DRIVERLESS OR NOT – THAT IS THE QUESTION.

We received an excep-onally good response to our Joel

S. Pollack Memorial Scholarship essay ques-on this year. The ques-on was “We hear more and more about self-driving cars. In your opinion, what are the advantages and disadvantages of driverless cars regarding safety on the roads? What are the ethical ramifica-ons of driverless cars?” James Bastian President

This definitely is a hot topic and appears in newspapers

and magazines on a regular basis. Newsday’s Opinion Page on this subject came in March with the writer’s own thoughts. He pointed out that cars driven by well-programmed robots would certainly cause fewer accidents because they would not lose concentra-on and would have automa-c reflexes. Imagine driving on the LIE without fear of angry or distracted speeders or drivers who con-nue to text. Sta-s-cs show that deaths due to auto accidents are up 14% in the past 2 years, close to 40,000 a year (not all on the LIE I hope).…..

Smart cars are already here in some states and a

number of automakers and technology companies are tes-ng fleets of self-driving vehicles, many with backup drivers who can take the wheel in an emergency. Time magazine recently pointed out that within a 3 year period there was a 28% increase in auto related deaths caused by distracted drivers,

mostly within the 15-24 age group. The writer felt that autonomous cars will remake driving in a whole new way and will be here soon. The -tle of that ar-cle was: “Why You Shouldn’t be Allowed to Drive”. You get the message right in the -tle. Newsday wrote on April 15 that Apple is going well beyond the iPhone and joining the compe--ve race to design self-driving cars.

What do our high school students say? Of the close to

100 applica-ons received on this subject, most students said they much preferred to drive themselves. Comments included …..’I don’t trust computers that much’….. ‘I would worry about hackers gecng into the system and taking over the vehicle’….. ‘Too many people would lose jobs, like driver ed. teachers, truckers and taxi drivers’….’I like to be in control’.

Drunk driving was the cause of Joel Pollack’s young

demise. He was an innocent vic-m at the age of 35 with a wonderful future ahead of him. Perhaps Joel would be here today if the car that hit him did not have a human behind the wheel…..

And The Winners Are...

We received close to 100 applications for

the “Joel S. Pollack Memorial Scholarship”. Each of the students sent an essay on the topic of selfdriving cars, the advantages, disadvantages as well as the ethical ramifications. The essays were all thoroughly researched with many writing 4 and 5 page papers. It was surprising how many of the essays were not in favor of this new advancement in technology. It was a very difficult decision picking the winner Madelyn Collins of Susan E. Wagner High School in Staten Island. She will be Eileen Black Director

attending St. John’s University in the fall where she will be studying computer science.

We also received over 100 applications for the “Stephen T. Dooley Service

Scholarship”. Many of the students posted over 400 hours of community service over the course of their 4 years of high school. It was also a difficult decision picking the winner Madison Cinnamo of West Hempstead HS in West Hempstead. She will be attending New Paltz in the fall where she will be studying communication disorders.

Congratulations to both of our winners and we wish them much success in

their college careers and future endeavors!

Legislative Update: 20003 it’s no 90210 By Neil Levy

Last year I wrote an article for all my fellow

TriCounty members highlighting our industry’s legislative efforts. I had a catchy title called “I’m just a Bill…”in order to catch people’s interest. No longer a virgin Legislative committee member, I don’t need to resort to such tactics. We all know the insurance industry is rewarding. We help people, families, and businesses in their time of need but the insurance industry is vital to our New York economy. It creates over $150 billion in overall positive impact in the next few years as Neil Levy Director

well as supports over 158,000 jobs. I and a few of my colleagues will head to “The Hill”

in Washington DC on May 3rd-5th to represent TriCounty with hundreds of “Big I” representatives. We will meet with our Congressmen and women and Senators to discuss key topics in Workers Compensation, Hurricane Deductibles, Labor Law, Health Insurance, and of course how the insurance industry will focus and handle Transportation Network Companies (TNC’s) such as Uber and Lyft. The sharing economy is going to change insurance and we as agents need to understand the opportunities and obstacles ahead so we can properly advise our clients.

I would urge all of our readers to check out IIABNY.org to review the issues

and bills that we are supporting or refuting. Our lobbying effort continue to prove successful. Just last year we were instrumental in the passage of a law to end [10]


improper certificates of insurance, we won a victory for small business and many of our agents with the expansion of the “limited exemption” as it relates to Cybersecurity rules proposed by the Department of Financial Services (DFS.)

We all want to write more business and in addition to lobbying for our industry

on issues that will allow us to do just that, we are focused on issues that allow us to operate in a less confusing environment and that protect and serve our industry. IIABNY’s efforts spared our agencies from paying drastically larger penalties for inadvertently failing to renew one of the many insurance licenses. We protected our agencies from a proposal in the budget that was just passed that would allow to the government to hand pick one insurer for a ‘”Wrap-Up” program and side-step the contractor/insurance agent relationship.

Meeting Eric Madoff Photos don’t begin to tell the story of our combined lunch meeting with Suffolk IIAB on April 5th at Jewel Restaurant in Melville. You needed to be there to hear Eric Madoff, Executive Director and CEO of the New York State Insurance Fund speak to our group of close to 100 members and other industry guests. There were lots of questions following his superb talk and everyone left with a wealth of Information. If you missed this one, be sure to come to a future meeting with him. Are We Better Drivers? by Steve Ferrar

First, who are we? We are those that are

in some manner involved in the auto insurance industry. We are producers, CSR's, claims reps, claims managers, attorneys, claims adjusters, agency owners and managers.

