JUST OVER 1,200 COURTHOUSE professionals assembled September 22-24 at the Minneapolis Convention Center to check out the latest in court technology trends, products and solutions at CTC 2015. The show consisted of six educational tracks hosted by court implementers along with their support teams. Each of the six concurrent tracks delivered eight hourlong sessions. he goal of DWI courts is quite clear: to protect public safety by using the drug court model to address the root cause of impaired driving from alcohol and other drugs of abuse. Variants of DWI courts include drug courts that also take DWI offenders, which are commonly referred to as hybrid DWI courts or DWI/drug courts. These courts often enhance their close monitoring of offenders using home and field visits, as well as technological innovations such as ignition interlock systems and the transdermal alcohol detection devices. New developments in these

monitoring devices as well as more stringent substance abuse testing procedures are helping the judiciary branch keep the roads safer and cut down on the number of repeat offenders.

Tracking Technology Trends

Calibrated Solutions

“In view that most jurisdictions require all ignition interlock devices to meet the current NHTSA standards, I believe the new focus will be on the calibration equipment and the overall process of how these certified ignition interlocks are calibrated,” says Brad Boyd, COO at Low Cost Interlock. Boyd feels that monitoring authorities will start to enforce stricter calibration requirements to ensure that the retrieved data reports are a true reflection of the individuals’ breath tests. “If a device is calibrated incorrectly—as a result of faulty calibration equipment and or an untrained technician—this will ultimately cause incorrect breath test readings and possibly allow the individual to drive the vehicle outside the scope of the jurisdictional regulations. CAN OUTSOURCING DEBT COLLECTION PAY OFF FOR YOUR COURT?

DURING

the Great Recession, courts, facing budget cuts and personnel shortages, saw an increase in using third party sources to collect fines and fees. Court collection is a complex and complicated beast. There is not only the matter of compliance; there is also the matter of legal restrictions, chasing down those who don’t pay, convenience on the payer’s part, etc. Don McKinley, owner and founder of National Courts, Collecting, and Consulting (N3CS), notes that collections can become the “forgotten stepchild” until it is budget time. McKinley has dedicat-

ed decades of his career to doing “anything to help courts advance.” As noted on his website (www.n3cs.com), there is an estimated $100 billion dollars in government and criminal debt that is being scrutinized by officials at every level of government. Courts are often criticized for not effectively collecting these debts, and they are also criticized for allegedly levying and collecting criminal court costs, fees, and fines from those least able to pay it. (The first National American Court Collection Conference took place from October 19-21, 2015 to discuss such matters.) Budgets are stretched, personnel are

down, and the fact is, many agree, courts need help. That help can come from third parties such as consulting organizations such as N3CS, other government agencies, and technology and service providers such as RevQ and nCourt.

Factors to Consider There are several things to consider when debating involving a third party. Nial Raaen, principal consultant at the National Center for State Courts (NCSC) points out that during the recession there was a lot of interest in third party services, but since then the trend has tapered off a

bit. (There is not much data on whether courts are using it more or less.) He furthers that there are avenues that can complicate matters. Legally some states can pass a collection fee onto an offender, and some states cannot, so that will have an impact on utilizing third-party services. There is also, says Steve Ard, chief operating officer at RevQ, the matter that “it can be very difficult for courts to procure services due to the complexities of the procurement process and the compliance requirements that surround the collection of debt.” Raaen suggests that courts examine some considerations. Who’s going to bear the costs? What will be the metric of success? What services are being offered? The primary consideration, says McKinley, is that jurisdictions not consider courts to be revenue gener-

ating sources. That’s where entities can get into trouble, and once that path is taken, it can become a slippery slope. He points out the Department of Justice’s Report on Ferguson, Mo., which “did not have a good collections process.” The system relied on courts to generate revenue rather than for enforcement and complicity. Simply put, if they wrote more tickets, they would have more money. (Since then, the judge and clerk in Ferguson have resigned.) He stresses that there is indeed a positive role for outside vendors, but courts must be mindful and pay attention to what those vendors are doing. It is not just a matter of courts turning over the responsibility to an outside organization. The court still has the overall responsibility and jurisdiction in the case. “It’s a matter of compliance.”

Policy in Place? One problematic policy addressed at the conference, says McKinley, is that courts do not have their policies in writing. If policies are handed down orally, the problem starts there. Steps A through Z should be in writing. Courts should ask themselves: How complete are they? How up-to-date are they? If they are not defined completely, they are open to interpretation, or worse, misinterpretation. It should be, says McKinley, if someone comes in off the street, they should be able to understand the policy, and those policies should be reviewed every year or two. He also advises that small steps such as referring to those who owe money as “customers” rather than “defendants” can have an impact.

