CA MAU SHIPWRECK PORCELAIN

In 1725 a Chinese junk filled with export porcelain and sailing ninety miles south of Canton on its way to the Malaysian archipelago sank after apparently suffering an intense fire on-board which was so hot that it fused together some pieces of its precious cargo. This fire, burning at 1400 degrees Fahrenheit may have started in the kitchen as cast iron cooking pots were found melted together and it may have burned long enough for the crew to escape along with the ship’s seals. The junk lay for over two hundred and eighty years without being discovered or disturbed until, in 1998, two Vietnamese fishermen snagged their nets on a quantity of Chinese porcelain and began to haul it from the deep. Before the Vietnamese Ministry of Culture and Information stepped in, the fishermen had managed to bring to the surface over thirty thousand pieces of porcelain. In 2005 the Vietnamese Government decided to sell a proportion of the overall 130,000 pieces of porcelain that had been salvaged and sent 76,000 to auction with Sothebys in Amsterdam in January 2007.

The shipwreck, the Ca Mau, finally unloaded its cargo to an eager market over three days in the Netherlands and the ring of commerce between East and West for this beautiful porcelain was sealed once more after a two century gap. Shipwreck porcelains are a fascinating subject and shed much light on history, porcelain, human and marine archaeology and commerce.They represent in their purest form, a time capsule, sealing in the fashion of the day represented by the most popular shapes and designs.After the discovery of the Nanking Cargo by Michael Hatcher in the 1980’s there have been many shipwreck porcelain sales at auction, including Vung Tau,Tek Sing, Diana and of course, Ca Mau.The number of pieces offered have been breathtaking, usually 100,000 pieces or more per sale and reflect the size of these cargoes in their day and the demand for such wares throughout South east Asia and Europe.

A great deal of the cargo from the Ca Mau consisted of tea bowls, saucers and saucer dishes for the mass market and although some of these were finished in a coffee brown or café au lait finish, the majority were painted in cobalt blue against a white porcelain ground. Such tea bowls and saucers are ideal for collectors, being easy to display, relatively inexpensive and often displaying a myriad of different patterns.At the Amsterdam sale, for instance, fifty tea bowls and saucers in the ‘Passing Boats Allover’ pattern were on sale for 2000 Euros, or just over £1000 for 100 individual pieces of porcelain from 1725! Equating to £10 a piece or three pints of beer, not bad for a collection of 18th century Chinese porcelain.

Lot 24 A CHINESE ROSEWOOD DISPLAY CABINET, circa 1840, the pierced dragon carved pediment over three pierced frieze arches, above an arrangement of short and quarter open shelves with pierced galleries and two short drawers to the lower right hand side and a single cabinet door to the left, above a pierced apron on short leaf carved legs, terminating in a ball and claw foot, the cabinet constructed in two sections, 115cm wide, 224cm high, 31cm deep

According to the vendor his great grandfather was presented with this cabinet by the Kowloon Chinese Railway Company as a token of their appreciation of his services as Chief Surveyor in the construction, through a mountainous region of China which involved extensive and complex tunneling works. Lot 60 A GILDED AND ROBIN’S EGG BLUE GLAZED FIGURE OF AVALOKITESVARA, late Qianlong/Jiaqing period (1760-1820), the kneeling figure with hands raised in an open gesture, wearing a five lobed diadem above his gilded face, his bare chest and forearms picked out with robin’s egg enamelled jewellery, with similar decoration to his skirt and shoes, the underskirt with sponge gilding, raised on a circular base of dark and light blue enamel lotus petals in gilded frames, the hollow interior signed with two characters, probably reading ‘Coming Happiness’, minor gilding loss, right hand thumb missing, 29cm high

