As an art advisor and appraiser, I have seen the dark side of the industry: art appraisers that charge clients exorbitant fees, ϐ ǯ real value, auction houses that lure clients to sell and their work goes unsold, dealers that place a huge price tag on a painting which has little or no value, Dz ϐ dz Ǥ

Don’t get me wrong; there are professional appraisers and auction houses that look after the client’s best interests. There is a cadre of art advisors that negotiate strategically on behalf of buyers and sellers of art, and dealers of the highest quality and the best taste. In this article, I hope to provide you with some guidance and to help the art buyer and seller make smarter decisions. Rule #1: Just because an artwork is expensive, doesn’t mean that it has value. The story usually goes like this. Mr. and Mrs. Smith go to Nantucket for vacation. A painting is purchased, a colorful seascape or a Nantucket scene, a memento of their trip. More than likely, the price tag for the painting is high. Jump ahead some years later. Mr. Smith and Mrs. Ǥ ϐ ǡ ǡ Ǥ to conduct a valuation of their tangible assets. Mrs. Smith remembers spending $50,000 on that painting that they bought in Nantucket and assumes the painting will be valued at a higher price than they paid. As appraisers, we do our due diligence. We investigate the artist’s sales in the auction marketplace. In the case of the painting bought in a gallery while on vacation, it is likely that the artist’s paintings have never sold at auction. It is probable that the piece cannot be valued above $1,000. The price paid to a dealer is not its fair market value or the price it will sell for in the open market. Fair market value is used for estate planning and estate taxes, equitable division, charitable donation, estimates for sale and when appraising a work used as collateral for a loan. It is not necessarily the price you paid for it. When buying at a gallery, have an independent appraiser provide you with an opinion of value for the painting before you write the gallery a check. Rule #2: The auction house is not your friend. Sure, it seems like they are your friends. They offered to do your appraisals for free, invited you to glamorous parties and private exhibitions.

They arranged internships for your children and generously sent you their beautiful auction sales catalogues. An auction house is trying to build up your loyalty so that ǡ ϐ Ǥ completely appropriate. The job of an auction house’s contemporary art department is to consign the best pieces at a commission ϐ Ǥ is that the auction market is VERY competitive. At the highest level, there are two major auction houses, Sotheby’s and Christie’s, ϐ same product. All of the auction houses below the two dominant players are even more competitive.

TAKEOFF ART Recently, a very unhappy client called us with a story of a prominent appraiser still engaging in this practice. The appraiser charged $100,000 for the valuation of six paintings and stated that her fee was based on a percentage of the value of the painting. According to the standard practice of our profession, an appraiser’s fee for service must be hourly or based on a predetermined amount agreed upon by the appraiser and the client. Appraisers that charge these ridiculous fees give the profession a bad name. Ͷǣ ϐ Ǥ In 2014, a client called us seeking to sell her collection of 100 paintings. After looking at her list of artists, I was encouraged. She owned a Chagall, Dali, Miro, and Picasso, to name a few. I dug deeper into the collection, asking her where she bought the paintings and what she paid. My excitement for the collection dropped immediately Dz ϐ dz she had purchased them all while traveling on her yearly cruise. ϐ Ǥ worse, she had paid high retail for each of the works and I knew that the majority were fakes. I showed her list to seven or eight auction houses and each told me the same thing. They would get pennies on the dollar for each work. One of the hardest messages to deliver to a collector is that their treasures have little to no value. Just because the work is signed by Chagall doesn’t mean that it is an original Ǥ ǡ ϐ authenticity, the small print clearly delineates that the work is a replica or print of an original.

The goal of this article is not to dissuade you from buying or selling art or having your art appraised. When buying a painting from a dealer, ask for an independent opinion. So many of our clients seek ϐ of dollars. When selling anything at auction, go to more than one auction house. If you are not comfortable doing that yourself, have an independent advisor negotiate on your behalf. When hiring an appraiser, ask a few simple questions: ͳǤ What is the fee structure? You want to ensure they base their fee for service on an hourly rate. ʹǤ What is their experience valuing your material? You never want an American furniture specialist valuing your Asian works.

