I
n Washington, D.C., republicans are blaming democrats for wanting to raise taxes to cover budget cuts, while democrats are blaming republicans for wanting to protect the rich at the expense of people dependent upon government entitlements. The only thing that seems certain about this debate, is that it will continue forever with no positive outcome apparent. As a taxpayer and one who represents Kansas Agribusiness, I am sick and tired of the finger pointing and want to see the partisan rhetoric cease and be replaced by leadership that will exert some adult supervision and do what is right for our country. A good place to start is by dialing back some of the asinine business regulations I see daily coming out of Washington, D. C. and Topeka. Let me cite just one example that came to light this past month when a KARA member called our office with a problem. The Kansas Highway Patrol and US Department of Transportation had stopped and ticketed them for violations that no one in the industry was aware of and had not been enforced for at least 10 years. Numerous contacts with USDOT by KARA staff resulted in a temporary resolution to the matter, and KARA staff is continuing to work with the member and regulators to find a long term solution. This resolution saved the member thousands of dollars in fines and lost income. The member later stated the following: “I have always appreciated KARA, but you never really know what you have until you are in a bind and need help. You were certainly there for us when we needed you. It became apparent to me that we need to give you the tools to continue to do your good work in support of our industry. When the pressure heats up on us we need to step up and increase our commitment to you. I am convinced it is the best long term investment that we can make this year. For that reason, we are gladly paying our dues and including an additional $2,000 contribution to your PAC.” The member went on to express his concern about the future with respect to current regulatory pressure that agribusiness faces. He appreciated the fact KARA knew “exactly what to do and who to talk with to make it happen”. This is only one of the many examples of our staff being at the right place at the right time. However, even with great staff we need to make sure that the frustrations and concerns of agribusiness are heard by the people that can change these issues for us…the policy makers. Therefore, this fall please consider “investing” in your future by supporting the PAC so that we can carry your message forward and work to bring more common sense to the laws and regulations you deal with each day. Over 100 members attend Annual Meeting On August 22-23, 109 KARA members gathered together in Manhattan to enjoy the 5th KARA Annual Meeting. Thank you to the following companies that sponsored the event: BASF, Bayer CropScience, CHS, DeBruce Fertilizer, DuPont Crop Protection, Heartland Ag, Helena Chemical Company, KFSA, Koch Nitrogen, Lang Diesel, Poole Chemical and Syngenta Crop Protection. The meeting opened with a Welcome Dinner followed by “A Night at the Races” in Aggieville, where members enjoyed some friendly horse race betting. The speaker line-up was outstanding this year and included Jay Vroom, CropLife America President & CEO; Dr. Ron Trewyn, KSU Vice President of Research; and Derek Schmidt, Kansas Attorney General. All did a fantastic job addressing issues important to the industry in which our members do business. The event concluded with our annual Chairman’s Golf Tournament at Manhattan’s award-winning Colbert Hill’s Golf Course. Mid Kansas Coop Purchasing Manager Elected Chairman of KARA KARA elected Doug Wright, purchasing manager of Mid Kansas Cooperative in Moundridge, as its new chairman on August 23 during the annual meeting in Manhattan. Wright was appointed by the 23-member board of directors to serve his two-year term as Chairman through August 2013. KARA members also elected Mike Shirley, agronomy division manager of Frontier Ag in Goodland, as their new first vice chairman. Kevin Brady, area manager of Lang Diesel in Benton, was elected KARA’s new second vice chairman.

NO-TIES TOURS
Staff travels state making member visits This summer, Tom Tunnell, Ron Seeber, Mary Jane Stankiewicz and Sarah Sexton-Bowser of the KARA staff hit the road for a couple of No Ties Tours spanning the state. The annual No-Ties Tours are a chance for staff to visit with members in their work environment and learn about the needs and concerns of the association and industry. Your KARA staff values member interaction and looks forward to this every year. Members had a variety of concerns ranging from the size and quality of harvest to government intrusion and taxes. Staff, as always, was impressed by the level of frank discussion and input we received from our members. Without such key feedback, we cannot as an association adapt, mature, and be the premier voice of agribusiness in Kansas. In addition to members, our staff was also able to meet with a number of legislators during the trips and pass on the concerns from our membership. Thank you to all of you that took the time to talk and allow us into your business.

