What Is The Process Of A Divorce? Are you thinking that divorce is the best option to resolve the disagreements between you and your spouse? Are you wondering how you can pay for the divorce? Maybe you are worried about how you’ll be able to work out child custody. There are many questions that will come up and there will be a lot of difficult answers. You may want to take it all one step at a time, though. Begin with this question: What is the process of a divorce? With this basic understanding, you’ll be able to tackle the rest of your questions as they come up. There probably aren’t many divorces that are just the same; every couple facing a divorce has their own unique challenges and concerns. Still, the basic steps in the process are pretty standard. If you understand this framework, the rest of the information and proceedings can be a little more predictable. That made things easier for me and I hope that it will make them easier for you. Before beginning the divorce process, some states require that the two spouses separate. If this is true for you, then you’ll need to live in separate locations for a determined amount of time. Even if that isn’t the case where you live, the separation period can help you to understand if you are really committed to splitting up. Some couples may find during the separation that they really want to make the marriage work after all. Some people choose to remain separated and never actually continue onto official divorce proceedings. The next step will be to file a petition. This pretty much involves a lot of paperwork. If you have an attorney, then he or she will be able to review the paperwork, watching out for mistakes and making sure that you get things done in order and on time. As part of your paperwork, you will need to identify why you are asking for a divorce. The reasons allowing you to get divorced, or the grounds for a divorce, may be different from one state to another state. You will also need to make a list of the possessions that are going to be split up during the divorce. Once the papers have been filed, your spouse will need to be notified and will then have a certain number of days to respond. There is a document called a Voluntary Appearance which takes care of this step. Sometimes a temporary hearing is necessary in order to establish some sort of order while waiting for the rest of the divorce proceedings to come to a conclusion. There are a lot of reasons that the temporary hearing can be scheduled. After this hearing, there might be a long wait before the final agreement is arrived at. The agreement is the next step. At this point you may be writing out how things will be handled for the rest of the separation until the divorce goes to trial, or it could be the end of the divorce proceedings. This will probably be determined by how much disagreement there is between you and your spouse. If the proceedings do go to a trial, then a judge will determine the final decisions. Divorces can be difficult; hopefully, knowing how the process works will make it a little bit easier for you.
