower take up from investors, however, the number of people with 3 or more residential property loans is relatively small.

CIMB: Embracing Diverse Needs It doesn’t come as a surprise when the CIMB Group announced a record RM3.5 bil net profit in 2010. Last year was a super year for properties and news abound of record profits among the big developers. Banks naturally follow suit as they play a pivotal role in the property industry. We speak to Peter England, Head of Retail Financial Services, CIMB Bank, on the bank’s take on property loans. iProperty.com: How much of your total loan portfolio consists of property loans? Peter England: Property loans to individual borrowers make up about 30% of our total loans in CIMB Bank Malaysia. We believe this an appropriate size given the diverse nature of our business in Malaysia. iP: What was your growth rate of property loans from 2009 – 2010 on a yearly basis? PE: The growth rate of our property loans from 2009 to 2010 is in the high teens. Our growth rate is higher than the industry average mainly due the fact that we have a very large branch network and one of the largest mobile sales teams in Malaysia. The mobile sales team particularly, is able to provide very personalised service to clients as they can meet at the customers’ convenience in terms of time and location, so clients do not need to come to the bank. iP: What is the outlook for the property market this year? PE: The broader property market appears to be softening a little, particularly in certain areas where there seems to be oversupply. But as always, demand for good quality properties (both primary and sub-sale) in areas where supply is limited is robust and its outlook for this year continues to be good. Property prices in and around Kuala Lumpur have appreciated and properties, especially the landed ones are still in great demand.

iP: Do you see any hike in interest rate this year? PE: Market view seems to expect a smallish rate hike, perhaps up to 50 bps by year end, so we will wait and see. As global recovery continues to be questionable, particularly in the light of recent unfortunate events, it is possible that rates may stay where they are. As always, we would expect Bank Negara Malaysia (BNM) to take a very careful approach in balancing economic growth and the risk of inflation, so I don’t think we would expect anything too dramatic. iP: Will you be coming up with special loan packages for homeowners this year? PE: We recently launched a unique home loan package called Capped Rate Loan. This package allows a customer to choose a cap for the base lending rate (BLR) and this will provide the customer with peace of mind because of the protection against rising BLR. With the chosen cap, customers are guaranteed that their interest rate will not rise beyond a certain pre agreed limit during the capped period of 3 years or 5 years. However, should BLR fall below the cap, customers will enjoy cost savings because of the lower rate. This package will allow customers to enjoy the best of both worlds. In fact, CIMB Bank offers various packages depending on the diverse needs of the customers. For pricing considerations, we have fixed rate packages, fixed-to-float packages as well as floating rate packages. Fixed rate packages usually offer customers the peace of mind while the floating rate package is subjected to BLR/base financing rate (BFR) fluctuation. In terms of facility type, there are term loans, flexi loans and overdraft facilities available. Term loan facility allows customers to manage their cash flow with a repayment schedule. Meanwhile, flexi loan facility allows customers who have extra cash in hand to enjoy interest/profit savings whenever they pay extra, and overdraft facility provides customers the convenience of having access to standby cash. iP: What is your view on 2nd generation loans? Please define it. PE: We do not have a package specifically called 2nd generation loans. However, where appropriate, we do approve loans based on the younger applicant’s age to compute the tenure in the case of joint application where one applicant is much older in age.

The Other Boom

With all the talk about an on-off (potential) property boom in Malaysia, the fact is Malaysia is already experiencing another boom – the tourism boom. Quietly descending upon us, our tourism industry is fast becoming one of the top income generating activities in Malaysia, with the potential of surpassing our manufacturing and commodity sectors

Hotel Galore Judging from the number of new hotels opening recently and new ones to come onstream further down the road, it looks like Malaysia is set for a tourism boom in the months ahead. In fact, from all evidence, we are already well and truly in the midst of a boom. Despite the massive Japan earthquake and tsunami early March, Malaysia expects tourists from countries such as China and India to increase due to several factors, chief among them is the growing affluence of people from rising economic powerhouses China and India. Malaysia is also blessed with being the hub of Air Asia which is bringing tourists from many countries along its expanding international routes, such as India, China, South Korea, the Middle East, Europe, Australia, Thailand and Indonesia. Other factors are rising government investments in infrastructural projects, attractive luxury destinations, and the emphasis on our great variety of

food. The recognition of Penang and Melaka as UNESCO world heritage cities also helped to put Malaysia on the international travellers’ map. Further, our growing status as a haven for medical tourism, particularly in Penang, attracts a continuous flow of medical tourists from countries such as Indonesia, the US and Europe. During the Budget 2011 announcement in October last year, the government was even prepared to allocate RM100 mil to part-finance developer and resort operator Karambunai Corp’s integrated eco-tourism resort in Kota Kinabalu. The RM3 bil project is expected to take about five years to complete.

