PROOF OF FIREARMS

The term ‘proof exemption certificate’ indicates that a firearm has been examined at a Proof House but not proved, as either (a) it was deemed of interest and not intended for use, or (b) ammunition was not available. In either case, the firearm must be regarded as unsafe to fire unless subsequently proved. Firearms proved for Black Powder should not be used with modern smokeless ammunition.

Comment in this catalogue is restricted in general to exceptional condition and to those defects that might affect the immediate safety of a firearm in normal use. An intending buyer unable to make technical examinations and assessments is recommended to seek advice from a gunmaker or from the specialist in charge. All prospective buyers are advised to consult the lists of bore and wall-thickness measurements posted in the saleroom. Potential buyers should note that guns are stripped only where there is a strong indication of a mechanical malfunction. Stripping is not otherwise undertaken. Guns intended for use should be stripped and cleaned beforehand. Hammer guns should have their rebound mechanisms checked before use. The safety mechanisms of all guns must be tested before use.

TAXIDERMY & RELATED ITEMS

As a seller of these articles, Gavin Gardiner Ltd undertakes to comply fully with CITES regulations and DEFRA. Buyers are advised to inform themselves of all such regulations and should expect the exportation of items to take some time to arrange.

The term ‘Certificate of Unprovability’ indicates that a firearm has been examined at a Proof House and is deemed both unsuitable for proof and use. Reproof is required before any such firearm is to be used.

Lot 96 J. PURDEY & SONS A MATCHED PAIR OF 12-BORE SELF-OPENING SIDELOCK EJECTOR GUNS, NOS. 16073 AND 16073

30-inch barrels with 2 1/2-inch chambers, about improved cylinder and 3/4 choke and 1/4 and 1/4 choke borings respectively, the additional 30-inch barrels for the No.2 gun with 2 1/2-inch chambers about full choke borings, the frames, locks and gold numbered top levers with fine bouquet and scroll engraving, the No.1 gun retaining most of its original hardening colour, the No.2 gun retaining traces of original hardening colour, cocking indicators, 14 1/4-inch well figured stocks, No.2 gun with a leather cheek pad, 6lb. 8oz., nitro proof, No.1 gun barrel wall thickness marginal, No.2 gun barrel wall thickness below the recommended minimum, in their maker’s triple leather gun case The maker confirms that a pair of guns numbered 16072 and 16073 were ordered by G. Ward on 10th June 1895. In 1903 and 1910 pairs of extra barrels were made and fitted for each gun. Purdey records indicate that by 1956 the pair had been split, gun no. 16072 having been purchased by Purdey and subsequently sold on. A replacement No.1 gun was then built, using one of the pairs of original barrels and was numbered 16073 so as not to cause confusion with the gun that Purdey had subsequently sold. The vendor’s family is not sure how the second gun came to be built, but it is speculated that the original No.1 gun was stolen in the aftermath of World War II and that Purdey offered to replace it as they had unwittingly sold the original No.1 gun. Research in to the Purdey records is ongoing.

The guns were originally ordered as nonejector guns, although by this time ejectors had become standard. Consequently, although not fitted, the action and fore-end appear to be already machined to accept the additional parts required. This is confirmed by the note in the maker’s records “provision for ejectors”.

The maker confirms that the guns were built in 1900, and that they have no record of the Boss single trigger. The guns are unusual in two respects. Firstly they have reverse choke borings, the classic specification of a true grouse gun, firing the choked barrel first. Secondly, they are fitted with the Boss single trigger. At this time Purdey did not have their own reliable single trigger mechanism and it was not unknown for a client to have the rival firm’s proven single trigger fitted when the guns were built.

