Herron appeal denied; Superior Court appeal in future Lori Herron has been assessed civil penalties for failure to remove the 10 pot-bellied pigs she keeps at her house, following a notice of violation from the Town of Jamestown on Feb. 27, 2019. She appealed the penalty and was granted a hearing on Feb. 4, 2020, before the town’s Board of Adjustment, which denied her appeal. However, the issue is not dead. Herron’s attorney, Randy Herman, plans to appeal to the Guilford County Superior Court. In the meantime, the pigs can stay at her home at 2216 Guilford College Road. Since the Board of

Adjustment is a quasi-judicial group, meaning courtlike, the Council Chambers at Town Hall were rearranged to resemble a courtroom. The appellant, Herron and her attorney, Herman, of the law firm Bratcher Adams Folk, sat on one side and Town Attorney Beth Koonce, along with Chris Finan, both with Roberson Haworth law firm, represented the Town. The Board sat in front beside the court reporter and Board attorney Amanda Hodierne. Witnesses were sworn in prior to the proceedings. The meeting lasted twoand-a-half hours and both sides presented photos and other evidence to support their cause. Most of the testimonies were regarding the pigs currently at Herron’s

residence and not about the civil penalties assessed. In her opening statement, Koonce presented the reason for the hearing. “The evidence we’re going to present tonight is going to show the following: #1. At the time Ms. Herron purchased the property in 2000, that property was zoned residential,” she said. “#2. The development ordinance that was in effect … prohibited the keeping of livestock on the property and the development ordinance we’re operating under now also prohibits keeping livestock. #3. The word ‘livestock’ in our ordinance has always been defined to include swine. It doesn’t differentiate in the ordinance between livestock kept for commercial purposes and

The Guilford County Department of Health and Human Services wants to ban smoking on the grounds of municipal parks and any other property owned by the county or a local government. The department addressed the Guilford County Board of Commissioners during a public hearing on Sept. 19, 2019. In a vote following the hearing, Commissioners rejected DHHS’s petition. In accordance with that regulation, the following news release has been prepared and issued to media in the affected county: The Town of Jamestown had a discharge of untreated wastewater on Feb. 8, 2020, of an estimated 2,436 gallons at 202 Nutwood Drive in Jamestown. The untreated wastewater was discharged into an unnamed tributary to East Fork Deep River in the Deep River Basin. Great Clips has opened a new salon at Grandover Village in Jamestown, NC. It marks a milestone 10th business owned by Greensboro, North Carolina, native Richard White. He is training his niece and Vice President of Operations, Courtney Charles-Lowrance, to take over ownership of the 10 salons in Virginia and North Carolina in the near future. The family hair salon specializes in haircuts for adults and children of all ages, and perms and up-dos for special occasions such as weddings, holiday parties and proms. Great Clips is open seven days a week with no appointments required; however, the salon does offer an online check-in service, which allows customers to add their name to the waitlist before they arrive. More and more health experts stating their belief that vaping is very dangerous to health. As of this writing, 12 deaths related to vaping have occurred in 10 states. At its Feb. 18 meeting, the Jamestown Town Council will consider adopting the Guilford County Smoking Policy. In September of last year, commissioners voted down part two of the original DHHS proposal, saying that enforcement would be impossible in city-owned parks. They did approve part one, updating the language regarding new products. In 2009, Guilford County placed a ban on cigarettes and other tobacco products in governmental buildings. Jamestown adopted that ban at that time as well as a local ban on smoking at Wrenn Miller Park. Smoking was permitted outside government buildings “providing that the person smoking does not stand adjacent to a public entrance or air intake vent.” The Council will hold a public hearing to consider a text amendment to the Land Development Ordinance that would add a new zoning district, Planned Unit Development, or PUD. At its Nov. 18 meeting, the Jamestown Planning Board unanimously approved adding the PUD district to the Land Development Ordinance and

the matter went before the Town Council in January. However, Councilmember John Capes was absent from the Jan. 21 meeting and other councilmembers did not feel comfortable making a decision on adding a new zoning district and mentioned that perhaps this should wait until the new Comprehensive Plan – which would replace the current LDO – is completed in a few months. Therefore, the public hearing on the matter was tabled until the Feb. 18 meeting. The Council will hold a discussion of the non-profit policy and potential-grant funded services. Mark Hensley, AARP representative, will discuss AARP Livable Communities Program. According to the AARP website, “AARP Livable Communities supports the efforts of neighborhoods, towns, cities and rural areas to be great places for people of all ages. We believe that communities should provide safe, walkable streets; age-friendly housing and transportation options; access to needed services; and opportunities for residents of all ages to participate in community life.” Following the open session, the Council will go into closed session to discuss matters related to attorney-client privilege. The public is invited to attend the Council meeting on Feb. 18 at 6:30 p.m. in the Council Chambers.

