Bylaws—Vote

THE BYLAWS (AND STATE LAW) REQUIRE A QUORUM OF AT LEAST 1/3 OF THE MEMBERS TO PARTICIPATE IN THIS TYPE OF VOTE. IN THE CASE OF THE TKPOA, THAT IS AT LEAST 509 MEMBERS.

ALL MEMBERS RECENTLY RECEIVED a voting package to vote on the adoption of Amended and Restated Bylaws. This is the first update of the Bylaws in over twenty years. An update of the Bylaws had been in the works for some time, but recent changes in state law made an update necessary as soon as possible. An update of the CC&Rs is also planned for early next year.

The updated Bylaws have a fresh look and reflect changes in law as well as a few recommended changes by the Board. The changes in law were primarily the result of State Bill 323, which took effect this year. A summary of the proposed changes was included in the voting package, but members should review the proposed Bylaws for themselves. To assist members with voting, the current Bylaws are posted on the TKPOA website in the Documents/Bylaws CC&R section along with other information that may be of interest and assistance. A Town Hall is also scheduled for November 10th, 2020.

Please vote! The Bylaws (and state law) require a quorum of at least 1/3 of the members to participate in this type of vote. In the case of the TKPOA, that is at least 509 members. In order to be considered, mailed ballots must be received by the Inspector of Elections no later than 3:00 pm PST on December 14th, 2020. Ballots can also be submitted at the TKPOA Pavilion office in the locked ballot box located in the lobby Monday-Sunday 8:30 am–4:30 pm. Ballots will be opened and counted at an open Board of Directors meeting at the TKPOA Office on December 16th, 2020, starting at 6:00 pm. Hand delivered ballots will be accepted until 6:05 pm at this meeting. Any ballots received after that time and date will not be counted.

The Board of Directors or Inspector of Elections may extend these dates up to two successive periods of thirty (30) days each if needed to obtain a quorum. If the quorum requirement is not met, another costly vote will need to be conducted in the future.
