The legal definition of “emergency” is very restrictive. Do not add an emergency agenda item without first consulting your school district’s attorney. 3 The Open Meetings Act refers to “closed session” so we have used that term here. You may certainly substitute “executive session” if that is your board’s preference. 4 You are not required to have a free-standing public comment section of your agenda. Instead, you may allow public comment only on agenda items as they are addressed by the board during its meeting. Education lawyers differ about which approach they prefer and you should adopt the method of public comment that works best for your board and its community. No matter how you allow public comment, you should indicate where that comment is allowed in your agendas.