This figure is also discussed and illustrated in I. L. Legeza’s ‘A Descriptive and Illustrated Catalogue of the Malcolm MacDonald Collection of Chinese Ceramics’, London 1972, Pg. 79, No.384. A smaller, seated Buddha is illustrated in ‘Qing Imperial Porcelain’ Hong Kong, 1995, No. 72. It is unusual for these figures to be posed in such a manner and it is possible that they may have been modelled on a Ming Dynasty Xuande Period, gilt bronze original. For a gilt bronze and champleve enamel figure of similar form, dated to the Qianlong Period and in the Victoria and Albert Museum, see S.W Bushell,‘Chinese Art’, London 1924,Volume 2, Figure 94.Although these figures rarely appear at auction, for recent examples see: Christie’s Hong Kong, 29th April 2002, lot 539 and Christie’s London, 15th May 2007, lot 184. Avalokitesvara meaning ‘Lord who looks down’ is a bodhisattva who embodies the compassion of all Buddhas. He is one of the more widely revered bodhisattvas in mainstream Buddhism. The original name for this bodhisattva was Avalokitesvara. The Chinese name for Avalokitasvara is Guan Yin which is a translation of the earlier name Avalokitesvara Bodhisattva. This bodhisattva is variously depicted as male or female, and may also be referred to simply as Guanyin in certain contexts. £20,000 - £40,000

A similar example of this figure can be found in the Gulbenkian Art Museum, Durham University, accession number DUROM.1969.358 which was a gift from the Rt. Hon. Malcolm MacDonald to the University. The Durham figure is described as ‘A hollow moulded porcelain figure of a kneeling Bodhisattva on a circular lotus petalled base, wih both hands raised shoulder high, and wearing ornamental head-dress with an expression of joy on the face. Decorative elements of the costume are picked out in relief and reinforced with opaque, pale blue enamel and gilt on a coffee coloured ground’.

The double edged knife by Fairbairn-Sykes developed by William Ewart Fairbairn and Eric Anthony Sykes in Shanghai before World War II but made famous during 1939-44 by being issued to British Commandos including the SAS. The F-S fighting knife was manufactured by the Wilkinson Sword company and was made with various pommel and grip variations. £150 - £200

Lot 138 A PATHÉ KOK 28MM PROJECTOR, French, circa 1912, with black painted cast metal body and hand crank, with built in dynamo seated on a polished wooden base, 52.5cm wide, 35cm high, 25.5cm deep, along with two 28mm films on spools, titled ‘PartTrip on the Ganjies, Part French Magician on Stage’ and a cased spare spool (3) The projector was designed for home use by the Pathé Company. This projector was known as the ‘Kok’ after the firms trademark a crowing cockerel. Introduced in 1912 it made home movies a reality.The Kok projector used non flammable cellulose acerate safety film and an electric light rather than the gas lights often used at the time.The crank handle was an added safety feature that moved the film and also drove a small dynamo to power the projectors light source which went out when cranking stopped. £200 - £300

CONDITIONS OF SALE 1. Definitions. In these Conditions Halls Auctioneers Limited act only as auctioneers and agents for the seller and the representative of Halls Auctioneers Limited conducting the auction is called the “Auctioneer”.

The seller and the buyer agree to be bound by Halls Auctioneers Limited’s decision.

2. General. Whilst Halls Auctioneers Limited make every effort to ensure the accuracy of their catalogues and the description of any lot:(a) Each lot as set out in the catalogue or as divided or combined with any other lot or lots sold by the seller with all faults, imperfections and errors of description. (b) Halls Auctioneers Limited do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any lot unless they have been instructed in writing by the seller to so certify, and in such case the auctioneers do so as agents of the seller and are not themselves responsible for such claims. (c) All statements whether printed in the catalogue or made orally as to any of the matters set out in (b) above are statements of opinion only and are not to be taken as being or implying any warranties or representations of fact by Halls Auctioneers Limited unless they have been instructed in writing by the seller to so certify. (d) Any claim under any Statute must be received in writing by the Auctioneers within ten days of the day of the sale.

5. Default. Halls Auctioneers Limited disclaim responsibility for default by either the buyer or the seller because they act as agents for the seller only and therefore do not pay out to the seller until payment is received from the buyer. Instructions given by telephone are accepted at the sender’s risk and must be confirmed in writing forthwith. 6. In the event of a sale by private treaty both the seller and the buyer agree to be bound by the General and any Special Conditions of Sale.

7. Third Party Liability. Every person on Halls Auctioneers Limited’s premises at any time shall be deemed to be there at his own risk. He shall have no claim against Halls Auctioneers Limited in respect of any accident which may occur or injury, damage or loss howsoever caused, save in so far as the injury, damage or loss shall be caused by the direct negligence of Halls Auctioneers Limited’s employees.