“Once we label someone, it tends to make us look down our noses at them, even if it’s inadvertently.” His goal, he says, is to get customers out of the system as soon as possible. “If I get out of bed and help someone be more successful than they were before they met me, it was a good day.” He furthers, “It’s never about the money. It’s about compliance. If you focus on the compliance, the revenue will take care of itself.”

Another Option: Other State Agencies Another third party option for courts to use is other state programs, which, says Ard, “act as an agency within the state for courts’ collection needs.” California uses the Franchise Tax Board, which in other states is known as the Department of Revenue. Says Raaen, the Department of Treasury can provide tax intercept services for state taxes, but that issue is moot for states such as Florida and Texas that do not have state income taxes. Steve Ard and Jon Daane of RevQ note that, “Initially (over the last 20 years) collections were handled in-house. Over time it became a mix of in-house and outsourcing. This evolved into more outsourcing with an emphasis on managing the agencies and accounts being forwarded. Now we see a lot of hybrid models where the courts will take the initial steps in collecting on accounts, then based on strategies they have in place will outsource some or all as well.” RevQ, they say, is in a unique position having worked with government agencies, particularly courts, for over 20 years. The company provides not just technology but full solutions to improve in-house collections, the ability to outsource and manage effectively, and integrate with the “bigger picture” programs within the states. Other services are consulting to

increase revenue, reduce management and improve management. Finally, their services include client care, custom development, and training. RevQ’s collection product is Revenue Results, which can be used in numerous arenas by any government agency. turn minimizes user time doing manual tasks on each account. Those features include generating automated work lists, automated work flow, automated correspondence, payment plans, reporting, forwarding to outside collection agencies, and more. Those functions allow courts to electronically or manually input cases and accounts with automatic linking of multiple debts to a debtor; automatically import account transactions, cases and data from other systems; query accounts, store and use case-specific data, keep track of additional contacts or aliases; view collection activity notes; and customize user screens for specific needs. Daane notes, “The most successful clients use all of the tools.” There is another stage of debt collection aside the overworked courts and chasing down delinquent debt. There is also the matter of those who just want to pay their fine and, as McKinley says, “Get out of the system.” For years the

only two options for paying fines and other fees were either in person at the courthouse or by mail. Courts have been adopting the use of technology in every arena, so naturally collections is among them. Software is a primary component to advancing payment methods for payer and payee. One of those providers is Kennesaw, Ga.-based nCourt. Tony Clancy, chief executive officer, states that the company’s services are offered in 1,600 courts around the nation (as well as hundreds of other government customers). He furthers that the issues are uniform in almost all of them: there is too much work and not enough people, and the desire to make collections more accessible is everywhere. He points out one consideration that those involved in collections have

to constantly keep in mind, and that is the possibility of error could mean someone ending up in jail or losing his or her driver’s license. “The people who do it well have to be perfect.” What nCourt offers is the ability to allow “citizens to satisfy their obligations over the Internet, on their smart phone or tablet, or over the phone.” Payers visit a customized website that the company builds for the court. After entering identifying information, the payer reads and accepts the terms. Payers view payment amounts, agree to a convenience fee, and then pay with a credit card. They will then receive an email confirmation of payment. On the court’s end, a clerk receives instant notification when a payment has been made. They use a customized online system to approve or

deny payment with additional options for transferring to a different jurisdiction or to mark the payment as pending. Clerks use a payment dashboard to run reports or gain additional details on transactions. In cases where nCourt integrates with a court’s system, the clerk does not need to review or approve. This all occurs in real time. The service comes at no cost to the court. The citizen pays a convenience fee in order to avoid annoyances such as taking time off work, travel and parking; however, the service does allow “customers to absorb this cost if they wish, buffering citizens from any additional fees.” Courts also receive daily reports. Electronic monitoring technology and equipment provide cost-effective alternatives to incarceration.

ELECTRONIC MONITORING TECHNOLOGY continues to offer an ideal cost-effective tool that can make the difference in assisting an offender’s transition from incarceration or as an alternative to incarceration. The technology was first developed almost 50 years ago by twin brothers Robert and Kirk Gable while studying in the social psychology department at Harvard University. Since that time, electronic monitoring devices have become an essential part of the criminal justice system. By integrating treatment, job support and other transitional services in a supervised program that electronically tracks and documents movements, community corrections officers are now able to help individuals return successfully to their communities. Combined with the cost-effectiveness of this alternative to incarceration, now may be the right time for government agencies to use electronic monitoring. House arrest programs also have the potential to

reduce jail and prison overcrowding, to be more costeffective than incarceration, to provide a flexible sentencing alternative, to provide an immediate sanction, and to provide a greater social benefit than incarceration. When an intensive supervision program is well run, it can have successful outcomes. The technology behind these devices continues to evolve and drive the criminal justice market. Where once it used only radio signals to detect whether someone was home or out in public, now many devices use GPS and cell tower signals to give precise locations. In addition, new advancements in monitoring DUI offenders also can detect blood-alcohol levels through a person’s sweat. “Quite frankly, providing community-based supervision officers with the ability to simultaneously track and engage in two-way communications with offenders makes the current electronic monitoring model virtually obsolete,” says Jeff Milner, VP of sales and marketing at