No ownership restrictions By 2020, Malaysia needs 50 per cent more hotel rooms to cater for the anticipated tourist arrivals of 36 mil, so declares our good Tourism Minister Datuk Seri Dr Ng Yen Yen recently. According to her, tourist arrivals in 2010 were 24.6 mil compared

with 23.6 million in 2009, an increase of 1 mil tourists within a year. If we extrapolate that and assume that we get an increase of 1 mil arrivals per year, we would indeed reach 36 mil in 11 years’ time, thus requiring more hotel accommodation. Whether or not we will reach that figure remains to be seen. Meanwhile, on the ground, sentiments are bullish especially from foreign investors as there are no restrictions on foreign ownership of hospitality assets in Malaysia. Hotels with foreign ownership and/ or foreign management that are newly launched or confirmed coming are the recently launched InterContinental in Jalan Ampang, while the Pullman Kuala Lumpur Bangsar is expected to launch in November and the Grand Hyatt Kuala Lumpur in Jalan Pinang in 2012. Hilton Doubletree opened its doors near KLCC a few months back. Over the next 5 years, expect to see St Regis Kuala Lumpur, Best Western

Locals catching up Among local hotels, the well-known ones are Cititel, Seri Malaysia and Naza Talyya chain of hotels, which cater to the masses while Royale Bintang serves more upmarket clientele. Tune Hotel is fast closing in on its competitors, offering refreshingly 5-star facilities at 1-star price. Who wouldn’t fall for that?

Premier Dua Sentral, Hilton Garden Inn, Movenpick, Park Regis Kuala Lumpur and Four Season Place vying for the tourist dollars. These will add to the 30,000 rooms contained within 236 hotels already in operation in Kuala Lumpur alone. Nationwide, as at February this year, there were a total of 1,610 hotels in the three to five star category and budget hotels offering a combined total of 161,117 rooms Though average occupancy rate in KL hovers around 67% in 2010, which was 4.2 % higher than in 2009, the expected increase in tourist arrivals – 25 mil targeted this year, would generate demand for all types of accommodation including homestays. The latter which have proven popular has absorbed quite a bit of the incoming traffic.

But Tune will soon be more prevalent overseas. By 2015 Tune hopes to have 30 hotels in India and 64 elsewhere in Southeast Asia and China, compared with only 20 in Malaysia. More are planned for Australia and the Middle East. The world’s fourth largest hotel incidentally is located in Malaysia at First World Hotel, Genting Highlands. Even with a combined total of over 7,000 rooms for all 5 hotels in Genting, the hotels at the casino resort are fully booked every Saturday and during school and public holidays. Thus, as far as Genting is concerned, there is a shortage. But what about the rest of the country? Admittedly, during school and public holidays, all hotels in holiday destinations in Malaysia are practically filled up. Apart from Genting, Malacca, by virtue of its proximity to Singapore and its world

heritage city status, is seeing fullybooked hotel rooms practically every weekend too. Incidentally, Malacca recorded the highest number of tourist arrivals last year.

‘Stampedes’ on the way Fears that there might be a glut might be too premature. It’s perhaps too early to tell, but judging from the number of hotels that are in the pipeline, the consensus is that there is a dire need for more hotel accommodation. And why ever not? Check out the statistics. Malaysia is continuing to emerge as a top travel destination in Asia, appearing on several travel-trend forecasts such as the Specialty Travel Agents Association’s (STAA) Top 10 Travel Trends for 2011. Further, according to Abacus International, a global technology partner for the airline industry, Asia is en route to become the top travel region in the world as early as 2015. Even several economic crises were not able to stem the tide of tourist stampedes coming our way. Like it or not, Asia is at the cusp of a big tourism boom. And Malaysia is one of the biggest beneficiaries of that.