He’s resilient. Johnson was raised as an only child in a family that was close knit but frequently displaced. As he became a teenager, he “struggled to stay on the right path... getting arrested when [he] was thirteen,” Johnson says. But a fateful awakening came the following year: “When I was fourteen, we got evicted. We came home to a padlock... I looked up at my mom and she was crying, and there was nothing I could do. I remember thinking, ‘this can never happen again.’ ” Determined to never relive the anguish of that day, Johnson channeled his pain into the will to forge a lasting career. He’s a tireless worker. “The men I idolized built their bodies and became somebody — like Sylvester Stallone and Arnold Schwarzenegger — and I thought, ‘that could be me,’ ” Johnson says. “So I started working out... I didn’t realize back then that I was having ϐ Ǥdz rooms (between football, wrestling and running track), Johnson ϐ Ǥ

He quickly discovered that in wrestling, the relationship with the audience was far more visceral than when he was simply one of four rushing the quarterback. In the ring, he was the center of attention — he commanded it — and the sport allowed him to tap into an entire reservoir of latent talent. Eighteen years and 17 world championships later, Johnson is beloved by wrestling enthusiasts (and even those who detest the sport) for his magnetic charisma. He’s an actorǤ ϐ to the ring, so in the late nineties, Johnson began to pursue acting.

If you "Google" names from the late 1800s in the era of powerful trusts controlled by men like Andrew Carnegie, John D. Rockefeller Ǥ Ǥ ǡ ϐ a monopoly. So it's no surprise that the game Monopoly was founded on what was happening at that time. The board game has some amazing similarities to the game of business titans have played over the years. According to Phil Orbanes, former Vice President of Parker Brothers, the original owner of Monopoly, Rich Uncle Pennybags of the American version of the game is modeled after J. P. Morgan. This is hard to dispute when you compare his picture to the actual character. His namesake company he helped form, J.P. Morgan, reportedly bailed out the U.S. Treasury in 1895 and again in 1907, before helping to create the Federal Reserve System in 1914. 70

In rule number11 of the game of Monopoly, the "banker" can never go bankrupt and can "issue" new money on ordinary slips of paper. It's clear that rule number 11 was based on the banking practices of the early 1900s and these same practices continue today. The monetary policy of the Federal Reserve System is based partially on the theory that it is best overall to expand or contract the money supply as economic conditions change. If you understand this point, you can then be on the right side of the expansion or contraction. I never paid much attention to the utility and railroad companies between the properties in the game Monopoly; they always seemed like an annoyance if I landed on them. What's interesting is that J.P. Morgan also bailed out and combined bankrupt railroads and utility companies, stacked their boards and “stabilized” rates before these ϐ Dz dz Ǧ Ǥ In 1885, J.P. Morgan brokered a trust between two rival ϐ ǡ ǡ ǡ ϐ ϐ competitors, including two you’ll recognize from Monopoly: the Baltimore & Ohio and the Reading Railroad. With Morgan's control of the boards of these companies, competition was very friendly ϐ Ǥ For years, Morgan was the primary investor in Thomas Edison's projects. In 1892, Morgan arranged the merger of Edison General Electric Company with the Thompson-Houston Company to become General Electric, which, with competition again eliminated, became ϐ Ǥ

