Aside from notorious escapes like that of David Sweat and Richard Matt from the Clinton Corrections Facility earlier this year, prison breaks are decreasing (there were 2,001 escapes in 2013). “the vast majority of escapees are ‘walk-aways’ from community corrections facilities that have minimal supervision,” Slate reported in 2001. (The feds are better at keeping their prisoners inside—in 2013 they had zero instances of escapes.) THERE ARE TWO primary types of correctional video visitations, Chris Talbot, CEO and president of SecureVRS, points out. There is the optional type, in which facilities offer inmates the use of a video visitation system so they can communicate with people on an approved list such as family members, attorneys, clergy, and 22 CORRECTIONS FORUM • NOVEMBER/DECEMBER 2015

doctors, either within or outside the institution. If it is used within the facility, there is no charge. If the visitor is outside the institution, there may or may not be a charge. The availability is “purely optional and purely for the hearing world.” The other type is mandated video visitation, which is a requirement of the Americans

with Disabilities Act (ADA) and requires hearing impaired inmates to have the same phone call access as hearing inmates. While the first case is more common, the use of video visitation is growing in both arenas. There are, however, concerns involving both optional and mandated video conferencing. Officials state that video visitation systems improve security in

numerous ways. Prisoners’ rights activists worry that the system, which they argue can be prone to technical glitches, will replace the free person-to-person visitation with person-to-pixel visitations, and on top of that, the trend might be to eventually eliminate the free in-person visits with one that would require a fee. Lawsuits have been filed, and bills have been introduced and passed. In Dallas in 2013, Judge Clay Jenkins and inmate advocates successfully fought a proposed contract that would have banned in-person visits altogether and awarded a contract that would allow solely for video visitation. State Representative Eric Johnson, who authored the House version of the bill, pointed out to the Dallas Observer that the bill “relates to county jails, not prisons—60 percent of those who are there are innocent, waiting for trial, and couldn't afford the bond to get out of jail." In June 2015, Gov. Greg Abbott signed House Bill 549 into law, which mandates that inmates in county jails be allowed at least two noncontact visitations per week. (Some jails were grandfathered in to remain solely with video visits because they were built without the facilities for face-to-face visitation. The determination will be decided on a case-by-case basis.)

Cutting the Contraband Regardless of the legal battles, the optional use of video visitation can offer a solution to security and other concerns that have long plagued understaffed and overworked correctional facilities. Nathan Skipper, VP of Sales at Montgomery Technology, Inc., (MTI) states, “Ask any facility administrator, and he or she will tell you that one of the biggest headaches of the job is handling visitation. “The primary security concern related to video visitation,” furthers Skipper, “has to do with the

whole reason that it was invented to start with: contraband.” Video visitation can essentially eliminate contraband being smuggled in by visitors because it prevents any physical contact between the inmate and the visitor. Systems also allow the facility to arrange the system so visits are conducted in different areas ensuring that not only are visitors not in contact with inmates, they are not even in the same building. There is also the matter of security of both personnel and inmates. As Skipper notes, video visitation reduces or eliminates the need to move inmates because visitation stations can be mounted in the dorms. “The highest security risk for a correctional facility is caused by inmate movement.” Another security concern, says Skipper, is ensuring confidentiality for privileged visitors such as attorneys, which cannot be recorded or monitored due to client-attorney privilege. He furthers that a system such as theirs prevents this by providing two layers of security. First, attorneys can be registered as privileged visitors, in which case they will not be recorded. Second, facilities have the option to designate certain visitor booths as “privileged” booths, in which case no visit that occurs on those stations will be recorded or monitored. Another security matter is that since so many correctional facilities are in remote areas, the proliferation of off-site visitation brings with it the concern of Internet-based attacks. “While it is highly unlikely that a hacker could pirate the actual video and audio streams of a session, a larger concern is that he or she might obtain access to inmate data, wreak havoc on the system itself, or access recordings.” (MTI addresses this threat through the use of standard security protocols such as firewalls that prevent access to all but the necessary ports. Automating the Process There is also the matter of personnel and time restraints. MTI’s Connexus video visitation solution, says Skipper, “can almost completely automate the visitation process.” The visitation process requires manpower, and depending on the demand, that may lead to overtime. “This is due in large part to the amount of work that is required to locate the inmate, check in the visitor, and facilitate the visit. With our system, we utilize common information about the inmate (such as his current location) to automate the process. So, the visitor can come to a lobby kiosk where he or she picks up the inmate, swipes his or her driver’s license, and is then directed to a visitor booth where the visit immediately begins.” The system also allows a “Floor View” portal that notifies floor officers when a new visit has begun for an inmate. As a result, the floor officer can notify the inmate of an active visit without involving the visitation staff. “This automation can also extend to scheduled visitation. Visitors can use the same lobby kiosk (or our website) to schedule a visit with an inmate. The visitor then shows up at the scheduled time and goes to a lobby monitor to find the visitor booth for his or her visit. With this level of automation, the facility staff can dedicate their time to monitoring visits, helping disabled visitors, and running background checks.” There is, of course, also the matter of mandated video visitation, and Talbot warns of an unanticipated security issue. For decades Congress has implemented laws regarding those with a disability. As Talbot stated in his CORRECTIONS FORUM • NOVEMBER/DECEMBER 2015 23