Architect-turned-entrepreneur Dato’ Bill Ch’ng, a colourful personality in the corporate world, reminisces about an exciting episode in his life involving the most famous hill in Malaysia. Dato’ Bill C.P. Ch’ng has many claims to fame. After winning several architectural awards, the Malaysian-born Australiatrained architect decided to venture into the corporate world. It was the right move as the multi-talented man soon discovered. From 1982, he dabbled in property development, construction, retail, hotel and financial services in Malaysia, Singapore, Hong Kong and China, holding top positions in well-known companies such as Sheraton-Imperial Hotel Sdn Bhd, Emporium Department Stores and Supermarkets Singapore Limited, Boustead PLC London and Boustead Singapore Limited. It wasn’t exactly a surprise that he was named one of “50 Asia’s Top Corporate CEOs” by Business Weekly International magazine in 1989. Now at 70, Dato’ Bill, once dubbed the Turnaround Specialist for returning MPCorp (formerly MPL) to the black, sits as its Chief Executive Officer. He lives the grand vision of turning LakeHill and APTEC(Asia-Pacific Trade & Expo City) in Iskandar into a trading and expo hub in Southeast Asia. But the one story that always seems to elude closure was his claim that he was the pioneer architect/planner and founding member of Genting Highland

Casino Hill Resort. Intrigued, we asked him what’s the story behind his claim.

The Story Here’s his story (edited for space and clarity): “The late (Tan Sri Dato Seri (Dr.) Lim Goh Tong and I were partners at that time. I did the whole master planning and design of the resort and he was the contractor. It was former Prime Minister Tunku Abdul Rahman’s dream to build a hill resort near KL, designed by Malaysians instead of colonial resorts such as Frasers Hill and Cameron Highlands. At that time (1964), Lim was in his 50s and was planning on building his mushroom farm and a house for his retirement. A chance encounter with Tunku in his Gombak house opened up the possibility of building a hill resort near Gunung Sempah where Lim had a piece of land. Tunku had apparently asked PWD (JKR) to do a feasibility study but it concluded that the project was not viable. I then suggested private sector investment to which Tunku replied: “If you can get an investor to build this resort, I will guarantee you the government’s help, but there would be no financial support from the government.” Lim and I thought about it and decided that we wanted to build a casino on the hill resort as it would make money. We went to Macau to check out the scene. Convinced, we made up our minds that that would be what we wanted to do – build a casino on a hill resort near Gunung Sempah. We decided to ask Tunku for a casino license first before we get the funds.

Tunku said it was subject to cabinet approval and subject to the Finance Minister, Tun Tan Siew Sin’s approval and the Home Minister’s approval. We were then still fighting Chin Peng in the jungle so the Home Minister’s approval was required too. And Parliament must approve unanimously. To cut a long story short, we managed to get all the approvals required for a casino license. We then tried to get bank loans but were rejected as all of them doubted the viability of the project. We decided to build the road to the hilltop first to prove that it was possible (and viable). We didn’t have enough money to build the road, so Lim used old machinery. We couldn’t afford a surveyor, so we went up the wrong hill. That’s why the road wend down on the way up. Every weekend we camped there to build. Lim then went to Macau and managed to get Stanley Ho to invest 50% in the project with an 8-10 year franchise on the casino operations. Unfortunately, approval was not granted due to fears that the casino king might fund the communists at that time. By now, Lim had spent over RM1 mil to build part of the road up. We were close to zero funds. Fortunately, we were introduced to the boss of WalkerHill Casino, Korea. The boss came and agreed to fund us. Genting Highlands was born as a result. The rest was history. In 1972, I resigned due to personal reasons. However, I still have copyright to the master layout and design plan of the original theme for the hill resort. ”

Buying Property From Developers Robert Tan, a lawyer who wrote one of the very few books in Malaysia on Property Buying gives a preview of his book

Injustice to Cash Buyer Some years ago, a property investor told me a story. He spoke softly. “I saw it happen,” he said. A lady had retired from the work force. She had plenty of EPF money. She wanted to invest her money. She bought a property from a developer. The property came with guaranteed rental returns at a fixed rate and for a fixed time period. Impressed by these promises, the lady bought the property with her EPF money. The property was completed. The developer paid the guaranteed rental returns for a few months. Subsequently, the developer stopped the payments. News got around that the developer was in financial trouble. The lady thought that the property, being fully paid for in cash, belonged to her. She was greatly mistaken. The developer had failed to pay its bank (bridging financier) the redemption sum for the property. The bank held the property as security for the developer’s loan. The bank wanted to auction off the property to recover the developer’s loan. Subsequently, the developer was wound up. The bank got the property. Fair or otherwise, the lady lost the property and her money. I was a junior lawyer when the story was told. I was wanted to know what the lady could do about her property. I went to the bookshops to find a book that could give me an answer.