WHY VETERAN’S COURT? Rhode Island’s VTC specifically helps vets transition back to civilian life. Scott Tirocchi said that when Rhode Island District Court started a vet treatment program in 2011, it had a capacity of 25. As of last month the program’s capacity is about 80. That seems to be following the number of arrested vets coming into the state’s jail population: one year ago the number of justice-involved vets in the state was 150, this year that number is 250. While there is no hard and fast number of vets seeking treatment, “they don’t appear to be reducing,” says Tirocchi, who is the administrator of the Veterans Treatment Court

and deputy director of the Pretrial Services Unit. The day we spoke President Obama had changed course and had just extended our country’s presence in Afghanistan, keeping 5,500 troops on the ground there into 2017. “We can’t expect it not to have repercussions,” he noted. Of 320 million people in the U.S. less than 1% have served in the military. Yet, despite the relatively small percentage, there are currently 22.5 million living U.S. military veterans, and this number is expected to increase dramatically as military

personnel return from Iraq and Afghanistan. In 2010 when Tirocchi was serving as a counselor in the jail system, he observed that a high portion of those inmates were first time offenders who had never been in trouble with the law. Their behavior was not appropriate for civilian life. For example, they were driving at a high rate of speed, a kind of behavior needed in war zones, he explains, and they were commonly arrested for reckless driving or for disorderly conduct. They weren’t aware of the high-risk behavior they were

exhibiting, he says. Veterans had issues such as “TBI, PTSD and substance abuse,” he says, referring to traumatic brain injuries and post traumatic stress disorder. There was and is also significant alcohol dependence and abuse, as well as abuse of opinoids. This type of behavior is on par with veterans across the country, he says. In fact, in 2008 when a judge in Buffalo, N.Y., began making these same observations and noticing an increase in the number of veterans appearing on his Drug Court and Mental Health Court dockets, the Honorable Robert Russell founded the first Veterans Treatment Court. It is a hybrid drug and mental health that treats the particular stressors that follow veterans home. As of June 2014 there were more than 200 of these veterans problem-solving courts in the U.S., according the National Institute of Justice.

Statistics on Vets

Studies bear out that returning vets have difficulties returning to civilian life. In fact, according to a National Academies study, a full 44 percent of returning service members from Iraq and Afghanistan have reported difficulties after they returned. Significant numbers of these deployed personnel have suffered traumatic brain injuries and many have shown symptoms of posttraumatic stress disorder, depression, and substance misuse or abuse. In the scientific literature, the estimates of the prevalence of those conditions among service members who served in these two conflicts range from 19.5 to 22.8 percent for mild TBI (commonly known as concussion), 4 to 20 percent for PTSD, 5 to 37 percent for depression, and 4.7 to 39 percent for problematic alcohol use. These military and veteran personnel often have more than one health condition. The most common overlapping health disorders are PTSD, substance use disorders, depression, and symptoms attributed to mild TBI. In 2010, nearly 300 service members committed suicide, and about half of those suicides involved service members who had deployed to Iraq or Afghanistan. Unlike physical wounds, these conditions affect mood, thoughts, and behavior and often remain invisible to other service members, family, and society. In addition, symptoms of these conditions, especially PTSD and depression, can have a delayed onset— appearing months after exposure to stress. The Buffalo Court acknowledged those comorbid disorders within the veteran population and takes a multipronged approach to dealing with them. As such, it is a collaborative effort among law enforcement, the courts, the V.A. healthcare system and a mentoring program. Like other problem-solving courts, it attempts to rehabili-

tate participants using structured treatment programs rather than relying on punitive sentences. It is reported have excellent results: for those who have graduated the Buffalo program, the recidivism rate has plummeted, with only 5 percent returning to jail, according to a newspaper series on war veterans in The Ithaca Times in June 2015.