Herron testifies Lori Herron then took the witness stand. She stated that she got her first pig at the end of 1999 and one reason she moved was to raise the pig in a less-congested

area than where she had lived in Greensboro. “Michael [her husband] saw some little pigs and fell in love,” Herron said. She recalled she had spoken with someone named John (believed to be John Frezell), the planning director at the time, when they were considering the move to Jamestown in 2000. Frezell said pigs were not a problem. Herron and Young had only one pig at the time. They added two pigs in 2002, several others in subsequent years, including one that was pregnant at the time, a fact unknown to Herron. That produced six piglets, bringing the number to 10. She tried to find homes for these six new piglets but was unsuccessful. The pigs sleep in a closet in the bedroom, eat in the kitchen and use the bathroom outside. They are pets only. Herron has seizures and she says the pigs can sense when she is on the verge of a seizure and will alert her or Young. She considers them emotional-support animals. On cross-examination by Finan, she admitted that she had received no written permission from the Town during earlier conversations. In August, the Town Council denied a text amendment to the Land Development Ordinance suggested by Herron which better defined the word “livestock” and would have allowed her to keep the potbellied pigs as pets. “In proposing the amendment, do you consider that a concession that you had violated the ordinance?” Finan asked. “No. We were just fol-

lowing suggestions,” Herron said. “It’s because we didn’t think we were violating the ordinance that we proposed the amendment to clarify our position.” Husband testifies Michael Young, Herron’s husband, was called to the witness stand by Herman and stated that potbellied pigs were trending at the time they moved and the couple was just checking on Jamestown’s ordinances when they moved. He could not remember the name of the man he spoke with but has been told it was John ,Frezell. “He said it wasn’t a problem so I had no reason to believe it was a problem,” Young said. Violations Herron said her husband received a call from the Town in 2005 because one of the pigs had gotten loose and was eating a neighbor’s flowers, but there was no code violation issued at the time. She has received several notices of code violation in recent years, but the pigs were never mentioned. One notice was in July 2013 regarding the condition of her yard and one in April 2015 from thenTown Planner Carrie Spencer regarding a possible violation regarding debris. Johnson also learned that Guilford County Animal Control sent her a violation letter in 2017 regarding a report of unsanitary conditions of the pigs and house. All manners were handled without penalties. Herron has received several extensions of the origi-

nal 30-day pig removal deadline imposed a year ago. The most recent was in August of last year when she requested the text amendment. After the Town Council denied the amendment, on Oct. 22 of last year, Koonce sent an email to Herron and Young stating, “The Town of Jamestown is moving forward with enforcement of the code violation against you. The next steps will involve financial penalties and the seeking of an injunction from Superior Court enforcing the provisions of the Town’s Ordinance against keeping pigs in residentially-zoned areas.” Closing statements In closing statements, Finan said it all comes down to the definition of “livestock.” “The Permitted Uses [table] is clear and unambiguous,” he said, “and does not allow the growing of crops or the keeping of livestock within a residentially-zoned area.” Herman disagreed. “The term ‘livestock’, as understood under North Carolina law is complicated and ambiguous. It depends on the context of which we define the term.” He added the keeping of pigs should have been grandfathered in LDO updates. Verdict There was very little discussion among Board of Adjustment members before making their unanimous decision to deny Herron’s appeal. They agreed that the Town had the right to issue the violation and

also had the right to assess civil penalties. “The [initial] ruling was for one pig,” said BOA member Russ Walker. “There are 10 now.” “The Town has been consistent in the ordinance,” said Eddie Oakley. “It hasn’t changed.” “There is a clear violation,” said Ed Stafford. After the ruling, Johnson said the Town intends to file a request for an injunction before Superior Court to remove the pigs. “If Herron also appeals, the Court will probably stay the injunction until they hear the appeal and then consider the injunction,” he said. Herron can keep pigs during any upcoming proceedings and the Town cannot remove them. “If she (loses) and doesn’t follow the court’s directive, she could be held in contempt of court and be at the mercy of the judge.” Herman plans to appeal. “Once the order goes into affect, we have 30 days to appeal. Johnson testifies Koonce called Assistant Town Manager/Planning Director Matthew Johnson as her only witness. He related the history of the original complaint from Feb. 26, 2019, when he received a call regarding trash and odors from Herron’s property. He visited the site, saw the trash, but, in attempting to go to the door to speak with someone, was prohibited by a fence containing the pigs. He later stated that if he had seen the pigs from the street, he would have issued a notice of code violation. “I consulted the ordinance,” he said. “The first thing I would have done would have looked at the Permitted Uses table.” Johnson believes the category of “limited agriculture” applies. The Permitted Uses table in the ordinance does not allow livestock – and specifically mentions swine – in single-family residential areas in Jamestown. He believes this also