3. The Auction. (a) The Auctioneer has absolute discretion to divide any lot, to combine any two or more lots or withdraw any lot or lots from the sale, to refuse bids, regulate bidding or cancel the sale without in any case giving any reason or without previous notice. He may bid on behalf of the seller for all goods which are being offered subject to reserve or at the Auctioneer’s discretion. (b) The highest bidder shall be the buyer except in the case of a dispute. The Auctioneer may at his sole discretion determine the advance of bidding or refuse a bid. If during the auction the Auctioneer considers that a dispute has arisen, he has absolute discretion to settle it or to re-offer the lot. (c) Each lot is put up for sale subject to any reserve price placed by the seller. Where no reserve has been placed (but not otherwise) the seller has the right to bid either personally or by any one person on his behalf (who may be the Auctioneer). (d) All conditions, notices, descriptions, statements and other matters in the catalogue and elsewhere concerning any lot are subject to any

8. Inspection. Opportunity is given for inspection and each buyer by making a bid for a lot acknowledges that he has satisfied himself fully before bidding by inspection or otherwise to all the Sale Conditions, the physical condition of and description of the lot including but not restricted to whether the lot is damaged or has been repaired or restored. 9. Property and Risk. The legal title in a lot shall not pass to the buyer until the lot(s) has been paid for in full and the Auctioneers shall be entitled to a lien on any lot sold until the purchase price (as defined in 10 below) is paid in full but each lot is at the sole risk of the buyer from the fall of the hammer. 13. Commission to Bid. Halls Auctioneers Limited will execute bids on behalf of intending buyers unable to attend the sale at no charge. Halls Auctioneers Limited undertake to purchase lots as cheaply as allowed by other bids and reserves. Bids must be submitted in writing and whilst every care is taken in carrying out instructions Halls Auctioneers Limited cannot be held responsible for errors or omissions made in carrying out such bids.

10. Every bidder shall be deemed to act as principal unless there is in force a written acknowledgement by Halls Auctioneers Limited that he acts as agent on behalf of a named principal.

14. Lots on which Value Added Tax is payable on or included in the hammer price are indicated in the catalogue or description sheet with a sign. VAT is payable on or included in the hammer price of such lots at the rates prevailing on the day of the auction.

11. Removal of Goods. (a) No purchase shall be claimed or removed until the sale has been concluded. All lots shall be paid for and removed at the buyer’s risk and expense by the end of the second working day after the sale, failing which the Auctioneer shall not be responsible if the same are lost, stolen, damaged or destroyed, and all lots not so removed shall remain at the risk of the buyer and subject to a warehousing charge. If they are not paid for and removed within seven days of the sale the Auctioneer may re-sell them by auction or privately without notice to the buyer. Any liability which there may be on the part of the Auctioneer in respect of any loss shall be restricted to a maximum of the price paid by the buyer of the lot. (b) In the event of any failure of the buyer to comply with any of the above conditions the damages recoverable by the seller or the Auctioneers from the defaulter shall include any loss arising on any re-sale of the lots, together with the charges and expenses in respect of both sales, and together with interest at 2% above Nat West Bank plc Base Rate upon the price of any lot which has not been paid for within forty-eight hours of the sale, and any money deposited in part payment shall be held by the Auctioneers on account of any liability of the defaulter to them or to the seller. The Auctioneers are unable to accept payment from successful bidders other than in cash or by the bidder’s own cheque. Cheques drawn by third parties, whether in the Auctioneer’s favour or requiring endorsement, cannot be accepted.

CONDITIONS OF SALE APPLICABLE TO SELLERS 15. The seller authorises Halls Auctioneers Limited to deduct commission at the published rate and to retain the buyer’s premium of 17.5% plus VAT. The seller agrees to pay all special advertising charges and illustration charges (see 24) insomuch that they are reasonable Scale of Commission - Halls Business tariff card available at all Halls offices and salerooms on request. 16. Value Added Tax. A seller who sends for sale by auction any chattel(s) which is an asset of his business must disclose to the Auctioneer whether or not he is a registered person forValue AddedTax purposes and, if so, his registered number and whether or not he intends to operate the Dealer Margin Scheme covering works of art, etc. This information must be supplied to the Auctioneer on or prior to delivery of the goods. 17. Instructions. All goods delivered to the Auctioneers’ premises will be deemed to be delivered for Sale by Auction and will be catalogued and sold accordingly unless special instructions are recorded on the receipt. 18. Reserves. Halls Auctioneers Limited will be pleased to advise on suitable protective reserves but if no reserves have been received prior to the day of the Sale, the lot will be sold without reserve or at the discretion of the Auctioneer. Reserves must be confirmed in writing or notified on the receipt at the time of delivery.

