Please take a moment to visit the neighborhood’s new website located at www. settlersvillagehoa.com . The Board is very interested in any and all feedback. I find it interesting, if not a little bittersweet, to experience the things my parents had to experience as I and my siblings grew up. There was graduation, moving out on my own, getting a job, getting married and having children just to name a few. At the time, it was virtually impossible for me to see how my parents were affected as I adjusted to my own pathway in life. Now my kids are out on their own. One is getting ready to get married and one is closing on finishing school. It tugs hard at the heartstrings as I and my wife watch the little girls that we cared for, raised and protected all our lives, suddenly come into their own as confident (most of the time) young women. I know they do not need us as before and to me, that is so very sad. With my own parents gone for many years, I now understand how they must of felt. You cannot help but be proud of how your children turned out and to join them in the joy or reaching new milestones in life. But it would be nice to have my little girls back again (although I would need my youth and energy back too). To all of you who have young children, I encourage you to love the moment because they grow up way too fast. For those of you where I am now, take heart. It really is fun to watch them progress through things as you did when you were younger, although they probably will not choose the way you might prefer. But it has become so fascinating to see my children as adults and be able to relate to them on a whole new level. Congratulations kids, although you are still your momma’s and my little girls… Steve. The HOA did receive an anonymous complaint letter and wanted to try and address the large number of points that were brought up. First, the HOA Board members receive a report each month on who the management company has cited with a letter. The process is unavoidably long because of the legislative requirements regarding adequate notice, of what expenses can now be recovered by the HOA and inspection limitations. As an example, an inspector cannot trespass by entering the property - they can only view from either a public right of way or at the invitation of a resident. The average time requirement is 5 months from first notice until the attorney’s final notice and that only gets longer if legal action is required. When a property is placed for force mow, the resident can order the service to leave or not enter the property, which then requires the aforementioned legal action - more time. And we still have a handful of properties left over the Section 5 annex that are not officially members of the HOA due to developer error.

The signs on Whitwell will stay. The feedback for the signage received by Board has been overwhelmingly positive and this was only the 2nd direct complaint that did not like them. In any case, these were selected because at some point, West Little York will expand to 4 lanes and we may lose the signage anyway. Settlers does not own the land on which the signs sit, the land actually belongs to the MUD. As noted a ways down in this newsletter, the HOA and MUD are independent entities and the HOA has no say in the price of water. Likewise, the Harris County Regional Water Authority is also independent from the HOA and the MUD and again, we have no say in their charges. While the MUD had its first price rise in several years just recently, the HCRWA has sent more than a few price hikes to cover the costs associated with the area’s ongoing mandatory conversion to surface water supplies. These are passed directly to the customer and the MUD and its residents currently receive no benefit… yet. Settlers, per our discussions with the deputies, is considered one of the more pleasant neighborhoods in the area in terms of safety and looks. Common area repairs are handled as fast as they are found and within budgetary limitations. The Board will be reviewing the repair options for the FM 529 marquis, which currently range all over the board from $5,000 to $25,000 depending on what option is chosen. There is no way anyone could see the rot inside the sign until we had an unfortunate incident that gave us a view inside the structure. The entire Board, not just Mr. Breard, approved the plan for the sign Current monies saved toward the pool project have reached $323,067.45. Again, as a reminder, the original plan was to build the pool in stages to keep from straining the neighborhood’s budget. Unfortunately, replacing the pool requires the replacement of the filtering equipment and both the water supply and wastewater plumbing and piping. That, in turn, requires immediate attention to the building, which would house the filtering facilities. And because rework would be needed to bring the electrical up to code, which is legally required by any extensive renovation to the building, the project will have to be structured into a single, large project. The minimum needed in the bank before beginning the project would be $472,000 or 80% of the total projected project’s cost. Some of you might have noticed the ongoing work in the pool. This work is designed to buy an extra 2 years of life or so for the pool surface rather than investing money in re-plastering costing around $15,000 for something we expect to demolish in 2 years. The Board for Harris County MUD #105 met on Monday, June 18, 2012. Michael Keefe presented a tax assessor/collector’s report. There was no City of Houston Strategic Partnership Agreement update. 2011 taxes are 98.2% collected. The Board next reviewed the operator’s report, which showed the District has 2,333 connections. The operator reviewed the regular maintenance items with the Board, as well as the larger invoices. The District accounted for 108.2% of water produced during the previous month. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting to contest, explain or correct the charges, services or disconnection. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges so the Board unanimously authorized the District operator to proceed with termination of the utility service pursuant to the provisions of the District’s Rate Order. The Board acknowledged receipt of the annual ethics disclosure letter and updates from Mr. Ideus, the District’s investment officer and then next authorized the District’s attorney to submit to the required entities the necessary emergency operations information and critical

