National Commander’s Welcome
F
or more than 60 years, we in AMVETS have taken to heart the credo of service set forth by our organization’s founding fathers. In so doing, we endeavor to provide our fellow veterans with the type of support they truly deserve. This outreach effort takes many forms, from the professional advice our service officers offer on earned veterans benefits to our legislative efforts on Capitol Hill to the work done by our hospital volunteers. Other AMVETS members involve themselves in a range of initiatives aimed at contributing to the quality of life in their local communities. These two areas—veterans service and community service—drive the commitment we have to make a difference in the lives of others. The pages of this website provide more detailed information on each area, as well as a wealth of information for veterans, their families and other interested citizens. Please take a few minutes to review what makes AMVETS the distinctive organization it is. Our aim of building for a better America is an undertaking to which all can contribute. About your National Commander - Duane Miskulin Commander Miskulin, a native of Stevens Point, Wisc., has completed his ascent to the post of National Commander, a journey that began with AMVETS nearly two decades ago. Miskulin has held numerous positions at all levels of the organization, starting at his post. Last year, Miskulin served as AMVETS National First Vice-Commander. In a recent interview, Miskulin said his top priority for his term as National Commander will be addressed the mental health needs of veterans, past and present--particularly incidents of traumatic brain injury, which are becoming more and more prevalent on today’s battlefield. 2
State Commander’s Greeting
F
irst and foremost I want to thank you all for the support thru some tough times and the good times. You need to know that New Orleans made us a strong voice at the National level. I have been to several events with National staff involved and can state first hand they are interested in California’s views and support for elections and on the floor. Thank you for the strong showing. I ask that you give the same support to the next commander.
I can’t deny that we have had, and at the present still have, some tough issues to deal with due to some past problems that should have never happened. However, your JA and others are on the job and working day and night to protect your rights as members to keep the votes and to build a bigger and stronger Department that will operate as a unit law. Nobody said it would be easy but you have a group that have stayed the course and will continue to do so. I feel we have made a lot of progress in the past nine months and will Commander continue to do so if you all stick together for the big three – serving “The Past – Byrum The Present – The Future”. I know at times we don’t all agree on certain issues, but do believe we can come to agreements to better the Department if we work at it. Come on, I know several of you were not happy with grants; hell, neither was I on some things. Economy not easy on the Foundation either. Keep in mind that the Department and Foundation looked at over 175 grant request (with some not explaining request very well) and had to make tough decisions to help all as much as they could. Hopefully, income next year will be better and more can be granted. Don’t give up the battle just because we don’t always have it our way. Keep the big picture in mind thru thick and thin. I am confident that you can get the task at hand accomplished one way or the other. One big grant that was long overdue was the grant for our wonderful Ladies with the Auxiliary so they could finally have some money to operate full bore. Well deserved ladies! I have to say it sure makes me proud when National talks about California and the super job on reporting in the past nine months (keep it up). You are out and about doing some darn good service for so many and I am proud to brag on California AMVETS when I get the chance. I have no problem telling others that we are moving forward with more involvement and projects. I sure as heck want to brag on our Service Officers and the fine job they have been doing and will continue to do I’m sure. I mean, WOW - $96,000,000 in claims – outstanding! Chapman University Legal Clinic – over $2,000,000 in cases handled for service members and vets, Honor Flight, Valley Forge, Spirit of 45. We have posts going above and beyond to serve the big three – Past – Present – Future. We are funding our Department and Auxiliary, we are having training sessions for Staff and Post officers, we’re working together with National, have better communication at meetings, members are working together and listening to each other, working out our differences when we have to. One of our members, Post 99 Commander Pete Molina was appointed to be the First American Indian Veteran to be Assistant Deputy for American Indian Veterans Outreach for the State of California, April 20th was the first AMVETS Legislative Day in our Capitol and much more has and is happening because of you our members who are willing to put your best efforts into helping our veterans. I want to thank the E-board and the committees for all the hard work and, doing the right things when called to duty. Thank you, Rose, for keeping me on the right track when I needed your help and always getting things I ask taken care of for me. Guess what it comes down to is the fact that even though it has been some tough calls at times for me on certain issues, I am damn proud to say I have had the honor of being your Commander and I ask that you continue your support for the next Commander. Wishing all a very successful upcoming year – May God bless you and your families. 3

