TEKAT MAJU HOLDS SOFT LAUNCH FOR VILA ELEMEN Tekat Maju Sdn Bhd recently held the soft launch for Vila Elemen, its latest development in the Sultan Abdul Aziz Shah Golf Club in Shah Alam which comprises semi-detached homes and bungalows. Spread across 8 acres of prime leasehold land, the low-density project has a gross development value of RM200 million.

NAZA TTDI UNVEILS TTDI GATEWAY Naza TTDI Sdn Bhd has unveiled TTDI Gateway, a landmark business lifestyle hub in Section 13, Shah Alam. The 38.8-acre master planned integrated development will comprise offices, serviced apartments
and retail components divided into three phases. It has an expected gross development value of RM2.5 billion and is targeted to be completed by 2020. The project was conceptualised based on three key ideas: vibrancy, visibility and value. Sited a stone’s throw away from sports and recreational attractions, the Vibrancy of Section 13 is expected to be further enhanced at TTDI Gateway. Furthermore, the development enjoys prime Visibility thanks to major highways as well as the closeness of public transportation options and offers Value through its three major retail components which are an existing hypermarket, a home improvement store and a retail mall. The first phase of TTDI Gateway, TTDI Sentralis’ business suites and retail spaces, was launched late last year. The business suites saw a healthy take-up rate of 70% while the retail units are fully sold. The upcoming launch in the third quarter of 2014 will comprise TTDI Sentralis’ serviced apartments as well as the retail spaces and offices for Phase 2.

TROPICANA SELLS KUALA LUMPUR CITY CENTRE LAND Tropicana Corporation Berhad announced the sale of approximately 3.138 acres of prime freehold land located along Jalan Bukit Bintang in Kuala Lumpur to Offshore Triangle Sdn Bhd for a total cash consideration of RM448.4 million or RM3,280 per sq ft. Targeted for completion in the first half of 2015, this transaction is expected to generate an estimated net gain of RM145 million for Tropicana, translating into an incremental net earnings per share of 11 sen. Offshore Triangle Sdn Bhd is an alliance between Tropicana and Agile Property Holdings Ltd, a property developer in China, with Agile Property having a 70% equity stake in the joint venture and Tropicana the remaining 30%. The proposed land acquisition is earmarked for a mixed commercial development. This sale and the joint development agreement underscore Tropicana’s transformation strategy
in unlocking the significant value of its land bank through development as well as disposal opportunities and forming strategic alliances to accelerate growth. Land sale transactions undertaken by the Group over recent months, including this transaction, will raise gross proceeds of approximately RM1.1 billion and are in line with its focus on de-gearing and strengthening its group balance sheet.
FRONTIER 2 WINS “BEST IN MALAYSIA: INDUSTRIAL DEVELOPMENT” Providing a recreational park at the centre of an industrial zone in Malaysia is almost unheard of, which is probably why Frontier Industrial Park in Johor Bahru won the Best Industrial Development in Malaysia category at the Asia Pacific Property Awards. Frontier Industrial Park Phase 2 (Frontier 2), a gated eco-friendly project with 92 semi-detached and detached factories was named the “FiveStar Winner” as Best in Malaysia for Industrial Development. The project is developed by WB Land Sdn Bhd, a company backed by Woon Brothers Construction Sdn Bhd which has a 38-year track record of delivering its projects ahead of schedule. It is adjacent to the matured industrial hub of Desa Cemerlang and has a two-acre Central Park equipped with a gym and other sports facilities. Aside from this unique feature, Frontier 2 also offers other practical and eco-friendly solutions. For instance, the buildings are North-South oriented to avoid the glare of the sun and high glazed windows that let in natural light without the heat. Rainwater harvesting is also a standard feature of the factory units together with front and side roller shutters.

3 iProperty.com: How would you describe your company’s performance in the first quarter of 2014? Dato’ Sri (Dr) Vincent Tiew: We are on course thanks to the preview of our Scott Towers @ Larkin development in Johor Bahru in the first quarter of 2014, but we still have a long way to go before we reach our targeted gross development value sales of RM750 million for the year. This is partly due to the soft property sentiment in the local real estate industry which continues to persist at this point in time. In general, I would say we fell a little short of our target in the first quarter but we are looking to pick up the pace in the second quarter of this year. iP: You have two projects planned for the second quarter of 2014 which are Taipan @ Slim River and EVO SoHo Suites. What can you tell us about Taipan @ Slim River? Dato’ Sri (Dr) Vincent Tiew: Taipan @ Slim River is spread across 12.793 acres of land in Slim River which is the second largest town in Perak’s Tanjung Malim district and is developed by Bella Advance Sdn Bhd, a wholly-owned subsidiary of the Andaman Group. It is a freehold commercial and business centre development with a doublestorey retail centre, hypermarket and restaurants which has a gross development value of RM65 million.