Additionally, Morgan had begun talks with Charles M. Schwab, president of Carnegie Co., and businessman Andrew Carnegie in 1900. The goal was to buy out Carnegie's steel business and merge ǡ ǡ ϐ Ǥ ͳͻͲͳǡ Ǥ Ǥ ϐ billion-dollar company in the world. What a fabulous time to be alive. There really is so much more to the story, and the History channel did a great job producing a series about it called “The Men Who Built America.” Be sure to catch it. In looking at a list of potential monopolies that exist today, people may be surprised to learn that all of the companies on the list are technology based. Industries which are large but only recently established are often controlled by just one company. That was true when the PC was introduced widely in 1980. Microsoft offered the only PC operating system that had enough market share to make it viable. That dominance fed on itself as the number of PC manufacturers and users rose. In our lifetimes, the Internet has created another "land grab" of opportunity, just like in the Industrial Age. We are living in a time of huge opportunity and potential abundance, just like in the History channel’s documentary. The best is yet to come. The world will always be full of those that Ǥ ϐ about Mr. Charles H. Duell, the Commissioner of the U.S. Patent ϐ ͳͺͻͻǡ ̶ invented has been invented." workers. Most people are rewarded for subordination, unlike their superiors, who, of course, have their own rules. Andrew Carnegie said it best: "The greatest astonishment of my life was the discovery that the man who does the work is not the man who gets rich." I continue to tell my kids: respect your teachers, but understand that there is no single clear path to success, including college, and that the people in charge do not necessarily have all the answers. HOW TO MAKE YOUR BRAINSTORMING SESSIONS FUN AND PRODUCTIVE

T

here’s a lot of idea generation going on in the world today. Some ideas end up changing life as we know it. Others never make it off the ground. The process for coming up with those ideas is widely varied. There’s no one right way to brainstorm ideas. In fact, sometimes applying several different techniques to a particular challenge can yield the greatest results. 74

Alex Osborn popularized the term brainstorming in his 1953 book Applied Imagination. Designated the “Father of Brainstorming,” he established four rules to follow in any brainstorming session to reduce inhibitions and encourage the greatest number of ideas. The ϐ ǯ ϐ Ǥ ǡ his second rule, seeks to encourage any and all ideas. Osborn said, “It is easier to tone down a wild idea than to think up a new one.” So no matter how crazy an idea might be, it should never be discounted at the beginning of a brainstorming session. Osborn’s last two rules of brainstorming revolve around using ideas that have been presented in the session. Freewheeling, the third rule, refers to using one idea as a jumping off point for the next. Brainstorming works when people use each other’s ideas to trigger their own thinking. Our minds are highly associative, so one thought

easily triggers another. If we use the ideas of others, it will stop us from getting trapped by our own thinking structures. Osborn’s last rule is to mutate and combine. By mutating, we deliberately distort and modify existing ideas. Then we can combine existing ideas to deliberately try to build new ones. One thing that Osborn didn’t suggest is having participants prepare for brainstorming sessions by telling them the purpose beforehand. There have been multiple studies since 1958 that show if you try to brainstorm with a group without individual ϐ ǡ Ǧ Ǥ Many believe that by communicating the topic and the intended outcome to the group prior to the session, participants come better prepared and generate better ideas. ǡ you can use. According to Creativity Techniques, 2011, there are ʹͲͲ creativity. So which one is right for your situation? It depends on the topic or challenge and the participants. Taking into consideration the difference in a brainstorming session. Ǧ Ǧ ǡ like the “worst idea” method. Instead of asking for the best of the best ideas, you ask for the worst of the worst. Whatever stupid, terrible idea the group can think of is fair game. This always ignites some laughter and engagement from the group. Once you have your list of bad ideas, try turning them around into good ones. It’s ǡ Ǥ 76

