PLAN FOR YOUR FUTURE Cheri Minors, Associate, Cox Hallett Wilkinson Limited Last months article looked at the importance of making a Will and touched base briefly on other important documents to consider in addition to a Will such as a Living Will (also known as a Health Care Directive) and an Enduring Power of Attorney (EPA). In order to demonstrate how useful these documents can be in addition to a Will let’s look at an example. Tom is 66 years old. He has recently been in a traumatic car accident and is paralyzed from the waist down and is in a coma. The doctor has advised that Tom may be permanently paralyzed and may never recover physically. Tom is also currently on life support and can be in a coma for a prolonged period of time. Tom owns a property and lives alone. He has several bank accounts all in his sole name. A Living Will provides an individual with the power to make provisions for the kind of medical treatment they want to receive prior to becoming incapable of making such decisions. If Tom had a Living Will in place at the time of his accident then he could have appointed an individual of his choosing to be responsible to make medical decisions on his behalf. With a Living Will Tom could also direct to refuse medical or surgical treatment in certain circumstances i.e. if the burdens and risks outweigh its potential benefits. Being able to direct what treatment you do want to receive and don’t want to receive while mentally and physically capable takes the burden of such decisions off of the shoulders of your loved ones. Tom could have directed in his Living Will that he did not wish to be kept alive by artificial means. A Living Will will typically only come into effect when two registered medical practitioners are of the opinion that you are no longer capable of making and communicating decisions about your medical care. This is usually the case when you are either unconscious or unlikely to ever regain consciousness, suffering from an incurable or irreversible condition which will result in your death or are severely mentally or physically disabled.

Without a Living Will in place, Tom’s family will have to make difficult medical decisions about Tom’s future health care. The other such important document to consider having in place is an Enduring Power of Attorney. An EPA is a documents whereby you can appoint a family member, loved one or trusted friend as your attorney at law to manage your affairs in the circumstance that you are unable to manage your affairs on your own. In the case of Tom, if he had an EPA in place at the time of his accident then such attorney would now have the power to manage his affairs on his behalf. With an EPA in place the appointed attorney would be able to access Tom’s bank accounts to either pay any outstanding medical expenses and/or any outstanding bills such as rent, utilities and maintenance expenses. Without an EPA in place Tom’s family will now have to make an application to the Supreme Court of Bermuda for a Receiving Order to obtain the authority to manage Tom’s affairs on his behalf. Such application is not only costly but also burdensome. An EPA can also be a useful tool for the elderly. An EPA can be drafted to either take effect immediately for someone that is currently having difficulty managing their affairs (i.e. if they are unable to walk and are immobile) or drafted to take effect upon the issuance of a doctor’s certificate attesting that an individual is no longer able to manage their own affairs. If you wish to enter into a Will, Living Will and/or an EPA, speak to your lawyer who can provide you with further advice and information. Plan for your future today ... tomorrow may be too late.