Dato’ Sri (Dr) Vincent Tiew: It is the final phase of Sentral @ Bangi, a joint venture project between PKNS Holdings Bhd and Andaman Group which is being handled by the joint venture company PKNS-Andaman Development Sdn Bhd . EVO SoHo Suites occupies 4.436 acres of the master development’s total land and comprises two tower blocks of Small Office Home Offices (SoHos), a four-storey shopping centre and a six-level car park. These two 31-storey towers which are positioned on top of the shopping centre consist of 440 units of the Type A studio SoHos and 176 units of the Type B studio SoHos with similar built-up sizes of 454 sq ft, 44 units of Type C duplex SoHos with built-up sizes of 1,217 sq ft and 44 units of Type D duplex SoHos measuring 1,352 sq ft in built-up size. During that period, we will be launching a total of three projects valued at more than RM2 billion in terms of gross development value which is expected to spill over into 2015. How Much Is Really Needed for Affordable Housing
HOW MUCH IS REALLY NEEDED FOR AFFORDABLE HOUSING Is it more than just a myth?
You may find it hard to believe. Just 4-5 years ago (Date of writing: Feb 2014), it was actually possible to own a decentsized and decent quality condominium unit in urban centers like KL / Petaling Jaya / Johor Baru / Penang for RM200,000. They were in fact, quite common. From 2010 up until 2012, the government had considered the price bracket of RM220,000 to be within the “affordable” housing range. This was evident when they first launched the My First Home / Skim Rumah Pertamaku (SRP) for houses up to RM220,000. However, towards the tail end of 2012, it was becoming increasingly evident that houses for that price were becoming more of a rarity. Genuine first time house buyers were gradually finding themselves priced out of the market. Recognizing the changing property price landscape, the government in 2013 bumped the maximum price range for qualifying for SRP up to RM400,000. The move garnered ridicule from both sides of the spectrum for different reasons. On one end, lower income groups found it laughable that a price tag of RM400,000 for a house could even be considered “affordable” as it was far beyond their reach.

On the other hand, the younger and more urbane groups who were striving towards their first home derided the ceiling price of RM400,000 as being out of touch. Their contention was that prices for an acceptable standard of housing was already priced beyond RM400,000. If anything, the government’s efforts at trying to determine what is “affordable” shows us that it should be assessed to our personal situation. And what might be affordable to you today may no longer provide as comparable a standard of living compared to what was affordable to you 5 years ago. Regardless of what is affordable to you, how much is really needed to purchase an “affordable” house? We examine house prices ranging from RM100,000 to RM600,000. AFFORDABILITY OF INITIAL ENTRY COSTS Firstly, are the entry costs of purchasing a house. The table above illustrates the kind of up-front cash one must have to purchase a house in a given price range. There is the standard 10% down payment, along with the rest of the legal fees and stamp duties which follows a scheduled fee structure.
If the entry costs above look discouraging, fret not! There is hope yet. If you are a first time buyer, there are certain schemes and methods that you can take advantage of to ease your burden of saving up enough cash. These include: i) A 50% Stamp Duty Discount on Sale and Purchase Agreement for properties up to RM400,000. ii) Skim Rumah Pertamaku, which allows you to take a 100% loan for properties up to RM400,000, negating the need to pay the initial 10% down payment.
Even if one does not qualify for the above schemes, there is still KWSP’s scheme that allows you to withdraw money from your EPF Account II to help pay for the down payment of the house. AFFORDABILITY OF LOAN Even if one can afford the initial cash outlay to purchase the house, one must still be able to qualify for a mortgage loan to proceed with the purchase. When assessing whether a housing loan is affordable, there are 2 criteria that must be considered. Firstly, do you meet the minimum acceptable level of income you must have before a bank would even give you
a housing loan. Secondly, even if you do qualify for the home loan, after paying off your monthly installments, realistically, could you get by on the remaining amount? It would be unwise to enter into a home purchase if your answer to either of the above is “No”.
The table above indicates the estimated minimum level of household income one must have to qualify for a loan of the given amount in the year 2014. It also shows clearly the estimated monthly installments one must pay. These calculations have not even taken into consideration any other commitments that you may have! CONCLUSION While your personal financial situation may be unique, the costs associated with the purchase of a home are somewhat set according to price. The best way to know what you can afford is to measure your personal finances against the required costs. Investors to Sabah have in the past primarily concentrated on its three main sectors-agriculture, oil and gas and tourism. However rising prices of land in the state has propelled its property sector to the forefront generating much interest in the land acquisition in urban and suburban areas of Kota Kinabalu as well as in upcoming townships in Lahad Datu, Sandakan, Labuan and Tawau. The demand for these land banks is from developers in Peninsular Malaysia and as local tycoons are looking to diversify interest. The robust growth experienced in Sabah’s tourism industry has also contributed to the increasing momentum of its property sector. Sabah receives about 4 million visitors a year, about two-thirds of whom are domestic tourists. Although the industry took a serious beating last year as a result of the insurgency uprising in Lahad Datu, it has bounced back and is seeing a rise in its visitor numbers. Tourism is not just a key driver of Sabah’s economy; it has also helped to create jobs for the local people and helped to raise income levels. The improvement in tourism has brought on a demand in leisure property development benefiting retail, commercial and residential property sector.