white paper, “Title II of the Americans with Disabilities Act, 42 U.S.C. § 12141 et seq. extends these same rights to inmates in all state and local facilities.” The concern, he says, comes in when hearing-impaired inmates are incarcerated, they are denied access to the telephone system, yet deaf inmates have constitutional rights to equal access. When access is provided to hearing inmates but not deaf inmates, the facility is open to liability. There was a time that a technology called TTY was used, but that technology is now obsolete and has been replaced by video-based technology that relays calls between a hearing-impaired inmate, a hearing person, and an interpreter. Use of the system is deliberately made easy because the mandate has an ease of use clause. By implementing a commercial video relay service (VRS), correctional facilities are meeting ADA requirements, but, as Talbot says, it might inadvertently being akin to introducing a security threat similar to a sanctioned video cell phone. Says Talbot, “The introduction of commercial VRS without a managed-access system has the potential for illegal activity, including gang con24 CORRECTIONS FORUM • NOVEMBER/DECEMBER 2015

trol, taunting witnesses, planning escapes, or arrangement of other serious crimes. Common security practices implemented by ICS vendors for hearing inmate telephone calls cannot be implemented by VRS providers, per FCC rules and regulations, and are further prohibited from recording VRS/videophone calls and or terminating or reporting

any criminal activity that may be said by a deaf prisoner. Therefore, without a managedaccess system, VRS calls cannot be recorded, monitored or blocked. Additionally, without a security system for commercial VRS in place, prisoners using commercial VRS are easily able to make prison-to-prison calls without the knowledge of prison administration.” The security risks at hand include the fact that there is not a personally identifiable call history. VRS providers often provide video terminals that do not require deaf prisoners to sign in using their own profile before making a video call; therefore, all deaf prisoners share the same user ID. Providers also do not maintain an approved call list, so it is possible for a prisoner to call any telephone number of any deaf person including another deaf person at the same or another location. Furthermore, there is no method to block the prisoner from making an unlimited amount of telephone calls. “After being connected to an interpreter, whether for an inbound or outbound call, the deaf prisoner

cured VRS systems might be proliferating because of the aging inmate population and correctional facilities’ intention of remaining ADA compliant. The mandate covers both deaf and hard of hearing inmates, so inmates who transition from perfect to poor hearing will qualify. They can call anywhere because VRS providers are paid $5 or $6 per minute (it used to be $18 per minute) and can realize huge amounts of income. Even if they

wanted to, U.S. providers are not allowed to be the judge and jury of a phone call, nor are they allowed to record calls. SecureVRS is not a provider, though, so they can. What the service offers is managed access for deaf prisoners that blocks prison-to-prison video calls, monitors and/or records inmate calls (with the exception of clergy, doctors and attorneys), stops unauthorized video calls, and “bridges ADA requirements with reality.” J

