GLENCAIRN CRIME WATCH SECOND TUESDAY EVERY MONTH Want to know the best crime prevention device ever invented? A good neighbor! In fact neighbors working together in cooperation with law enforcement can make one of the best crime-fighting teams around. We call it Glencairn Crime Watch. Crime Watch is a crime prevention program which enlists the active participation of citizens in cooperation with law enforcement to reduce crime in their communities. It involves: (1) Neighbors getting to know each other and working together in a program of mutual assistance. (2) Citizens being trained to recognize and report suspicious activities in their neighborhoods.

(3) Implementation of crime prevention techniques, such as home security, Operation Identification and others. You may hear it called Neighborhood Watch, Citizen Crime Watch, or Block Watch. The names differ but the idea is the same: Neighbors looking out for each other. board members cannot make a decision on an individual basis. It takes a majority vote of the Board to make a decision. That is why the Board meets on Mondays before the member meeting to discuss issues with members.

Again, the important thing is to submit an ACC form prior to painting. Your ACC Committee and Board of Directors do everything they can within the parameters of the governing documents, to work with all homeowners in a timely manner and on a one on one basis. STATE OF TEXAS PARKING LAW AND REGULATIONS SUBCHAPTER G. STOPPING, STANDING AND PARKING 545.301. Stopping, standing or parking outside a business or residence district. (a) An operator may not stop, park, or leave standing an attended or unattended vehicle on the main traveled part of a highway outside a business or residence district unless: (1) stopping, parking or leaving the vehicle off the main traveled part of the highway is not practicable; (2) a width of highway beside the vehicle is unobstructed and open for passage of other vehicles; and (3) the vehicle is in clear view for at least 200 feet in each direction on the highway. (b) This section does not apply to an operator of a vehicle that is disabled while on the paved or main traveled part of a highway if it is impossible to avoid stopping and temporarily leaving the vehicle on the highway. 545.302. Stopping, standing, or parking prohibited in certain places. (a) An operator may not stop, stand, or park a vehicle: (1) on the roadway side of a vehicle stopped or parked at the edge or curb of a street; (2) on a sidewalk; (3) in an intersection; (4) on a crosswalk; (5) between a safety zone and the adjacent curb or within 30 feet of a place on the curb immediately opposite the ends of a safety zone, unless the governing body of a municipality designates a different length by signs or markings; (6) alongside or opposite a street excavation or obstruction if stopping, standing, or parking the vehicle would obstruct traffic; (7) on a bridge or other elevated structure on a highway or in a highway tunnel; (8) on a railroad track; or (9) where an official sign prohibits stopping. (b) An operator may not, except momentarily to pick up or discharge a passenger, stand or park an occupied or unoccupied vehicle: (1) in front of a public or private driveway; (2) within 15 feet of a fire hydrant; (3) within 20 feet of a crosswalk at an intersection; (4) within 30 feet on the approach to a flashing signal, stop sign, yield sign, or traffic control signal located at the side of a roadway;