DEVELOPMENT PUSHING PROPERTY PRICES UP Sabah is currently in a rapid economic development phase as part of the Economic Transformation Programme, which is spearheaded by Sabah Economic Development and Investment Authority (SEDIA). Areas of focus for development have been designated as the Sabah Development Corridor (SDC). The aggressive implementation of SDC supported by soaring oil palm revenues have seen Sabah’s real estate market sector recording a high demand. Property values are reportedly appreciating in all segments with prices for residential, commercial and industrial units projected to increase by 5-10% over next year. The emphasis will be very much in increasing Kota Kinabalu’s economic performance and liveability. The strong development impulses generated have seen the expansion of more premium property developments within a 5km radius of Kota Kinabalu, making the state capital an attractive investment destination for overseas investors. Notable developments around Kota Kinabalu are the Riverson Projects, Kota Kinabalu Waterfront, The Loft Residence, The Jesselton Residences as well as Pacific City, which
is set to become Kota Kinabalu’s largest and most significant landmark to date. The project offers purchasers the convenience of living in a modern integrated complex with retail, entertainment, health and leisure facilities within easy reach. AFFORDABLE HOUSING: AN INCREASING CONCERN Increasing property prices in Sabah has raised the issue of affordable housing for locals. After Selangor and Kuala Lumpur, Sabah has registered the highest increase in house prices averaging 11 to 12% annually over the past 3 years. Double storey residential property prices start at above RM360,000. Although Sabah has sizeable land, the shortage of developed land is as a result of the slower pace of infrastructure development. Physical and economic developments have been very much focused on Kota Kinabalu encouraging much rural to urban migration. Most developers concentrate on the medium to high end market as margins are better. The lower end market to which the
majority of the population belongs is grossly underserved. There exists a serious gap of more than 40% between demand and supply of houses in this segment. There are some initiatives by the state government currently in place to address affordable housing but it will have to be executed in tandem with growing demand. AN OPTIMISTIC MARKET The Sabah property rise is in its preliminary stage and has much potential for growth. Many of the country’s biggest developers are making their presence felt in the state. The focus has been mainly in Kota Kinabalu but growth in other parts are also gaining momentum.

1 After spending most of his life in Perth, Australia Tee Hong Wee returned home and embarked upon one of his life’s biggest journeys. Currently the Founder and Managing Director of the highly successful Chang Cheng Group, his foray into realty was complemented by his appointment as President of the Sabah Housing and Real Estate Developers’ Association’s (SHAREDA) Youth Council. Tee’s current project as head of Chang Cheng Group is the mixed development, C-Park, which amongst others will house President College’s East Malaysia campus and the tallest hotel in Sabah operated by an acclaimed Hong Kong group (Lanson Place). Despite that, he and his team believe in the importance of giving back to society.

Tasked with the duty of overlooking the association’s corporate social responsibility, the recently-appointed SHAREDA Youth Council head shared with iProperty.com his plans for the remainder of his time with the association, his views on going green and his perfect Sabah. iProperty.com: Francis Goh, President of SHAREDA, has given the youth wing the task of networking and facilitating young developers. How important is it in real estate to have a fresher, younger perspective? Tee Hong Wee: While it is my belief that a fresher perspective and new ideas are always welcome especially in our field of real estate development where architectural and engineering
designs are always pushing the frontier further, the experience of the older generation is essential in our industry as it will help curb the mistakes that separate profit from bankruptcy. Such is the effect of the sheer volume of this business. Moreover, it is imperative that the younger generation obtain the proper grooming, network and view each other as allies rather than competitors. Past generations practised what I call ‘cannibalism business’ which perpetuates the idea of a dog-eat-dog environment. The present generation, however, aims for synergy and a good working relationship with their partners as those are the ingredients for good business growth. Growth through these synergies is my personal, and our President’s, vision of the future.
iP: One of the biggest projects you undertook post-inauguration was the ‘A Day for Family and Giving’ project. Why is this kind of work important to you? Tee: Since the inception of the youth wing, this cause was one of the first corporate social responsibility (CSR) projects that we embarked upon. Apart from the usual donation of food and supplies to the underprivileged, this program was unique and not your average CSR project.
Tee: Like any other state or even country, the balance between development and nature is always a hot-button issue for policymakers. Unfortunately, in most cases development results in the deterioration of the environment. I do believe, however, that Sabah’s state government has made valiant efforts to set up parks and other conservation sites where developments are strictly controlled.

