Diamondback sells Johnson property Development on the Johnson farm property is still probable as Diamondback Investment Group, doing business as Castleton Village LLC., has sold the nearly 467-acre property to D.R. Horton, a national company that bills itself as “America’s largest homebuilder.” The property, along Guilford College and Mackay roads was in the news for the majority of 2020 and several months of this year as Diamondback announced several plans for devel-

Many local residents opposed the development, stating even the final revised plans presented in November 2020 consisting of 1,269 single-family and townhouses, along with 34 mixed-use buildings, was still too high in density. Diamondback had announced plans for the property at two neighborhood meetings at GTCC Feb. 13, 2020, but immediately received pushback from the audience. One year later, on Feb. 16, 2021, the Jamestown Town Council denied both the rezoning and annexation requests. The Jamestown Planning Board spent seven meetings

After being closed during the pandemic, the shop will hold a soft reopening for limited hours during the first two weeks. It will be open July 12-16 from 1-5 p.m., July 17 from 10 a.m.-1 p.m., July 19-23 from 1-5 p.m. and July 24 from 10 a.m.-1 p.m. A volunteer from Friends of the Library will be there to greet you and offer assistance. Included in the group are Nancy Dyer, Joanne Miller, Victoria Panzer, Nancy Wilson, Bobbie Huggins and Jenny Naples. “We can’t wait to see you,” Naples said. Masks and social distancing are required and all sales are for cash or checks only. Starting July 26, The Corner Book Shop will be open during library hours and operate the same way as before the pandemic.

Council to meet July 20 By CAROL BROOKS freelance writer cab1hp@gmail.com The Jamestown Town Council has several items on its agenda for July 20. Under old business, the Council will consider approval of an amendment to an inter-local agreement with Guilford County regarding funding for the Jamestown Public Library. A second inter-local agreement with the county for the animal shelter and control services will also be considered. Finance Director Judy Gallman will lead a discussion about non-profit contracts and funding for services. New business includes quarterly reports on the Jamestown Park and Golf Course as well as a maintenance report for the park and course. The Council will consider approval of a special event permit for the Jamestown Rotary Christmas Parade. Also under consideration are a budget amendment and financing for golf equipment and a new sanitation truck. At the end of the regular session, the Council will go into closed session to discuss matters related to personnel and attorney-client privilege, Lori Herron, 2216 Guilford College Road vs. Town of Jamestown. Liveable Communities Committee discuses code enforcement By CAROL BROOKS freelance writer cab1hp@gmail.com As people age, they are often no longer capable of taking care of many things, including their property. Tall grass, dead trees, peeling paint and scraggly shrubbery are all things that could result in notification of a code violation by the Town of Jamestown. But what if neighbors or other concerned citizens pitched in to take care of the violations? That is one goal both of the local AARP Liveable Communities Committee and Alliance Code Enforcement. “A number of citizens in the community have reached out [to me] offering their services or they would connect people with others that could help,” said Assistant Town Manager /Planning Director Matthew Johnson at a committee meeting July 8, noting this does not mean free lawn care, but just on a shortterm basis. He also noted the offers are not limited to seniors or the disabled. “This is something older peo-

ple have a problem with,” said Rebecca Rayborn, Town Council representative who was one of those interested in looking into how Jamestown could make seniors feel more comfortable with their environment. In May, Brandon Emory of Alliance Code Enforcement rode through every street in Jamestown’s residential and extra-territorial jurisdiction areas looking for Nuisance Abatement and Property Maintenance Code violations such as overgrown lots, junk vehicles, junk piles, minimum housing (abandoned, damaged, etc.). He found 289 violations. Over 45 of the total were overgrown lots. The Town’s ordinance limits grass height to 9 inches. The violations must be fixed within 14 days or be subject to civil penalty of $50 for each violation. Civil action could be instituted if the violations are not corrected or if payment is not received within a designated time period. To help, Emory told the Town Council that church and scout groups and even Habitat for Humanity could help owners

