THE PRESIDENT’S LETTER
(from the Settlers Village HOA Board) Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com . The Board is very interested in any and all feedback. This year the Board experienced the problem we long knew was coming. As the directors began experiencing an assortment of personal issues, things just could not get done. A case in point is the holiday decoration contest. Elected officials are not supposed to rule the residents and handle all facets of life. A democratic society is not designed for that and the majority of Americans are not hard-wired to accept that. Instead, directors are elected to administer rules and regulations that are set in place to make your neighborhood a place that benefits all and handle things that one person cannot. Your Board has done an admirable job handling security, lighting and common area facilities. Directors are unpaid, elected volunteers and volunteers are the essence of the personal side of politics. And hence one sees the problem. Volunteers are not something Settlers Village is known for any longer. Settlers Village is a microcosm of what the United States has been experiencing. If people do not vote, do not get involved, then you can complain all you want (although your right to do so would be a question), but nothing will change and the prospects for improvement are minimal to non-existent. My hope is that everyone takes this little diatribe to heart and really ponders what you can do to make this place better. We have volunteer opportunities we publish, but the Board is always looking for other prospects. One needs to be willing to shepherd a suggestion and not look for someone else to carry the ball.

(Addendum To The Pool Project: Because the conditions for obtaining a loan to replace the pool have deteriorated so badly, the Board is going to look at investing money to extend the pool’s life and explore proceeding with building replacement as the first part of the overall project.) The Board tentatively set the next meeting for Monday, February 6, 2013 at 6:30 PM at the little room by the pool. The Board unanimously agreed to have a meeting on December 7th or 8th to pick the winners of the holiday decorating in the community. The prizes will be $100 for first prize, $50 for second prize and $25 to the third place winner. Municipal Utility District The Board of Directors (“Board”) of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Road, Katy, Harris County, Texas 77449 in accordance with the duly posted notice of said meeting, with a quorum of Directors present, as follows:

Mr. Breard reported that he had instructed PCMI to contact the association to obtain a loan in the amount of $600,000 to expedite the installation of the pool and building. The association’s bank stated the amount most they could loan the association was $240,000. The loan would be amortized over a seven (7) year period at a rate of 6.75% interest. Mr. Breard will obtain the name of another lender and have PCMI contact them and see if they can loan more money at a better rate.

Taylor Goodall, Jr. The meeting was called to order and declared open for such business as might regularly come before it. The minutes of the meeting held on October 15, 2012 were presented, reviewed and approved as presented. Michael Keefe presented a tax assessor/collector’s report. 2012 taxes are 0.5% collected. After further review and discussion, the Board approved the tax assessor/ collector’s report as presented and authorized issuance of the checks listed thereon. The Board also reviewed the bookkeeper’s report and after payment of bills at this meeting, the general fund balance will stand at $403,443.60. The capital projects fund balance is $2,888,243.36. The debt service fund balance is $2,992,339.36. The Board approved the bookkeeper’s report as presented and authorized issuance of the checks listed thereon. The Board reviewed the operator’s report. The District has 2,332 connections. It was requested that the operators provide proposals for televising problems in preliminary sanitary sewer lines and replace blown out lights at the wastewater treatment plant. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting to contest, explain or correct the charges, services or disconnection. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. After discussion, the Board unanimously authorized the District operator to proceed with termination of the utility service pursuant to the provisions of the District’s Rate Order and approved the operator’s report as presented. Jason Johnson and Delea Cooper presented an engineer’s report. Commencement of the 105/165 interconnect is pending agency approvals. The engineers await the City of Houston approval of a variance on the replacement water well to be located at Water Plant #1. The Board also instructed its engineers to produce a cost

Construction of the storm water quality feature at Eagle Ranch detention basin is 100% complete and the operator and engineers continue to work with Layne regarding issues with the arsenic removal system. The District will pursue all options available to it in the event any issues are deemed to be caused by improper installation or design by Layne or the contractor. The board also concurred with Cy-Fair ISD to award Hassel Construction the contract for its utility construction as the lowest bidder.

The Board also approved a renewal of the district’s insurance. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA). All are residents and property owners within the district. The MUD Board can be contacted via their attorney Taylor Goodall of Smith, Murdaugh, Little & Bonham at 713-652-6500. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to cite offenders as more than enough time has passed to allow everyone to become familiar with the new rules. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278 and $297 in 2011. We have collected $306 so far for 2012. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake. While the dollar delinquency translates to the equivalent of 548 delinquent properties, there are actually 151 properties (as opposed to 149 in 2011) in delinquency 3. Property owners need to understand that keeping your yard mowed and trimmed is one of the least expensive methods to maintaining the property values in Settlers Village. And just the same as with maintenance fees, a timely action and response to violations is your obligation as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved.

On Thursday, November 8th, an alert resident in Settlers Village phoned in a suspicious person call to the Harris County Constables Dispatch number. Deputies were dispatched and located the individual who was the subject of the complaint. Officer questioned the young man and noted he had several items in his possession that seemed out of the ordinary, but had to release him as there had been no reports of a burglary or theft with these items listed as missing. That evening, a homeowner called in a burglary and when he presented his list of missing items, the officers recognized a distinctive item of jewelry. The officers went to the young man’s home and were admitted into the house by the father who accompanied the officers to the young man’s room. Officers found a number of items inside the young man’s room including the piece of jewelry and placed that man under arrest. A search of the room found more items which allowed deputies to clear 2 additional area burglaries. The young man had just been recently released from jail where he will making a return engagement.

Anyone 16 years of age and is subject to the county’s curfew and must be off the streets between midnight and 6 AM. Also included are daytime school hours between 8 AM and 2 PM. This applies to home schooled children as well. Officers have instructions to either arrest offenders or take them home to their parents. As always, if you see anything or anyone that looks suspicious or out of place, please call the deputies to investigate at 713-463-6666 or use 911 if it is an emergency. Deputies do not need to come by your house is you feel that might cause problems or endanger your family. Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed.

Best Trash will leave a tag explaining the reasons for non-collection of the item. An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. Best Trash will meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day.
In June 2012, Best Trash became your new trash & recycle collection provider. Your trash service will change to Tuesday and Friday. Your recycle collection day will be Friday. Please have trash and recyclables out to the curb by 7 AM.

Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day.