We supported this program because we believed in the saying, “Give a man a fish and you feed him for a day; show him how to fish and you feed him for a lifetime.” In this program, we were asked to provide supplies and physical manpower to assist in the digging of a 25m fish pond which the orphanage could use to breed fish. Japanese exchange students were even flown in from their home country to help. We are hoping that this event will be an annual one so we can gather more youth to embrace the joys of giving.
Nevertheless, I encourage my fellow developers to minimise their impact on the environment as well as try and build as green a development as possible so that future generations will be able to still enjoy Sabah’s natural beauty.
Additionally, the government should also adopt lower taxes for developers undertaking green projects as the current stamp duty waiver is not big enough an incentive for mid-range-priced developments.
iP: Do you worry that urbanisation will take over Sabah’s status as one of Southeast Asia’s most natural resources-rich places?
iP: Do you think enough is being done to preserve nature when it comes to the country’s rapid development? Tee: I commend the efforts of our policymakers in implementing green initiatives such as the Green Building Index (GBI) and the Feed-in Tariff (FiT) but I believe more can be done as they are not enough to convince developers to adopt these green policies. Unless you are selling properties at RM1,000 per sq ft,
Too much onus and pressure are placed on developers to build not only green but affordable housing. I believe that if we are to truly preserve our environment all parties have to play their part, not only the developers. For example, financial institutions should not only prioritise loans for green projects but lower the interest rates as well.
iP: What are your plans for the rest of your tenure? Tee: In addition to the CSR efforts that I mentioned, our youth wing will also be undertaking two charity golf events, a SHAREDA Youth Gala Night, a Christmas Shoebox Giveaway and most importantly our own CSC program – SHAREDA Sustainable Support for Society – in which we will be raising funds through internal events. We hope to use these funds to build at least 10 homes for the poor in rural areas.

A NATURALLY BLESSED STATE Leveraging on the state’s natural beauty and high tourist traffic, Sabah’s property market has a healthy and promising future on the horizon.
The past few years have been more than kind to Sabah’s real estate industry with the emergence of several high-profile and impressive developments in the market. One such development is PacifiCity, a rescued abandoned project handled by Pacific Sanctuary Holdings Sdn Bhd. iProperty.com spoke to the company’s General Manager (Commercial Affairs) Jonathan Wheeler to learn more about his opinion on the property industry of Malaysia’s easternmost state. iProperty.com: What are some of the key differences between Sabah’s real estate market and the market in the peninsula? Jonathan Wheeler: In Kuala Lumpur, prime new residential developments have reached the levels of sophistication and design as well as offering facilities often equivalent to those of Singapore and other established global cities. These types of developments are characterised by prime connected locations, very high-end finishes, firstclass maintenance and even the offer of concierge and management services.

In contrast, developers in Sabah have only recently started to provide this standard of property; the demand for such things until now was not widespread and those who could afford this luxury would usually build their own houses.

However, that is no longer the case. Land prices in the prime areas of Kota Kinabalu have increased to such an extent that it is more economical to build condominiums than town houses. Additionally, there has been a renewed demand for high-quality housing fuelled by a new generation of well-travelled local professionals and the growing presence of expatriates who are moving here to either work in the oil and gas industry or for retirement purposes. To put things in perspective, prices for high-end sea-view condominiums in the desirable areas of Kota Kinabalu such as Signal Hill, Likas and Waterfront barely breach RM1000 per sq ft, which is considerably lower than the equivalent locations in Kuala Lumpur or even Penang and Johor where prices can be as high as RM2500 per sq ft. iP: Kota Kinabalu is slowly but surely becoming a thriving metropolis. Will the urbanisation of Sabah affect its reputation as a land rich with natural beauty? Wheeler: Sabah has a world-renowned reputation as a place of natural beauty, boasting the best beaches in Asia, majestic mountains and jungles teeming with wildlife as well as a rich cultural heritage. The state also has vast resources in the form of oil and gas as well as agriculture which are two of its most valuable income generators.

Kota Kinabalu is the gateway to accessing these wonders and resources. For the state to continue to thrive, the capital city must be able to handle the business and tourist demands that come its way. As with any urban centre, city-planners have the challenging task of balancing development with social and environmental concerns. In Sabah, I have been very impressed with how the authorities handle this as there are effective town, district and regional plans for multi-sector economic development along with zoning for conservation of waterfronts and land banks.

I first saw this here in the palm oil industry which is a major component of the state’s gross domestic product. Palm plantations in Sabah were among the first in the world to be certified as sustainable sources of palm oil and this happened so quickly due to the efficient public-private coordination and forward planning being practised here. The same level of coordination can be found in the state’s zoning of areas for development and conservation. A lot of research and consultation goes into these plans and it is always done with the balancing of economic growth with conservation in mind.

iP: How does Sabah’s high tourist traffic influence the transactions of residences in Sabah? Wheeler: Sabah has so much to offer visitors; because it is blessed with unspoilt natural beauty and located in the heart of Southeast Asia, it is no surprise that Kota Kinabalu International Airport is now the second busiest airport in Malaysia. After all, it has direct connections throughout Asia as well as Australia and is within a 3-hour flight’s distance of nearly every major city in the region. The arrivals in Sabah last year topped 3 million, which is a fantastic achievement for the state and the local economy.