12. Purchase Price. The buyer shall pay the hammer price together with a premium at the stated rates on the hammer price of 17.5%. Under the Auctioneers’ Margin Scheme operated by HM Customs & Excise, the premium does attractVAT as an addition to the stated premium rate.There is a 2.5% surcharge on all transactions made by credit card along with a one pound fee for payments on debit cards under twenty five pounds.

19. Indemnity.Vendors shall indemnify Halls Auctioneers Limited against any claims in connection with goods sold by Halls on the vendor’s behalf. 64


26. Agency. The Auctioneers act throughout as Agents only and are not responsible for any default by the buyer. Halls Auctioneers Limited disclaim liability for paying the vendor until they have received settlement from the purchaser.

20. Collections. The Auctioneers do not themselves undertake the collection of goods but acting expressly as Agents, they will if required, instruct or recommend a carrier on the vendor’s behalf for which there will be a charge.

21. Withdrawals. Where a seller cancels instructions for sale, or where a lot is withdrawn for any reason other than misattribution or authenticity, Halls Auctioneers Limited reserves the right to charge a fee equal to 10% plus VAT of the reserve price of the lot, or where no reserve has been fixed, Halls’ lower estimate of the item(s) withdrawn, together with any expenses incurred in relation to the item(s) withdrawn.

27. Warehousing. The Auctioneers exempt themselves from any liability to goods delivered to their salerooms without sufficient sale instructions, and reserve the right to make a warehousing charge in this respect. A similar warehousing charge will be applicable for goods left on their premises after they have requested the vendor to remove them. 28. Unsold Goods. Unsold goods must be collected if they are not to be re-offered within 14 days following receipt of any after sale advice slip. Halls Auctioneers Limited reserve the right to sell by auction on behalf of the vendor without reserve any items after this period.

22. Insurance. Halls Fine Art are not regulated by the FSA for the provision of insurance to its clients. However, Halls Fine Art, for its own protection insures property consigned to it at bottom pre sale estimate, unless the item has been sold, in which instance property is insured at the hammer price for loss, occasioned as a result of theft, fire or negligence whilst in their custody or control.

29. Important Notice. Any monies held on your behalf will be held in a Clients Bank Account at the Nat West Bank PLC, 8 Mardol Head, Shrewsbury and will be protected by the FSA. Furthermore for your protection, Halls adhere to the Clients Monies rules of the RICS. Any incidental interest earned on such monies will be retained by Halls as part of their terms of engagements, and by instructing Halls to act on your behalf, you are agreeing to and endorsing that course of action.

23. Warranty of Title. The seller warrants to Halls Auctioneers Limited and to the buyer that he is the true owner of the property or is properly authorised to sell the property by the true owner and is able to transfer good and marketable title to the property free from any third party claims.

24. Photography. Vendors give Halls Auctioneers Limited the right to photograph and illustrate and promote any lot placed with them for sale and to use such photographs and illustrations at any time at their discretion, whether or not in connection with the auction.

RICS operates a Clients’ Money Protection Scheme (CMPS). This scheme, of last resort, covers direct loss of clients’ money as a result of misappropriation (or equivalent) by a RICS Regulated Firm, up to a £50,000 limit. The CMPS nor Halls will provide protection for the failure of a bank. But protection for bank failure is provided byThe Financial Services Compensation Scheme up to a £50,000 limit.

25. Electrical and Mechanical Goods. The seller and consignor of electrical or mechanical goods warrants and undertakes to Halls Auctioneers Limited that on the date received by Halls that the same are safe if reasonably used for the purpose for which they were designed and free from any defect not obvious on external inspection which could prove dangerous to human life or health, and will indemnify Halls its servants and agents against any loss or damage suffered by any breach of the above warranty.