Ǥ ǡ or as a way to reignite a session that’s losing steam. In rolestorming, the group picks someone famous or someone they all know, or they can invent an identity. Then they brainstorm ideas using this identity, thinking of the challenge from that person’s perspective. What kinds of ideas would this person suggest? This can really generate some creative ideas, especially if you pick a really interesting character and look at the challenge through his or her eyes. Beyond holding a traditional brainstorming session, another Ǧ ϐ Ǥ board throughout the week. At the end of the week, bring everyone together, review the ideas, mutate and combine them where it makes sense, and then decide which ones are the best. ǯ ϐ Ǧ ǡ ǯ ϐ Ǥ The next great idea may not come from the marketing or engineering team, it may be someone in the accounting or administrative departǦ Ǥ Ǥ points of view you have, the broader the ideas and more likely you’ll ϐ Ǥ One of the most important elements of a successful brainstorming Ǥ ǯ Ǧ brainstorming session where you could hear a pin drop and the energy Ǥ use one that already exists, but by all means, have fun when you’re doing it. LESSONS WE CAN LEARN FROM THE TERMINALLY ILL BY TENZIN KIYOSAKI WITH AN INTRODUCTION BY ROBERT KIYOSAKI

I

n the Kiyosaki family there are four children. I am the eldest. Tenzin, born Barbara, is second, followed by Jon and Beth. Our parents had four children within four years, and although we share the same parents and are close in age, all four of us are very, very different people.

Ǥ ϐ Ǥ Ǥ ǡ ǡ the artistically gifted. I was always interested in guns and money. I went to a Marine recruiter at age 14 and was told to come back later. Eight years later, I took my oath as ǡ ϐ ǡ ǡ ǡ ǡ ϐ Vietnam. Returning home, I immediately went into business. Tenzin’s life took a completely opposite path. She was always a gentle, peaceful person, which means we didn’t see eye to eye as kids. After high school, I went my way and she went hers. We both found success in life, but in very different ways. Her life’s lessons have enriched my life in ways that money and success alone do not enrich a life. Tenzin found her calling — and her new name: Tenzin Kacho — in 1985, as a Tibetan nun ordained by the Dalai Lama and working in Los Angeles. For years, Tenzin would send the family photos of the Dalai Lama with her by his side, greeting dignitaries, political leaders and movie stars. In 2002, she invited my wife Kim and me to L.A. to see the Dalai Lama. ϐ Ǥ ǡ ϐ Ǥ greeted the crowd and introduced His Holiness, the Dalai Lama. When the event ended, Tenzin came to get us and took us backstage for a personal audience with His Holiness. Many of the celebrities wanted time with His ǡ Ǥ ǡ ǡ ϐ time, I had a glimpse of who my younger sister really was. In 2012, after decades as a Buddhist nun, my sister returned her monastic vows for personal reasons and went on to become a hospice chaplain in Los Angeles. I believe we all have a calling in life, and working with the dying seems to be hers.

eath, in many ways, is a great equalizer. Regardless of how our lives unfold, we leave this earth, as we arrived here, with little but our spirit.

Over the past six years, my work in hospice care has given me insights into the way terminally ill men and women look at death . . . and how they prepare for it. I have found that there are three regrets that people struggle with as they prepare to die and they involve forgiveness, love and leaps of faith. As a home health hospice chaplain for a hospital in Los Angeles, California, I meet many people who have chosen to spend their last days at home. I meet patients and their families who are coping with every possible emotional, physical, relational and spiritual situation. End of life comes whether we are ready for it or not, and generally, it is not convenient. While death is inevitable for everyone, many people Ǥ ϐ ǡ preparedness is often lacking.

A huge factor is denial. I see many people who are convinced that it’s just not going to happen — or that it will happen, but not until they are really old. They see death as an event in the distant future, certainly not now. Or, as something that happens to others, not them. I remind myself, as I drive through the busy streets of Southern California, that it’s possible that I could die before the ailing patients I’m driving to see. And while my current odds are probably better than theirs, there’s no telling when my time will come. In fact, I have witnessed cases in which a loving, care-giving spouse or daughter passes away before the patient. Whether we are well or frail, have many resources or none, are young or old, there is no certainty that we will live beyond this day, this month. And when it is our time, we can take nothing with us. We leave behind our name, our reputation, family and friends and all our possessions; we cannot, in the end, even take our body. We traverse

