THE PRESIDENT’S LETTER (FROM THE SETTLERS VILLAGE HOA BOARD)
Please take a moment to visit the neighborhood’s new website located at www.settlersvillagehoa.com. The Board is very interested in any and all feedback. The Board wanted to take a few moments to address a series of high profile crime issue occurring in the area. Almost everyone knows of the shooting fatality that occurred on Carmel Valley where the Settlers Village Subdivision becomes Highland Creek Estates. That victim was not a resident of Settlers. Not too long after that, a body was found outside Settlers on FM 529. The victim has also been shot and again, was not a Settlers resident. And more recently, in a story that made local headlines, a carload of Katy teens was parked near Lakeview’s lake. Apparently, someone had a gun that accidentally discharged and fatally wounded one of the teens in the front seat. It is important to note that our deputies maintain a very high profile in Settlers with frequent traffic stops and patrols. The point, of course, is not just to maintain the safety of our residents, but also to make the impression on would be problem individuals, that it would be better to take their issues elsewhere - even if just outside of the neighborhood. Crime stats are published monthly and it is impressive that even when we have neighborhood “spikes,” they rarely compare with what goes on outside of Settlers. Part of the reason for our success is the willingness of our residents to get involved, even if anonymously, to call the police when something or someone seems out of place. So remember that Settlers is your home and your home will only be as good as you make it. And on a side note - come on people! Right now, the weather has been relatively benign and conditions are right for everyone to work towards keeping the yards nice. Every month the Board gets a report as to how many yards have issues. It’s disappointing when we see some properties literally making a monthly appearance when keeping the yards maintained happens to be the very least expensive thing you can do to maintain your property values. The Board understands how one can occasionally, by the luck of the draw, get tagged with one of those famous yard letters from PCMI, just because that happened to be the one weekend you could not get to yard work. But recurring, monthly issues with mowing, edging, trimming trees and bushes, weeding, even picking up litter and debris - we have to repeat - come on people! Please do your part to keep the neighborhood a nice place to live. Enforcement will be used should the issue prove necessary and that is a whole lot more expensive than the gas and oil to run your mower/edger/trimmer for a couple of hours.

A Board of Directors meeting was held June 3, 2013, 6:00 PM at the little room by the Pool, 6700 Settlers Village Drive, Katy TX 77449. Board Members in attendance were Kim Rogers, Rick Davenport, Kathy Cones, Steve Breard and Tulibelle Igartua-Martinez. Representing Planned Community Management (PCMI) was Dolores Sue.

The minutes of the meeting held April 11, 2013 were reviewed. A motion was made, seconded and unanimously agreed to accept the minutes as written. The Board reviewed the financial statement as of April 30, 2013. PCMI has been in touch with the company that is preparing the drawings for the recreational center. The check has been written and the Board has signed the check therefore the drawings should be coming in the near future. AS soon as the Board obtains the drawings the process of obtaining will proceed by the general contractor, Hansen and Sons. The Board would like for construction to begin by the end of September or October 2013.

Kim Rogers explained that cracks in the coping need to be filled as soon as possible. Kim Rogers also reported that the pool is need of new furniture or refurbish the existing furniture. It was unanimously agreed that Kim Rogers will obtain prices from Chair King to purchase a few new pieces for the summer. The next Board meeting was scheduled for September 4, 2013. This meeting will be at the offices of PCMI at 6:00 PM. This meeting will be the 2014 budget meeting.

Steve Breard explained the Municipal Utilities District had employed a new Engineer. This engineer determined the source of the problems and it is believed the repairs should be completed and running shortly. The two (2) new wells should up and running by the end of summer 2013. Having three (3) working wells should facilitate better water pressure. PCMI was instructed to notify Cypress Fairbanks School District they need to mow at Walker Elementary and it was noted that one camera is not working. All others are working and recording fine.

Previously the Board had agreed to a $25 gift card for the winner of the yard of the month. The Board discussed and unanimously agreed there will be $50 gift card for the first place winner, $25 for second and PCMI will purchase an honorary mention sign for the runner up, which will have no monetary value. At 7:07 PM the Board adjourned into executive session to discuss deed restriction matters. All business being concluded, the meeting adjourned at 7:21 PM. Municipal Utility District The Board of Directors (“Board”) of Harris County Municipal Utility District No. 105 (“District”) met at 1825 North Mason Road, Katy, Harris County, Texas 77449 on April 15, 25 and 29, 2013. Directors present, as follows: Steve Breard, President Charles LaConti, Vice President Kathy Cones, Secretary Stanley Craig, Assistant Vice President Pamela Brandenburg, Assistant Secretary The regular April 15th meeting was called to order and declared open for such business as might regularly come before it. The Board considered the minutes of the meeting held on March 18, 2013 and approved the minutes as presented. The tax assessor-collector’s report and SPA report noted that 2012 taxes are 97.1% collected. After further review and discussion, the Board unanimously approved the tax assessor-collector’s report as presented. In the absence of the bookkeeper, Mr. Goodall distributed the bookkeeper’s report and the Board reviewed the pay estimates contained in the bookkeeper’s report. Subject to review and discussion of the report, the Board unanimously approved the bookkeeper’s report as presented and authorized issuance of the checks listed. The Board reviewed the operator’s report, which indicated the District has 2,340 active connections and 93.8% water accountability. The operator then submitted a list of delinquent accounts to the Board for termination of utility service and stated that the accounts in question have been given written notification of the opportunity to appear, either in person or in writing, at the Board meeting. The operator noted that the accounts listed had neither attended today’s meeting nor contacted the operator’s office or the District to

