Former resident sworn in as 30th N.C. chief justice

Preamble to the North Carolina State Constitution: “We, the people of the State of North Carolina, grateful to Almighty God, the Sovereign Ruler of Nations, for the preservation of the American Union and the existence of our civil, political and religious liberties, and acknowledging our depen-dence upon Him for the continuance of those blessings to us and our posterity, do, for the more certain security thereof and for the better government of this State, ordain and establish this Constitution.” Chief Justice Paul Newby considers the Preamble to the North Carolina State Constitution a guiding document in his professional life. The latest achievement is serving as the 30th chief justice to the North Carolina Supreme Court. He was elected to the posi-

tion in November, defeating then Chief Justice Cheri Beasley. Newby was sworn in during the early minutes of Jan. 1, as the clock slipped from 2020 into 2021. Superior Court Judge Andrew Heath administered the oath of office in Newby’s home. He was later sworn into office in a virtual public ceremony on Jan. 6. Newby in turn issued the oath of office to new associate justices Phil Berger Jr. and Tamara Barringer. Chief Justice Newby noted that he now wears two hats – that of head of the seven justices on the Supreme Court and head of the judicial branch, which includes 6,500 employees, 500 of whom are independently elected officials. “My challenge is to collaborate with them and encourage them to provide equal justice for all,” Newby said. That is not what our founding fathers intended. Judges should not impose their views on us.”

Newby has maintained that philosophy throughout his time serving on the N.C. Supreme Court and feels it is even more important now. “Constitutional principles are timeless and are even more significant today,” he said. “The constitution is our contract with the people and is not negotiable. We need to apply the law as it was intended and let the legislators make any changes.” The pandemic has challenged the fact that courts should be open and judgment rendered without favor, denial or delay. “I believe what is good for one part of the state may not work for others,” Newby said about court closings. “The government closest to the people can best access how to serve its people. “Since courts have a constitutional mandate to be open, I have approached the governor’s staff about making the (Covid) vaccine available to anyone working there. Although born in Asheboro, his family moved to Jamestown when he was 3 years old. He was raised there and graduated from Ragsdale High School. He was a member of Boy Scout Troop #17 and received both the Eagle Scout and Heroism awards. “So many of the values I have, I learned from my family and from my community,” Newby said. “I was blessed to be raised in such a loving, caring and safe community.” Newby graduated from Duke University and received his law degree from the University of North Carolina at Chapel Hill. Town Council to hold first meeting of 2021 By CAROL BROOKS freelance writer cab1hp@gmail.com The agenda for the first Jamestown Town Council meeting of 2021 on Jan. 19 is full of important items related to the future of the town. The Council will hold a public hearing regarding the annexation and development of the Johnson property along Guilford College and Mackay roads. The Planning Board rejected the development at its Nov. 23 special meeting. Additionally, there will be a public hearing for a rezoning request for the same property from Agricultural (AG) to Planned Unit Development (PUD). Due to social gathering restrictions for COVID-19, public access to the meeting will be limited. The Council does not anticipate opening the public comment portion of the public hearings at this meeting and will likely continue the public hearings to a future date. In other business, there will be a discussion regarding nonprofit contracts and another regarding the unsealing of closed session minutes.

Derek Carson, interim chief of the Pinecroft-Sedgefield Fire Department, will give the department’s annual report. Capt. Holder of the Guilford County Sheriff’s Department will give the annual report from his department. The Council will consider adopting the Guilford County Multi-Jurisdictional Hazard Mitigation Plan. According to the county, “Hazard mitigation techniques include such as strengthening or protecting buildings and infrastructure from the destructive forces of potential hazards and the adoption of sound land use policies and the creation of public awareness programs.” Hazards include natural as well as man-made problems. The plan may be viewed at www. guilfordcountync.gov/ourcounty/emergency-services/ emergency-management/ mitigation. The Town Council meeting will be streamed live on the Town’s YouTube page at www.youtube.com/channel/UCmi_MH3cM_DfOvhsLO9ZC6w. It will also be available following the meeting.

Wife’s kidney donation increases couple’s years together This is a reprint of the story in the December 23, 2020, issue of the Jamestown News. Part II of a series Many young people have a desire to one day find their soul mate, that special someone with whom they can share a lifetime together. After being introduced through mutual friends when

they were in their 20s, Jessica and Brent Gentel (a 1996 Ragsdale graduate) fell in love and vowed to share their lives in 2003. Their relationship only deepened, however, when in July of 2020 Jessica gladly gave Brent one of her kidneys. “Brent’s mother had donated a kidney to him about six months before we met,” Jessica said. “It lasted 20 years before it began to fail.” A transplanted kidney’s lifespan is 15 to 20 years on average. When the couple realized Brent would need

another kidney, Jessica’s first thought was to contact his three siblings to see if any of them matched. When none of them did, Jessica decided to be tested. “I had thought his siblings would be the most likely donors,” Jessica said. “I never really thought I would match and was amazed to find out that I did. Brent’s mother passed away with cancer before we found out I would be able to give him a kidney. “I never had any second thoughts about donating a

kidney to Brent. He is not only my husband, but also the father of our kids. We both believe that the fact I was a match was a blessing from God. I am glad I was able to donate a kidney to him and to be his life partner.” The couple went to Duke Hospital in Durham for their surgeries. The transplant team worked with them to make sure they understood the procedure and to eliminate any fears. see kidney, page 2