something we all face. This is a normal part of our life. Rejoice in your life, don’t worry.” The woman barely stirred, and then hissed angrily between her dry lips, “It’s all mine, it’s all mine.” These were her only words and she died a few days later. I asked myself: What did she think she could take with her? In sharp contrast was a visit I made to another woman whose home was near the ocean. I pulled into their sweeping circular driveway and parked. Knocking on the grand entry doors, I was greeted by beautiful teenage grandchildren who ushered me in. The patient’s husband met me and as we walked toward her bedroom, he showed me her beautiful works of art and said she had a studio at the back of the home and had presented at galleries. In the patient’s ϐ gather and ocean waves could be seen rolling in to shore from the large, low windows. The patient was lying in bed, awake and alert,

from the physical realm to the spiritual — and even that is questioned by radical materialists. “We just become dirt,” one patient said to me. What we believe of the afterlife (or lack thereof) affects our state of mind and how we treat others. I recall a nurse who asked me to visit a patient who was lingering, her vital signs hovering barely this side of death. She hadn’t eaten for days, yet she would not pass on. I visited her at her 1950s-style tract home, a home she never remodeled. Years earlier, she had demanded that her only son move to the garage, and then, years later, that he leave the home completely. When we tried to inform him of his mother’s failing condition, we couldn’t locate him. I sat with her and quietly whispered to her to help her relax and understand what was happening, saying to her, “Do not be afraid; just relax as best you can. Your vital signs are showing that you are coming close to death.” I looked for other soothing words: “End of life is

ready for my visit. She and the family knew she had little time left and I asked her, “How are you facing this?” She shrugged her shoulders and replied: “I’m on to my next adventure.” I thought to myself, I hope to always remember this moment. Here was a woman with a loving family, everything anyone could want, a successful career as an artist, and she was facing end of life with acceptance and tenacity. I sense that when we have lived our lives fully — accomplished and lived our aspirations and dreams — and our time comes, we are perhaps more ready than someone who never ventured forth. If we allow ourselves to regularly consider that we don’t know when death will come, but that it will most certainly come, that thought can help us keep our priorities in order and to act on them. Over the years, three regrets have consistently surfaced as I’ve worked with patients and families. ISSUE 1 . 2015

Or have they possibly begun to partly concentrate more on academic meritocracy or potentially lucrative ϐ schools for the wealthy and privileged plutocracy? Have their credentials become a brand that a trickling few ϐ own co-branding?

Are their results generating powerful leaders and captains of industries, or are they, like other, less prestigious universities, mass-producing lost pawns and sheep with over-exaggerated credentials and small-percentage advantages? Are ϐ ϐ ǡ or contributions and prestigious careers, or simply with many who smoke weed and play video games on their parents’ fraternity or dormitory couches? Are there graduates today living with anxiety, depression, aimlessness and isolation, or are they clearer, brighter and more determined than their counterparts of yesteryear? These may just be questions worth pondering and answering. Do our elite educational institutions offer exceptional opportunities to their students and alumni, or are the many off-brand universities potentially offering similar or possibly greater bargains with fewer entitlements, hassles and costs? Does the handful of super-elite students truly outperform the honor students of their ǫ ϐ by stagnant traditions and cushioned by reputation, or are they truly encouraging innovative and creative contributions? Can the more obscure institutions compete with and outshine those better known? Is it time for Richard Branson or the like to do what he

once did with Virgin Airlines to awaken British Airways to its oncestagnant conventions? Some have claimed that these more selective universities spend more time on student instruction and support, and have more technologically-current facilities than less selective ones, and that they are ultimately greater long-term bargains. Others have claimed that graduates of the more selective universities are more ǡ ϐ and spouses, and will earn 20 percent more each year throughout their working lives than those who attend less selective universities. They claim that these advantages swamp any differences in cost. But are these claims still valid? Probably so, but it is wise to ponder. Of course, if students don’t know where they are going, any road or university will take them there. Ultimately, the university is there for the purpose of teaching ǣ Ǧ ϐ Ǣ Ǣ ϐ Ǣ Ǣ negotiate tradeoffs and equity between competing or cooperating values. The university is there to help students build their “true selves,” so they can become authentic individuals, unique beings or inspired souls. A university is there to educate its students about the prehistory of the human species and the basic laws governing Ǣ 86