7 This naturally has had a positive influence on the housing market in Sabah. When a visitor experiences first-hand the quality of life we enjoy here, the low crime rate and economical cost of living, it causes many to wish to immediately relocate or ultimately retire here. We have seen this with overseas buyers of our residential projects who come from West Malaysia, Hong Kong, Singapore, Korea and Taiwan. There is also a strong demand for shortstay accommodation especially in Kota Kinabalu as the rapid growth in tourist arrivals has resulted in a shortage of hotel rooms. Hotels in the city enjoy some of the highest occupancy rates in Malaysia and
iP: As a developer, what is the best philosophy to practise when embarking on projects? Wheeler: For any project to be successful, we believe it must first benefit the surrounding community. Regardless of whether it is a residential, retail or commercial project, if it fails to add value to the lives of existing residents and businesses then it will be very difficult to achieve financial success through it. Before embarking on any project, we make sure our investments will have the best possible social and environmental returns. That is not to say that financial returns are ignored; we have in fact seen these actually improve when we focus first on the social and environmental aspects of a project before we concentrate on the financial gain aspect. iP: What is your opinion on the future growth of Sabah’s property market? Wheeler: Sabah has so many catalysts for economic growth which, combined with well-managed governance, can only ensure that the state continues to thrive. Well-located properties as a result should remain a good investment avenue as more companies especially those in the oil and gas industry set up offices here. This is because the demand for housing will increase, which in turn should bolster the demand for rental units and increase the budgets of local residents.

muscles sometimes have to work in a small kitchen. Another limitation is plants. Not many apartments come with gardens or flower beds, so residents are only able to store potted plants indoors. Not all plants work under such lowly-lit conditions. For those of you seeking stress-free greenery options, here are a few you can consider. POTHOS Because: You can put it in a pot or let it hang from above. It
requires only a little bit of water and close to no sunlight at all. And the best part? It absorbs toxins from its surroundings. How cool is that? The only thing to remember is to keep cutting the plants back from overgrowing. ALOE Because: You’d probably recognise the name as it is an ingredient in many medicinal and toiletry products. As the townships are already established and rather crowded, there aren’t many new developments in the pipeline. While there are some new condominiums and apartments being constructed in the southern parts of the township, most new developments are opting for Bukit Jalil instead of OUG. A new commercial complex that is being built in the middle of OUG offers a new wet and dry marketplace for traders and shoppers. Sources reveal that Lucky Plaza (Central Plaza) in OUG has been purchased
by a developer, and stopped operations in August 2013 in lieu of redevelopment. Most of the existing houses within the townships are aged and even though most of these houses are freehold, the poor maintenance has affected its desirability, making it less competitive against new products. However, due to the great location, facilities and living environment, prices have not shown any signs of decreasing. With many of the existing landed properties filling up the land spaces, more high-rise properties can be expected in these areas.

Good money management can mean many things – from living within your means to saving for short and long-term goals, to having a realistic plan to pay off your debts. If you want to get on top of your finances, a budget is a really good way to start. It’s a record of money you have coming in and of payments that you make. Keeping a spending diary is an effective way of seeing exactly what you spend your money on. For most homeowners, your mortgage payment is by far your biggest monthly expense. Owning a home outright can be a huge financial advantage, but there’s no rush. In most cases, you will stick to a 30year repayment tenure and you may invest your extra money in gaining extra income from other investment tools. Calculate how much you would save by paying off your loan early, and then compare your savings with how much your extra payments could earn you if invested in a mutual fund, earning 8%-10% per annum.

The equity in your home (what it’s worth minus what you owe) can be a good source of low-interest funds for major purchases. Consider refinancing or top-up loan credit line (applicable to properties with higher market value compared to agreement value) to generate cash if you need to finance home improvements or have other major expenses to cover. In addition, if you’re carrying a lot of high-interest debt, you can use your equity to reduce the interest you pay. Just don’t go overboard. Despite all of the problems with mortgages during the housing downturn, mortgage debt is still considered “good” debt. But it’s still debt, so don’t abuse your equity. Remember, the collateral for these loans is your home. For most housing loans, the interest rate you pay will fluctuate with the rate of the market (refer to previous Base Lending Rate). Usually this will not modify the overall amount of your mortgage payment, but rather, change the portion of your monthly

The above table shows that those with loans with compounding interest of 1.05% will pay twice the total payable interest as at Letter Offer; provided that there is no further increase of interest rate for its balance tenure of 321 months. COMPOUNDING INTEREST: LONGER TENURE CREATES GREATER COMPOUNDING EFFECT The compounding interest graph tells us that we should, at any time, review our Base Lending Rate as well as effective interest to capitalise the capital arrears (shortfall of monthly principle payment). Otherwise, you have to pay 1 to 3 times more of its payable interest as at Letter Offer and it is always subject to the Base Lending Rate. You can definitely pay less interest by using the same formula that incurs compound interest. This doesn’t mean reducing loan amounts or loan tenures by depositing lump sums to slash the principle outstanding amount. Rather, it is using a patterned formula - namely the “Slashes Interest Methodology” - to avoid compounding interest and further slash the loan interest and tenure by half. This methodology is using the opposite method from banking practice to gain yourself unexpected savings from your future payable housing loan interest. There you have it. The benefit of real estate investing is about making money. Just be sure to run the numbers either on your own with good real estate investment software, which gives you accurate information, or with the help of a professional. Remember, real estate investing isn’t whimsy, it’s business. Best of all, real estate investment is profitable when done correctly.

