March 2013 THE PRESIDENT’S LETTER

(from the Settlers Village HOA Board) Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com . The Board is very interested in any and all feedback. A Board of Directors meeting was held February 6, 2013, 6:30 PM at the little room by the Pool, 6700 Settlers Village Drive, Katy TX 77449. Board Members in attendance were Kim Rogers, Kathy Cones, Steve Breard and Tulibelle Igartua-Martinez. Representing Planned Community Management (PCMI) was Dolores Sue. With a quorum present, President Rogers called the meeting to order at 6:30 PM. There were two homeowners present. One of the residents stated that there was a light out on the sign to the playground and one at the playground area. One resident wanted to get more involved and have more subdivision participation and events. The Board stated they would love to have volunteers and community events and encouraged her to have her neighbor’s come to the meetings and sign up to volunteer for various events. She also stated the Christmas Judging contest was not done appropriately as residents were given a date and the date that the actual judging was done was not the date that was published. She wanted to know the plans for next year to make sure everyone knew the date and time for the holiday light judging. Further, she thought the date that was chosen was too early in December.

The Board stated this year they will strive to set a date and keep to the date that is chosen. This resident also stated she had sent in a question via the website and did not receive a response. The Board apologized as they thought they had answered all of the notices sent through the website. This resident also stated the date of the meeting in the newsletter was correct however it said Monday, February 6, 2013 and she would like someone to proof the articles before being placed in the newsletter. The minutes of the meeting held November 5, 2013 were reviewed. A motion was made, seconded and unanimously agreed to accept the minutes as written. The Board reviewed the financial statement as of December 31, 2012. The Marquis Sign at FM 529 Entrance has been installed. The Board reviewed a proposal on installing just the recreational building. The cost was $297,750 and that included the demolition of the old building and all sales tax. After due discussion, the Board unanimously agreed to set an appointment with the original construction company, Hansen and Sons, who originally prepared all the drawings for the community. The Board agreed that they would like to meet this construction company February 19th, 20th or 21st . PCMI was instructed to contact Mr. Hansen to arrange the meeting. The Board reviewed the 2013 mosquito spraying contract. The cost was the same as last year $65 plus tax per trip. A motion was

made, seconded and unanimously agreed to accept the proposal. The Board reviewed a proposal from A-Gleam on replacing the footboard for a cost $832.33. A motion was made, seconded and unanimously agreed to accept the proposal. The Board instructed PCMI to contact A-Gleam and inform them they did have approval on installing the footboard, but they must clean the pool room and the storage room to community standards. The Board discussed the implementation of yard of the month, beginning March and ending in August. First place will receive a $25 gift card and a sign for the yard. Honorable mention will receive a sign representing their nice yard. The Board instructed PCMI to contact the landscaping company and have them install flowers at both the FM 529 entrance and Fry Road. They want a lot of flowers installed so that it looks very full. Further, the Board instructed PCMI to ask the landscaper to trim the shrubs at the Fry Road entrance as they are too tall and they want them much shorter. The Board’s next meeting was scheduled of April 11, 2013 at 6:30 PM at the little room by the pool. The Board will post signs for the next meeting. All business being concluded, the meeting adjourned at 8:15 PM. Miller and G. Taylor Goodall, Jr. The meeting was called to order and declared open for such business as might regularly come before it. The minutes of the meeting held in December 2012 were presented, reviewed and approved as presented. Michael Keefe presented a tax assessor/collector’s report. 2012 taxes are 68.7% collected. After further review and discussion, the Board approved the tax assessor/ collector’s report as presented and authorized issuance of the checks listed thereon. The Board also reviewed the bookkeeper’s report and after payment of bills at this meeting, the general fund balance will stand at $564,087.15. The capital projects fund balance is $2,887,073.26. The debt service fund balance is $3,977,995.68. The Board approved the bookkeeper’s report as presented and authorized issuance of the checks listed thereon. The Board reviewed the operator’s report. The District has 2,348 connections. Television inspection has been completed of the sanitary line running along Settlers Valley and repairs to clear roots and grease infiltration have been approved. The Board will next to moving towards inspection of the Carmel Valley lines. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting to contest, explain or correct the charges, services or disconnection. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. After discussion, the Board unanimously authorized the District operator to proceed with termination of the utility service pursuant to the provisions of the District’s Rate Order and approved the operator’s report as presented. Jason Johnson and Delea Cooper presented an engineer’s report. The Board has been advised that the Water Well site will require expansion for drilling to be permissible. This would necessitate the purchase of land from Cy-Fair’s Walker Elementary School site. The plant’s facilities are needed for the eventual connection to surface water, so the Board will be weighing the option of building an entirely new water supply facility in the far western portion of the district

