WORKPLACE INVESTIGATIONS Bullying, harassment and intimidation in the workplace are some of the most difficult people issues which organisations may have to deal with. Organisations can also have to contend with grievances from employees and disciplinary issues. Failure to address and resolve an allegation of bullying or harassment, or a grievance brought by an employee, or a disciplinary issue, can lead to a difficult, obstructive and stressful work environment and ultimately may lead to industrial relations problems and litigation. We often find that managers are too busy, not adequately trained or are too closely involved to handle this kind of situation effectively without some expert assistance. LEARNING AND DEVELOPMENT (L&D) Insight HR can design and deliver training programmes that are tailored to the specific needs of your organisation – to what your HR practitioners and people managers need. We can also assist your HR practitioners and people managers in the development of your L&D Strategy. INFORMATION & CONSULTATION FORUMS The Employees (Provision of Information and Consultation) Act 2006 (updated in 2013) imposes information and consultation obligations on employers with at least 50 employees. However, the requirement to inform and consult with employees does not apply automatically. It applies if an employer chooses to start the process or, potentially, if there is a formal written request from at least 10% of the workforce. Many Irish employers have already taken the initiative to put in place information and consultation arrangements before any such request from the workforce. Correspondingly, such employers generally have more control over the process. NERA The National Employment Rights Authority (NERA) can carry out an inspection of your workplace at any time following a complaint from an employee or simply at random. These workplace inspections are carried out to ensure compliance with employment rights legislation including working time, minimum wage, protection of young persons, parental leave, information and consultation and redundancy payments. 2013 saw the completion of 5,546 inspection cases – compared to 4,689 cases in the same period in 2012. The number of prosecutions also increased from 70 in 2012 to 85 in 2013.
