THE PRESIDENT’S LETTER

(from the Settlers Village HOA Board) Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com. The Board is very interested in any and all feedback. In the past, I have liked to contribute little snippets of my life and thought I would share this one with you all to alleviate the tedious stream of neighborhood reports. May 11th will have passed by the time we publish next time. On that date, I again had to come to grips that my little girl not actually being a little girl anymore. Those of you who have been around for a while either know directly of my eldest daughter’s exploits or have gotten to read about some of them here. As I write about this, May 11th is still 2 days away. Over the last months, we have been through a whirlwind of venues, dresses, family contacts and the various “stuff” that makes up a wedding. She has friends and friends of friends contributing time to make invitations, cake and party “thingies” (I don’t know what they are for). And the cost… oh dear lord… the cost. Yes, I know in my head that weddings are phenomenal money pits, but in my heart I cringe at each passing dollar. And my goal at this wedding is the same as at my own, to show up. But I have already gotten to see my daughter in her wedding dress and there does not seem to anything to stop the catch in my throat. Her husband to be is a fine young man just getting going in the world, just as I used to be. And my daughter is definitely not a little girl anymore, I now accept (sort of) that she is full grown woman and will, in the future at some point, have a family of her own. And it is both fun and nostalgic to watch the two of them building their home in an apartment that is only a stepping stone to another place. By the way, my daughter is having an outdoor wedding and wouldn’t you know it, weather is not supposed to be good. That will be interesting to see the will of nature collide with the will of my daughter. We shall see.

Municipal Utility District The Board of Directors (“Board”) of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Road, Katy, Harris County, Texas 77449 on March 18, 2013. Directors present, as follows: Steve Breard, President Charles LaConti, Vice President Kathy Cones, Secretary Stanley Craig, Assistant Vice President Pamela Brandenburg, Assistant Secretary Also present were Gary Hastings, Greg Dubiel, Robert Moorman, Michael Keefe, Jason Johnson, Delea Cooper, Perry Miller, Jack Baber, Brian Krueger, members of the public and G. Taylor Goodall, Jr. The meeting was called to order and declared open for such business as might regularly come before it. The Board considered the minutes of the meeting held on February 18, 2013 and approved the minutes as presented. The Board opened the floor for public comments. Richard Zerweck, President of Lakeville HOA, expressed concerns regarding security in the Lakeville area. After a lengthy discussion, President Breard assured Mr. Zerweck and the other Lakeville residents present that he would take the residents’ concerns, which include street parking issues and the adequacy of patrols, to the constables. President Breard will also make an effort to have constable reports regarding the Lakeville area sent to the Lakeville HOA. The tax assessor-collector’s report and SPA report noted that 2012 taxes are 96.4% collected. After further review and discussion, the Board unanimously approved the tax assessor-collector’s report as presented. The Board was presented with a Resolution requesting a certified estimate of value from the Harris County Appraisal District as of March 1, 2013, which the Board also approved. There was presented for the Board’s review, the annual audit of the

District’s books and records for the fiscal year ended September 30, 2012. The Board considered the audit in detail and unanimously authorized the President and Secretary to indicate the Board’s approval of the audit and that the attorneys be directed to furnish copies to the Texas Commission on Environmental Quality as required by Section 49.194 of the Texas Water Code. The Board also reviewed a Resolution affirming review of the District’s investment policy and a list of qualified broker-dealers. After discussion and agreement that no changes to the policy were warranted, the Board adopted the Resolution Affirming Review of Investment Policy, Strategies and Objectives, containing an updated list of qualified broker-dealers. In the absence of the bookkeeper, Mr. Goodall distributed the bookkeeper’s report and the Board reviewed the pay estimates contained in the bookkeeper’s report. Subject to review and discussion of the report, the Board unanimously approved the bookkeeper’s report as presented and authorized issuance of the checks listed. The Board reviewed the operator’s report, which indicated the District has 2,345 connections and 104.2% water accountability. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to contest or explain the charges. The Board unanimously authorized the District operator to proceed with termination of the utility service and approved the operator’s report as presented. Perry Miller presented a Champions Hydro-Lawn report noting the importance of over-seeding for proper upkeep of the District’s regional detention pond. The Board unanimously accepted the report as presented. Jason Johnson and Delea Cooper presented an engineer’s report and indicated the contracts have been forwarded to the contractor for execution for the interconnect water meter installation. The engineers reviewed Water Plant No. 1 issues and