(5) within 20 feet of a driveway entrance to a fire station and on the side of a street opposite the entrance to a fire station within 75 feet of the entrance, if the entrance is properly marked with a sign; or (6) where an official sign prohibits standing. (c) An operator may not, except temporarily to load or unload merchandise or passengers, park an occupied or unoccupied vehicle: (1) within 50 feet of the nearest rail of a railroad crossing; or (2) where an official sign prohibits parking. (d) A person may stop, stand, or park a bicycle on a sidewalk if the bicycle does not impede the normal and reasonable movement of pedestrian or other traffic on the sidewalk. (e) A municipality may adopt an ordinance exempting a private vehicle operated by an elevator constructor responding to an elevator emergency from Subsections (a)(1), (a)(5), (a)(6), (a)(9), (b), and (c). (f) Subsections (a), (b), and (c) do not apply if the avoidance of conflict of other traffic is necessary or if the operator is complying with the law or the direction of a police officer or official traffic control device. (g) If the governing body of a municipality determines that it is necessary to improve the economic development of the municipality’s central business district and that it will not adversely affect public safety, the governing body may adopt an ordinance regulating the standing, stopping, or parking of a vehicle at a place described by Subsection (a)(1), other than the road or highway in the state highway system, in the central business district of the municipality as defined in the ordinance. To the extent of any conflict between the ordinance and Subsection (a)(1), the ordinance controls. 545.303. Additional parking regulations. (a) An operator who stops or parks on a twoway roadway shall do so with the righthand wheels of the vehicle parallel to and within 18 inches of the righthand curb or edge of the roadway. (b) An operator who stops or parks on a oneway roadway shall stop or park the vehicle parallel to the curb or edge of the roadway in the direction of authorized traffic movement with the righthand wheels 18 inches of the righthand curb or edge of the roadway or the lefthand wheels within 18 inches of the lefthand curb or edge of the roadway. This subsection does not apply where a local ordinance otherwise regulates stopping or parking on the oneway roadway. (c) A local authority by ordinance may permit angle parking on a roadway. This subsection does not apply to the federal aid or state highway unless the director of the Texas Department of Transportation determines that the roadway is wide enough to permit angle parking without interfering with the free movement of traffic. (d) The Texas Department of Transportation, on a highway under the jurisdiction of the department, may place signs prohibiting or restricting the stopping, standing, or parking of a vehicle on the highway where the director of the Texas Department of Transportation determines that stopping, standing, or parking is dangerous to, or would unduly interfere with, the free movement of traffic on the highway. (e) To the extent of any conflict between Subsection (a) or (b) and a municipal ordinance adopted under Section 545.302(g), the ordinance controls. 545.304. Moving the vehicle of another; unlawful parking. A person may not move a vehicle that is not lawfully under the person’s control: (1) into an area where a vehicle is prohibited under Section 545.302; or (2) away from a curb a distance that is unlawful under Section 545.303.

545.305. Removal of unlawfully stopped vehicle. A peace officer listed under Article 2.12, Code of Criminal Procedure, or a license and weight inspector of the department may remove or require the operator or person in charge of a vehicle to move a vehicle from a if the vehicle: (1) is unattended on a bridge, viaduct, or causeway or in a tube or tunnel and the vehicle is obstructing traffic; (2) is unlawfully parked and blocking the entrance to a private driveway; (3) has been reported as stolen; (4) is identified as having been stolen in a warrant issued on the filing of a complaint; (5) is unattended and the officer has reasonable grounds to believe that the vehicle has been abandoned for longer than 48 hours; (6) is disabled so that the normal operation is impossible or impractical and the owner or person in charge of the vehicle is; (A) incapacitated and unable to provide for the vehicle’s removal or custody; or (B) not in the immediate vicinity of the vehicle; (7) is disabled so that normal operation is impossible or impractical and the owner or person in charge of the vehicle does not designate a particular towing or storage company; (8) is operated by a person an officer arrests for an alleged offense and the officer is required by law to take the person into custody; or (9) is, in the opinion of the officer, a hazard, interferes with a normal function of a government agency, or because of a catastrophe, emergency, or unusual circumstance is imperiled. (b) An officer acting under Subsection (a) may require that the vehicle be taken to: (1) the nearest garage or other place of safety; (2) a garage designated or maintained by the governmental agency that employs the officer; or (3) a position off the paved or main traveled part of the highway. (c) A law enforcement agency other than the department that removes an abandoned vehicle in an unincorporated shall notify the sheriff. (d) The owner of the vehicle that is removed or stored under this section is liable for all reasonable towing and storage fees incurred. (e) In this section: (1) “Towing company” means an individual, corporation, partnership, or other association engaged in the business of towing vehicles on a highway for compensation or with the expectation of compensation for the or storage of the vehicles and includes the owner, operator, employee, or agent of a towing company. (2) “Storage company” means an individual, corporation, partnership, or other association engaged in the business of storing or repairing vehicles for compensation or with the expectation of compensation for the storage or repair of the vehicles and includes the owner, operator, employee, or agent of the storage company. The deed restriction violation reviewed in this issue is “improperly stored materials.” Once again, this is an overview and there could be specific issues that are not covered. For additional information, feel free to contact the Deed Restriction Department at ACMP, Inc. 281-855-9867. The Association regularly cites properties with trash, trash cans, landscape material, toys and any number of items that remain in the front yard or are visible from the street. The minutes of the June member meeting list items Mr. Rothchild of REMAX has stated create good property values. The major issue is curb appeal, which includes not storing items in view from the street. Trash, papers and other items in view from the street are it unsightly but will depress property values. The Association would hope that neighbors are considerate of each other and maintain their properties in a neat, attractive manner. This is the “community” attitude. Unfortunately, some people prefer a more individualistic attitude or just simply don’t care and leave trash and other items in view from the street on a continual basis. While they have a right to their views, the deed restrictions prohibit the storage of trash, refuse or any other material in view from the street. It is fine to have and express views, but the appearance of the subdivision should be a community issue in which everyone is considerate of each other’s property and property values. We truly hope that as homeowners walk throughout the subdivision

