WINDSONG COMMUNITY IMPROVEMENT ASSOCIATION December Minute Briefs CALL TO ORDER: : The December meeting of the Board of Directors of the Windsong CIA was held on December 21, 2012. The meeting was called to order at 6:30 PM. Present were Board Members: Dennis Shook, Steve Zunker and Brenda McCullah. Also present were, homeowners/residents, Janet Shook, Cheryl Zunker, Vince McCullah and Steve & Keri Rosen and Cristi Cauthron, SCS Management Services, Inc. The Board reviewed the 2012 accomplishments of the Association. The following items were addressed: 1) The Windsong Trails Recreation Area parking lot was re-constructed. 2) The pool shower was refurbished. 3) A clock was added to the pool building tower above the concession stand. 4) The Holly Forest Recreation Area playground was refurbished with replacement of some of the equipment. 5) The Garden Manor Drive entrance monument was repaired. Also landscape and irrigation replacement was completed. 6) New electrical lines and irrigation were installed along with other general maintenance work completed at the Grand Forest Drive entrance. NEW BUSINESS: The Board discussed 2013 proposed projects for the Association. The following items were addressed: 1) The roof of the clubhouse will be replaced and the air conditioning units also need to be considered for replacement. 2) Picnic tables and benches will be added at the Holly Forest Recreation Area. 3) The tennis courts will be refurbished. 4) Digital electronic signs will be added to the main entrance at the Windsong Trails Recreation Area and to the marquee at the Holly Forest Recreation Area. YOUR 2013 ANNUAL ASSESSMENT RATE Dear Resident: This publication has been prepared as an informational tutorial for homeowners, to supply important information regarding YOUR 2013 ANNUAL ASSESSMENT RATE and contains important information about deed restriction issues that could affect all residents of the subdivision. The following is a summary of questions and answers to issues that are commonly asked. Homeowners/ property owners sometimes find “deed restrictions” and their enforcement confusing. Additionally, they misunderstand or are unfamiliar with their obligations as owners. The Board of Directors for Windsong Community Improvement Association sincerely hope that this publication will serve to guide and assist you in better understanding the benefit and support you receive by the privilege of homeownership in a deed restricted community. Without the support of a homeowners association, property values are more likely to be debilitated by outside factors that cannot be controlled.

WHAT is a “Homeowners Association?” Homeowners associations are non-profit corporations formed to “maintain” a subdivision (community, neighborhood). Because each association is an independent “company,” each is unique in its business operations, governing documents, use restrictions, services offered, rate of assessments, etc. WHAT is an “Assessment?” An assessment is very similar to a tax. It is used to provide services to the community. Taxes are based on property values and provide many services, some that you may or may not be aware of or feel you benefit from. Assessments are assessed on a “per lot” basis according to the needs of the Association for which they are collected and the services provided. Each member must pay his share of the operating expenses of the “corporation.” In Windsong, those services include pool, tennis courts, playgrounds and clubhouse maintenance; management and deed restriction enforcement; landscape and irrigation maintenance for all common areas and entrances; legal; utilities (water & sewer, electricity, gas and telephone); street lights, community events; mosquito fogging, routine corporate expenses such as insurance and property taxes; capital reserves and other miscellaneous services to the residents. As in taxes, whether you “use” the services or not, does not relieve your liability to pay. WHO has to pay the “Assessment?” All members of Windsong Community Improvement Association are assessed at a uniform rate and therefore, obligated to pay. Failure to pay can ultimately result in the loss of your property. The Association’s rights include the “power of sale” (Article VI, Section 7.6) in connection with the lien (the right to foreclose the lien), as well as, other collection procedures. WHO is a “Member?” Every property (lot) owner within the subdivision is a member of the Association, whether or not they chose to be and whether or not, it is referenced in their deed. WHO decides how much I have to pay and what services I get? Your association is governed by three governing documents. The Articles of Incorporation, the By-Laws and the Declarations of Covenants, Conditions and Restrictions, the “Deed Restrictions.” The By-Laws are the rules and regulations that define and regulate the authority of the Board of Directors. The Board of Directors consists of five (5) directors who are elected by the membership. The Board is empowered to operate the business of the Association, which includes, but is not limited to, setting the rate of the assessment. Article VII, Section 7.3 of the deed restrictions provide that the maximum annual assessment may be increased each year not more than 10% above the maximum for the previous year without a vote of the membership and Article VII, Section 7.5 states “Subject to the criteria and limitations set out in Section 7.3, the Board of Directors of the Association shall determine the amount to be levied as the annual assessment.”