Scenarios Talbot considers are situations such as if a gang member were to find out that he could have a right to use VRS. (The other is a doctor’s note.) That member could then have unfettered access to call anywhere in the world. There is also the concern of inmate intimidation. ach and every day corrections staff put their lives on the line working in dangerous and unpredictable environments. Over the years, new developments in asset management, software and monitoring technology have enabled facilities to provide a safer environment for staff and inmates. There is a wide range of equipment involved in prison operations and keeping track of all of that equipment can be a challenge. Among them are solutions such as automated asset management systems, which securely manage access to correctional facility keys, guard weapons and communications systems, as well as track the location of these assets as well as the location of correctional personnel. Other advances in technology have allowed companies such as Black Creek to develop powerful products that incorporate more advanced functions into less

equipment, so that corrections staff can perform their jobs more efficiently. “For example, with our new mobile device app, we have been able to condense an entire touchscreen control station into an Android or Apple tablet,” comments Ike Newton, president, Black Creek Integrated Systems, Irondale, Ala. “Corrections officers are now able to directly supervise their inmates from dayrooms or other points remote from the Control Station while still having all security controls immediately accessible by their side. This makes facilities safer, less expensive to build, and the staff more productive,” he adds. Another security company, Senstar offers an extensive portfolio for correctional environments. “Our perimeter intrusion detection systems have been helping to keep inmates inside prison grounds and our life safety products have been protecting correctional staff for over 30 years,”

reports Stewart Dewar, product manager at Senstar, Toronto. “Our products and comprehensive security solutions are installed in hundreds of correctional facilities around the world. In the U.S., the majority of sites using electronic security utilize Senstar products to prevent escape and keep staff safe.”

Tracking Maintenance Systems Local, state and federal prisons systems are also faced with aging prison assets that are in need of repair or replacement. Making the proper repairs, replacement or refurbish decisions is difficult to do without the correct information regarding an asset’s history. This includes the date purchased, number of work orders, detail of work done and the cause of the work request. Collecting the right information can be done with enterprise asset management-

These types of software are used to automate and schedule maintenance that provides prison and jail administrators with the information they need to make sound asset and maintenance management decisions. The size and scope of the federal prison system makes prison facility management a true challenge even with the best CMMS system. Some of the other notable issues in managing prison assets and performing maintenance include budget reductions and constraints in addition to helping control labor costs. he next tech boom is taking place behind bars. At least this is what a Huffington Post article headline stated in those exact words earlier this year. And according to the quickening pace of inmates using tablets and other technology it seems those words are certainly true. One amazing instance, according to the article referenced, began about five years ago when two San Francisco-based venture capitalists took a risk and set up an intensive tech entrepreneurship program at San Quentin State Prison. inmates with technology they would not otherwise be exposed to inside the walls. Called The Last Mile, inmates in this California entrepreneurship program meet two times a week for six months. Participants, some of whom have never even used the Internet, learn how to use computers, how to connect on social media—tweeting and blogging through handwritten messages transcribed by volunteers—and how to form a business. Day, notes the article, during which participants present their ideas for tech startups to an audience that’s a mix of fellow inmates and some of Silicon Valley’s best and brightest. The event was featured in a documentary short from filmmaker Ondi Timoner, released last March and co-produced by Wired magazine. It features formerly incarcerated individuals that have started their own businesses and learned how to market their firms over the Internet or gotten full-time jobs in the tech market.

Recidivism Sky High Lack of education has been found to be a reason inmates commit new crimes and over 65% land back in prison within three years of release, according to a 2013 RAND corporation report. The report also found that inmates who received education while in prison were 43% less likely to become repeat offenders. Brian Hill, a J.D.-MBA student at Northwestern University, realized the potential inmates have and the impact education can make with them. To that end, he founded a company in Chicago called Jail Education Solutions that has been financed through grants and other support from such groups as the incubator Impact Engine and the MacArthur Foundation. The company created a platform called Edovo that has specially-designed tablet computers that can operate inside correctional facilities. The computers, operating on a closed network, can be rented at low cost by inmates, who choose educational content that best suits their interests and needs— including literacy training, GED studies, college coursework, vocational programs, financial instruction and substance abuse therapy. Hill is hoping that will spread. In fact the JES tablets were part of a pilot program in Philadelphia 36 CORRECTIONS FORUM • NOVEMBER/DECEMBER 2015