“Article IV, Section 13 No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste materials shall not be kept except in sanitary containers constructed of metal, plastic or masonry materials with sanitary covers or lids. All incinerator or other equipment for the storage or disposal of such waste material shall be kept in clean and sanitary condition. Provided, further, that no Lot shall be used for the open storage of any materials whatsoever which storage is visible from the street, except that new building materials used in the construction of improvements erected upon any Lot may be placed upon such Lot at the time construction is commenced and may be maintained …” The Association, its Board of Directors and management company have a responsibility to enforce this deed restriction. The Board believes the enforcement procedure is fair and offers property owners the opportunity to explain any problems regarding storage of material. The management company inspects the subdivision twice a month. If a material of any type is observed the violation is noted on the first citing. If material of any type is observed on a subsequent inspection, a first letter will be sent via first class mail. The first letters states that if there are extenuating circumstances or you believe the letter is in error to contact the management company. Landscape material, construction material and trash cans will be cited unless the owner has called in and informed the Association about the situation and stated an agreeable date the materials will be removed. Since the Association has no way of knowing the exact length of time the material has been stored in view from the street, but has allowed sufficient time to complete improvements, the material must be cited. The Association is attempting to be considerate, the restrictions state that it there be no open storage of materials period. They do not say until the flower bed is constructed or until the dirt is spread in the backyard. The Association wants to work with homeowners. If no communication is received after the property owner receives the first and the material is observed during a subsequent inspection, a second letter will be sent via certified mail. A picture is taken at the time the material(s) is observed during the second inspection. The charges for the certified letter and photo are the responsibility of the property owner in accordance with the Texas Property Code. If the material is still in view from the street and still in violation during the subsequent inspection, it is placed at Board Direction. The material has now been stored on the property for at least six weeks. The Board will inspect the property to observe the violation and will take one of three courses of action.

If the material remains in view from the street, the Association may have the material removed by a contractor. The charges for enforcement of deed restrictions are the responsibility of the property owner, but the Association must pay the expense up front and get reimbursed by the property owner.

The Association could have the attorney send a letter to the property owner requesting removal of the items. There is definitely a charge associated with this avenue of enforcement. If the Board chooses to take the attorney avenue for correction of the violation and the

The restriction was put in place to prevent a cluttered, unsightly appearance in the neighborhood. This in turn would cause property values to decline. violation is not corrected, the next step is a lawsuit. Once this step is taken, legal fees increase rapidly. The Association could send a “President’s“ letter, which is a final appeal from the Association for the violation to be corrected. Once again, the trash, materials or whatever, has now been stored in view from the street for almost six weeks.

The Association does not want to file lawsuits for any deed restriction violations. If homeowners communicate with the Board, they have always worked with the homeowners. The same would apply in this situation. The key issue is communication. The Board will rarely ever file a lawsuit for improper storage of material. It would, however, use a contractor to remove the material if at all possible. The charge associated with the removal will be billed to the property owner.