Augustus William Adolphus George Frederick

Lot 153 ALBERT STAEHLE A PAIR OF 16-BORE PINFIRE HAMMER GUNS, NOS. 1135/6, BUILT FOR A HANOVERIAN PRINCE 30-inch damascus barrels with 2 1/2-inch chambers, about true cylinder borings, gold lined breeches, file-cut ribs signed in gold, the rounded frames, nonrebounding back locks, hammers and horn-mounted underlevers with gold lined decoration surrounding scenes of game in landscapes amidst scrollwork, Lefaucheux patent actions, set triggers, scrolling steel trigger guards with horn grips, 14-inch well figured stocks with cheekpieces and chequered steel butt plates, 7lb. 6oz., Austrian black powder proof

The tang of both guns is engraved with a crown and the entwined intials “AE”, surmounted with a Prince’s crown. The presence of set trigger mechanisms indicates that the guns may well have had a set of rifle barrels. Prince Ernest Augustus, Crown Prince of Hanover, Heir of Brunswick, 3rd Duke of Cumberland and Teviotdale.

(Ernest Augustus William Adolphus George Frederick, 21 September 1845-14 November 1923), was the eldest child and only son of George V of Hanover and his wife, Marie of Saxe-Altenburg. Ernest Augustus was deprived of the throne of Hanover upon its annexation by Prussia in 1866 and later the Duchy of Brunswick in 1884. Although he was the senior male-line great grandson of George III, the Duke of Cumberland was deprived of his British peerages and honours for having sided with Germany in World War I. Ernest Augustus was the last Hanoverian prince to hold a British royal title and the Order of the Garter. His descendants are in the line of succession to the British throne. £2500 - 3500

GAVIN GARDINER LIMITED’S AUTHENTICITY GUARANTEE If Gavin Gardiner Limited sells an item of Property which is later shown to be a “Counterfeit”, subject to the terms below Gavin Gardiner Limited will rescind the sale and refund the Buyer the total amount paid by the Buyer to Gavin Gardiner Limited for that Property, up to a maximum of the Purchase Price.

The Guarantee lasts for one (1) year after the date of the relevant auction, is for the benefit of the Buyer only and is non-transferable.

“Counterfeit” means an item of Property that in Gavin Gardiner Limited’s reasonable opinion is an imitation created with the intent to deceive over the authorship, origin, date, age, period, culture or source, where the correct description of such matters is not included in the catalogue description for the Property. Property shall not be considered Counterfeit solely because of any damage and/or restoration and/or modification work (including, but not limited to, recolouring, refinishing or rebarreling).

Please note that this Guarantee does not apply if either:-

(i) the catalogue description was in accordance with the generally accepted opinions of scholars and experts at the date of the sale, or the catalogue description indicated that there was a conflict of such opinions; or

(ii) the only method of establishing at the date of the sale that the item was a Counterfeit would have been by means of processes not then generally available or accepted, unreasonably expensive or impractical; or likely to have caused damage to or loss in value to the Property (in Gavin Gardiner Limited’s reasonable opinion); or (iii) there has been no material loss in value of the Property from its value had it accorded with its catalogue description. To claim under this Guarantee, the Buyer must:-

(i) notify Gavin Gardiner Limited in writing within one (1) month of receiving any information that causes the Buyer to question the authenticity or attribution of the Property, specifying the lot number, date of the auction at which it was purchased and the reasons why it is believed to be Counterfeit; and

Gavin Gardiner Limited has discretion to waive any of the above requirements. Gavin Gardiner Limited may require the Buyer to obtain at the Buyer's cost the reports of two independent and recognised experts in the relevant field and acceptable to Gavin Gardiner Limited. Gavin Gardiner Limited shall not be bound by any reports produced by the Buyer, and reserves the right to seek additional expert advice at its own expense. In the event Gavin Gardiner Limited decides to rescind the sale under this Guarantee, it may refund to the Buyer the reasonable costs of up to two mutually approved independent expert reports, provided always that the costs of such reports have been approved in advance and in writing by Gavin Gardiner Limited.

(ii) return the Property to Gavin Gardiner Limited in the same condition as at the date of sale and be able to transfer good title in the Property, free from any third party claims arising after the date of the sale.