ENSURING SMOOTH TRANSITION TO JMB OR MC How you can make sure your management works for, and not against you.
HASSLE-FREE: Section 15 of the Strata Management Act, 2013 (Act 757) (SMA) was drafted with the intention of ensuring a smooth transition from developers to a Joint Management Body (JMB) or Management Corporation (MC). It is generally agreed that the current Strata Titles Act, 1985 (Act 318) is difficult to understand whilst the Building & Common Property (Management & Maintenance) Act, 2007 (Act 663) is too shallow and has its set of teething problems. It is indeed an astronomical problem for people who rely on the prevailing laws to determine their rights, benefits, obligations and duties. Many homebuyers complain about the difficulties involved in obtaining from the developer necessary documents required to effectively form a JMB or MC.

The management and maintenance of a subdivided property is the most important factor in ensuring the continued value and enjoyment of all. More assistance to purchasers/owners for the periods mentioned below is needed, especially in light of the confusion that has arisen, especially from the purchasers/owners’ side: (a) JMB stage; (b) before forming MC; (c) transition from developer-controlled to owner-controlled and MC-controlled. Similarly, purchasers have the right to know from the outset (at the time of purchase) the exact amount of their contributions to the management fund and not rely on the “fair and justifiable” proportion to be made known to them only later, after the
developer’s surveyor has done the survey and calculation. As the amount determined is the actual amount, is it sufficient for the actual maintenance and management of the common property? It is only fair that purchasers know in advance what their contributions entail. It is not uncommon to find owners stressed out with the rocky transition when the JMC is moving from developer-controlled to owner-controlled, or from JMC (with developer’s part participation) to MC. To make matters worse, the relationship between the developer and the owners has often been strained considerably due to issues like poor management and maintenance, and high contribution levies. The new SMA addresses this issue from the outset i.e. from the JMB stage itself, when purchasers/owners assume power (to manage) in their hands. HBA MEMORANDUM DATED 12 JUNE 2003 HBA had made numerous recommendations since its existence to all related Ministries and one of which was in the form of a written Memorandum, as early as 12 June 2003, to Datuk Dr Tan Kee Kwong, the then Deputy Minister of Land & Co-operative Development during the ‘Mesyuarat Pendidikan Untuk Bangunan Bil 3/2003’ which has finally become a reality in the laws embodied in the new legislation: SMA. HBA made the relevant recommendations that could enhance the subdivided property’s management and maintenance whether developer-controlled, JMB or MC-controlled. The current Strata Titles Act does not provide for the transfer of documents that are crucial for the MC in order for the it to fulfill its role and obligation. Similarly JMB, formed under Act 663, faced problems (transfer of documents) from developer-controlled to be inherited by the duly constituted JMB. At the Select Drafting Committee where HBA was a permanent member, we have emphasised that there must be:
sinking fund (surplus or deficit); estimated income from all sources, estimated expenditures from the management funds; the total of all contributions to the management fund and sinking fund; a financial statement with details of opening and current balances in the funds; income and expenditures by special levy, etc; • Documents which the developers must present at the 1st AGM — namely all plans required to obtain a building permit and any amendments to building permit plans; any documents in the developer’s possession that indicate the location of pipes, wires, cables, chutes, ducts or other service facilities; all contracts entered into by or on behalf; the registered strata plans; the names and addresses of contractors, subcontractors and persons who primarily supplied labour or materials to the project; all warranties, manuals, schematic drawings, operating instructions, service guides, manufacturers; list of owners with their parcel lot addresses, parking lot numbers, unit entitlement; names of end-financiers: assignment of voting or other rights by parcel proprietors; etc; • Documents to be inherited after the 1st AGM — transfer control of money; keys to the administration office; the audited accounts of the maintenance account and the sinking fund account; updated financial statement to be delivered within a stipulated time frame; ensure insurance coverage continues; etc; and
• Documents prepared by the developers for the 1st AGM — namely Notice of AGM; an annual budget detailing the opening balance in the management fund and