want to take this opportunity to welcome all of you to our 65th Department Convention; especially those who are attending an AMVETS convention for the first time or who are here as a guest.
Thank you to our host Posts 98 and 2009 and those who helped them to put together our banquet entertainment. Thanks to the Doubletree Modesto staff who have worked hard to help make this convention so successful and enjoyable for all of us. May you all have an enjoyable time making new acquaintances, connecting with old friends, sightseeing in downtown Modesto and learning more about California AMVETS and how things operate for all of us to help veterans. ur country owes a debt to our veterans that can never be repaid. Since the founding of our Republic, brave men and women have answered the call to defend their country. We enjoy our freedoms today because of the heroism of veterans. Sadly, too many paid the ultimate price to secure our liberty. While anchored here in Modesto, in the presence of our Flag, let us pledge to defend our Constitutional rights, promote the American way and pursue the AMVETS goals. Legislative Rules For Convention And De The following rules have been adopted to govern Conventions and Executive Meetings unless amended or deleted by a two-thirds majority vote at such a meeting.
form. If submitted by a Post the resolution must be signed by the Post Commander or the Post Adjutant. A resolution may be submitted when sponsored by five AMVETS in good standing from five different Posts.
Robert’s Rules of Order - In any matter not covered by the AMVETS National Constitution and By-Laws, Department of California Constitution and By-Laws or these Convention and DEC rules, Robert’s Rules of Order shall prevail.
No Resolutions - shall be discussed on the floor until it has been reported out by an appropriate Committee after referral by the Resolutions Committee. All resolutions properly submitted must be reported to the floor of the meeting. No Committee shall give consideration to any resolution, the subject matter of which does not pertain to the duties or functions of that particular Committee. Under these rules, a Committee may originate such resolutions as pertain to the subject with which the Committee is charge. A two thirds vote of the delegates may accept a resolution which does not meet the above requirements. Video & Recording Devices - in the audience are absolutely prohibited. Official minutes of this convention are property of AMVETS Department of California.
Privilege of the Floor - All AMVETS shall have the privilege of the floor when properly recognized by the chair. When recognized, they will declare their NAME and POST NUMBER, also when making a motion or a second. Time Limit on Debate - Debate shall be limited to three minutes for each speaker, except for the proponent of a resolution or motion who shall have two minutes for rebuttal. Debate on any one subject shall be limited to fifteen minutes unless extended by a two thirds vote of the members present. Post Delegate Chairman - shall control his delegation with regard to monopolizing argument on the floor, pro and con on a question. On Any Question - the Chair shall recognize proponents and opponents alternately. The Floor - shall be permitted but once to any one individual on any one subject except the proponent of a resolution or motion, except by majority consent of the members present. However, Committee Chairman may speak as frequently as necessary in connection with their committee reports. In the event of controversy, the Chair shall not entertain any motion which will curtail further debate without affording the Committee Chairman, or the proponent, an opportunity for a two minute rebuttal. Resolutions, Requirements for Presentation All resolutions to come before the meeting must be presented to the Resolutions Committee, or the Department Executive Director, for referral to the proper committee, before close of business on the first day of the meeting. They must be presented in three copies, typed or printed in proper resolution

epartment Executive Committee Meetings Voting - Only duly accredited delegates or, in their absence, the accredited alternates, shall vote on any question before the meeting. Any vote is subject to challenge by another delegate. Voting shall be by voice or hand vote, except that the Chair, or the delegates of at least three Posts, may demand a roll call vote. Election of Department Officers shall be by VOICE VOTE. (a) Final nominations for Officers shall be held at 9:30 AM sharp on Sunday morning and the election shall immediately follow the close of nominations. Nominations, Invitations for Meetings - Nomination speeches for Department Officers, invitations for meetings and acceptance speeches shall not exceed three (3) minutes. Not more than two seconding speeches for any candidate or place shall be permitted. Such speeches shall not be more than one (1) minute.

Discussions, Personal and Local Grievances - Discussion of PERSONAL GRIEVANCES, LOCAL CONDITIONS OR CLAIMS CONCERNING AN INDIVIDUAL with respect to his personal interest shall not be permitted on the floor; however, such matters may be discussed before Committees with a majority approval of the members of such committee. Time Keeper and Rules Administrator - The Provost Marshall shall be the Sergeant-at-Arms. The Judge Advocate shall be the administrator of the Rules of the meeting. A Time Keeper shall be appointed by the Department Commander. Each may appoint assistants with the approval of the Department Commander.
Each Office - shall be voted on separately in the order outlined in Article VI of the Department Constitution. As each Department Officer is elected, nominations will be in order for the next office indicated. Voting Delegates - shall be furnished with some visible means of identification to facilitate vote counting. Offices would then be voted upon and filled in the order listed in Article 7. The election shall proceed under the supervision of three AMVETS appointed by the Department Commander. The candidates for office may have one personal representative to witness the counting of the ballots for the office he or she seeks. The election shall proceed for one office at a time.
Election Rules - Delegates and Alternates who have paid their registration fees will be qualified to represent Posts in good standing.
During the Elections of Officers - the doors will be closed and no one will be allowed to come in; however, delegates may go out.
Election of all Officers - shall be by a majority of the votes cast. After any ballot for any office, if no candidate receives a majority of the votes cast, the candidate receiving the lowest number of votes shall be eliminated. A candidate for any office receiving less than ten percent (10%) of the votes on any ballot shall likewise be eliminated when there are more than three 11
