GLENCAIRN MEMBER MEETING The Glencairn Community Association Monthly Member meeting will be on the second Tuesday of the month (June 11, 2013). The meeting will commence at 7:30 PM at the Glencairn Civic Center.

MONTHLY MEETING OF THE MEMBERS MAY 14, 2013 Pursuant to Article V, Section 3 of the restated and amended by-laws of the Glencairn Community Improvement Association the Regular Monthly Meeting of the Members was duly called and held on May 14, 2013, 8:09 PM, at 17030 Kieth Harrow Blvd, Houston TX 77084. IN ATTENDANCE Directors Anderson, Coy, Hill, Jones, Mendieta and Quick were in attendance. Management representative Johannes Lonaker and homeowners listed on the sign in register were also in attendance. MEETING MINUTES The March 12, 2013 minutes were approved as presented in the Chatter.
COMMITTEE REPORTS HIGHWAY 6 GREEN MEDIANS PROJECT Director Anderson stated that medians will be installed and made green where available on Hwy. 6 from West Little York to Pine Forest. If support from the local businesses and the utility districts cannot be obtained, the medians will be solid concrete rather than landscaped. POOLS Director Mendieta advised the residents that the pool building is finished and the decking around the clubhouse will be finished this week. OPEN FORUM The Board of Directors inquired if residents from the floor had any issues to discuss with the Board regarding the community. A resident asked the Board if the utility district will be acquiring surface land in addition to their easement request to install a new water line. The Board advised that the utility district will not be seeking surface land. They will need the easement to bury the water line. Several residents stated that there is a group home on Bagpipe. The Board will look into who to contact to determine what type of group home it is and whether it is licensed through the State of Texas. A resident stated that residents from the apartment complex are jumping the wall on Haggis and have pulled several boards from the backyard fence of the empty property on Royal Mile. The Board will look into this matter.

The Board advised the residents present to contact the owner of the vacant lot next to the Hindu Temple every time the lot needs to be mowed. The more residents calling, the likelier the lot will be mowed by the owner. If this does not prompt action by the owner, then residents should call Harris County Public Health and Environmental Services at 713-274-6300 or file complaints online at www.hcphes.org. Director Anderson advised residents that there will be a pool party on June 8, 2013 from 4:00 PM to 8:00 PM. This party is open to all residents who have a current pool tag. There will be a concession stand run by the swim team and other activities. CHIROPRACTIC HEALTH and WELLNESS CENTER GLENCAIRN CRIME WATCH A DIFFERENT APPROACH TO LAW ENFORCEMENT IN GLENCAIRN The Glencairn subdivision has three contracts with the Harris County Sheriff’s Office, which include one deputy per shift who uses a marked vehicle; their shifts are staggered to provide maximum coverage for the subdivision. A marked vehicle is one, which has overhead lights, siren and signage on the car signifying that it is a Sheriff’s Office vehicle. The contracts are doing a great job and their commitment to Glencairn is excellent. However, the contracts lack the crucial flexibility, which we need in order to stay ahead of the rapid momentum of crime, criminals, sudden trends, etc. This is why we have chosen to utilize the professional services of Harris County Sheriff’s Deputies who are off-duty and driving non-marked vehicles. These deputies work shorter hours than normal eight-hour shifts. Further, these deputies are chosen for their ability to spot problems and document issues, as well as make arrests and deter criminals. The deputies are in uniform and they are selected for the particular needs of our subdivision. Obviously our contracts have gaps in service, which are unavoidable; two days off each week for each contract adds up to 48 hours of potential opportunities for the criminal element. In addition, deputies take vacations, use comp time, sick leave and have training while on duty. That is part of the package when we use the contract deputy program. However, the Supplemental Law Enforcement Program does not take days off. Multiple deputies are available for the time 4
slots, which are selected by TCLEOSE certified team chief in conjunction with feedback from the citizens and our contract coordinator, Patty Hill. If a deputy working a particular time slot goes on vacation, another deputy covers the time slot. These deputies are paid only for the time that they work. Additionally, the times when our Supplemental Deputies work are flexible and can be varied with a two hour notice. A sudden increase in burglaries or gang activity will warrant creative placement of these Supplemental Deputies into time slots, which answer the needs of that unique problem. Further, hours can be extended when necessary for these Supplemental Deputies. The program is being completely outlined and planned by the Chief of the Supplemental Law Enforcement Program and our security coordinator. Your on-going feedback about incidents, trends, etc., that you are seeing will help to fine-tune the scheduling of these deputies throughout the year. Crime and the criminal element are fast moving, ever-changing targets. While you may not see these deputies, they will be here at odd hours, late night hours, special shifts and whenever they are needed to nip crime and criminals in the bud before any issue gets out of hand. In the past, Glencairn has used Supplemental Deputies in addition to our contract. While we stopped doing this several years ago, the need has become obvious and we are returning to this tried and true program with the improvement of accountability statistics, trend analysis and professional management. The deed restriction violation reviewed in this issue is “improperly stored materials.” Once again, this is an overview and there could be specific issues that are not covered. For additional information, feel free to contact the Deed Restriction Department at ACMP, Inc. , 281-855-9867. The Association regularly cites properties with trash, trash cans, landscape material, toys and any number of items that remain in the front yard or are visible from the street. In previous minutes of the member meeting list items, Mr. Rothchild of REMAX has stated create good property values. The major issue is curb appeal, which includes not storing items in view from the street. Trash, papers and other items in view from the street are it unsightly but will depress property values. The Association would hope that neighbors are considerate of each other and maintain their properties in a neat, attractive manner. This is the “community” attitude. Unfortunately, some people prefer a more individualistic attitude or just simply don’t care and leave trash and other items in view from the street on a continual basis. While they have a right to their views, the deed restrictions prohibit the storage of trash, refuse or

