A new year is upon us and, as usual, the holiday season now seems like a blur. There were holiday par8es galore and it seems as if the true spirit of the season might be lost in the insanity that befalls many of us during this season of joy. As I write, Thanksgiving is just a mere month and a week past, along with Hanukah, Christmas and the New Year celebra8ons….and we are off running again with a new calendar. TriCounty did have a great holiday party on the 12th of December at the Chateau Briand which was aIended by over 200 guests. There are pictures in this TriLines and on our website.. Everyone had a really good 8me as always. Kudos to Ron Brunell, Adam Erickson, James Bas8an, Pat Calvert and Jean Abatelli for making the party such a success. The next TriCounty mee8ng will be held at Oliver’s Gastropub in Astoria on January 30th, and we have a huge event planned in March as a joint mee8ng with Suffolk IIAA when Chris Paradiso…..the na8onal marke8ng guru, expert in Social Media, (and everything electronic), a Rough Notes cover story, and advisor to Astonish agents, ….. is coming to Long Island to share his exper8se along with useful 8ps. An event that is of cri8cal significance to independent agents is our annual L-‐Day where we meet with our NY State Legislators in Albany. This is scheduled for March 25, 2014 and I cannot stress the importance of this one day commitment. There is strength in numbers
and our officials need to see and hear us in person. TriCounty is offering free transporta8on so be sure to set this date aside. There will be more informa8on on L-‐Day coming your way in the weeks ahead. The Big “I” Na8onal Legisla8ve Conference will be held on April 9 & 10 in Washington DC and once again, we urge you to travel with us. This is an enjoyable trip and an experience not to be missed. Obituary It is with deep felt sympathy that we announce the passing of Michael D. Levine on December 24, 2013, at the tender age of 50. Michael was very active in the Queens/ Kings Big I for a number of years. When Queens/Kings and Nassau merged in 2002, Michael was elected president of the newly formed TriCounty in 2003.

Local Legislative Meeting On December 16th members of the TriCounty Legislative Committee met with NYS Senator Jack Martins at his office in Garden City Park. Senator Martins’ Chief of Staff, Paul Ehrich, also joined the discussion. We had many topics to cover in a short period of time. The first subject we introduced was the standardization of the hurricane deductible triggers. As we know, the companies all have different events which will trigger the application of their catastrophic windstorm deductibles. Although agents do not like hurricane deductibles, we understand their necessity in keeping the property by Stephen Folan insurance market open in hurricane prone areas like The Folan Agency Ltd. Long Island. Our issue is that all policies do not have the same set of rules which trigger the application of the higher deductible. This can lead to an increased professional liability exposure for agents that represent various companies with different triggers. We pointed out that the number of calls legislators received after Superstorm Sandy would have been exponentially higher if the storm was declared a hurricane when it made landfall in NY. The NYS Assembly has passed their version of the bill, but it never seems to get passed in the Senate. Senator Martins is a co-sponsor of the senate bill. He is working to get the legislation passed in the Senate. While on the topic of Superstorm Sandy we discussed the bills that were passed by the Assembly which were knee-jerk reactions to what people were experiencing after the storm. We thanked Senator Martins for not taking action on these bills which were introduced during a stressful time. Senator Martins’ family is involved with small business, so he was well versed on the remaining topics we wanted to discuss. Bill were passed in both the
Local Legislative Meeting con’t Assembly and Senate and brought to the Governor for his signature as relates to the issuance of certificates of insurance and requires the issuance of a certificate of insurance as a summary or evidence of property or casualty insurance. We forwarded him a fax from the Village of East Hills stating their liability insurance requirements. This is not a joke. It reads:
“Effective immediately: all liability insurance forms must indicate that “NO EXCLUSIONS APPLY” This must be clearly indicated on each certificate of insurance submitted with every building permit application. No application will be accepted with certificates that do not contain these words.”