This area is more rural than other parts of the new road and the group would like it to be low-density zoning, not high-density. Small doesn’t want to see the bypass turn into another Wendover Avenue, with commercial businesses lining the road. “Along with all the problems highdensity development causes, the purpose of the bypass will be defeated within a few short years,” Small said. “It will cease to move traffic quickly. It will be an eyesore and entrance to Riverwalk will be a nightmare.” Poteat pointed out that once an area is developed high-density, the property is no longer recognizable due to clear-cutting and grading. “They change everything that was

there,” Poteat said of developers. “They come in and plan roads for the maximum housing and then put in non-native plants. Whatever benefit was there for people and animals is gone. “If you allow low density, [you have] the ability to have houses spaced out. You keep the look of the landscape. It also protects the riparian areas. It also will not impact traffic significantly. “We don’t lose the character of Jamestown. You keep that feeling of Jamestown being a small town.” Riparian refers to wetlands adjacent to rivers and streams. A portion of Deep River on Poteat’s property is included in the area under question. Poteat admitted she was not against development and change but was looking for a good mix of low- and high-density zoning.

Small cited the need to upgrade existing roadways to handle high-density traffic, the potential for increased flooding, and pollution to Deep River due to increased runoff. Although this part of the bypass would be in High Point, she believes some of this would fall under the Town of Jamestown’s jurisdiction “with absolutely no tax base added to help offset the increased costs.” “I think it’s a losing proposition for Jamestown but a perfect one for High Point,” Small said. “There are steps that can be taken so we can avoid personally getting taken in, but if the whole area changes drastically that’s still a huge problem. “This should be of a concern to the residents of Jamestown. Jamestown is getting hammered from both sides.” The bypass is expected to open in 2022.

Annexation needed for high-density development The area along Bales Chapel and Dillon roads near the bypass, including Marie Poteat’s and the Small family’s property, is within High Point’s Extraterritorial Jurisdiction and abuts the Jamestown corporate limits, which end at the Riverwalk development. Jamestown Planning Director Matthew Johnson confirmed that everything south of this area is on the City of High Point’s side of the annexation agreement line. That agreement with High Point was renewed prior to its expiration date of Dec. 20, 2018, and now expires Jan. 1, 2048. The only way for high-density development to receive water and sewer is for High Point to annex this area. Low-density development does not require water and sewer availability. The “Jamestown Land Use Assessment Document” issued by the City of High Point and available at www.highpointnc.gov/landuseassess-

ments, describes the area: “Currently, the area is mostly undeveloped parcels, with some single-family residential uses on large lots. The area may have potential for some increased residential development. Like Area 7, for this area to develop with increased densities it will need City water and sewer services and, therefore, will need to be annexed into the city. … It is currently designated as Low-Density Residential on the Land Use Plan and has Guilford County zoning of Agricultural and Residential Single Family 40 (RS-40), which limits development to one dwelling per acre. The land use classification is recommended to change from Low-Density Residential to Medium-Density Residential to support higher density residential development. However, a change in zoning should be developer driven to ensure the land use policies are met and the adjacent residences are protected.”

“I was nervous because of Covid,” Jessica said. “Duke was not allowing visitors, so on the day of the surgery we were dropped off at the door to the hospital.” The Gentels did have support at home. Jessica’s mother stayed with the couple’s 13- and 15-year-old daughters. When they were allowed one visitor each, Jessica’s dad and the best friend of Brent’s mother came to see them. Jessica and Brent were on the same floor following surgery. Since he was the first one up and walking, Brent was able to visit his wife in her room. “As hard as it was to go through the surgeries, when I look back it seems to have gone by so fast,” Jessica said. “It is amazing to give life to someone. We both consider it a miracle how God orchestrated everything in his timing. “I believe this has matured our daughters and brought our entire family closer together.” Jessica put something about the kidney transplant on her Instagram site and Brent’s sister shared it. Danielle Cannon, another Ragsdale graduate who planned to donate a kidney to a stranger, saw the post and reached out to Jessica to find out personally what the experience was like. “She and I just connected,” Jessica said. Although one recipient was known and the other was not, Jessica and Danielle both have positive feelings about donating their kidneys. “Giving life or prolonging the life of another person is important,” Jessica said. Supreme Court. During his time as assistant U.S. attorney, he played an integral role in conducting an undercover sting operation that recovered North Carolina’s original copy of the Bill of Rights, which was stolen at the end of the Civil War. He also serves as an adjunct professor at Campbell University School of Law. He co-authored The North Carolina State Constitution with History and Commentary. Judith Miller Cates was born July 14, 1944, the daughter of Bill and Estelle Miller of Hillsborough, NC. She is survived by a sister, Myra Miller of Hillsborough, NC, husband of 54 years, Hugh M. Cates of Jamestown, NC, and two sons, Brad Cates of Wilson, NC with his daughters Taylor and Sarah, and Daniel Cates of Truckee, CA with daughter Sawyer Marie Cates. Judy graduated in 1966 from High Point University and later earned two additional Master Degrees, continuing her passion for learning and knowledge. Her teaching career covered many years at both Ragsdale High School and later Southern Guilford. In retirement, she became an avid supporter of the Jamestown Library and long-term member of the Jamestown Modern Book Club. Never one for complacency and not prone to stay in place for too long, her hobbies included reading extensively, gardening flowers and vegetables, and traveling the world. Having visited 6 of 7 continents, her first objective was to learn the native appreciations and salutations. She loved the experience and mystery of life and all it has to offer.