TAL PROGRAM, SCHOLARSHIP AUCTION
TAL class wraps up, heads to Expo for Graduation The 2011 Tomorrow’s Agribusiness Leader’s class finished their final session in Wichita wrapping up what has been an exiting year. Session III included insightful messages from KARA Board Chair Doug Wright. Wright was able to draw from his personal and professional experience to share with the class some potential challenges and pitfalls to watch out for as they continue their career pursuits. Also during the session, Dr. Don Hackett, WSU Center for Management Development, provided a crash course on how to better manage employees and increase productivity. The day also included a lively and intuitive presentation from State Senator Ty Masterson and State Representative Dan Kerschen on changing political tides under the statehouse dome and their desires and predictions for the 2012 election cycle. True to form, the 2011 TAL class was not shy to ask provocative questions and received straight forward responses. Their last TAL duty is to man the TAL shotgun raffle booth at the Expo and to graduate the morning of November 17 in Overland Park.

Scholarship Auction looking for donations The Kansas Agribusiness Retailers Association is proud to announce its annual Scholarship Auction at the Expo to be held on November 16 in Overland Park. All proceeds from this auction directly benefit high school and college students in Kansas wanting to pursue an education in agricultural-related fields by providing much needed financial relief for deserving kids and their families.

From our state capitol to our nation’s power center, the 2011 class enjoyed meeting with and reinforcing to policy makers that KARA is the voice of Agribusiness. In DC, the TAL class excelled at the roll of ambassadors from the heartland expressing a message that overregulation, fiscal frivolity and plain ignorance of the facts are not the way to administer good government. They shared real life stories with lawmakers of interactions with regulators that pushed

Environmental Stewardship Day raises awareness in industry On August 2 in Wichita, KARA members gathered to learn about environmental stewardship practices, how to manage an environmental project and DOT audits. As KARA’s newest training program, Environmental Stewardship Day aimed to increase the awareness of the responsibility agriculture has to be good stewards of the earth and how to communicate that message to customers and the public.

Water requirement in anhydrous ammonia The Fertilizer Institute issued a memo on August 12 alerting members of reports that the U.S. Department of Transportation (DOT) inspectors have been auditing ammonia production facilities to ensure compliance with 49 C.F.R., Section 173.315(l) which requires 0.2 percent water in all anhydrous ammonia offered for transportation or transported.
1. Acquire a registration number from DHS to sell, transfer and/or purchase ammonium nitrate. 2. Requires applicants who sell, transfer or purchase ammonium nitrate to conduct a background check using the Terrorist Screening Database. 3. Requires DHS to issue an ammonium nitrate registration number for each ammonium nitrate seller or purchaser upon completion of an application to DHS. 4. Requires ammonium nitrate sellers to verify each potential ammonium nitrate purchaser's identification and registration number prior to selling product. 5. Requires all ammonium nitrate facilities to keep records of sales or transfers of ammonium nitrate for at least two years after each transaction. 6. Certain ammonium nitrate sellers must report the theft or loss of certain quantities of ammonium nitrate to Federal authorities within 24 hours of discovering the theft or loss.
New SPCC rules The Agricultural Retailers Association (ARA) published on August 30 a reminder that the Environmental Protection Agency's (EPA) Oil Spill Prevention, Control and Countermeasure (SPCC) Program will take effect this Nov. 10, 2011. The new rule requires all locations with 1,320 gallons of any oil will need an SPCC plan, not just fuel oil distributors. This is an expansion of the old rule and now includes all agricultural facilities, including farms and retailers.