applied prior to 2001. He produced copies of the 2001 and 2009 Land Development Ordinances and said the 2009 document “has not changed substantially” from the 2001 document. “To the best of your knowledge, has ‘livestock’ in the LDO always been interpreted to include swine?” Koonce asked Johnson. “It has,” he said. In his cross-examination, Herman argued about the definition of livestock. “Does the LDO contain a definition of livestock?” he asked. “It does not,” Johnson said. Johnson consulted other sources in his attempt to define livestock, including N.C. General Statute 68-15, which defines “livestock” as including, “but shall not be limited to, equine animals, bovine animals, sheep, goats, llamas and swine.” “I believe it is very clear,” Johnson said. “Livestock is defined clearly.” Herman asked about the original 2000 and 2006 R15 zoning designation for Herron’s property. Johnson couldn’t find any zoning charts prior to 2001 but he knew swine were not permitted in R15, which is defined as medium density single-family and multifamily residential areas. The 2009 LDO changed the zoning designation to SingleFamily Residential.

And so 2016 finally draws to a close. It’s been the longest election year in American history. It ran from Feb. 1, 2016, the date of the Iowa caucuses, to the Senate vote to acquit President Donald Trump in early February 2020. It’s true that Nov. 6, 2016, was a signal event in this long election year, but it didn’t really conclude anything, even though the result wasn’t in doubt. Usually, contested elections are ties or near-ties. This is the first time an election has gone into overtime, with repeated attempts at what were in effect recounts, despite the winner comfortably prevailing (Donald Trump won handily in electoral votes, the measure that determines the outcome, 304-227). Immediately Democrats concluded that they’d been robbed, and Hillary Clinton did indeed get some bad breaks during the campaign, most consequently at the hands of then-FBI director James Comey. Such is life in the arena. But no one on the left was in a mood to move on. Rather taking stock and recalibrating as warranted, Democrats remained fixated on 2016. Rather than simply mobilizing opposition to Trump’s agenda and reelection, as any opposition always does, they mused about how to reverse the 2016 result. Rather than acknowledging the nearimpossibility of removing a duly elected president, they indulged in fantasies about how to do exactly that. Above all, they obsessed about Russia as the cause of their undoing in 2016. With enough investigation, all would be made plain, the Trump-Russia conspiracy would be unraveled, the walls would close in, and the world would be restored to its axis. The rightful winner of 2016 wouldn’t take office, but the wrongful winner would

be vanquished. What voters in Michigan, Pennsylvania and Wisconsin failed to do, the grinding machinery of investigation would achieve. When the Mueller probe didn’t produce the impeachment that the Democrats had expected with such fervent certainty, it seemed briefly they’d finally have to accept the outcome of 2016, however grudgingly. Then, Ukraine emerged, and impeachment was, thankfully and gloriously, back on. Russia was a proximate cause of the impeachment over Ukraine. The Democrats charged that Trump sought Ukrainian interference in our elections, just as he had sought Russian interference (for all their interest in the Mueller investigation, Democrats have never absorbed its conclusion that there is no evidence that Trump colluded with the Russians). Absent their conviction that Trump is an illegitimate president, Democrats would have been, understandably, outraged by Ukraine and determined to investigate it, but they wouldn’t have impeached over it. In this sense, the Senate trial is the last act in the 2016 election. It establishes, once and for all, that he won’t leave office prior to the end of his first term. It makes it clear that another election, not some other mechanism, will be necessary to remove him. It represents the final failure of the investigatory apparatus around Trump’s alleged Russia collusion to deliver Democrats from the consequences of their 2016 defeat. Trump, obviously, isn’t blameless in any of this. But he is not a Russian agent. He won the presidency in a free and fair election, and despite his attempted removal, will have a chance to do so again. On to 2020. When the carrier kennel comes out, he begins to tremble and whine, and resists being put in. He is always very stressed at the vet office. How can I help him be less scared about visiting the vet? — Sarah in Chicago dear SaraH: You’re not alone in this. Many pets get extremely anxious when they have to go to the veterinarian, and it can be a stressful experience for the owner, too, who knows their pet is so worried and stressed out. Talk to the vet for suggestions and strategies to minimize your dog’s anxiety on the way to the office. The day before Jester’s checkup, call the vet’s office and remind them that

your dog will need extra TLC during the visit. This way, the vet is prepared, too. Spend time desensitizing Jester to the carrier cage. This will take a while but will make it easier to place him into the cage for any trip — not just the vet visit. Jester strongly associates the carrier with vet visits. You need to help him associate it with other things, like fun and treats. Bring the carrier out periodically and sit next to it, placing Jester’s favorite toy nearby. Don’t force him into it or, really, do anything — just have the carrier cage out while you go about your day. Each time he approaches the carrier calmly, without barking or trembling, give Jester a little treat. Ideally, you want him to climb freely into the carrier, expecting a treat.