• Budgets and Special Fund — HBA believes that the developer should prepare and disclose the initial budget to ensure accurate estimate of projected operating cost and special fund. Owners should get and deserve the full disclosure by their stratified property developers and the opportunity to develop the budget. STRATA MANAGEMENT ACT 2013 HBA is pleased that our call has been heeded by the lawmakers. In Parliament the Strata Management Act, which then was at its Bill stage, was strenuously debated by both political divides in the Dewan Rakyat and despite the Minister of Housing & Local Government having been queried on numerous issues, this issue of ‘Handing over by developers to the JMB’ was supported by all the Members of Parliament. It even had the unanimous support of the Honourable Senators in Dewan Negara. We now produce herewith Section15 which reads, inter alia: SECTION 15 – Handing over by developer to the joint management body (1) The developer shall, before the developer’s management period expires — (a) transfer all balances of moneys in the maintenance account and the sinking fund account, after payment of all the expenditures which have been properly charged to the accounts, to the joint management body; (b) hand over to the joint management body — (i) the administration office set up by the developer under paragraph 9(4)(a); (ii) the audited accounts of the maintenance account and the sinking fund account or, if such accounts have not been audited, the unaudited accounts; (iii) all the assets of the development area; (iv) all records relating to and necessary for the maintenance and management of the buildings or lands intended for subdivision into

parcels and the common property of the development area; and (v) all invoices, receipts and payment vouchers in respect of the maintenance account and sinking fund account. (2) If only unaudited accounts have been handed over under subparagraph (1)(b) (ii), the developer shall, not more than three months after the expiry of the developer’s management period, hand over to the joint management body the audited accounts up to the date of transfer of the balances of moneys referred to in paragraph (1)(a). (3) Without prejudice to the generality of subparagraph (1)(b)(iv), the developer shall deliver to the joint management body copies of all of the following documents: (a) all approved plans for buildings or lands intended for subdivision into parcels relating to the development area; (b) any document in the developer’s possession that indicates, as far as practicable, the actual location of any pipe, wire, cable, chute, duct or other facility for the passage or provision of systems or services, if the developer has reason to believe that the pipe, wire, cable, chute, duct or other facility is not located as shown on an approved plan or an approved amended plan; (c) all contracts entered into by the developer in respect of the maintenance or management of any building or land intended for subdivision into parcels and the common property comprised in the development area; (d) a copy of the schedule of parcels or the amended schedule of parcels filed with the Commissioner under subsection
6(1) or (2), if applicable, or a copy of the proposed strata plan filed with the Director under the provisions of the Strata Titles Act 1985, if any;
(e) the names and addresses of such contractors, subcontractors and persons who supplied labour or materials to the development area during the construction of any building or land intended for subdivision into parcels and the common property comprised in the development area; (f) all warranties, manuals, schematic drawings, operating instructions, service guides, manufacturer’s documentation and other similar information in respect of the construction, installation, operation, maintenance, repair and servicing of any common property, including any warranty or information provided to the developer by any person referred to in paragraph (e); (g) the register of all parcel owners of the buildings or lands intended for subdivision into parcels; and
(h) the original copy of all insurance policies effected under this Act. (4) Any developer who fails to comply with subsection (1), (2) or (3) commits an offence and shall, on conviction, be liable to a fine not exceeding two hundred and fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both and, in the case of a continuing offence, to a further fine not exceeding five thousand ringgit for every day or part thereof during which the offence continues after conviction.
There is a corresponding Section 55 in the SMA that relates to the same issue from developercontrolled to MC entitled: ‘Handing over of control to Management Corporation’. *The SMA though passed by Parliament and gazetted last year has not been implemented, as yet. It is pending the finalization of the governing Strata Management Regulations.

STEADY GROWTH IN SABAH Sabah’s property market is expected maintain a healthy level of growth despite recent setbacks. - BY CHAN AI CHENG
It appears certain that the local residential and commercial property markets will enjoy growth in the coming years, but recent developments such as the MH370 incident may arguably subdue the tourism market in Sabah and Malaysia in general. According to the Williams Talhar and Wong (TWT) Property Market 2014 report, the property sector in Sabah, which encompasses the residential, commercial and industrial segments, has generally experienced a steady pace of growth thus far. Despite recent macro events such as the decline in palm oil prices and stricter lending guidelines, property prices have been sustained and developments in established locations as well as those close to hubs of activity remain sought after.

