All guarantees are between buyer & seller and in no event shall Mohawk Valley Auction be responsible for correctness or warranties or genuineness of description of property the purchaser must understand he is buying property entirely upon his own, or his agents examination and/or opinion. At the fall of the auctioneer’s hammer ownership of the lot passes to the highest bidder acknowledged by the auctioneer saying sold or otherwise declaring completion of sale. Any dispute arising as to any bidding shall be determined by the auctioneers at their sole discretion and the auctioneers’ discretion the auctioneers may immediately put the lot in dispute back up for sale. If any dispute arises after the sale Mohawk Valley Auction sale record shall be conclusive in all respects. All Payments must be made by cash, travelers check, certified check or money order. We encourage all broke horses to be hitched.
Guarantee:
Each consignor to this sale will make the guarantee he desires to give his animal or animals, and will be totally responsible for that guarantee. This guarantee will be announced at the time this animal is offered for sale. The committee will announce any unsoundness that they observe & the hitch results.
Warranties:
Every animal must be sold & purchaser assumes all risk and expense on animals incurred after the fall of the auctioneer’s hammer.
Liability:
Everyone is cautioned to exercise care while attending the sale. All persons entering on the premises at the time of the sale due so at their own risk. All parties entering onto the grounds upon which the sale is held here by expressly release the Mohawk Valley Auction and all members of the sale committee from any liability or responsibility for injuries sustained by them during the attendance of said sale from any cause or source whatsoever.
Expenses:
Cost of Selling horses, 6% Commission, $50 min., $200 maximum, $50 no sale fee. Seller will pay the transfer fee on registered horses unless papers are not handled by the sale committee. Ponies min. $35 commission. This sale is on the Percheron Horse Association of America list of authorized sales.

If an item is consigned and does not fetch a bid it is considered no value. Sale committee is no longer responsible for said item. If consignor wants said item back, he or she must be there to receive them.
IMPORTANT:
All horses must have current coggins test dated after April 6th, 2017. Every horse must have a good halter and lead on it before the sale, it goes with the horse. If consignor fails to provide a halter and lead the cost will be deducted from the sale price.
