Can a tenant sub-let a rental property on Airbnb? Airbnb’s popularity continues to grow and the opportunity to make some extra cash is appealing to many, whether they are home owners or renters, which leads to the question – can a tenant legally sub-lease part or all of their rented property on Airbnb? And if so, under what circumstances can they do it? When a tenant arranges to rent out part or all of a property they are renting this is called a sublease or sub-letting. The Act that governs rental accommodation in Queensland is the Residential Tenancies and Rooming Accommodation Act 2008. If a tenant wants to sub-let the property they are renting, they must seek written permission from the landlord, usually via the property manager. The Act states that the lessor/agent must not unreasonably refuse permission to sub-let or transfer the agreement from one person to another. What does this mean? Well, according to the Act it means the lessor must act reasonably in failing to agree to consent to sub-let, and will be taken to be act unreasonably if they behave in a “capricious or retaliatory way” in failing to agree to the sub-let. Like most things in life, it’s probably down to the tenant and the landlord having a good, mutually respectful relationship. If the tenant has proven trustworthy, reliable and to have taken good care of the property then the landlord may be more likely to grant this request. Landlords are likely to value good tenants who maintain the property and protect its value.

THE LEGISLATION

It’s important to understand that this sublease does not remove the original tenant’s responsibility for the property. So, for example, if Jane is renting a property from Bob and she’s going away for a fortnight, she may ask Bob if she can put it on Airbnb for the fortnight she’s away. If Bob says yes, Jane is still responsible for the property, even while she is away, so if the property is damaged by the Airbnb visitors (the sub-tenants), subject to any other agreement Jane and Bob may have in respect of this arrangement, Bob will still likely have recourse against Jane under their lease agreement in respect of that damage. If Bob says no, then Jane doesn’t have permission to sub-let the property. If Jane believes Bob has acted unreasonably in failing to agree to a sub-let arrangement then Jane can apply to a tribunal to obtain a determination. However, this is extremely rare.

In the REIQ’s view, a landlord is more likely to say yes to a sub-lease arrangement that is a longer-term arrangement and where the normal checks and balances are in place, such as the normal vetting of the potential sub-let tenant. With Airbnb those checks and balances are not in place and this may, understandably, make some landlords nervous because they have no idea who is residing in their property.

DICKY BEACH was separated from Caloundra by the Tooway Creek until a bridge was built in 1937. The year before Dicky Beach came under vice-regal notice when the Governor of Queensland built a holiday residence, Currimundi House, in Wilson Avenue, just north of the creek. During World War II Dicky Beach was occupied by barbed wire defences and army camps & the bridge was widely used. In about 1950 the North Caloundra Surf Life-Saving Club commenced with a two-story fibro structure on the headland near the Neil Street Rocks, taking over the patrol of Dicky Beach from the Metropolitan SLSC which had looked after Dicky and Kings Beaches since the 1920s.

REIQ advocates for landlords to allow pets under rental law review

The REIQ is urging legislators to update laws to allow landlords and tenants to negotiate a position on pets. We don’t want to highlight Victorian reforms as this mandates pet ownership unless landlord can reasonably withhold consent Most landlords don’t allow pets in their rental properties, hoping to protect their investment and limit any maintenance and repairs that will need to be done after a tenant vacates. Landlords make this decision based on the fear that pets will damage their property. Dogs and cats shed hair and can leave odours throughout the property, especially in carpets and the back yard. As a result, only about 10 per cent of Queensland rental properties allow pets. In Queensland, landlords are currently not permitted to request any additional bond or

increased protection to manage the potential increased risks and damage in relation to the property.

More than 63% of Australian households own a pet and about 53% own a dog or a cat. This means there is a large number of families who are excluded from pet ownership because they rent, or, if they have a pet, are locked out of most rental properties. There are many benefits to pet ownership, including companionship, responsibility and, in some cases, improved home security. And it seems unfair to restrict renters from experiencing those benefits, simply by virtue of the fact that they rent.

Data suggests there are benefits to landlords to allowing pets in their investment property. Those households with pets tend to move less often and, due to the fact that there are fewer properties that allow pets, and be less likely to break leases to move within a town. There is also some suggestion that people with pets would be open to paying higher rents, and perhaps some version of ‘pet insurance’ to accommodate their furry friends.

In a series of decisions QCAT has ruled that absolute pet bans are not permissible in the by-laws that govern apartment and unit living. However, in other instances pet restrictions have been upheld. The REIQ is supportive of greater contractual freedom in this area. This would allow parties to come to a negotiated agreement that permits pets in the rental property while mitigating the issues that landlords may face if they permit pets in the property.

A proactive property manager will be able to monitor pet impact on a property and will offer mitigation tips to tenants as condition of rental, to help limit risk of damage. And it’s possible that by allowing pets a landlord may attract a more loyal, long-term tenant.