The 2013 annual assessment was invoiced in the month of November. If your mortgage company notified SCS Management Services, Inc. of funds available in escrow, bills will be sent to them directly. If you do not receive an invoice, please call SCS at 281-463-1777. The assessment is due on January 1, 2013. A late penalty of 10% is charged to delinquent accounts effective February 1, 2013. Payments go directly to a lockbox at our bank. SCS interfaces daily, via computer, with the bank to record payments. This guarantees maximum efficiency when posting your payment. FLAGS AND FLAPOLES ARCHITECTURAL GUIDELINES FLAGS: This policy is only for the display of the flag of the United States of America; the flag of the State of Texas; and an official or replica flag of any branch of the United States Armed Forces on any property. No disrespect should be shown to the flag of the United States of America. Flags shall be no larger than 3 feet by 5 feet. FLAGPOLES: No more than one building or pole-mounted flagpole not to exceed 20 feet in height will be permitted on any property. Any flagpole attached to a dwelling or a freestanding flagpole must be constructed of permanent, long-lasting materials, with a finish appropriate to the materials used in the construction of the flagpole and harmonious with the dwelling. The display of a flag or the location and construction of the supporting flagpole, shall comply with applicable zoning ordinances, easements and setbacks of record. Flagpoles should be located so as to minimize their impact on neighboring properties. When locating freestanding flagpoles, the size of the property, relationship to adjacent residences, the size of the flag, the height, color and material of the pole shall be considered. CONDITION: A displayed flag and the flagpole on which it is flown shall be maintained in good condition. Any deteriorated flag or deteriorated or structurally unsafe flagpole shall be repaired, replaced or removed. NOISE: Flags shall be displayed in such a manner so as to abate noise caused by an external halyard of a flagpole so as to not be a nuisance, irritant or adversely impact other neighboring property owners.

LIGHTS: Any lighting used to illuminate a displayed flag must not be a nuisance or impact neighboring properties with regard to glare or intensity. Lighting which is part of the original structure may not be altered without prior approval. Proposed replacement or additional fixtures must be compatible in style and scale with the existing property. Exterior lighting shall not be directed outside the owner’s property and should not have an adverse visual impact upon adjoining neighbors. ASSOCIATION PROPERTY: Property Owners may not locate a displayed flag or flagpole on property that is owned or maintained by the Association.
BASKETBALL GOALS ARCHITECTURAL GUIDELINES Please be aware that if you have a basketball goal in street view it must be maintained at all times. Basketball goals are permitted subject to the prior approval of the ACC and the following: * A net shall be maintained on the rim at all times. The net shall be replaced in the event that it becomes frayed or torn. * A rim shall be affixed to the backboard at all times. The rim shall be repaired or, if necessary, replaced in the event that it becomes broken or bent. * The backboard shall be repainted, repaired or replaced in the event that the surface of the backboard becomes chipped or cracked or the backboard becomes warped or unaligned. The backboard shall also be kept clean of mildew or mold. * Basketball goals that are visible from the street shall be attached to the front of the garage or freestanding. * In no event shall a basketball goal be placed at any curb either temporarily or permanently. * The pole and all mounting supports must be maintained in an attractive condition. The pole shall be removed if the basketball goal is no longer functional.

CONTRACT DEPUTY PATROL The Harris County Municipal Utility District #183 has a contract through Harris County for one Deputy from the Sheriff’s Department to patrol the District. The MUD has also hired five part-time off duty police officers to patrol the District as needed. Their jobs are to watch out for suspicious persons and/or activities and report any incidents to the Sheriff’s Department for further action. The Deputy Sheriff and the part-time off duty police officers patrol the Windsong and Windsong Place communities as well as any commercial properties within the District.

