WELCOME LETTER
Hello readers
Well, after a lot of ‘will they, won’t they’, ‘can we, can’t we’, by the time you read this, restrictions may – or may not – have been lifted. I’m writing with crossed fingers (which isn’t easy, let me tell you!) in the hope that the Prime Minister will announce a ‘free pass’ back to life as we once knew it. Hopefully, the vaccine will be working and will have been sufficiently distributed through society to make it safe for us all to once again enjoy our freedom.
As things have slowly eased over the last few months it has been so nice to once again see the local area bustling, businesses reopening and enjoying a thriving trade, and people interacting with one another. It’s the beginning of a return to the vibrant area that we know and love! We’re fortunate to live in such a wonderful, close-knit community with people who support each other and our local businesses. Hopefully this will help the area to bounce back quickly from the past eighteen months of upheaval and uncertainty, emerging stronger and more resilient as a result.
As travel restrictions encourage most people to holiday in the UK rather than abroad this year, we may well be welcoming more visitors to our towns and villages as people enjoy the stunning area that we’re lucky enough to call home … and many of us will be venturing further afield to explore other regions of the UK. Team ATL have been individually enjoying a bit of time away in various locations around Britain recently, from the Northumbrian coast to Whitby, London, and – a little closer to home – the delights of a lodge at Mercia Marina! Well, a break is a break, isn’t it! If you’re looking for somewhere for a nice day out or even an overnight stay without travelling too far, it’s highly recommended.
Of course, you don’t even have to go that far – you can literally ‘holiday at home’ and spend some time enjoying the wonderful local restaurants, pubs, shops, museums, country houses, lakes, waterfalls and walks that are right on our doorstep. From watersports at Carsington Reservoir, to the delights of Chatsworth House and Calke Abbey, the Museum of Making at Derby Silk Mill, Wirksworth’s Heritage Centre or Belper’s own Strutt’s North Mill Museum, there are activities and events to entertain all ages. The new swan boats are happily a-swimming on the Derwent in Belper River Gardens ready for people to ride and, if you turn to page 38, you can follow the route to take a scenic walk from High Peak Junction on Cromford Canal up to Black Rocks where you’ll be rewarded with a stunning panorama of the Derwent Valley. Another way to get a great view of this is from the cable cars at the Heights of Abraham … yet another day out to add to your list! So, if you’ve not been lucky enough to book a trip this summer, don’t worry – a ‘staycation’ at home could be just as much fun.
Talking of luck … if you enter our competitions you could be the lucky winner of a two course meal for two, kindly provided by The Queens Head at Little Eaton, or a bottle of champagne! Now that would make a staycation even more special, wouldn’t it!
Whatever your plans are for the summer, we hope that you have a lovely time – and we’ll see you again in a couple of months. In the meantime take care, and stay safe.
All the best,
Team ATL

The breakdown of a relationship is difficult. When children are involved it can be challenging. Decisions need to be made regarding where the children will live, how much time they will spend with the other parent, what will happen during school holidays, at Christmas, etc.
Parents are expected to work together and put the best interests of the children first. This is easier said than done. The demise of a relationship rarely occurs overnight. There is generally a build up over time. Children are often aware of hostility in spite of attempts to shield them. It is not uncommon for there to be an alliance with one parent and for a child to be resisting or refusing to spend time with the other parent post-separation. This may be a result of parental alienation. The concept of parental alienation has been around for some time. The Children and Family Court Advisory and Support Service (CAFCASS) say that, while there is no single definition, they recognise parental alienation as “when a child’s resistance or hostility towards one parent is not justified and is the result of psychological manipulation by the other parent.” The indicators can include a parent constantly badmouthing or belittling the other, limiting contact, forbidding discussion about them or creating the impression that the other parent does not love the child. The impact can be devastating for the other parent and also for their extended family.

Legal Matters: If a child is resistant or refusing to spend time with one parent then prompt action is needed Parental Alienation and consideration may need to be given to making an application to the court. Delay in addressing the issue can lead to a profound and long-lasting impact on the child and in some cases the complete breakdown of the relationship between the child and the parent. When a marriage or a civil partnership breaks down, consideration needs to be given to how the assets of the union are to The real issue is the behaviour of the parents; the court may need to determine the factual matrix before considering the appropriate outcome for the child. If we fast forward to the present day, the reasons to use a Trust are broadly the same as in medieval England; there are different types of Trusts and there are many different types of situations which may create Trusts. Trusts may be set up in a lifetime, or through a Will following death. Trusts may provide circumstances in which beneficiaries will become absolutely entitled to the Trust Fund, or they may provide flexibility by allowing for discretion to be exercised as to who should Ben Stubbins benefit.

70 years later the trust is still providing that accommodation. Another of the trusts we look after was set up by a client who wanted to help people with particular medical conditions. Her kindness has enabled her trustees to provide financial support to a gifted young musician who has experienced a number of health issues that have interfered with her education, to enable that child to be educated in the most appropriate environment. A Charitable Trust can be set up either during your lifetime with savings and investments built up already, or alternatively through a specially prepared Will that will only take effect following your death and will therefore not deprive you of capital or income during your lifetime. Our team at Shacklocks have a particular speciality in preparing arrangements of this kind and also of acting as professional trustees to enable wishes to be fulfilled and instructions to be followed.