noted that they are proceeding with the design of a small-capacity well and expect to submit plans within a month. Pay Application No. 3 in the amount of $88,474.50 was recommended for payment for Water Well No. 3, which is 60% complete. The Board then engaged in lengthy discussion regarding the existing Water Well No. 2 iron removal system. After a lengthy discussion, it was unanimously agreed that all necessary actions should be taken to keep the arsenic removal system fully operational at this point and Mr. Goodall, the engineers and the bookkeeper should have a meeting to formulate a recommendation to the Board for final disposition of all water quality issues currently associated with the District’s water wells. It was decided that after that meeting takes place, a special meeting should be called for the Board members to consider the recommendations. It was noted that construction has commenced on the utilities and paving to serve Jasmine Heights, Section Five. Construction is approximately 40% complete for utilities extension to serve the future Cy-Fair ISD campus. The Board considered developer reports. Robert Moorman noted that D.R. Horton continues to proceed with development in the District and hopes to add an additional 30 to 40 houses by the end of 2013. The Board considered the status of the upcoming bond authorization and maintenance tax elections. Jack Baber approached the Board and presented a proposed plan of financing for a Series 2013 Refunding Bond issue, which would yield the District an estimated present value savings of approximately 6%. The Board engaged in lengthy discussion regarding what parameters the consultants should use as the standards for proceeding with the financing plan. It was noted that the District is in the extraterritorial jurisdiction of the City of Houston and must meet a test prescribed by Houston ordinances to refund a debt. After examination of Mr. Baber’s analysis, it was decided that all actions necessary to issue refunding bonds to achieve a 5% minimum present value savings with a principal amount not to exceed $10 million dollars and authorization to last for 180 days. Mr. Baber explained the transaction in detail to the Board. The Board considered approval of the Preliminary Official Statement and Official Statement for the Series 2013 Refunding Bonds and authorization of a Notice of Refunding for the bonds to be refunded. Mr. Baber reviewed the Preliminary Official Statement in detail with the Board of Directors. He noted that the document describes the District and the proposed transaction. After a thorough review, the Board voted to approve the Preliminary Official Statement and the Official Statement for the Series 2013 Refunding Bonds and also approved the Notices of Refunding. Mr. Goodall noted that it would be appropriate for the Board to designate a District officer authorized to act on behalf of the District in the issuance , sale and approval and delivery of the Series 2013 Refunding Bonds to carry out all necessary acts and procedures, including, but not limited to, entering into a bond purchase agreement, entering into a Paying Agent Registrar Agreement and an Escrow Agreement, if necessary and approving the Official Statement and any supplements thereto and evidencing such acts by execution of an Approval Certificate. After discussion, the Board authorized and designated the Board President, Vice President and Secretary to act on its behalf. The Board further authorized all of its consultants to take all actions to issue, sell, approve and deliver the bonds according to previously discussed parameters. The Board was presented with the attached Bond Order for the Series 2013 Refunding Bonds. Mr. Goodall explained the Bond Order in detail to the Board noting that the Bond Order is the District’s covenant with the bondholders. As such, the District covenants to levy a tax sufficient rate and amount to pay the bonds and the District covenants to maintain the tax exempt status of the bonds. The District further covenants to maintain sufficient insurance on facilities and the District promises to annually update certain financial information that is of interest to bondholders. The Bond Order contains the parameters under which the Board President,

Vice President and Secretary are authorized to execute an approval certificate on the day that the bonds are sold. After discussion, the Board approved the Bond Order as presented. There was presented the attached Order Authorizing Actions for Issuance, Approval and Delivery of the Series 2013 Refunding Bonds. The Board adopted the Order as presented. The Board also met on April 9, 2013 and considered issues associated with the District’s water supply systems. Mr. Goodall noted the importance of making prudent, decisive and economically feasible decisions regarding the future of the District’s water supply system and noted the importance of returning the water supply system to full capacity for current and anticipated development as soon as possible. Mr. Goodall stressed the importance of meeting deadlines once decisions are made. Jason Johnson and Delea Cooper presented the attached analysis and recommendation for issues associated with the District’s water supply system. The Board then engaged a lengthy question-and-answer discussion regarding the methodology of the analysis and associated issues. It was noted that the engineers spent a great deal of time with the analysis and consulted the District’s attorney and bookkeeper prior to presenting the analysis and recommendation to the Board. After discussion, it was decided that the proposal before the Board was a preferable Recommended by issues. Larry Kupstas and Jack Baber noted the means to solve the importance of solving the issues as quickly as possible so that the Tom Tynan, District will be SportsRadio 610 able am to meet demands on the District’s water supply system that are reasonably anticipated at this point. Mr. Goodall noted the importance of meeting goals for time of implementing the recommendations. After further discussion, the Board unanimously authorized proceeding with the proposal as presented and instructed the engineers to have a timeline for proposal implementation for review and approval by the Board at the regularly scheduled April 15, 2013 Board of Directors meeting. It was noted that the recommendation would allow for the Board to have significant improvements to the District’s water supply system as soon as possible and with funds presently on-hand. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA). All directors are residents and property owners within the district. The MUD Board can be contacted via their attorney, Taylor Goodall of Smith, Murdaugh, Little & Bonham, at 713-652-6500. Please also remember the rules regarding personal sign postings. The placing of private signs of any type onto county owned sign poles or Centerpoint owned lightpoles is expressly prohibited per Texas House bill. Please do not subject yourself to the embarrassment of having your signs removed by the HOA or having a deputy come tell you that they must be removed. Jurisdiction for enforcement is shared by the Harris County JP and District courts. While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to issue citations to offenders as more than enough time has passed to allow everyone to become familiar with the new rules. The HOA is also considering levying civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278, $297 in 2011 and $306 in 2012. We have collected $93 so far in 2013. Please rinse and bag the cans to minimize the attraction to bugs. the HOA is also closely monitoring the water well situation with MUD #105. It is not clear, as yet, if water restrictions will resume in the summer. Until that point, however, property owners are expected to maintain their property as required by their deed restrictions. Property owners should, by now, understand that keeping your yard mowed and trimmed ( and this includes trees and bushes) is one of the least expensive methods to maintaining the property values in Settlers Village. And as with maintenance fees, timely action and response to violations is your obligation as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved to keep your property neat