HIGH-END AND AFFORDABLE HOUSING INTEREST Francis Goh, President of the Sabah Housing and Real Estate Developers Association (SHAREDA) recently said that Kota Kinabalu is ranked third in Malaysia after Penang and Kuala Lumpur in terms of the rapid surge in property prices with increases by as much as 100% to 150% within the last five years – a trend which is expected to continue for the next five years. He noted that the price of a double-storey terraced house with a built-up area of 1,200 sq ft has increased by up to 114% or RM600,000 between 2007 and 2011. According to the WTW market report, in the high-end condominium sector, units with a good and uninterrupted sea view are commanding higher prices at the RM1,000 per sq ft mark.
The Peak Collection, developed by SBC Corporation, is one of the developments strategically positioned to allow residents to look beyond the sea and towards the horizon. The report indicated that the analysed average transacted sub-sale price for Peak Vista is approximately RM800 per sq ft. The report indicated that developments in good locations which are priced below the RM500,000 threshold have been well-received although these are mainly for apartment or condominium units of about 1,000 sq ft in size. Contributing to this situation is the additional supply of 10,000 units to the current total of affordable houses, with the result being that more than 23,126 affordable houses are set to be
completed within the state in the next few years. “We need the additional houses to accommodate the squatter families that have been recorded by our local authorities. We know there are many more families hoping for decent and affordable housing, and we are doing our best to meet their expectations,” said Sabah Chief Minister Datuk Seri Musa Aman recently. He added that the Lintas Sibuga housing schemes form part of the 13,756 low-cost units that have been completed in the state so far. RISING TOURISM APPEAL The WTW report also stated that the continued uptrend in tourism as reflected by increasing visitor arrivals to Sabah, particularly from China and Hong Kong, through Kota Kinabalu has also augured well for hotels in the city.
STABLE SUPPLY OF OFFICE SPACE In terms of the commercial sector, the report stated that the supply of purpose-built offices during the first half of 2013 remained relatively stable at some 6.2 million sq ft. A significant portion of the incoming office supply will come from the upcoming Sabah State Administrative Complex near Yayasan Tun Mustapha and Wisma Innoprise.
Based on preliminary statistics sourced from the Malaysian Airline System Berhad (MASB) Sabah, Immigration Department and Sabah as well as AirAsia, a total of 3,383,243 visitors had arrived at Sabah in 2013, representing an increase in 17.6% from 2012. Visitors from China, which include those from Hong Kong and Macau, accounted for 360,361 of those arrivals and currently form the largest group of international visitors in Sabah.
It will supposedly accommodate the various departments under the Chief Minister’s Department as well as related agencies and government-linked companies (GLCs). Aside from purpose-built office buildings and signature offices, the future supply of office space outside the city centre
will also come from shop-office developments. With the exception of several recently developed government office buildings, the private high-rise purpose-built office buildings for Kota Kinabalu are primarily more than 12 years old. This development implies that such buildings are in need of renovation in the coming years. Goh noted prices of two-storey and three-storey shop offices have surged by 61% and 111% respectively between 2007 and 2011. He added that despite the fact that more than 10,000 properties of all types are built every year, this was insufficient in meeting or much less coping with the demands of the market.

ECO-FRIENDLY, FENG SHUI-FRIENDLY? Can these two equally important elements co-exist? Going green is no longer a movement pushed to the forefront by tree huggers around the world, it has become a lifestyle as of late, a way of living almost. Being eco-friendly is more than just aiming towards minimising the catastrophic impacts of global warming; it is about creating and maintaining a sustainable living environment for us and the future generation. As they say in order to start big, you start small and begin from your very own home. Planting greens in our property is the simplest, most economical eco-friendly move we could make. From as tiny a plant as a cactus to mighty shrubbery, planting has become more than just decorating. It has contributed to creating a balanced living environment for occupants of a certain area. However, you must be wondering, does this ‘balance’ harmonise the Qi surrounding your property? Despite many pre-conceived myths, there really are no Feng Shui plants. Whatever type of flower you have in your garden doesn’t really affect your property’s Feng Shui. Plants are usually quite harmless as they have nothing to do with classical Feng Shui. They aren’t even mentioned in respect of Feng Shui in the ancient texts so don’t be alarmed about the possibility that planting mother-in-law’s tongue harbours mother-in-law issues. Nor will a thousandmoney plant cash in more wealth for you. Creeper plants? Not creepy at all. They’re all in the name and that’s all there is to it, really.

Now, let’s get to that cactus misconception. Let me be perfectly clear - just because sharp, pointy objects are known to direct Sha Qi towards us, it doesn’t mean those tiny pointy needles of a puny cactus will do the same. The key is to always think of the big picture. Yes, sharp corners are Sha Qi but small pointy plants are not and they will certainly not send off killing Qi in your direction simply because you have it on your desk at home. Remember, it’s all about proportionality in Feng Shui. A tiny little cactus cannot possibly generate substantial negative Qi to harm you. Unless it’s 10 feet high, and unless it is obstructing your main door, your cactus can cause you no Feng Shui harm. What is significant to remember is to always keep the sunlight in. As it is the source of Qi, it is very important to keep the pathway towards your main door as clear and as unobstructed as possible. This is symbolic in our growth and health, or career advancement so, as the Irish would say, “Let the sun shine all day long and may everything go right and nothing wrong!” Nevertheless, look out for any cracks on your property, as they create a wind gap that lures in Sha Qi. As one of the two most important features in external environment analysis, water is the Yang element that demands much attention. The appearance of this Blood of the Dragon itself reflects what type of Qi we are letting into our property.
Healthy, clean and flowing water indicates vibrant Qi bouncing about throughout the property, especially the wealth Qi. Meanwhile dirty, stagnant water causes bad health, poor performance and bad wealth luck for the occupants of the property. Let the water flow, so your Qi circulates and renews itself and that the environment is vibrant and is constantly being rejuvenated. Often, Chinese items have either flowery or romantic-sounding names, but it doesn’t mean they should be taken literally. If you like culturally-inspired furniture, or even a Chinese-style garden, then by all means, go for it! Even if you don’t, you won’t be losing out on any Qi.