Can you imagine the premium on that policy? Senator Martins doesn’t understand why Governor Cuomo will not sign the certificates bill, and said he will look into it. The problems with the New York State Insurance Fund are well known to agents. We explained to Senator Martins that since the SIF is not regulated by the Department of Financial Services, they can create their own rules. This puts the other workers’ compensation providers and their agents at a disadvantage. The biggest concern we have is the 30-day wait to cancel a policy written in the SIF. The Senator agreed that some of the practices of the SIF need to be changed. When the Scaffold Law was brought up, the Senator rolled his eyes. It seems he is as tired of discussing sections 240 and 240(1) as agents are. He feels that there will be some movement on the absolute liability contained in the NYS Labor Law this session. We can only hope!
Local Legislative Meeting con’t The final discussion centered on health care. There are many problems with the new Affordable Care Act, but those are issues that Washington has to iron out. Our concern at the state level is the NYS Health Insurance Exchange. We expressed our concerns about the diminishing commissions for the amount of work and time needed to review our small business clients’ health insurance programs. Many agents will not remain in the health insurance field for $5 commissions, but the business owner going on the government websites doesn’t understand the intricacies of comparing health insurance plans. One CEO purchased a plan on the exchange and then found out he had no out-of-network benefits. This was not his intention. Agents are also concerned about what the navigators are saying to the insureds. They have no boundaries like licensed agents do. Senator Martins feels the agent should be compensated for the professional work involved. All in all it was a productive meeting. Senator Martins was very engaged and knowledgeable about the topics we discussed. Hopefully, our meeting pointed out some of the struggles agents are going through that can be remedied through proper legislation. We have more local meetings scheduled before we head to Albany at the end of March. Get involved! If you personally know a legislator that would be willing to meet with us, let us know. 2013 Tri-County Holiday Party Celebrating the holidays with family and friends is a deeply rooted tradition and after several months of recovering from Sandy it was a pleasure to see everyone turn out for Tri-County’s annual party! We had an excellent turnout with close to 200 attendees. The food and company were great and the atmosphere was warm and welcoming. Giving Back Each year we offer $5,000 in scholarships to college-bound high school seniors in our region based on outstanding community service (Stephen T. Dooley Memorial Scholarship) and well-written essays based on a question pertaining to driver safety, (Joel S. Pollack Memorial Scholarship) This year, the question was:”Everyone knows an accident can increase your auto insurance rates. Write an essay explaining what else affects auto insurance rates.” Applicants were encouraged to consider things that can increase or decrease rates.”
There was an overwhelming number of responses this winter, with close to 200 completed applications submitted. Representatives of TriCounty plan to attend the graduating ceremonies of each of our two winners’s schools and present the awards.
Giving Back con’t In addition to these two scholarships, TriCounty offers another $5,000 to two students from St. John’s University, School of Risk Management, Insurance and Actuarial Science. Criteria for this award is based on the students being either juniors or seniors and majoring in insurance, with a minimum GPA of 3.0.
Five applications are selected by the university director and sent to our committee who then makes the final selections. Winners are recognized with symbolic checks of $2,500 each along with photographs taken at our annual installation dinner each spring. TriCounty IIAA has played a significant role in the development and growth of the NextGen group on Long Island. Understanding the need to develop future leaders
in the industry, a NextGen Task Force was created to work with IIABNY and offers meetings to local young professionals. TriCounty extends discounts to NextGen members to encourage their attendance and participation at membership meetings. Our newsletter, Tri-Lines, promotes upcoming events and recaps their successes. It is fair to say our efforts are paying off as this continues to be a successful venture! Adam Erickson, one of our directors, has been involved with NextGen since 2010. He attends the business meetings, participates in recruitment of new members and helps to organize local networking meetings and charitable fundraising events, which are often supported by TriCounty financially and through attendance. Adam continues to offer valuable insight from NextGen members and is an asset to our Board of Directors.