where 100 inmates were given the devices to do everything from literacy classes and college coursework to vocational training and financial literacy seminars, according to money.CNN.com. Philadelphia’s reentry efforts are also being assisted by another start-up firm, Textizen. It built a web platform to manage and organize mass text messages for Philadelphia's Office of Reintegration Services (RISE), according to the website. The program adds a streamlined way for case workers to communicate with participants so they can easily remind participants of appointments and alert them to job expos and other community events. "I find I have better results when I use text messages," says Khalil Morrison, a case manager there. He says that approximately “90% to 95% of people show up with a text message, as opposed to maybe 50% [with another method]."

ful in constructive changes in their lives.” Another inmate communications company, Telmate, offers a comprehensive suite of communications, entertainment, education, commissary and cash management software services accessible by various devices such as its tablets, stations, inmate phones and kiosks. Telmate Tablets are wireless, corrections-grade, 7” tablets designed for inmate commissary ordering, education, legal research, messaging, photo sharing and entertainment and much more.

For inmates, the Telmate Tablet provides entertainment (movies, music, news, web browsing, etc.), communications (messaging, photo sharing, etc.), access to services (education, law library, medical, etc.), and access to their account (budget balance, transfers, etc.) To avoid potential security risks, Telmate uses a custom version of the Android operating system. Certain features have been permanently removed while others have been replaced with more secure versions. ing that difficulties during inmate transfer are no longer cause for concern. The use of tablets in the modern day correctional facility aids inmates as well, says Nirav Parikh, GTL’s senior product manager, Mobility. Technology can drive up sales in the commissary due to ease of use and availability. Company president Marshall Boon has found with his clients that on average “commissary sales increase up to 30% when inmates have pod kiosks or tablet devices.” Others concur that technology often brings an uptick in sales. Telmate for example, has a strategic partnership with Trinity Services Group, Inc., which brings automation to the latter’s oversight and delivery of customized food and commissary services. SUPERVISORY TOOLS FOR PROBATION & PAROLE From treatment to intensive supervision, tools that efficiently manage growing caseloads.

T

his past October the Bureau of Prisons early released some 6,000 federal prisoners convicted of drug offenses for which the sentences had been reduced. It was historic. The Washington Post called it “the largest one-time federal release.” (That said, it is interesting to note that state and federal prisons in combination actually release twice that number every week as inmates serve out their time.) Of the inmates set free this fall by the Bureau of Prisons, about two-thirds of them will go to halfway houses and home confinement before being put on supervised release. About onethird are foreign citizens who will be quickly deported, officials said. It is all part of an effort to reduce overcrowding and provide relief to drug offenders who received harsh sentences over the past three decades, according to U.S. officials. The early releases follow action by the U.S. Sentencing Commission—an independent agency that sets sentencing policies for federal crimes—that reduced the potential punishment for future drug offenders last year and then made 44 CORRECTIONS FORUM • NOVEMBER/DECEMBER 2015

that change retroactive. As for the trend regarding adults on probation and parole, it has been decreasing the past few years, according to the Bureau of Justice Statistics’ Annual Probation Survey and Annual Parole Survey. Beginning in 2008 and every year since then until 2013 (the last year statistics are available), the number of adults on community supervision has dropped. Between yearend 2012 and 2013 the number of U.S. adults under community supervision declined by about 29,900 (down 0.6%), dropping to an estimated 4,751,400 offenders at yearend 2013. This decline follows more than two and a half decades of population growth, as the number of adults under community supervision increased each year from 1980 to 2007. But sentencing reform may now reverse that downward trend. According to the Washington Post: The Commission estimated that “its change in sentencing guidelines eventually could result in 46,000 of the nation’s approximately 100,000 drug offenders in federal prison qualifying for early release.” The Sentencing Commission