Be aware that Law Enforcement can and will ticket vehicles parked too far from the curb, parked the wrong way on the street, parked facing in on a cul-de-sac instead of parallel to the curb or parking too close to a fire hydrant or a traffic sign. We receive many complaints from homeowners about vehicles parked on the street blocking the flow of traffic. The reason for that is because the roads were not designed with a parking lane. There is not enough width to allow for a parking lane. More seriously, when an emergency vehicle is unable to obtain egress and ingress to a street, precious minutes are lost that could mean loss of life/and or property.

Royal Disposal collects our trash. The homeowner’s maintenance fee does not pay for trash pick-up. Residents are billed quarterly in advance on an individual basis. A letter regarding this service was mailed to all residents in January and articles were published for the first few months of 2011 in the “Windsong Whistler.” Information is also published on a monthly basis on the inside back cover. WINDSONG CIA RESIDENT DEED RESTRICTION COMPLAINT FORM
1. First things first‌an Architectural Control Application needs to be completed and submitted to Windsong CIA c/o SCS management Services before any work is started. 2. Include samples of paint, shingles, etc. with the application. 3. Once submitted, SCS Management Services will forward the application to the Architectural Control Committee for review. 4. Wait for a written approval from the ACC before beginning any work.
The Board of Directors receives resident complaint forms on a monthly basis. We thank those who take the time to send them. The forms are reviewed at the monthly Board meetings and then referred to SCS Management Services to process. SCS verifies the report during their next drive-by deed restriction patrol of the community. Many times we receive complaints such as disturbing the peace, animal smells coming from a house or yard, barking dogs, neighbor to neighbor disputes, etc. We want to let you know that the association cannot enforce these types of reports.

Did you know that if you complete any project that does not meet architectural guidelines you are in violation of the deed restrictions? The association has the right to take action to enforce the deed restrictions and request the removal or modification of your improvement. We want you to know before hand so that you do not spend money on improvements that may not be approved. Remember, that the deed restrictions and the architectural guidelines are in place to protect neighborhood harmony and maintain everyone’s property values.

EXTERIOR HOUSE PAINT COLOR SELECTION The WCIA provides many opportunities for the residents to obtain approval for exterior painting prior to commencing the work. Each new resident is mailed a New Resident Welcome Packet that contains among other things a copy of the Architectural Guidelines that is recorded in the real property records of Harris County. Kittens and puppies are being dumped in Subdivisions and shopping strips. They will not find good homes. Most will be taken by the pound or shelter and those are overflowing with pets. They cannot help but have to euthanize some. You, as a responsible pet owner can be of great help by having your cat or dog spayed or neutered and not worry about finding homes for the offspring. You will have a healthier and happy pet.
It is also important that you turn on your garage/driveway lights at night. Encourage your neighbors to do so also. Effective home lighting can be an effective deterrent to crime.

A comedy about the family vacations you’d like to forget! Houston Family Arts Center announces auditions for its Main Stage production of Leaving Iowa written by Tim Clue and Spike Manton. An annual trek to Civil War Battlefields would be excruciating enough for young Don without the wrong turns and awful roadside attractions. But as an adult, Don takes a more understanding view of both those vacations and his father. This folksy and nostalgic comedy about family vacations will delight anyone who’s ever sat in a car for more than an hour. EASY VEGAN VALENTINE SUGAR COOKIE RECIPE! As a vegetarian, it’s difficult to find sweets that are eggless and also dairy-free. But it’s not impossible! Be sure to surprise your valentine with this super easy and vegan sugar cookie recipe: • 1 cup plain white flour • 1/2 cup or slightly less granulated sugar • 1/2 cup SmartBalance or soy butter • 1 tsp. baking powder • 1 tsp. vanilla extract Directions 1. Pre-heat the oven to 345 degrees. 2. Cream the butter and sugar in a large bowl using a spatula or an electric whisk until it is fluffy. Stir in the vanilla extract and thoroughly mix. 3. In a separate bowl, combine the flour and baking powder. 4. Add the flour to the creamed butter and mix until a soft dough is formed. 5. Shape into a log and wrap in cling film or foil and refrigerate for an hour or overnight. 6. Tear off small amounts of dough and shape into balls spacing them well apart on a baking sheet, as they will spread in the oven. 7. Bake for 15-20 minutes depending on your oven. Ease them off using a palate knife - they will be a little soft still but that is fine. 8. Allow them to cool on a rack for at least an hour. Store in an airtight container for up to a week.