fix their violations. Monetary donations could also be solicited. Alliance would keep a list of those offering help. This is good news to the AARP Liveable Communities Committee as one goal is to make Jamestown a place where seniors would want to live. In October 2020, the Town Council voted to become a part of the AARP Network of AgeFriendly Communities, a worldwide network of communities committed to giving older residents the chance to live rewarding, productive and safe lives. Jamestown is the first community in the immediate area to participate. State and federal funding is available for programs. Planning includes community revitalization and economic development that recognize the

needs of all people regardless of age, income, physical ability, race, and other factors. Community decisions on land use, housing and transportation must be taken into consideration. Focus areas are outdoor spaces and buildings, transportation, housing, social participation, respect and social inclusion, work and civic engagement, communication and information, and community and health services. Jamestown’s AARP Livable Communities Committee met for the first time in February and learned from Bob Gerken, local AARP representative, how they could set up these communities. Gerken noted that age-friendly means housing, public safety and the ability for everyone to participate in the community, among other things. The time to begin to look at these items is now. “By 2035, the number of adults older than 65 will be greater than the number of children under 18,” Gerken said of the need. continued from front mentoring, networking and wellness. “Our goal is to help women elevate to the next level, whatever that may be for each individual,” said Pam Baldwin, director. “Working women need the emotional support lacking in many of their lives,” said board member Martha Yarborough. “They often feel alone while doing the best they can. Women in Motion is an avenue of support for women.” An all-volunteer board previously ran the organization, but it hired Baldwin as its director in April. “We knew that for us to thrive we needed a director,” Yarborough said. “I woke up one night and thought of Pam and called her the next day. She agreed to talk.” Baldwin was an artist with her own business and

president of Arts Davidson County. She had participated in Women in Motion and was well aware of what goals the organization embraced. “After talking to Martha, It was an easy yes,” Baldwin said. “It is a huge thing to support other women.” Women in Motion leadership also felt they needed more programing, which could not be done under the High Point Community Foundation, the grant-supported organization under which WIM was first established. Jane Liebsher, president of United Way and a participant in the Women in Motion Kitty Congdon Mentoring Series, realized United Way could bring new life to Women in Motion and the partnership was born. Currently the group has more than 40 members. Part

of each member’s donation goes into a grant fund to help other women. “Members get the benefits of belonging to Women in Motion and also give benefits to others,” Baldwin said. The organization, which serves women in the greater High Point community including Archdale, Trinity, Thomasville and Jamestown, continues to be supported by the Brayton Family Charitable Foundation, which started the program, the Emily Millis-Hiatt Fund, High Point Community Foundation and the Congdon Family. “Kitty Congdon’s contributions come from her children,” Yarborough explained. “She is a mentor to them and they are passing it on to others.” The Kitty Congdon Mentoring Series helps new

According to LegalZoom.com, a special warranty deed “guarantees that there are no defects or problems with the title during the seller’s ownership period, but makes no promises about the condition of the title before the seller owned the property. A special warranty deed is a particular kind of deed for real estate that makes guarantees about the title only during a certain period of time. Special warranty deeds can leave a buyer open to other, older title claims.” Diamondback once suggested ball fields could be located at the corner of Guilford College and Mackay Roads. The company would construct these fields, then

turn them over to the Town of Jamestown upon completion. Later plans did not include ball fields. Development by Diamondback was contingent upon the Town approving new Planned Use Development (PUD) zoning, which the Council agreed to in June of 2020, following the Planning Board’s November 2019 approval. However, Diamondback did state it would follow current singlefamily zoning districts if PUD had been denied. “PUD is a zoning tool which is used to create flexibility for both the Town and a potential developer in order to help achieve a more acceptable development outcome,” said Jamestown Planning Director Matthew Johnson in 2020. It is to be used to accommodate commercial, residential and mixed-use development on large-scale sites of 10 acres or more. It gives the Plan-