estimated that an additional 8,550 inmates would be eligible for release between this Nov. 1 and Nov. 1, 2016. The release of these offenders has left probation and parole officers’ caseloads bulging—with the very real possibility of them growing much larger. Yet experts caution about overdependence on technology. in the case of sex offender supervision, a study released in July by the Sex Offender Management Assessment and Planning Initiative (SOMAPI) found that for sex offenders technological monitoring alone had little effect on recidivism rates. The report, a Research in Brief called Adult Sex Offender Management, states that “despite the intuitive value of using science to guide decisionmaking, laws and policies designed to combat sexual offending are often introduced or enacted in the absence of empirical support.” Several large-scale studies have

assessed the effectiveness of intensive supervision used with criminal offenders. The Brief continues: it is not known whether findings from these studies are generalizable to sex offender populations, but the findings provide important insights concerning the effectiveness of intensive supervision overall. Results of these studies found no research support for the effectiveness of community-based Intensive Supervised Probation (ISP) with a primary surveillance orientation in reducing criminal recidivism (Aos, Miller, & Drake, 2006; Petersilia & Turner, 1993), but did find research support for the effectiveness of treatment-oriented ISP (Aos, Miller, & Drake, 2006). Questions about the effectiveness of intensive supervision in the absence of treatment have led to the development of intensive supervision programs with a treatment orientation, according to the Brief. A specific example is the containment approach, which includes collaboration on specialized supervision of sexual offenders provided by trained supervision personnel, sexoffense-specific treatment, and polygraph assessment. But results are varied. Research on its effectiveness has been completed in a handful of jurisdictions across the country with some studies showing effectiveness, as measured by significant reductions in sexual recidivism, based upon the use of specialized supervision models (Aytes et al., 2001; Lowden et al., 2003; McGrath et al., 2003), while other studies found no recidivism reduction for the program (Boone et al., 2006; Stalans, Seng, & Yarnold, 2002). Research has also been mixed on the use of GPS with general criminal offenders, the Brief furthers, with one systematic review showing no significant reduction in criminal recidivism for offenders subject to electronic monitoring techniques (Aos, Miller, & Drake, 2006), while another study indicated that criminal

offenders on electronic monitoring had lower levels of criminal recidivism (Padgett, Bales, & Blomberg, 2006).

It also generates output reports in support of case management, supervision strategies, and case outcomes. Monitoring DUIs Ignition Interlock devices can also assist case supervisors. According to the July 2013 report Ignition Interlock Institutes: Promoting the Use of Interlocks, and based on more than 20 years of research, “interlocks reduce recidivism among convicted impaired drivers by a range of 50% to 90%.” Despite the

research, however, the report furthers, interlocks are not being used to their full potential. Approximately 1.2 million impaired driving arrests are still made each year. When Mothers Against Drunk Driving launched a campaign to install interlocks in 2006, only one state (New Mexico) had enacted a law that required interlocks for all (including first-time) impaired driving offenders; at least five states had no interlock provision in its laws. Fast forward to the present, where every state has enacted a law that provides for use of IIDs, although their provisions differ greatly, notes the Ignition Interlocks Institutes. In June 2010, interlocks got another boost: the Board of Directors of the National Association of Drug Court Professionals formally began supporting their use for DWI Court and Drug Court participants. They stated: “Research demonstrates that ignition interlock devices are an effective tool in stopping an individual from starting a vehicle after consuming alcohol while the device is installed on that vehicle.” The organization further cautions: Research also demonstrates that once the ignition interlock device is removed from the vehicle, recidivism rates eventually return to pre-installation levels. To achieve a long-term change in behavior and reduce long-term risk, individuals should also be involved in a comprehensive alcohol/drug treatment program. A study conducted in New Mexico, where various strategies were employed, including interlocks, found the state experienced a 37% reduction in the statewide re-arrest rate for impaired driving offenders, a 31% reduction in alcohol involved crashes, and 35% fewer DWI-caused fatalities over the last several years.