Northwest Flyers Youth Track Club Registration for Middle and High School Athletes The Northwest Flyers Youth Track Club is registering athletes for the 2013 summer track season. Elementary students up to 6th grade should register during February and the first week of March. Middle and high school athletes can also register, but should compete after their school season is over. The non-profit, 501(c)(3) club is affiliated with USA Track & Field (USATF) and provides a full program of sanctioned “track” events such as sprints, hurdles, middle distance, distance and relays and sanctioned “field” events such as long jump, triple jump, high jump, pole vault, shot put, discus and javelin. Registration for Fun, Fair, Positive Soccer (FFPS) is open for boys and girls ages 4 to 18 for the Spring Season. Games start on April 13, 2013. FFPS is a non-profit youth soccer program dedicated to providing a positive youth sports experience for all children. Founded in 1986 in Katy, Texas, FFPS has grown to 22 leagues and 15,000 players throughout the Greater Houston area. FFPS offers children a fun and fair experience, including one practice per week, a full uniform and trophy for every player, equal playing time and play every position, co-ed/balanced teams, positive coaching and more. No tryouts are required. Online Registration schedule and fees (sign up early and save): Thru March 8th: $99 March 9th to March 18th: $104 March 19th and After: $109 Go to www.FFPS.org to sign up. CFISD’s program has been identified statewide as a best practice to help homeless students achieve academically, emotionally and socially. Cy-Lakes EASE counselor Kim Childress was a presenter and she described her role in developing the initial relationship with CFISD homeless students. As one of the “guardian angels” which Dave Schrant, homeless liaison, calls the EASE counselors, Ms. Childress works with her team to provide services to more than 1,000 homeless students in CFISD. After the presentation in Albuquerque, the CFISD homeless team received accolades from homeless liaisons, counselors and state counselors throughout the nation.

CY-LAKES STUDENT VIDHA DIXIT AWARDED TIER ONE SCHOLARSHIP FROM UNIVERSITY OF HOUSTON Vidha Dixit, Cy-Lakes High School senior, was recently awarded a Tier One Scholarship from the University of Houston. She was surprised that the award was not sent to her in a traditional letter, but was bound into a personalized hardcover book. Being one of the newest Tier One universities in Texas, the University of Houston offers a campus recognized for cultural and academic diversity. Vidha’s scholarship package includes opportunities to work with mentors on realworld projects that showcase her research both locally and nationally, as well as the opportunity to study abroad in any one of 27 countries. The scholarship package, including four years of tuition through the Honors College, is worth approximately $58,450. Vidha states, “The Tier One scholarship will enable me to accomplish my goals of receiving a college degree and studying political science by providing me with an unparalleled education at a leading public research university.”