ning Board and Town Council more control over types of development. “You can create the product you want to see in Jamestown,” Johnson added. “This [amendment to the Land Development Ordinance] will give you the legal ability to hold [a developer’s] feet to the fire.” Perhaps as a backup in case the initial plan was denied, Diamondback submitted plans to the Town for a single-family development in November 2020. To pursue those plans, however, they would have needed to wait 12 months before making a formal petition. According to the current Land Development Ordinance, “When an application for a zoning amendment has been approved or denied by the Jamestown Town Council, no rezoning application of the same property shall be accepted or considered within 12

months after the date of the approval or denial.” This waiting period could be waived, however, by a three-fourths vote of the Council if it determines there have been substantial changes in conditions or circumstances. (LDO Section 5:3-6 A-B) Horton has not announced plans for the property. The property is currently in Jamestown’s Extra-Territorial Jurisdiction, or ETJ, meaning the town has control of the areas but they are not technically within the town limits. If annexation is approved, the addition would add about 0.5 square miles to the town’s size, which is currently 3 square miles. The town currently has about 4 square miles in the ETJ. The town’s population, approximately 4,581, could potentially double in size once development occurs.

As reported in this column recently, the Library of America honored the late Elizabeth Spencer on June 1 by adding to its series an 864-page volume of her work. This month it adds another North Carolina connected author to its series, the popular short

story writer, O. Henry. The new volume, “O. Henry: 101 Stories,” is being published this week. O. Henry was the pen name for William Sidney Porter, who was born in Greensboro in 1862 and grew up there. Shortly after he earned a license as a pharmacist and worked in his uncle’s business, he moved west to work on a ranch in Texas. After a stint in

prison for a crime that had to do with missing money, he made his way to New York City. He found a home on the city’s streets and bars, where he met the ordinary people who inspired his extraordinary stories. He was, according to Louis Menand, writing in The New Yorker’s June 28 edition, “a prodigious drinker, with a reputation for being

He died in 1910, at 47, due in part to liver cirrhosis along with diabetes and an enlarged heart. He is buried in Asheville’s Riverside Cemetery not far from the grave of another North Carolina writer, Thomas Wolfe. Some visitors leave a few pennies on O. Henry’s grave. Some leave exactly $1.87. Why? For many O. Henry fans, their favorite story is “The Gift of the Magi,” set in New York City at Christmastime. A poverty-stricken couple struggle to find

money to buy each other a nice present. The story begins: “One dollar and eighty-seven cents. That was all. And sixty cents of it was in pennies. Pennies saved one and two at a time by bulldozing the grocer and the vegetable man and the butcher until one’s cheeks burned with the silent imputation of parsimony that such close dealing implied. Three times Della counted it. One dollar and eighty-seven cents. And the next day would be Christmas.” Finally, Della sells her lovely hair for $20 to buy a gold chain for her husband’s treasured pocket watch. You remember what happened. If not, you can guess. Such human dilemmas and remarkable endings

made and still make O. Henry one of the country’s favorite writers. Like Charles Dickens he is more admired by us ordinary readers than by the literary elite. Working for the Sunday World newspaper, he wrote a new story every week. Menand suggests that such regularly written stories should be considered “on the model of the comic strip--which is, effectively, what they were when they appeared once a week in the Sunday World. In some weeks, your favorite comic strip is more entertaining than it is in others, but you always read it, because you know what you’re going to get. The same is true of O. Henry stories. Porter had a formula; he had a set of character types; and he had a distinctive verbal palette.” One aside: I try, not always successfully, to persuade my editors that my weekly columns are similarly like comic strips. Menand continues, “The story writer begins with an idea about what readers will feel when they finish reading, just as a lyric poet starts with a nonverbal state of mind and then constructs a verbal artifact that evokes it.” Not everyone will agree that O. Henry’s stories are the same as good poetry. But this reader admits that reading “The Gift of the Magi” and many of his stories can bring tears to my eyes every time I read them. On my next trip to Asheville, I will be leaving $1.87, including 60 pennies, on O. Henry’s grave.
