PRESIDENT’S MESSAGE

In the last couple of days I have started to see actual

conversa3ons popping up on Linked-­‐in regarding drone insurance. Apparently, there is a client that flies drones to take aerial photos for businesses like hotels, golf courses, real estate, etc. I men3on this since were all dealing with Cyber Security exposures and the never ending stream of news regarding autonomous cars.

I bring up these stories since it’s more important than

ever to reach out and network with your fellow agents and carrier representa3ves. I know it’s easy to say that “it’s been a long week” or “I get a million insurance ar3cles” however we’re in a rela3onship business and we need to step back some 3mes and get out and meet with our peers in the insurance community.

Tri-­‐County has a couple of events on radar that will give

you a great opportunity to get out of the office and network with your peers. We have a September bowling night in conjunc3on with Downstate Associa3on.

We are also looking forward to this year’s golf ou3ng on

October 9 at the Hempstead Golf & Country Club, a new venue for TriCounty. This year’s honoree is Peter Resnick Execu3ve Vice President Interboro Insurance Group.

Food for Thought on Property by Andrew Chong

Property seems to be one of the top lines of

business that generate errors and omissions claims frequently. Whether it may be due to failure to calculate or adjust the replacement cost of the building or due to substantial percentage of unoccupied units in the property. Agents and brokers should heed more attention when writing property. Property may be one of the easiest lines of business to write; however, it may be a double-edged sword.

One of basic errors and omission claims arises

from valuation of the property. It is shocking that number of brokers cannot distinguish different types of valuation on the property. There are: 1) replacement cost, 2) actual cash value, and 3) functional replacement cost.

Replacement cost is defined as the cost to replace the property, new today,

with materials of like kind and quality. Replacement cost may not be applied for older buildings. This may cause problems for buildings throughout older cities like our own New York City. Buildings may be over one hundred (100) years old, but carriers may not be willing to offer replacement cost because like-material may not be found or it will be more expensive to find the materials of like kind and quality. Some carriers actually gotten over this and offers replacement cost on older buildings as long as they have updates within last fifteen years to thirty years.

Actual cash value is defined as replacement cost less the depreciation value.

The only difference between actual cash value and replacement cost is the

depreciation. If your property is brand new, and has not had any depreciation, there is no difference between the two methods. Actual cash value is not the same as accounting depreciated value. Actual cash value is determined by first calculating the replacement value of the property. The next step involves estimating the amount to be subtracted, which reflects the building's age, wear, and tear.

Functional replacement cost is defined as the cost of acquiring another item of

property that will perform the same function with equal efficiency, even if it is not identical to the property being replaced. This may not be used widely in the industry; however, mostly this is used for older buildings built prior to 1900, which the construction material cannot be found and replaced.

Note that agreed amount is not a type of valuation. It is a provision that eliminates

co-insurance clause. Some people think that agreed amount or agreed value is a type of valuation. It is a provision that is used while the valuation is replacement cost to waive co-insurance on the property.

Which Valuation Method Is Best? No method is the best. Choosing the best

method is very circumstantial depending upon applicants’ situation. Clearly, replacement cost value is a preferred method. But, if the budget would not allow for this, applicants can get some of their buildings insured at ACV and others at replacement cost value. This approach will may be frugal, but involves assuming the risk for the difference between the ACV and the replacement cost value. If some buildings are functionally obsolete and the goal is to replace the square footage, consider insuring them using the functional replacement cost value option.

The best recommendation is to take some time to consider the different valuation

options available for the accounts that can fit the accounts’ budget. Offer various type of valuation and try to obtain a written statement that the applicant actually understood and selected the chosen valuation. Or the preferred recommendation is to provide replacement cost valuation with an attachment of agreed amount provision.

Two Tri-County scholarship programs were started many years ago in honor

of two outstanding leaders of our organization who had died long before their time. Each year, the Joel S. Pollack Memorial Scholarship offers $2,500 to a high school graduating student for the best essay in a chosen topic usually dealing with driver safety. The award is sent to the winning student’s college after enrollment to assist with education and relating expenses. This year, the award went to Chelsea Hroch a graduate of Farmingdale High School.

The Stephen T. Dooley Community Service Scholarship award is presented to

a graduating student who has performed exemplarity community service during his or her years in high school. This award, also for $2,500, is mailed to the winner’s

chosen college for educational expenses after enrollment. The 2014 recipient was Lindsey Haynes of South Side High School. Certificates of appreciation were delivered to both high schools for presentations at the students’ awards ceremonies.

These scholarship programs have been so well received over the years

that the TriCounty Board of Directors expanded to another area of education. For the last 6 years, an additional scholarship has been awarded to the ‘best of the best’ students at St. Johns School of Risk Management in NYC. Five top students in either the junior or senior classes are chosen by the St.Johns education director and 1 or 2 winners are selected by the TriCounty education committee. Criteria includes a minimum GPA of 3.0 and majoring in insurance or

I recently received an email from my mortgagee,

Wells Fargo Bank, advising me that I can get quick competitive quotes and bundled insurance savings from them – online or over the phone. Is selling personal lines insurance so easy that everyone from Walmart to Google is now advertising lower rates?