any other material in view from the street. It is fine to have and express views but the appearance of the subdivision should be a community issue in which everyone is considerate of each other’s property and property values. We truly hope that as homeowners walk throughout the subdivision and see random trash blowing or laying around, they will pick it up. It only takes one person to start making a difference. That one person could be you. However, for properties where items are stored in view from the street on a continual basis, the Association must enforce the deed restrictions to preclude this storage. Every section of Glencairn Community Improvement Association, Inc. has a restriction regarding improper storage of material or storage and disposal of garbage and refuse. The restriction regarding storage of materials was, once again, not something the Board instituted but put in place by the Developer. The restriction was put in place to prevent a cluttered, unsightly appearance in the neighborhood. This in turn would cause property values to decline. Most sections of Glencairn C.I.A., Inc. have the following restriction regarding improperly stored material. Article IV, Section 13 No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste materials shall not be kept except in sanitary containers constructed of metal, plastic or masonry materials with sanitary covers or lids. All incinerator or other equipment for the storage or disposal of such waste material shall be kept in clean and sanitary condition. Provided, further, that no Lot shall be used for the open storage of any materials whatsoever which storage is visible from the street, except that new building materials used in the construction of improvements erected upon any Lot may be placed upon such Lot at the time construction is commenced and may be maintained …” The Association, its Board of Directors and management company have a responsibility to enforce this deed restriction. The Board believes the enforcement procedure is fair and offers property owners the opportunity to explain any problems regarding storage of material. The management company inspects the subdivision twice a month. If a material of any type is observed, the violation is noted on the first citing. If material of any type is observed on a subsequent inspection, a first letter will be sent via first class mail. The first letters states that if there are extenuating circumstances or you believe the letter is in error to contact the management company. Landscape material, construction material and trash cans will be cited unless the owner has called in and informed the Association about the situation and stated an agreeable date the materials will be removed. Since the Association has no way of knowing the exact length of time the material has been stored in view from the street, but has allowed sufficient time to complete improvements, the material must be cited. The Association is attempting to be considerate, the restrictions state that it there be no open storage of materials period. They do not say until the flower bed is constructed or until the dirt is spread in the backyard. The Association wants to work with homeowners. If no communication is received after the property owner receives the first and the material is observed during a subsequent inspection, a second letter will be sent via certified mail. A picture is taken at the time the material(s) is observed during

lawsuits for any deed restriction violations. If homeowners communicate with the Board, they have always worked with the homeowners. The same would apply in this situation. The key issue is communication. The Board will rarely ever file a lawsuit for improper storage of material. It would, however, use a contractor to remove the material if at all possible. The charge associated with the removal will be billed to the property owner.
If the material remains in view from the street, the Association may have the material removed by a contractor. The charges for enforcement of deed restrictions are the responsibility of the property owner, but the Association must pay the expense up front and get reimbursed by the property owner.