Homeowners begin receiving their annual assessment and account statement usually between November 15th and November 30th of each year. These statements will list any balances owed to the Association and payment is due by January 1st of the next year, unless the account is being handled by the attorney.

If every homeowner would pay their assessment on time, it would result in fewer expenses and less aggravation for everyone involved. The Board of Directors does not want to foreclose on any property, but has a responsibility to all the homeowners to ensure all fees are paid. It is unfair for other homeowners to bear the burden for homeowners that will not pay their maintenance fee assessment. However, the Board has, on a case by case basis, worked with homeowners unable to afford paying the assessment all at one time. This Board will continue to do so but if there is no communication from the homeowner, the Board has no other option but to proceed with the above collection policy.

In order to increase compliance and spread awareness, our office is requesting your assistance in informing residents in your community through your HOA newsletter or your scheduled HOA meetings of the need to obtain a permit for operating an alarm system, residential or business, within unincorporated Harris County. Many residents and businesses are unaware of the requirement to obtain an alarm permit once an alarm system has been installed and activated by the alarm company. Alarm systems are established and defined in the Local Government Code 233 (subchapter D), as well as the authority to regulate, adopt rules and impose penalties for unpermitted locations. Obtaining the required permit will avoid the issuance of a citation and excessive false alarm fees. The fee for current permit issuance is $35 with a yearly renewal fee of $10. All permit fees are waived for senior citizens 65 years or older. Under current guidelines, a permitted location is allowed five (5) free false alarms annually. Any subsequent false alarms during your permitted year are subject to a $75 fine that is billed to the permit holder’s address. If a site has an active alarm system, yet does not have a permit to operate such alarm, a false alarm may result in a Class C citation, which could range up to $500. Should you or your residents require a copy of the permit application form or would like to review the regulations regarding permit requirements, you may do so by visiting the Harris County Sheriff’s Office website at www.hcso.hctx./net. The application can be printed from the website, then completed and mailed to our office with the applicable fees. We are currently in the planning stages of making the application and payment process available on-line for the convenience to the public. GARDENING TIPS FOR JANUARY • Birds: Provide food and fresh water. More birds die from lack of water than from lack of food. • Cacti: Semi-dormant now. Reduce watering. • Camellias: Plants may be moved. Pick up and discard fallen blooms. • Cultivation: Changes in design may now be made, new beds dug and old ones rebuilt. Correct defects in drainage. Incorporate gypsum into heavy soils: repeat in three weeks. Dig granite dust, rock phosphate and quantities of organic matter into soil. Allow time for settling before planting. • Fertilize: Daylilies, spuria, Louisiana and bearded irises with complete fertilizer. Give strawberries 1 teaspoon ammonium sulfate, keeping six inches away from plant. Fertilize pansies with manure tea or blood meal. Water in. • Fruits: Plant fruit trees. Mulch figs with grass or straw to prevent freeze damage to crown. • House Plants: Water, when surface soil is crumbly dry. Wash dust off leaves to open pores. Mist often. Inspect for diseases and insects. Reduce water for poinsettias. • Lawns: Remove thatch aerate, and feed with low nitrogen mixture. • Pests: For petal blight prevention, spray azaleas and camellias as flowers open. Spray for scale with dormant oil solution if temperature will be above 35˚ and below 85˚ for next 48 hours. Always read and heed manufacturer s directions before spraying. • Propagation: Ivy cuttings root easily this month and next. Root cuttings of shrubs in mixture of loam and coarse sand; keep damp and semi-shaded until rooted. • Prune: Fruit trees in advance of new growth. Prune to groom and shape. Do not remove too much. Remove dead wood from trees and shrubs before spring buds swell, but do not prune spring bloomers. Prune crape myrtles. Prune nandina and others of similar growth habit by cutting unwanted canes out at base of plant. • Roses: Annual pruning about the middle of February, just before the spring buds break. To prevent later appearance of disease in the old beds, keep garden clean of debris and weeds. Complete preparation of new beds for roses.