High Deployment Rates

Back in Rhode Island, Tirocchi points out they have faced an unusual phenomena in regard to the high numbers of deployments since 9/11. Possibly owing to many Rhode Islanders in the Army and Air National Guard, its 10,000 calls since 2001 from the Department of Defense represent the nation’s second highest deployment rate per capita. When veterans began appearing in their court system, common problems they exhibited were sporadic feelings of isolation, having difficulty relating to those who have not served and future planning goals pertaining to finances, family, vocational and educational objectives. Along with PTSD and TBI, they were having trouble readjusting to the civilian world, and they had substance abuse issues mentioned above. Other unique

issues the Court found in those returning from deployment, Tirocchi says, are that “many will not selfidentify as veterans. They also have a lot of pride…but also a lot of shame.” In response, in April 2011 District Court Chief Judge Jeanne LaFazia requested the Court establish the first Veteran Treatment Court (VTC) within the state of R.I. The RIVTC is designed to direct defendants who have served in the military into a Court program that integrates treatment plans and support with the judicial process. It offers offenders a treatment option, which is judicially supervised and designed to divert offenders away from incarceration by providing rehabilitative alternatives. “It gave them a chance to press the pause button and recognize they needed the intervention,” explains Tirocchi, who is a veteran himself. The Court is a pre-plea, pre-sentence diversion program that is on average 12 months in length. It serves the entire state: the Court is centrally located in Warwick, R.I., and cases are transferred from other counties such as Providence, Washington and Newport, when

deemed appropriate. Similar to those in the general jail population, some individuals have criminogenic risk and will require criminogenic interventions to address these needs. These risks might be a history of antisocial behavior, antisocial personality pattern, antisocial cognition, antisocial attitudes, family and/or marital discord, poor school and/or work performance, few leisure or recreation activities, substance abuse and PTSD. Tirocchi explains that the former soldiers are identified as high risk (criminal)/high need (treatment) or high need/low risk and they treat each accordingly. He notes that his state’s court provides a multi-disciplined team that includes mental health and substance abuse, counselors, prosecutors, the judge, and ancillary organizations such as Americore, as well as the V.A. “We really do an assessment—both criminal and clinical in nature to determine the programming around them. We don’t do the

same [treatment] for everyone but we tailor it to each individual’s need,” he says. Veterans have their unique issues, he furthers. “Many are isolative. They have their own culture… Internally they wage their own little battles and keep to themselves,” Tirocchi says. At the same time he points out civilians in the reserves are being deployed; not just once but multiple deployments. “We face this with treatment that is much more precise, tailored, cognitive behavioral therapy,” he says. “It is a holistic, veteran-centered approach.” And because the Pretrial Services Unit oversees the RIVTA, he continues, “we can ID them early, usually at arraignment.”

Treatment Models

RIVTC employs various treatment models. Among these are: • TAMAR Education Model, a SAMHSA-approved trauma-specific intervention based on psychosocial educational empowerment principles. was developed for women in correctional settings, and provides basic insights on trauma, its developmental effects on symptoms and current functioning. It is a 10-week intervention combining psycho-educational approaches with expressive therapies. • Another is DBT, or Dialectical Behavior Therapy, a cognitive behavioral treatment that was originally developed to treat chronically suicidal individuals diagnosed with borderline personality disorder (BPD) and it is now recognized a standard psychological treatment for this population. It is an evidencebased model that assists in gaining common skills to address interpersonal skills, says Tirocchi. • MRT, or Moral Reconation Therapy, is a cognitive-behavioral program that is ideal for this popu-

lation because it address both substance abuse treatment and criminogenic needs. MRT addresses beliefs and reasoning. It is a systematic, step-by-step group counseling treatment approach for treatmentresistant clients. Tirocchi says he can’t speak enough about it because it offers treatment in a nontraditional manner. It has a homework component and perhaps most significantly “it hits upon values common to the veteran community—i.e., getting one’s own house in order, looking out for others, giving back.” In January 2015 RIVTC initiated the MRT veteran-specific treatment component called Winning the Invisible War. “It is especially effective with this particular population,” he believes. The Rhode Island Court also has another tool that is particularly

effective—a strong mentoring program, says Tirocchi. In the program 19 veterans serve as mentors, representing all branches of the service. “They tend to open up a lot more than with non veterans,” he adds. Since the beginning, we have had 170 folks graduate, Tirocchi says, and between 75 and 80 participants can be accommodated concurrently in the caseload. The court is one of a growing trend: according to Justice for Vets, a professional services division of the National Association of Drug Court Professionals, as of June 2014, 220 Veterans Treatment Courts across the U.S have already served 11,000 vets. As long as “our citizen soldiers” will be called upon, says Tirocchi, Veterans Courts will be challenged to help them readjust to civilian life with as much productivity and normalcy as possible.