What do we all have in common? Over the

years, we have encountered a multitude of descriptions and diagrams of auto accidents. Whether it's the driver's version while at our desks, details shared via telephone, police Steve Ferrar Director

reports, or MV-104 accident reports, we have seen and heard it all!

We continually see those diagrams of the rectangular vehicles with little

triangle fronts labeled Veh #1 and #2 or IV (Insured Vehicle) and CV (Claimant Vehicle). You know... the ones with those little tails showing the movement before impact.

We see the same accident descriptions and diagrams over and over and over

again resulting in clients that get surcharged, cancelled or injured. Then, while we are driving our own cars out in the real world and see a familiar scenario developing... Flash! Those diagrams with the little Veh #1 and #2 cars jump into our minds. We have seen this situation countless times and it doesn't end well. "CRASH!"

We know what follows; police, police reports, MV-104's, deductibles, rental

cars, No-Fault forms, accident surcharges, etc...

So we say to ourselves, "I don't want to go through all of this" and take

whatever steps are necessary to avoid it happening to us. Unfortunately, drivers without exposure to our repetitive viewing and reviewing of these accident scenarios are unable to foresee what will most likely happen, and end with a "CRASH." Here are two of the more frequent accident scenarios that come to mind: 1. You and the car in front of you are waiting on the entrance ramp to a parkway. Take your pick: Southern State, Meadowbrook, Cross Island, etc.. You both are waiting for that anticipated gap in traffic in order to accelerate and merge on. You are either looking in your side-view mirror or over your left shoulder. Finally, here comes your opportunity! The car in front of you starts to accelerate on the ramp, you do the same, and "CRASH." You've smashed into their rear because they "stopped for no apparent reason." You were looking back and assumed they would just keep accelerating onto the parkway. Result: "IV struck CV in rear." Chargeable accident! 2. You are stopped for a red light at an intersection, waiting to make a right on red. You keep looking left for the space in traffic and the opportunity to make your turn. There it is! The opening you've been waiting for. You start making the legal right on red and "CRASH." You did not look back and missed the pedestrian stepping off the curb to your right. Result: "IV struck pedestrian." Chargeable accident!

Most often, these potential accident scenarios do not come to mind until we

are driving along and one of these IV/CV situations starts to develop. Suddenly, that

big accident diagram that we have seen repeatedly flashes in our mind and we either hit the brakes, look back one more time, or do whatever the unfortunate driver in that diagram did not do. We, with our repetitive forced learning experience of others mistakes, do avoid the "CRASH."

So the next time you're reviewing those accident descriptions and diagrams,

count your blessings. We, in the business, due to forced continuous exposure are (consciously or subconsciously) in fact better drivers.

Motorists drove a record 3.22 trillion miles on

U.S. roads in 2016, a 2.8 percent rise from 2015 and the fifth consecutive year of year-over-year increases, according to the U.S. Department of Transportation.

Woman Walks into Ladder While on Phone

Walking-while-texting, which is now common, turned into a payday for a Georgia woman. She walked right into a ladder causing her phone to hit her forehead. And now, she’s $161,000 richer.

National Flood Insurance Program Secures $1 Billion in Reinsurance for 2017 For just the second time in its history, the federal government’s National Flood Insurance Program (NFIP) has reinsurance to help it weather major storms. The Federal Emergency Management Agency (FEMA), which manages NFIP, announced that it has secured more than $1 billion in reinsurance effective January 1, 2017 through January 1, 2018 from a group of 25 reinsurers. Under the agreement, the reinsurers agreed to indemnify FEMA for flood claims on an occurrence basis. The layer is structured to cover 26 percent of losses between $4 billion and $8 billion. A combined total of $1.042 billion of the NFIP’s flood risk was transferred to the private reinsurance market through this agreement.

Insurtech Lemonade Wins $34 Million in New Funding As It Readies for West Coast Expansion Lemonade, the home and renters insurance company run by artificial intelligence and behavioral economics, announced a $34 million B round of funding. The latest round was led by General Catalyst with participation from GV (formerly Google Ventures), Thrive Capital and Tusk Ventures, as well as existing investors Aleph, Sequoia, and XL Innovate. This brings Lemonade’s total funding to date to $60 million. [24]


The investment comes less than a year after Lemonade announced its seed round and less than two months after the insurtech company launched in New York. Lemonade was licensed as an insurance carrier in New York on September 15, 2016. The company said it has filed for a license in California and plans to expand in 2017. In an unusual move, in September Lemonade revealed its early numbers after its New York opening in a message from co-founder Shai Wininger. It said it sold 142 policies and generated $14,300 in gross written premium in its first 48 hours. “We believe in replacing brokers and paperwork with bots and machine learning, and we now have the backing to unleash this formula across new products and geographies,” said Daniel Schreiber, co-founder and CEO at Lemonade, announcing the new funding. Lemonade uses bots, or software that automatically performs simple tasks, to deliver insurance through its app and at lemonade.com. Consumers also file claims with the bot, which is authorized to pay claims instantly and without human intervention, creating what Lemonade’s founders say is a “delightful” insurance experience for customers. Unlike traditional insurance companies, Lemonade takes a flat fee and gives back unclaimed money to causes policyholders care about. State Farm Lost $7 Billion on Auto in 2016 State Farm joined the ranks of property/casualty insurers reporting challenges in their auto insurance line of business. State Farm said it lost $7 billion on its auto insurance underwriting in 2016. State Farm is not alone in seeing deteriorating results in its auto insurance line. It joins GEICO, Travelers, Allstate, The Hartford and other insurers looking for ways to counter rising auto costs. Analysts have reported that the auto line has been a drag on P/C insurers’ results.