Celebrate Mardi Gras!
Translated from the French, Mardi Gras means “Fat Tuesday.” In short, it’s the last day before the traditional Catholic Lenten fasting season leading up to Easter Sunday. For those cities that celebrate it - most famously New Orleans, Louisiana - Mardi Gras means feasts, multiple parades, elaborate costumes and parties. Mardi Gras Origin Some scholars trace Mardi Gras’ roots to the ancient Roman Lupercalia festival, which was held in mid-February. Like many other pagan holidays, early Church leaders incorporated elements of the celebration into the new faith rather than risk alienating converted followers. As Catholicism spread across Europe, so did the Mardi Gras celebration. Mardi Gras Comes to America By the Middle Ages, Mardi Gras or “Carnival,” had become a major holiday in France and early French explorers brought the tradition to the New World when establishing settlements in their explorations of the Mississippi River. With its strong French roots, New Orleans naturally evolved into one of the premier Mardi Gras destinations in the world. Mardi Gras: The Religious roots The Mardi Gras kicks off on the Epiphany, twelve days after Christmas on January 6th, also known as Twelfth Night or Three Kings Day, celebrating the arrival of the three wise men and their gifts to the baby Jesus. The season ends promptly at midnight on Fat Tuesday, the day before Ash Wednesday, the beginning of Lent. What’s in a name: Eating a calf The name “Fat Tuesday” comes from the tradition of eating a slaughtered calf on the final day of Carnival. These days, though, that definition has expanded to include feasting on pretty much any rich fatty food. Mardi Gras Around the world Mardi Gras or Carnival is celebrated in many cities around the world besides New Orleans, including Montreal, Quebec, Canada; Nice, France and Rio de Janeiro, Brazil. But many small towns and municipalities celebrate Mardi Gras as well, including the tiny community of Rubonia, Florida. The Universal Studios Florida theme park also throws a Mardi Gras celebration on weeknights from February to April, featuring parades and concerts by national acts.

Windsong Community Improvement Association handles the financial and legal affairs of the subdivision. Each lot owner is required to pay an annual maintenance fee which is used to pay street lights; taxes on and maintenance the common areas, such as the swimming pool, tennis courts, clubhouse, playgrounds, and entrances.; contract deputy patrols; and legal expenses incurred to enforce the deed restrictions, etc. The Board meets the 4th Thursday of each month at 7:00 PM in the meeting room at the Windsong Community Clubhouse. Residents are welcome to attend. Anyone wishing to place an item on the agenda should call SCS Management Services, Inc. at 281-463-1777 at least 5 days in advance.. The Annual Meeting of Members is held on the 1st Thursday in May. Board Members hold three year staggered terms and are elected. The election process is as follows: 1) Voting by proxy. Mail in proxies will be mailed with the Annual Meeting Notice. 2) Voting in person will be by attendance at the Annual Meeting.

DEED RESTRICTIONS
Deed restrictions are strictly enforced by Windsong Community Improvement Association. Copies of the restrictions are available upon request by mail. Please call 281-463-1777. Complaint forms are included in every “Windsong Whistler” for your convenience. The association’s office verifies complaints and writes letters to violators. WCIA will initiate legal action when warranted, to enforce the deed restrictions.
ARCHITECTURAL CONTROL
You MUST submit any plans for improvements or modifications of your home to Windsong CIA for review. Your plans will be checked to insure that they comply with the deed restrictions. This includes re-roofing, play forts (8 ft limit), temporary storage buildings, etc. Please call SCS Management 281-463-1777 to obtain the necessary form. You may also access www.scs.mgmt.com
TRASH COLLECTION ROYAL DISPOSAL. Royal Disposal collects our trash. The homeowner’s maintenance fee does not pay for trash pick-up. Residents are billed quarterly in advance on an individual basis. You must call Royal Disposal to start service at 713-526-1536. 1. Trash pick-up days are Tuesdays and Fridays between 7:00 AM and 6:00 PM. 2. Curbside pick-up for each home for a maximum of 6 cans per day. 3. All tree branches less than 3 inches in diameter and shrub trimmings should be cut in four feet lengths and bundled. 4. No pick-up is schedule on New Year’s Day; Memorial Day; Independence Day; Labor Day; Thanksgiving Day; and Christmas Day. Pick-up will resume the next regularly schedule day. 5. Heavy trash pick-up is scheduled every Friday. 6. Excluded items include, but are not limited to, acids; batteries; car parts; car tires; chemicals; construction trash (to include concrete, large quantities or rolls of carpeting, fencing, construction material and debris); dirt; garage door openers; hazardous or toxic or radioactive waste; large pieces of glass (must be broken and placed in cardboard box and weigh less than 40 pounds); human or animal fecal waste; large sofas and sleepers and furniture with metal frames; metal items; paint; petroleum products or filers; refrigerators (if Freon is not removed and refrigerator tagged); rocks; sand. Resident may call Customer Service at 713-526-1536 and arrange for items to be picked up at a negotiated price. WATER DISTRICT