the second inspection. The charges for the certified letter and photo are the responsibility of the property owner in accordance with the Texas Property Code. If the material is still in view from the street and still in violation during the subsequent inspection, it is placed at Board Direction. The material has now been stored on the property for at least six weeks. The Board will inspect the property to observe the violation and will take one of three courses of action.
The Association could have the attorney send a letter to the property owner requesting removal of the items. There is definitely a charge associated with this avenue of enforcement. If the Board chooses to take the attorney avenue for correction of the violation and the violation is not corrected, the next step is a lawsuit. Once this step is taken, legal fees increase rapidly. The Association could send a “President’s” letter, which is a final appeal from the Association for the violation to be corrected. In order to increase compliance and spread awareness, our office is requesting your assistance in informing residents in your community through your HOA newsletter or your scheduled HOA meetings of the need to obtain a permit for operating an alarm system, residential or business, within unincorporated Harris County. Many residents and businesses are unaware of the requirement to obtain an alarm permit once an alarm system has been installed and activated by the alarm company. Alarm systems are established and defined in the Local Government Code 233 (subchapter D), as well as the author-

ity to regulate, adopt rules and impose penalties for unpermitted locations. Obtaining the required permit will avoid the issuance of a citation and excessive false alarm fees. The fee for current permit issuance is $35 with a yearly renewal fee of $10. All permit fees are waived for senior citizens 65 years or older. Under current guidelines, a permitted location is allowed five (5) free false alarms annually. Any subsequent false alarms during your permitted year are subject to a $75 fine that is billed to the permit holder’s address. If a site has an active alarm system, yet does not have a permit to operate such alarm, a false alarm may result in a Class C citation, which could range up to $500. Should you or your residents require a copy of the permit application form or would like to review the regulations regarding permit requirements, you may do so by visiting the Harris County Sheriff’s Office website at www.hcso.hctx./ net. The application can be printed from the website, then completed and mailed to our office with the applicable fees. We are currently in the planning stages of making the application and payment process available on-line for the convenience to the public. We encourage you to plan ahead because the Architectural Control Committee has up to thirty (30) days to approve the form once your request is received by the managing agent. The Architectural Control Committee (ACC) is unique and important function. Its main purpose is to ensure that all changes are harmonious with the surrounding neighborhood and to assist in maintaining property vales. They are volunteers and go about fulfilling their function by ensuring all changes are structurally sound, attractive and harmonious with the neighborhood. The Association has color guidelines that have been set by the Architectural Control Committee and approved by the Board of Directors. These guidelines are comprised of earth-tone and neutral colors. Bright colors will not be approved. If your house is already painted with an unapproved color, then it must be changed the next time it needs painting. However, if you paint it an unapproved color and then submit a change request form, either voluntarily or because you have been cited as being in violation, you will need to repaint the house immediately. Each year the four year olds through the eighth grade students at Texas Christian School become published authors! Students collaborated to write and illustrate their very own hardbound books. The students of Texas Christian School are celebrating the publication of their books in a big way. While writing their books, the students learned that hard work really does pays off and that writing is a lot of work. Students went through the entire process from first rough draft, many revisions and finally the publication process where they now own their very own book as the author. Texas Christian’s writing program is designed to motivate students to learn through publishing by enabling students to write, illustrate and publish full-color, hardbound books that they will enjoy for years. Elisa Kendall, Afton Otwell and Bao Truong qualified to play in the TAPPS State Tennis Competition on April 24th – 25th in Waco, TX. Elisa Kendall won the 1A State Title, while Afton Otwell and Bao Truong tied for 5th place in each of their divisions. The combined points earned by Elisa and Afton allowed Texas Christian High School to place 3rd over all in the 1A Girls Division. TCS could not be more proud of the team’s accomplishment! CY LAKES SCIENCE TEACHER MAKES A “SPLASH” IN THE DISTRICT Nick Wright, who teaches Biology and Environmental Science at Cy-Lakes High School, has more than just a talent for science. Originally from Michigan, Nick has been swimming since he was a young child. At the age of nine he started swimming competitively and this continued throughout his junior year in college. Now Nick uses his swimming talent to teach lessons to children enrolled in the Splash Program, a swim program offered by Cy-Fair ISD. Nick says, “I really enjoy teaching people how to swim. It is very rewarding to help someone who can’t swim on their own learn how to be independent in the water.”

MEN’S OUTWARD FLAG FOOTBALL: Come join men 18 yrs and older for our men’s Outward Flag Football league coming this fall. Practice/Games will be on Saturday afternoons around 2:00 PM. The league will have a tournament at the conclusion of the season. Evaluations for all players will be Tuesday and Thursday, September 10th and 12th from 6:00-7:00 PM and Saturday, September 14th from 11:00 AM-12:00 PM.