rather than spending money for a well in the area where we had radiation issues at one point. Because surface water supplies are still slated for 10 years from now, the District will have to move forward to develop its own water supplies. Water well # 3 located behind the Fry Road Kroger is about 30% complete. The Board is still awaiting a report from the engineers regarding the iron bacteria problem at ‘Water Plant No. 2. Testing of additional equipment to remove the iron is showing promise. Jasmine Heights is moving forward with the limited extension of West Little York further to the west and has begun clearing land to develop its Section 5. Contractors have also moved onsite of the future Cy-Fair campus on FM 529 to begin utility extensions there. All work on the districts various flood control facilities has been completed. Developers have begun looking closely at the land directly west of Settlers Village with an eye to beginning development there sometime this year. More details will be given as the information is received. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA). All are residents and property owners within the district. The MUD Board can be contacted via their attorney Taylor Goodall of Smith, Murdaugh, Little & Bonham at 713-652-6500. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to cite offenders as more than enough time has passed to allow everyone to become familiar with the new rules. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278 and $297 in 2011. We have collected $306 so far for 2012. Please rinse and bag the cans to minimize the attraction to bugs. They can be dropped at 6642 Cove Lake.

Juan Hernandez(19) was killed in the shooting, which happened about 12:45 PM in the 20900 block of Carmel Valley where Settlers Village borders with Highland Creek Estates, according to the Harris County Sheriff’s Office. Deputies were told Hernandez was outside on the sidewalk on his way home after walking his brother to school when a suspect shot him once. Hernandez was rushed to North Cypress Medical Center, where he was pronounced dead. Deputies said the gunman ran away after the shooting. He was described only as wearing a gray, hooded sweatshirt and blue jeans. Deputies did not release a possible motive in the case. In June 2012, Best Trash became your new trash & recycle collection provider. Your trash service will change to Tuesday and Friday. Your recycle collection day will be Friday. Please have trash and recyclables out to the curb by 7 AM. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment. Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. By Federal Law, refrigerators, freezers or any other item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for non-collection of the item. An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. Best Trash will meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. MESSAGE FROM THE SUPERINTENDANT

Dear Parents and Community Members: The journey toward an equitable state funding system took a positive turn on February 4th when a Texas judge ruled the current system unconstitutional. District Judge John Dietz ruled in favor of the more than 600 Texas school districts - including Cypress-Fairbanks ISD - that filed a lawsuit against the state last year. In a statement regarding the ruling, Judge Dietz echoed many of the same comments he made while ruling the state funding system unconstitutional in 2005. He also voiced the same confusion for school finance that I and countless other educators, have felt for many years: “I have to say, there are 26 million Texans and I doubt there are 26 people in this state who understand this system,” he said. Judge Dietz also declared that “there has never been a more expeditious trial of a school finance case anywhere in the United States,” cementing my belief that this was the only logical decision to be made during this 44-day trial. I applaud Judge Dietz, the four plaintiff teams that defended the school districts’ case and the dozens of superintendents and school funding authorities who provided critical testimony in reaching this key decision. The final, written order in the case is expected to be delivered in early March, at which point the state has pledged to appeal the ruling to the Texas Supreme Court. Although there will be more obstacles before an agreeable solution is reached, we look forward to working with legislators and other state leaders as we plot the path toward equitable school finance. CY-HOPE GRANTS BENEFIT CFISD MUSIC PROGRAMS

A pair of grants from district supporter Cy-Hope, totaling $11,000, will benefit music programs at CFISD schools. One of the donations, in the amount of $10,000, will impact music programs at 18 elementary and six secondary campuses with 60 percent or more of students qualifying for free or reduced-price meals. The other $1,000 grant will fund the CFISD Choral Festival in the spring. For the organization’s support of CFISD music programs, the Board of Trustees recognized Cy-Hope representatives Lynda Zelenka, executive director and Dr. Betty Devine, during the Feb. 11th regular Board meeting at the Instructional Support Center (10300 Jones Road) at 6 PM.

According to Zelenka, the donation came about when Dr. Devine - the founder and artistic director for the Houston Choral Society expressed a desire to give back to Cy-Hope through her passion for music. “Music crosses all generations and all demographics. It’s a blessing for us to be able to fill a gap and make the community aware of some of these needs in Title I schools.”

Cy-Hope provided an additional $1,000 grant to fund reinstatement of the district wide Choral Festival for fifth-grade students, last held in 2006. The upcoming event will be held April 11th at the Berry Center. “Our teachers and students are very excited to bring back this great tradition,” said Loretta Bourn, coordinator for elementary music. “It’s a special opportunity for 340 voices to come together to sing at the Berry Center.” The $10,000 donation is anticipated to benefit 16,564 elementary and 1,100 secondary students. A variety of needs will be addressed, including Texas Music Educators Association (TMEA) registration assistance, music equipment for classrooms and additional master classes for secondary campuses.

The Northwest Flyers Track Club will host an orientation/registration session for all middle and high school athletes and their parents interested in joining for the 2013 season. FFPS is a non-profit youth soccer program dedicated to providing a positive youth sports experience for all children. Founded in 1986 in Katy, Texas, FFPS has grown to 22 leagues and 15,000 players throughout the Greater Houston area. FFPS offers children a fun and fair experience, including one practice per week, a full uniform and trophy for every player, equal playing time and play every position, co-ed/balanced teams, positive coaching and more.