• Call the constable’s office anytime you see a suspicious person and do not let race, age or gender influence you calling (a suspicious person is anyone you do not recognize on your street). • Call the constable’s office when you see a suspicious vehicle (any vehicle parked in front of your neighbor’s home or driving around your street that you don’t recognize). • Always keep all your doors and windows locked even when you are at home. • Always keep you overhead garage door in the down position. • Remember neighbors looking out for neighbors is how the police catch the bad guys. • If someone comes to your door, always go to the door and acknowledge that you are there and remember to never open the door for anyone that you do not know. The bad guys in almost all cases do not want you to be home. Then, always call the constable’s office so that we can check them out. When they leave your house they are going to your neighbors. • If you have children that stay at home alone no matter what their age they need to go to the door and have a preplanned story for whoever is there (my dad is working on the computer he says to come back later). Then have them call the constable’s office. • Never do business with people you don not know and trust. Never open the door for solicitors. If no one in the neighborhood buys anything from them, the companies that they work for will quit sending them into your subdivision.

TIPS FOR VACATION

• Please use the precinct 5 vacation watch for your home if you are going to be away (even overnight). • Use your alarm system (if applicable) • Inventory your home (record serial numbers or electronics, firearms, bicycles, etc. Take photos of jewelry). Keep the records in a safe place and file a copy with your homeowner’s insurance. This helps increase the chances of recovering your property and securing a conviction when the suspects are caught. • Use your exterior lighting at night!! Anyone 16 years of age and is subject to the county’s curfew and must be off the streets between midnight and 6 AM. Also included are daytime school hours between 8 AM and 2 PM. This applies to home schooled children as well. Officers have instructions to either arrest offenders or take them home to their parents. As always, if you see anything or anyone that looks suspicious or out of place, please call the deputies to investigate at 713-463-6666 or use 911 if it is an emergency. Deputies do not need to come by your house is you feel that might cause problems or endanger your family. Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed.

Authorities are investigating a body found near the side of a road in northwest Harris County. The body was reportedly discovered around 5 PM off FM 529 near Fry Road by a passing motorist. We’re told that person then flagged down a nearby deputy. According to the Harris County Sheriff’s Office, the victim was a Latino man in his 30s. Investigators believe he was killed at the scene. They said he was shot multiple times in the upper torso. They are working to identify the victim. Anyone with information can call HCSO or Crime Stoppers.

On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment.

An enhanced feature of the new provider will allow for collection of items excluded by the contract if notified in advance. Best Trash will meet with the customer prior to collection day to determine a price to haul the non-contract items. If a resident does not notify Best Trash of such a special pick-up before its scheduled day, Best Trash will leave a notice for the resident to contact Best Trash during normal business hours before the next scheduled pick up day. Please do not dispose of gasoline, motor or cooking oil, paints or any other liquid item in a container that is not visible to Best Trash personnel. SUMMER MEANS SWIM TIME

Summer is almost here, which means pools will be opening for the summer. Please take time to review water safety with your children before they even enter the pool. Drowning is the second leading cause of unintentional injury-related death among children age 14 and under. Believe it or not, the majority of children who drown do so in residential swimming pools while being cared for by one or both parents. In the time it takes you to run into the house to answer the phone, your child could drown - in as little as one inch of water. The American Academy of Pediatrics recommends that you not install swimming pools at all until your children are over 5 years of age. If you do have a pool, install a four-sided fence, about 5 feet high, with a self-closing latch that’s out of the reach of children. In open bodies of water and on boats, always use personal flotation devices, making sure that they fit properly. But floats and swimming lessons often give parents a false sense of security; they’re no replacement for supervision. At community pools, do not solely lean on the lifeguards to supervise your children. You are your child’s best safety net. Keep an eye on your children, learn CPR and keep a telephone with emergency numbers near the pool.
