NJNEOA Fundraising Since 2005, the New Jersey Narcotic Enforcement Officer’s Association has contracted with MIDWEST PUBLISHING, INC. for the purposes of fund raising. MIDWEST PUBLISHING, INC. has been serving the political, non-profit and charitable sectors since 1978. They are a corporation that utilizes the telephone as a means of soliciting monies for associations such as the NJNEOA. Currently they are used by the NNOAC as well as several other state narcotic associations. s my presidency matures I’d like to outline what my committees have done so far. The Membership Committee has been taking applications for membership and is reading the names as quickly as possible to expedite the process. Our Law & Legislation Committee has kept us up to date with any changes in the Laws and Legislature through our newsletter or at our seminars. Our Seminar Committee put together seminars that are both informative and taught by the most knowledgeable instructors in the state. he NJNEOA April Training Seminar is being held on April 17, 2012 at the Middlesex County Fire Academy. There will be two topics covered during the April seminar. The first topic is “Homemade Explosive Threats & Clandestine Manufacturing Processes” and “Drugs & Thugs.” It will be presented by Captain Robert Mazur of the New Jersey State Police (retired). The second topic is “Drugs & Thugs” which will be presented by Detective Sonji Powell and Detective Stephanie Treadwell, both of the Newark Police Department. The seminar is free for both NJNEOA members and non-members. Registration must be made prior to the conference. The NJNEOA was organized to encourage mutual cooperation, discussion and interest in the problems of enforcement concerning drug abuse; to exchange ideas and conduct seminars and conferences to educate those involved in the abatement of the illegal narcotic trade. The NJNEOA is a member of the National Narcotic Officers Association Coalition. The NNOAC represents 35 member states at the national level meeting with legislators, members of the Office of National Drug Control Policy and several legislative committees. This enables state and local law enforcement issues to be heard by our elected representatives in Washington, D.C.

he New Jersey Narcotic Enforcement Officer’s Association recognizes several police officers and their departments during the year by acknowledging the outstanding investigations they have conducted in the area of narcotic enforcement. The NJNEOA will present these officers and their departments with an NJNEOA Achievement Award at either one of the seminars the NJNEOA sponsors or at the Annual Conference. No longer will all of the awards be presented at the conference. In order to be considered for an award it is mandatory a detailed account of the specific investigation is submitted by a member of the NJNEOA for placement in the quarterly newspaper and on the Association’s website. It isn’t necessary the officers receiving awards be NJNEOA members. If need be, a generalized

The NJNEOA provides education and training to law enforcement officers tasked with investigating those involved in the illegal drug trade. 43rd Annual Conference Update
T
he 43rd Annual Conference dates, theme and agenda have been finalized and this year’s conference committee is working feverishly to make available the most pertinent training for law enforcement officers during these times. The dates for the conference are June 5-8, 2012 and the theme is “Education and Enforcement: a Necessary Partnership Needed to Eradicate Illegal Drugs.” It is once again being held at the Atlantic City Hilton and, just as last year, all members of the NJNEOA who are current in their dues prior to registering, are eligible to receive a $45 discount on their registration. I
The Appellate division Supresses Evidence Based Upon Police Use of Flash-Bang in Execution of Search Warrant
n August 2011, the Appellate Division reversed the judgment of a Monmouth County trial judge who had denied Defendant John Rockford’s motion to suppress evidence. The case involved the execution of a search warrant at the residence of the Defendant in Manalapan. The police had informant information that Rockford was selling marijuana and pills in the garage of the home he shared with his elderly parents. Rockford had previously been arrested for possession of small quantities of marijuana and hashish. His elderly father had three handguns and a BB gun registered to him, and the police had reason to believe that these firearms might be accessible to the Defendant. Based upon the foregoing information, the police applied for a no-knock search warrant for the home, a shed and a vehicle. The judge approved a search warrant for the home and shed, but rejected the no-knock provision, thus requiring the police to knock and announce before entering the premises. The police decided to execute the search warrant with the use of a flash-bang as a distraction device. Although the warrant could have been executed when Defendant was not at home, the police wanted to do the searches while Defendant was engaged in a drug sale. A team of 12 police officers waited for the garage door to open and a flash-bang was tossed into Defendant’s driveway. After the explosion of the device, police officers entered the garage, where Defendant and another man were located,
while yelling, “Police, we have a search warrant.” After securing the two occupants of the garage, police entered the home through the garage door entrance. While one team was entering via the garage, a second team was unsuccessfully battering the front door with a battering ram. Police armed with a machine gun confronted Defendant’s elderly parents inside the premises. The searches revealed quantities of marijuana, ecstasy, psilocybin and LSD in Defendant’s room, the garage and in one of the vehicles. Defendant moved to suppress this evidence. When the motion was denied, he entered a plea to possession with intent to distribute LSD. Defendant appealed the denial of the motion to suppress.

