1_GENERAL

RANGE

All goods supplied by j.h. miller & sons ltd are subject to the following terms and conditions of sale. the company will not accept any variation unless agreed in writing between the parties.

2_PRICES

The price of the goods will be subject to vat. whilst every endeavour will be made to supply goods at the prices quoted, the company reserves the right to invoice at prices ruling at date of despatch.

3_TITLE OF GOODS

The company shall remain sole and absolute owner of the goods until the full payment has been made. in case of non-payment the company shall be entitled to repossess the goods or proceeds of sale.

4_PAYMENT

Where a new account is to be opened, two trade references are required. all accounts are due for settlement before the end of the month following date of invoice. the company reserves the right to charge interest on unpaid invoices at the rate of 4% above nat west bank plc base rate. pro-forma accounts are to be paid in full prior to the goods being despatched.

5_CARRIAGE

Carriage and packing is free for delivery within the uk mainland on orders over £300.00 nett. orders under £300.00 will carry a £15.00 delivery charge. carriage to isle of man, ni, eire and scottish highlands will be charged at cost. in order to qualify for a next day delivery service the customer must place the order before 11am. Floor-lamps and other large fittings will incur a £22.50 charge per item, regardless of order value. orders sent direct to individual addresses on behalf of our customer will incur a £7.50 surcharge, regardless of order value.

6_NOTIFICATION OF DAMAGE OR LOSS

In case of alleged shortage or damage you must notify in writing both j.h. miller & sons ltd and the carrier within 7 days of receipt. claims made outside this time limit cannot be entertained. non-delivery of goods must be advised within 10 days from the receipt of invoice.

7_CANCELLATION AND RETURNS

Goods ordered by any customer and supplied correctly by the company will not normally be accepted for return. in such cases where the company is in agreement to accept goods to be returned, the company reserves the right to make a handling charge for goods returned to stock. the goods must be in their original packing to ensure no damage is sustained during transit.

8_DESIGN VARIATIONS

Due to the hand-made nature of our products, the goods supplied may vary in detail from the illustration and description given. colour finishes will be maintaned as accurately as possible, but an identical match cannot be guaranteed.

J H Miller started off in small premises in Moss Side, Manchester. After 60 years it has established itself as a leading manufacturer and distributor of decorative lighting for the domestic and commercial markets. j.h. miller & sons ltd will make good or replace at our works without charge any goods which are in our opinion defective. the claim must be within a reasonable period of time after the defect has been discovered. we accept no responsibility for defective material after the same has been cut or manipulated.

10_ENGLISH LAW

English law shall apply and any disputes shall be settled in the english courts.