• Transplanting: January is one of the best months to transplant woody plants, both evergreen and deciduous, especially trees. Energy will be expended on roots instead of foliage. Learn ultimate size and cultural needs of tree or plant before buying. Consider dwarf varieties to avoid crowding later. Group plants of similar cultural needs. Do not work wet soil. Assure good drainage. Keep plants moist. • Vegetables: Prepare beds, preferably raised for drainage, with about 50% humus, including rotted manure. • Winter Protection: Expect freeze any time; plan for protection of tender plants. Water. Remove coverings, particularly plastic, when temperature rises. Protect low plants with dry leaves, pine needles or soil mulch, but remove when weather warms.

Pet Tip: A very important thing you can do is have a collar with some form of ID and your phone number on it. Pet stores have special ID’s for your pets. Many pet owners are now “chipping” the pets. If found and taken to a vet they can scan chip and find the owner. If your pet has a rabies tag, the vet has your name and #. The first thing I ask a caller is “does the pet have ID on it.” If it does, I will help contact the # on the ID and get the pet to it’s owner ASAP. Or, the owner can pick up their lost pet. BOY SCOUTS Boy Scout Troop 61 Young men between the ages of 11-18 are encouraged to visit Boy Scout Troop 61 at 7:00 PM Wednesday nights at Peace Community Church, 5151 Addicks Satsuma Road, Houston, Texas, 77084. They will get a hands-on experience of what Scouting has to offer and have the opportunity to visit with the Scouts and their adult leaders to learn more about the things the troop has done during meetings and activities. CY-FAIR EDUCATIONAL FOUNDATION HONORS MILITARY HEROES The Foundation will kick off its fifth “Salute to Our Heroes” event on February 9, 2013 at the Omni Hotel Westside Houston. “Salute to Our Heroes” honors the brave men and women who have served to preserve our freedom and liberty. Proceeds from this event go to an endowment enabling graduating students from CFISD to attend college. The event will be generously underwritten by Earthcare Management and Kodiak Gas Services, as the Missing Man Underwriters. The Cypress Fairbanks Medical Center Hospital will be the Major General Sponsor.   This year our guest speaker is Steve Russell. LTC Steve Russell (Ret.) commanded the central unit responsible in the hunt and capture of Saddam Hussein. Through leadership and joint efforts across multiple teams, a large organization worked effectively to capture one of the world’s most notorious criminals. Russell is an American Hero. His proven leadership and problemresolution techniques engage audiences through his storytelling.    Salute to Our Heroes has two purposes. First, to give tribute to our heroes - soldiers serving now, veterans and those who have been wounded or killed in action. We want to honor those who have served their country.   The second purpose is to raise funds for scholarships for Cy-Fair ISD students. Each year we give three scholarships per Cy-Fair ISD high school, and the number of high schools is growing. It has been a challenge keeping up with the demand, but CFEF is dedicated to this mission.   The inaugural event honors Jersey Village High School graduate 1st Lt. Jeremy E. Ray, who was killed December 20, 2007 while serving his country in Iraq. A CFEF endowment was established in Jeremy’s memory by an anonymous donor. Last year the 1st Lieutenant Jeremy Ray Community Service and Peace Award was presented to Klein Funeral Homes & Memorials.   Following tradition, the event will have the Missing Man Table & Honors Ceremony. The table will have empty table settings with chairs leaning up against the table as though saved for someone.

The table settings have a single red rose displayed in a vase in reminder of the bloodshed for our country and the vase was tied with a red ribbon - a symbol of the continued pledge to shed blood for our country. A slice of lemon on the bread plate is a reminder of the bitterness of the loss of comrades in arms; a bowl of salt to symbolize the tears shed by family members of lost loved ones and glasses turned upside down indicate no one will sit there. Last year’s ceremony was performed by the 75th Army Division Honor Guard and was proceeded by Taps performed by William Veenstra, Cy-Fair High School Senior. The Heart of Relay: During the Relay for Life event, three ceremonies are held Survivors Lap: To start Relay, those who have survived their battle with cancer join together to walk a lap celebrating their victories over the disease. Fight Back Ceremony: Before participants leave Relay, they make a personal commitment to help fight back against cancer in several ways.