Joke of the Quarter A police officer pulls over a speeding car. The officer says, “I clocked you at 80 miles per hour, sir .” The driver says, “Gee, officer, I had it on cruise control at 60; perhaps your radar gun needs calibrating.” Not looking up from her knitting the wife says: “Now don’t be silly, dear -- you know that this car doesn’t have cruise control.” As the officer writes out the ticket, the driver looks over at his wife and growls, “Can’t you please keep your mouth shut for once?” The wife smiles demurely and says, “Well dear you should be thankful your radar detector went off when it did or your speed would have been higher.” As the officer makes out the second ticket for the illegal radar detector unit, the man glowers at his wife and says through clenched teeth, “Woman, can’t you keep your mouth shut?” The officer frowns and says, “And I notice that you’re not wearing your seat belt, sir. That’s an another $75 fine.” The driver says, “Yeah, well, you see, officer, I had it on, but I took it off when you pulled me over so that I could get my license out of my back pocket.” The wife says, “Now, dear, you know very well that you didn’t have your seat belt on. You never wear your seat belt when you’re driving.” And as the police officer is writing out the third ticket, the driver turns to his wife and barks, “WHY DON’T YOU PLEASE SHUT UP?” The officer looks over at the woman and asks, “Does your husband always talk to you this way, Ma’am?” “Only when he’s been drinking, officer.”

o all NJNEOA members: The N.J.N.E.O.A. is proud to announce that once again, at this year’s 43rd Annual Conference June 5 - 8, 2012 the N.J.N.E.O.A. will be awarding its 12th annual N.J.N.E.O.A. College Scholarship Fund in the amount of $1,000 each to qualified applicants. The recipients will be chosen by the Scholarship Committee, and the awards will be presented at a special ceremony during the banquet held at the conference. A Qualified Applicant Shall: Be a high school senior planning to attend a full time accredited college, beginning in the fall. Be the son or daughter of a full-time, sworn law enforcement officer who is a member in good standing of the NJNEOA. (good standing meaning dues paid). Be accepted to a full time four-year accredited college at the time of scholarship receipt. Complete and return, in its entirety, the N.J.N.E.O.A. Scholarship application, no later than May 15, 2012. Firearms-related Incidents are the Leading Cause of Officer Fatalities in 2011 Total Law Enforcement Fatalities Rise to 173 Officers Killed in 2011 According to preliminary data from the National Law Enforcement Officers Memorial Fund, 173 officers have been killed during 2011 — up 13 percent from 153 line-of-duty deaths in 2010.

For the first time in 14 years, more officers died from firearms-related incidents than trafficrelated incidents. Sixtyeight officers were shot and killed in 2011, up 15 percent from 2010 when 59 officers died from gunfire. The number of officers killed by firearms has now risen during each of the past three years. Traffic-related incidents claimed the lives of 64 officers this year, a 10 percent decrease from 2010 when 71 officers died on the roadway. This year, 44 officers were killed in automobile crashes, 11 officers were struck and killed, seven were killed in motorcycle crashes, and two officers were killed by train while in their automobile. Florida led the nation with 14 fatalities, closely followed by Texas (13), New York (11), California (10) and Georgia (10). Thirty-three percent of all officer fatalities occurred in these five states. The New York City Police Department and Puerto Rico Police Department both lost four officers — the most officers of any agency in 2011. In addition to firearm and traffic-related deaths, 41 officers died due to other causes including physical-related incidents, which accounted for 27 officer fatalities. Physical-related incidents include heart attacks and other illnesses, which are further explained on page four of this bulletin. The data and statistics contained in this report are preliminary and do not represent a final or complete list of individual officers who will be added to the National Law Enforcement Officers Memorial in 2012.

A Closer Look: Chiefs & Sheriffs Chief Ralph Painter Rainer (OR) Police Department Chief of Police Painter was shot and killed responding to a report of an auto theft in progress. Upon arriving at the scene, the suspect attacked Chief Painter and took the gun from his duty belt. The suspect shot Chief Painter who was transported to a hospital and pronounced dead. Chief Jerry Hicks Leadwood (MO) Police Department Chief of Police Hicks died as a result of injuries sustained in a single-vehicle crash when his patrol vehicle slid on a patch of ice and struck a tree. Chief Capers Wannamaker, Jr. St. Matthews (SC) Police Department Chief Wannamaker lost control of his patrol vehicle on a curved part of the roadway which caused the vehicle to veer off of the road and strike a tree. Chief Wannamaker died at the scene. Sheriff James Stewart Spalding County (GA) Sheriff’s Department Sheriff Stewart was on routine patrol when he attempted to cross an intersection and collided with a vehicle traveling in the opposite direction. Sheriff Stewart was airlifted to a hospital where he remained until his death 10 days later.
