Why it’s important to

Get Your Flu Shot The flu is a serious illness that can cause hospitalization, and even death. Early indicators from around the world suggest this year’s flu season may be really dangerous. Getting vaccinated is the best way to protect yourself. It is not true that getting a flu shot will cause the flu! The flu shot may be covered at little to no cost to you and offered in many locations, including doctors’ offices, clinics, health departments, and pharmacies. Speak with your doctor or Care Manager today if you have questions, or need help finding a place to get your shot. “WHACK” the flu before it affects you! W: Wash your hands often H: Home is where you stay when you are sick A: Avoid touching your eyes, nose and mouth C: Cover your coughs and sneezes K: Keep your distance from people who are coughing or sneezing Take care of yourself and loved ones by getting your flu shot. One Brooklyn Health Fair Keeping Seniors Informed To Save Lives

by Simone LeConte-Parker T

This past July, The Office of the Brooklyn Borough President Eric L. Adams sponsored the One Brooklyn Health Fair featuring the “Cut the Salt/Curb the Sugar” program. Useful information was provided by health vendors, including AlphaCare, The Rogosin Institute, and NYC Department of Health and Mental Hygiene. Attendees also enjoyed fitness activities, music, singing, and inspiring testimonials. One inspiring individual was Ms. Agnes Cappabianca, the Stroke Coordinator for New York University Brooklyn Campus, which was formerly Lutheran Medical Center. She has worked there for 42 years. Her job is to make sure all patients receive the highest standard of care, based on the protocols that must be followed for the best delivery of stroke care. Six years ago, while Ms. Cappabianca was taking care of stroke patients, she had a stroke. After quickly being escorted to the emergency room, she received the tPA drug for stroke care.

8 | nyforseniors.com

“I was paralyzed on the left side and had difficulty speaking and swallowing. I went to rehabilitation after the stroke for nine months, and I am happy to say that 99% of my deficit is gone,” Ms. Cappabianca stated. The lesson that she wants people to learn is that getting stroke care quickly by calling 911 ASAP can save lives. Ms. Cappabianca is a stroke nurse who also learned what it is like from the other side of the bed, as a stroke patient. Her goal is to to spread her story far and wide by engaging in public speaking at churches, community centers, and in everyday conversation. Her advice for readers is to identify the signs and symptoms of a stroke FAST which is an acronym for:

Facial drooping Arm numbness or weakness Speech difficulty Time to call 911

E . s e r P h g u o r o B n y Brookl by Angella Brown As usual, The Office of Brooklyn Borough President Eric L. Adams hosted one heck of a party; the 4th annual Seniors by the Sea event. A few hundred guests from nearby senior centers and programs packed the rotunda at the Marine Auditorium Center of Kingsborough Community College for a celebratory luncheon. Crowds of smiling seniors dined and danced the afternoon away, first enjoying a delicious

At the height of the luncheon, a bubbly toast was offered up to the many “Golden” Couples in attendance, who’ve been married for 50 years or more; a true testament to commitment, love, and mutual respect. In another area of the dining room, the TapSnap Phototainment station beckoned guests to pose for pics that were instantly transformed into souvenir photos. The Savvy Soul Line Dancers also kicked off a block of grooves that got attendees up and on their feet, doing the Electric Slide, the Wobble, the Cupid Shuffle, and more!

Advance Directive Did you know that if you are seriously ill and unable to make decisions for yourself during a medical emergency, you can designate someone to make those decisions on your behalf? These decisions protect your right to refuse medical treatment you do not want, or request the treatment that you do want, in the event you lose the ability to make medical decisions yourself. It’s called an Advance Directive or Living Will. An Advance Directive is a legal document that spells out your medical preferences to your family, friends and healthcare team, about healthcare decisions in the event that you are unable to make them such as during a surgical procedure or coma. There are different types of advance directives in New York State which include:

* Health Care Proxy which allows someone you choose as an agent to act on your behalf, if you can no longer speak for yourself. This health care proxy allows someone to speak for you, because you have made them aware of your choices for treatment in the event that you are unable to make them yourself.

* A Power of Attorney is a form of directive that gives someone that you choose, the power to act on your behalf for either medical care or finances. A “durable” power of attorney is someone you choose to make decisions being made on your behalf for both medical care and finances.

* A Living Will is a type of advance directive that allows you to determine your choices regarding your health care in the event you are incapacitated and cannot make medical decisions. In this case, your wishes will be known.

Important Considerations When A Spouse Needs Nursing Home Care Another major consideration is protection of the family home. If the couple has a disabled child, the client should also consider creating a special needs trust as part of this plan. Finally, there are situations in which a couple is estranged and has long been contemplating divorce. It is important to discuss with an attorney any family law issues and how any decisions will affect the Medicaid agency’s review of a Medicaid application. By Ronald A. Fatoullah, Esq. and Stacey Meshnick, Esq. Nursing home care in the New York Metropolitan area can cost up to $18,000 per month. When one spouse becomes ill and requires nursing home care, the well spouse should seek the proper advice regarding the resulting issues and possible solutions. When contemplating nursing home admission, a couple should execute advance directives, namely a Power of Attorney, Health Care Proxy and Living Will. These documents will allow the well spouse and/or the children, if any, to act on the sick spouse’s behalf. If payment options such as long-term care insurance are not available, Medicaid planning may be necessary. If the couple is engaging in Medicaid planning, the well spouse should execute a new will leaving out the ill spouse so he/she does not inherit assets if the well spouse passes away first. If the well spouse does not want to disinherit the ill spouse, he/she can execute a will that includes a special needs trust for the benefit of ill spouse that terminates upon his/her death.

In addition to these topics, there are many other issues to explore when a spouse is institutionalized and Medicaid is being considered. It is important to meet with an elder law professional who can provide appropriate advice.

Ronald A. Fatoullah, Esq. is the principal of Ronald Fatoullah & Associates, a law firm that concentrates in elder law, estate planning, Medicaid planning, guardianships, estate administration, trusts, wills, and real estate. Stacey Meshnick, Esq. is a senior staff attorney at the firm who has chaired the firm’s Medicaid department for over 15 years. The law firm can be reached at 718-261- 1700, 516466- 4422, or toll free at 1-877- ELDER-LAW or 1-877- ESTATES.