The only state that doesn’t allow car insurers to

Nationwide Insurance announced said it has signed a three-year agreement

with the National Football League (NFL) to become an official insurance sponsor of the league. The relationship kicks off this coming season and will run through the 2016 season.

Americans Clueless about LTC Expense

Is your agency marketing Long Term Care Insurance?

A new survey by The Associated Press-NORC Center for Public Aairs has

found that Americans 40 years or older often underestimate the cost of long-term care and overestimate the role of Medicare to pay for long-term care. Only 24 percent of respondents correctly estimated the monthly cost of a nursing home (up to $8,000 per month), 29 percent correctly estimated the monthly cost of an assisted-living facility (up to $4,000 per month), and 30 percent correctly estimated the cost of a part-time home health care aide (up to $2,000 per month), the survey found.

6.5 Million Homes from Maine to Texas at Risk for Storm Surge

More than 6.5 million homes along the U.S. Atlantic and Gulf coasts are at

risk of storm surge inundation, representing nearly $1.5 trillion in total potential reconstruction costs. More than $986 billion of that risk is concentrated within 15 major metro areas, according to a report by property data and analytics firm CoreLogic.

Florida ranks number one for the highest number of homes at risk of storm

surge damage, with nearly 2.5 million homes at various risk levels and $490 billion in total potential exposure to damage.

At the local level, the New York metropolitan area, which encompasses

northern New Jersey and Long Island as well, contains not only the highest number of homes at risk for potential storm surge damage (687,412), but also the highest total reconstruction value of homes exposed, at more than $251 billion. Insurance Journal [23]

Christopher Wukovits New TriCounty Director

Newly Elected Tri-County Director Christopher

Wukovits of AAA New York Insurance Services, Inc. of Garden City has been in the insurance industry for over 16 years.

He began his career 1998 in the independent

agency system as a sales agent and was quickly promoted to management. In 2002, he left the agency to pursue and opportunity to work at the start-up NYAIP carrier AutoOne. Chris worked there for almost 10 years and in 2010 after a short stint at St. John’s University as the Manager of their Call Center reunited with his old boss at AAA New York Insurance, where he is the Agency Manager responsible for the Sales and Service.

He is very excited to be part of the Tri-County Board and serve with a great

group of insurance professionals. Chris, his wife and two children live in Bayside. Chris strangely loves to read insurance policy forms and endorsements, play golf and spend time with his family.

Neil Levy New TriCounty Director

Unlike many others in the independent insurance

channels, Neil Levy entered the industry fairly recently. He began a career in Public Accounting specializing in the Hedge Fund and Financial Services industry before joining CBS Coverage Group in 2008.

Neil Levy is the President of CBS Coverage

Group, a large independent agency that recently joined Assured Partners in April of 2014. In addition to his general industry knowledge, his extensive career on Wall Street over 15 years has provided him with the expertise and knowledge to found CBS’s Financial Institutions Risk Group. This group is focused on Professional Liability coverage for financial institutions.

He was the president and founder of Highpoint Capital Advisors, LLC., an

investment limited partnership and has held diverse positions within the investment industry including as an equity analyst at boutique investment bank, Needham & Co., and as a controller at Cantor Fitzgerald in Manhattan

Neil is a Certified Public Accountant (CPA) and a Certified Financial Planner™

(CFP). He received his B.S. in Accounting from Lehigh University in 1993 and earned his MBA from New York University's Stern school of Business in 2000.

Neil is a member of the Chartered Financial Analyst (CFA) Institute as well as

the New York State Society of Securities Analysts and has been the feature of published articles in Hedge Fund Manager Weekly and Florida Trend Magazine..

Neil is a Registered Principal and an Investment Advisor Representative with

FINRA.

Neil is involved with numerous charities including Community Mainstreaming

Assoc. (CMA), Little Village School and the UJA. He resides on Long Island with his wife Robyn and three children.

I regularly get pushback from members who either don’t want to use social media or are using it with very little documentable results. Unlike the movie Field of Dreams, agencies who build awesome websites, blogs and Facebook pages are not guaranteed the traffic they want and expect. Social media does not always create specific new business activity and agencies shouldn’t rely on it to do so. But, the benefits of being active are surely there. Social media can be a good way to get name recognition. It also can help consumers to learn who you are and your business philosophy. It can convey your value proposition and you can make it tangible by posting testimonials from your clients. Sometimes it may even lead to writing new coverage. Understand that social media success doesn’t happen overnight. It takes time, consistency and a little creativity to drive your clients and prospects there. We can provide help with starting and implementing the process. Once it does take hold and you are getting a consistent level of visitors - your reach expands exponentially as visitors start sharing information from your site with their friends who may also

share to their friends and so on. Not interested in social media? That’s definitely your perogitive. My question to you is how are you reaching out to clients and prospects? Are they engaging with you and sharing information about you with their friends? Is your outreach successful in driving clients and prospects to you for insurance? What’s the age of those you reach and are you missing the younger consumers that everyone sites as the top users of social media (FYI - It’s not just young people using social media) Let’s not lose sight of our objective - to be recognized as a professional, community based resource for providing insurance protection and getting the opportunity to provide that protection for your current clients as well as prospects. It’s not how you do it, it’s how effective are you at doing it. Social media is a great tool to help accomplish this. The decision is yours.