Lacuna on Buyers’ Rights Sadly, I found none. “Isn’t there a book in plain language that could tell me what to do when buying developer’s property?” I asked.

I felt like I was at a dead-end. I was lost. I felt stupid.

In those moments, I felt that something was wrong. The majority of lawyers involved in the housing development industry were acting for developers or the banks. Very few were acting for the house buyers. Even fewer knew what house buyers’ rights were.

Some words include: “Phase 1 Sold Out.” The hot spot for growth”. “Free Legal Fees”. “Interest waived during construction”. “5 minutes to Kesas”. “New highway interchange”. “Proposed hospital, international school and hypermarket”. Many aggrieved house buyers have rather late in the day discovered these claims to be farfetched.

After meeting and talking to house buyers during the National Housebuyers Association’s meet the public sessions every weekend, I came to know that thousands of house buyers have had bad experiences buying property from developer. The lady in the story was just one of the many thousands of aggrieved house buyers. Her problem was one of the many problems faced by house buyers. While this was happening, there was a great lack of information on what to do when buying developer’s property. So, I decided to write a book.

Book to Fill Void The book would create awareness for house buyers including myself on the rights and risks in buying developer’s property. House buyers thus bear a heavy risk as they contract and pay for a house that is not yet in existence. In view of this, the housing development law is enacted to protect the interests of house buyers. The book explains the various stages of buying a developer’s property from the time the house buyer pays the earnest deposit to the time the developer delivers vacant possession of the property. The stages are discussed under respective topics that include among others the Sale and Purchase agreement, the booking fee, sale and advertising permit, delivery of vacant possession, damages for late completion, defects liability period and lawyers’ fees. Each topic aims to inform house buyers what the developers are obliged to do and what rights house buyers have. There are also summaries of real happenings and courts’ decisions which facilitate a good understanding of the areas of concern to house buyers.

Under the present housing development system, the Sell-ThenBuild system, where house buyers pay

progressively against stages of work done, the majority of developers have used house buyers’ money to undertake housing development business. This is business opportunity for developers as they are allowed to use other people’s (house buyers’) money to make profits for themselves. When something bad happens to the developer’s business, many developers have abandoned the business and left the house buyers who have already poured in millions of honestly earned income and savings into the purchase of the house to be caught in a quagmire of financial problems for many years.

Some excerpts from the book Advertisement and Sale of Housing Accommodation: The developer may advertise the housing development to the public. That is one way to woo purchasers to buy the properties in the development. Before it advertises the development, the developer must have an advertisement and sale permit. Without the permit, no

advertisement or sale can be made to nor moneys collected from the purchasers. If the developer breaches this provision, it is guilty of an offence and is liable on conviction to a fine of not more than RM20,000 or to imprisonment for not more than 5 years or to both.

Transfer of Title: In practice, upon issuance of the title, the developer would instruct the solicitor on its panel to attend to the transfer of the title to the purchaser. After receiving the developer’s instructions, the solicitor would write to the purchaser and

ask him to sign on the transfer form. The purchaser has the option to appoint either the solicitor on the developer’s panel or his own solicitor.

Defects Liability Period: In a defect claim, the purchaser gives a written notice and a defects list to the developer for the developer to make good the defects. Also, the purchaser gives a written notice to the stakeholder solicitor asking it to hold the stakeholder sum until the defects are repaired. The purchaser gets the relevant party to acknowledge receipt of the notices.

If there is a dispute between the purchaser and the developer regarding the defects, the stakeholder solicitor may file interpleader proceedings in the High Court to decide on the release of the stakeholder money. Alternatively, the purchaser may file a claim for the defects at the Homebuyers’ Tribunal.