Giving Back con’t In December, 2012, a donation of $2,585 was given to the Interfaith Nutrition Network ( The INN). TriCounty has been supporting this local charitable group for a number of years at its annual holiday party by encouraging attendees to contribute to the association present them with the donation. This continues to be an extremely rewarding effort as our generosity is greatly appreciated by this ongoing worthy organizaiton donation. The TriCounty Independent Insurance Agents Association is a branch of the National Big “I” association with more than 300 members doing business in the counties of Nassau, Queens, Brooklyn and Staten Island. Performance Reviews
We always come to the realization of doing
performance reviews around December. Then we set some time aside to talk to our staff about how they did. Well, at least we should, but sometimes we have no time and most times we lose good talent because of this. I came across an article that’s a bit dated but its great and everyone should read HERE ! by Alex Giraldo Club Agency
We all need to take a proactive approach when it comes to our staff’s performance or lack thereof. Performance reviews in my
opinion should be an ongoing progress throughout the year that culminates in a fair and just evaluation of someone’s strengths and weaknesses. I encourage everyone to do performance reviews periodically and be specific with your staff when you set goals and expectations. We as a whole are only as good as the sum of our parts.
Tips for Surviving Severe Cold Weather From The Insurance Information Institute
Much of the country periodically experiences severe and sustained cold
weather, with snowfalls interspersed with periods of melting and freezing. This can inflict considerable damage on homes.
Here are some tips and steps you can take to keep your home safe and make
insurance losses less likely during extended severe weather.
✴
Keep sidewalks and entrances to your home free from snow and ice.
✴
Watch for ice dams near gutter downspouts. Keep gutters free of leaves and debris so melting snow and ice can flow freely. Ice dams can cause water to build up and seep into your house.
✴
Keep the house heated to a minimum of 65 degrees. The temperature inside the walls where the pipes are located is substantially colder than the walls themselves. A temperature lower than 65 degrees will not keep the inside walls from freezing.
✴
Identify the location for the main water shutoff in your home. Find out how it works in case you have to use it.
✴
Open hot and cold faucets enough to let them drip slowly. Keeping water moving within the pipes will prevent freezing.
✴
If you own a swimming pool and temperatures are expected to dip below freezing, run the pool pump at night to keep the water flowing through the pipes.
✴
If you haven’t already, make sure all hoses are disconnected from outside spigots.
Tips for Surviving Severe Cold Weather con’t ✴
If your garage is attached to your house, keep the garage doors closed. The door leading to the house is probably not as well-insulated as an exterior door.
✴
If ice forms on tree limbs, watch for dead, damaged or dangerous branches that could break and fall because of ice, snow or wind and damage your house, a car, or injure someone walking near your property.
✴
If you use fireplaces, wood stoves and electric heaters, watch them closely and make sure they are working properly.
✴
Remember to close the flue in your fireplace when you’re not using it.
✴
If you have to leave your home on a trip, ask a neighbor to check the house regularly. If there is a problem with frozen pipes or water leakage, attending to it quickly could mean far less damage.
✴
If you plan to be away for an extended period of time (or if temperatures are expected to remain below freezing), have the water system, including pool plumbing, have the water system drained by a professional to keep pipes from freezing or bursting.
✴
A Worst-Case Scenario ✴
If you discover that pipes are frozen, don’t wait for them to burst. Take measures to thaw them immediately, or call a plumber for assistance.
✴
If your pipes burst, first turn off the water and then mop up spills. You don’t want the water to do more damage than it already has.
Tips for Surviving Severe Cold Weather con’t
✴
Call your agent or company as soon as you can. An insurance adjuster doesn’t need to see the spill before you take action. However, he or she will want to inspect any damaged items.
✴
Make temporary repairs and take other steps to protect your property from further damage. Remove any carpet or furniture that can be further damaged from seepage.
✴
Make a list of the damaged articles.
✴
Save the receipts for what you spend—including additional living expenses if you must leave your home until repairs are completed—and submit them to your insurance company for reimbursement.
Standard homeowners policies will cover most of the kinds of damage that
result from a freeze. For example, if house pipes freeze and burst or if ice forms in gutters and causes water to back up under roof shingles and seep into the house. You would also be covered if the weight of snow or ice damages your house.
However, most policies do not cover backups in sewers and drains or flood
damage, which can also happen in winter. To be covered for flooding, you need a policy from the National Flood Insurance Program, while coverage for sewers and drains is generally offered as an endorsement to a standard homeowners insurance policy.
If your home suffers water damage, it is important to make sure that it is
properly dried and repaired to prevent any potential problem with mold. Remember, mold can not survive without moisture.
Check with your agent or company so you’ll be sure what your policy covers.
