How Buyer’s Agents Are Paid It is your right in Nevada to have qualified representation. When working with an agent, you might wonder, “How does my agent get paid for their service?”
Well, here is how it breaks down: When a homeowner lists their property for sale with a Realtor® in the local Multiple Listing Service, they sign a contract with their listing agent to pay the listing commission and a selling commission. If you are represented by an agent that represents your interests exclusively, the listing agent must give the selling commission to that agent. If you are unrepresented, the listing agent is entitled to the entire commission. Listing agents will often infer that buyers will receive a discount if they are unrepresented and allow the listing agent to keep the entirety of the commission. If this is true, the offer should in some way reflect in writing that the agent is giving up the selling portion of the commission. Please remember that real estate commissions are based on the sales price of the home and that the listing agent is not only compelled by a contractual obligation to get the seller the most amount of money possible but by their own self-interests to talk you into a higher price. Your agent, on the other hand, is contractually obligated to look out for your best financial interests, regardless of compensation.

If representation is important to you, you may negotiate it into the purchase price in any kind of market. My business plan recognizes the importance of buyer representation. Is Now the Right Time to Buy? How’s the water? Dipping your toes in the market. Of all the things that you are reading about the current real estate market, which are the ones you should believe? Let’s start with the truthful buyer’s basics: The Federal government has built home ownership advantages into your income taxes – every day your pay rent, you are giving free money away. Every penny that you invest in a home that is your own contributes to your portfolio instead of your landlord’s. A home is a wonderful forced savings plan As a long-term investment, property ownership has historically been one of the most reliable investments.
What exactly do I need before I start looking? Earnest money deposit – anywhere from $1000 to 2% of purchase price of the home. This check will be cashed when your offer is accepted. Seasoned reserves – you don’t need a large down payment, but your lender would probably like to see that you have a couple of months payments in the bank. A cleaned up credit report – you don’t need perfect credit, but you shouldn’t expect any dirty surprises when you are trying to buy your dream home.

Market Statistics In 2018 we saw historically low inventories in the Reno/Sparks market. By the third and fourth quarters we saw the market slowdown and the housing inventory start to increase but we are still experiencing low inventories. What does “low inventories” mean? The National Association of REALTORS considers 5 to 6 months of inventory a healthy or normal market, where neither buyers nor sellers have a distinct advantage. We have studied our Reno/Sparks housing market by price range, and see a strong seller’s market in homes priced below $600,000. This price range make up almost 89% of the sales in our region. However, in the price ranges above $600,000 we have a greater inventory of available homes, and with that we see a shift to more of a balanced or buyer’s market.

How a Home is Priced Understanding how a home is priced will give you peace of mind. It will also help you decide how much you want to offer and how to negotiate. Homes are priced by comparing like homes in the immediate area. Professional Appraisal Buyers who are financing a home will generally be required to have an appraisal done by the lender. While a home inspection informs you what may be wrong with the home and if it is structurally sound, an appraisal gives you more financial insight into what the home is worth, whether or not your offer is reasonable, and you are better positioned if you or the home owner decides to negotiate. A home appraiser will provide a report to you once the appraisal is complete. Aside from giving you an estimated value for your home, they will also provide details about how they calculated that amount, and what affected the value. Generally, a full report includes: An explanation of how the appraiser determined the value Specifications about the size and condition of the home A list of improvements that have been done, and when Details of any structural problems A short market evaluation, including current trends Any relevant notes about the area or property Some appraisal reports may also include pictures, maps, sketches, or information about comparative trends in the market. An appraisal does not replace your home inspections. It will give you a more complete picture of the home you are buying.

Property Inspections When purchasing a home, it is critical to determine the condition of the property. The way to do that is through various types of inspections. The purpose of property inspections is to uncover any issues that would affect your decisions to purchase a particular home. Cosmetic issues that don’t materially affect the value of the home are typically not noted in reports. It is also important to have inspections when a property is newly constructed to ensure construction has been completed properly. There is always a level of risk when purchasing a home as inspectors can only evaluate what is visible. However, good inspectors can provide a great deal of confidence in the condition of a home.

SRPD Seller’s Real Property Disclosure Statement Full Disclosure of Property Recent legal decisions and new legislation provide that the seller has the responsibility for revealing to the buyer the true condition of the property. The concept of selling a property “as is”, with the buyer assuming all responsibility to determining the property condition, is not acceptable in the present marketplace. The seller must disclose the known condition of the property to the buyer. This information should be made available to the buyer as soon as possible. Charm or Irritant? Having lived in this property, the seller has become accustomed to the peculiar conditions that may have developed. But for the buyer, that peculiarity may be more than a mere inconvenience. It may be an irritant which the buyer cannot tolerate. It is important for the seller to review the condition of the property with the real estate agent and take special note of any problems on the Disclosure Statement. Nevada State requires that the seller provide the buyer with a completed “SRPD - Seller’s Real Property Disclosure Statement”. All Systems Go A basic assumption in every sale is that the house and systems in the house are functional. For example, the roof will hold out the rain and sun, the hot water heater will provide hot water, and the heater will provide heat. If it is known that any of the systems do not function properly, such facts should be included in the purchase agreement and acknowledged by the buyer. “As Is” An “as is” purchase is perfectly acceptable, as long as the buyer understands exactly what the “as is” condition entails. Thus, it can be said in the purchase agreement that the buyer accepts the roof and the plumbing and the electrical system in their present condition and acknowledges that they have defects. This acknowledgment provides a defense for the seller if it is claimed he did not disclose the problems.

Title and Escrow Helpful Reminders for Title and Escrow Identification – Please bring appropriate identification with you to the escrow company. Your identity will be verified. Use your legal name when filling out documents. Power of Attorney - In the event that you wish to use a Power of Attorney, arrangements must be made one to two weeks in advance with the escrow officer and the Power of Attorney must be approved by the buyer’s lender and your title company. These arrangements should be made as early as possible in the transaction. Trusts – If your property is held in a trust, inform your REALTOR® and the Title Company in the beginning of the transaction. Coordinate with your REALTOR® and have a copy of the Trust delivered to the Title company for review. Transfer of Funds – If you wish to transfer funds or wire transfer funds, arrangement must be made in advance with the escrow officer. Be aware, wire transfer fraud has become more prevalent.