Garland’s Oak Creek Lodge Proves to be the Perfect Place to Rediscover What Really Matters By Tami Austin

s publishers of Jetset Magazine, my husband Darrin and I have been privileged to travel to many luxurious destinations, and we have thoroughly enjoyed every one of them. But it was when we planned a family staycation to Sedona, Arizona, right in our own “backyard,” that we were surprised to discover a magical place unlike any we had ever visited.

Our destination was Garland’s Oak Creek Lodge, a collection of 16 rustic cabins set in beautiful Oak Creek Canyon on land that was homesteaded in the early 1900s. Our friends and Jetset contributors, Ken McElroy and Robert Kiyosaki, had just purchased the property along with their business partner Alex Brigham, and we were invited to check it out. I’ll admit we were a bit surprised to learn that there is no cell phone service, no Internet access and not even a TV at Garland’s Lodge (and so were our kids). What we soon discovered, however, is what a huge advantage that is for a family vacation. We all learned just how important it is to take a break from the electronics for a while and just enjoy being together, doing fun family activities and exploring the gorgeous property. Darrin and I even took a relaxing yoga class by the creek. We also enjoyed our charming cabin with its ϐ Ǥ Breakfast and lunch are included at Garland’s Lodge, and dining there is an experience in itself. They ring a bell at mealtime and ϐ ǡ they’re healthy and organic. Many of the ingredients are grown right there on the property. Garland’s Lodge started doing “farm to table” long before it was the fashionable thing to do. In fact, they’ve received so many requests for their recipes that they’ve even produced their

own cookbook. And the homemade apple cider pressed from apples grown in the property’s orchards is absolutely fantastic. Many families have been booking the same weeks at Garland’s Lodge for as many as 20 and 30 years, so when they learned that the property had been sold, they were concerned that things might change. They have no reason to worry. In the past, the lodge has only been open from April 1 through November 15, so to enable more guests to experience the lodge’s simple pleasures, the new owners are planning to open the lodge earlier in the season in 2015. erfectly scaled yet dramatic, stately and grand but unostentatious, and landscaped and detailed to the highest standards of care and craftsmanship, this 11,603-square-foot gated estate rests high on a 1.6-acre site on the east side of landmark Camelback Mountain in Paradise Valley. WAYNE WEBERBAUER American artist Wayne Weberbauer has had a creative spark in his blood since the earliest beginnings of his life. Wayne was considered special by all of his art teachers, giving him a chance to expand his creative talents. Upon graduating from art school, Wayne settled in Carmel, California, where he concentrated on landscape and wildlife painting. ALEXANDER BOSTIC Alex Bostic is a nationally award-winning realist painter. Since he was a little boy growing up in Brooklyn, New York, art was his passion. He attended Saturday art school at Pratt Institute and then he would go to the house of his seventh grade art teacher, Ms. Ellen Kuenzel, in Brooklyn Heights for more lessons. They would draw and paint and talk about art as well as visit the museums of New York City. This is when he really understood what it means to have a career as an artist. He would use his imagination to create art of all kinds, from 2D to 3D. At the time, he was copying mostly comics, but soon he was creating his own super heroes and characters. Alex graduated from Pratt Institute and received his master’s degree from Syracuse University. After more than twenty years of being an illustrator, Alex decided to further ϐ Ǥ Alex takes a romanticism approach to his art. He likes to create paintings that are romantic and tell a story. He uses color and light in his compositions and he paints ϐ Ǥ ϐ ǡ style, using oil as his main medium, but he also uses a variety of techniques such as acrylic, colored pencils and watercolors.