CHIROPRACTIC HEALTH and WELLNESS CENTER load customer eligibility determination form. The Board considered the proposed 2011 Consumer Confidence Report for distribution to District customers and approved and authorized distribution of the Consumer Confidence Report. Jason Johnson and Delea Cooper presented an engineer’s report. No pay applications were presented for approval. With respect to the arsenic removal system, the engineers continue to work with Layne regarding the service agreement. With respect to Water Plant No. 1, the engineers are working on the design of the proposed new well site placement and the necessary easements. With respect to the Lift Station No. 2 and Offsite Utilities, the engineers met with Center Point on June 5, 2012 to discuss the design and costs associated with providing power to the lift station. Lany Kupstas presented a developer’s report and stated that D. R. Horton is scheduled to close on additional Jasmine Heights sections on June 20, 2012. The Board requested representatives of D. R. Horton be present at meetings if active homebuilding is occurring in the District. Mr. Goodall next updated the Board on the status of the closing of Series 2012A Bonds. In that regard, Brian Krueger presented the developer’s reimbursement audit. Mr. Ideus reviewed the bookkeeper’s report. After payment of bills at this meeting, the general fund balance will stand at 5261,347.88. The capital projects fund balance is $421,061.29. The debt service fund balance is 53,290,706.97. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA). Its members are:

The MUD Board can be contacted via their attorney Taylor Goodall of Smith, Murdaugh, Little & Bonham at 713-652-6500. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned light poles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to cite offenders as more than enough time has passed to allow everyone to become familiar with the new rules. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278 and $297 in 2011. We have collected $107 so far for 2012. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake. As indicated earlier this year, Settlers is giving increased attention toward property upkeep and that means enforcement is and will be increasing. Owners need to understand that keeping your yard mowed and trimmed is one of the least expensive methods to maintaining the property values in Settlers Village. Just the same as with maintenance fees, a timely action and response to violations is your obligation as a resident. Ignoring a problem will not make it go away but it will make it more expensive as lawyers become involved.

Time now to make plans for fall landscaping projects. • Clean up flowerbeds of fallen foliage, yellowed leaves and dead wood. Light green leaves may signify lack of iron (chlorosis). Correct with iron cheleates. • Cut off old dead foliage on irises. Scratch in a little bone meal around the roots. • Prune roses to reshape and groom plants for fall growth. Follow up with a dose of fertilizer the first week of September. • Plants come out of summer rest and go crazy. Insect populations explode as we get into cooler temperatures. Diseases that have been dormant wake up. - Citrus, croton, avocado and mango are susceptible to spider mites and thrips. Discourage them with a strong jet of water from a hose directed to the undersides of the leaves. - Hibiscus, citrus, palms, gardenia and ixora are susceptible to scale and mealybug. • Winter vegetable gardens and perennials get planted. • Wait until November to plant petunias and pansies.

• Fire ants baits should be put out in September-October to lessen the number of eggs that make it to Spring. • St. Augustine grass gets its fall fertilizer during September. Continue to mow at maximum height. You want to leave a lot of leaf surface to produce carbohydrate reserves for the winter. • Keep an eye out for sod webworms. First sign of them is grass that appears to stop growing. You need to get them early for biological controls to work. When the caterpillars are only 1/4 inch, Bacillus thuringiensis applications can slow them. Bt is a bacteria that works on the caterpillars’ digestive systems and makes them stop feeding. Do the application late in the day. The larvae feed at night and you want them to get nice fresh Bt. • When the heat and drought end, the weather could bring brown patch disease in the St. Augustine grass. Watch for yellowish spots if the nights drop into the 60’s and days stay in the 80’s. • Get any pruning of hedges and such done now. You want the flush of new growth to be hardened-off before the end of October. Tree pruning should be put off until winter, when the trees are dormant. • Pre-emerge herbicide applications targeting annual bluegrass and the earlier-germinating winter broadleaf weeds needed to be put out starting in mid-August.

Registration for Fun, Fair, Positive Soccer (FFPS) is open for boys and girls ages 4 to 18 for the fall season. Games start on October 6, 2012. FFPS is a non-profit youth soccer program dedicated to providing a positive youth sports experience for all children. Founded in 1986 in Katy, Texas, FFPS has grown to 22 leagues and 16,000 players throughout the Greater Houston area. FFPS offers children a fun and fair experience, including one practice per week, a full uniform and trophy for every player, equal playing time, opportunities to play every position, co-ed/balanced teams, positive coaching and more. The 5th Annual Remodelors Council Charity Garage Sale, scheduled for Saturday and Sunday, Sept. 15th and 16th, will be held as part of the Texas Home & Garden Show at Reliant Center. Hours are Saturday, Sept. 15th, 10:00 AM - 7:00 PM and Sunday, Sept. 16th, 11:00 AM - 5:00 PM. Tickets are $10 for adults, $9 seniors and admission for children under 14 is free. All revenues from the annual garage sale go to fund the Remodelors Council charitable projects, which include Habitat for Humanity, SIRE Therapeutic Equestrian Center and Epiphany Community Health Outreach Services. The Remodelors Council members work hard to secure most of the materials needed for these projects and they donate much of the labor. Funds raised from the Charity Garage Sale, which is run completely by volunteers, are used only to purchase those items and services that can’t be secured through donations.