The Board considered developer reports. Robert Moorman noted that D.R. Horton continues to proceed with development in the District and hopes to add additional lots by the end of June. The Board also met on April 9, 2013 and considered issues associated with the District’s water supply systems and, this time, the performance of the District’s engineers in resolving recurring issues with the District’s water supply. It was decided that new firms would be invited to make proposals to replace the current engineers. On April 29th, the board voted to accept the proposal of Van de Wiele & Vogler, Inc. to become the District’s new engineers. They were instructed to be present at the May 20th meeting and be able to present a comprehensive review of the issues facing MUD #105 and proposed solutions to address those issues. The Harris County Municipal Utility District (MUD) Board #105 is an independent governmental agency that is completely separate from the Settlers Village Homeowners Association (SVHOA). All directors are residents and property owners within the district. The MUD Board can be contacted via their attorney, Taylor Goodall of Smith, Murdaugh, Little & Bonham, at 713-652-6500. Jason Johnson and Delea Cooper presented an engineer’s report and indicated the contracts have been forwarded to the contractor for execution for the interconnect water meter installation. The engineers reviewed Water Plant No. 2 issues and noted that they are proceeding with the design of a small-capacity well and expect to submit plans within a month. Pay Application No. 3 in the amount of $88,474.50 was recommended for payment for Water Well No. 3, which is 60% complete. The Board, again, engaged in lengthy discussion regarding the existing Water Well No. 2 iron removal system. After a lengthy discussion, it was unanimously agreed that all necessary actions should be taken to keep the arsenic removal system fully operational. It was decided that after that meeting takes place, a special meeting should be called for the Board members to consider the recommendations. It was noted that construction has been completed on the utilities and paving to serve Jasmine Heights, Section Five.

While the deputies have been asked to be lenient toward illegal signage, a discussion is now underway to allow the deputies to issue citations to offenders as more than enough time has passed to allow everyone to become familiar with the new rules. The HOA is also considering levying civil fines related to the costs of clean-up. Lastly, a quick reminder that Steve Breard is still collecting aluminum cans for the neighborhood with all proceeds going to the capital improvement fund for our pool. In 2010 we collected $278, $297 in 2011 and $306 in 2012. We have collected $117 so far in 2013. Please rinse and bag the cans to minimize the attraction to bugs. Even though the number of delinquent properties is down significantly, more significant is the total dollar delinquency for the neighborhood in April, which stood at $183,501.53 translating to a whopping 10% decrease from one year ago and a 10.7% decrease from one month ago. While the dollar delinquency translates to the equivalent of 637 delinquent properties, there are actually 221 properties (as opposed to 242 in 2012) in delinquency. 3. While Settlers is giving increased attention toward property upkeep, the HOA is also closely monitoring the water well situation with MUD #105. It is not clear, as yet, if water restrictions will resume in the summer. Until that point, however, property owners are expected to maintain their property as required by their deed restrictions. Property owners should, by now, understand that keeping your yard mowed and trimmed (and this includes trees and bushes) is one of the least expensive methods to maintaining the property values in Settlers Village. And as with maintenance fees, timely action and response to violations is your obligation as a resident and/or a property owner. Ignoring a problem will not make it go away but it will make it more expensive as the lawyers become involved to keep your property neat

CHIROPRACTIC HEALTH and WELLNESS CENTER • Call the constable’s office when you see a suspicious vehicle (any vehicle parked in front of your neighbor’s home or driving around your street that you don’t recognize). • Always keep all your doors and windows locked even when you are at home. • Always keep you overhead garage door in the down position. • Remember neighbors looking out for neighbors is how the police catch the bad guys. • If someone comes to your door, always go to the door and acknowledge that you are there and remember to never open the door for anyone that you do not know. The bad guys in almost all cases do not want you to be home. Then, always call the constable’s office so that we can check them out. When they leave your house they are going to your neighbors. • If you have children that stay at home alone no matter what their age they need to go to the door and have a preplanned story for whoever is there (my dad is working on the computer he says to come back later). Then have them call the constable’s office. • Never do business with people you don not know and trust. Never open the door for solicitors. If no one in the neighborhood buys anything from them, the companies that they work for will quit sending them into your subdivision. TIPS FOR VACATION • Please use the precinct 5 vacation watch for your home if you are going to be away (even overnight). • Use your alarm system (if applicable) • Inventory your home (record serial numbers or electronics, firearms, bicycles, etc. Take photos of jewelry). Keep the records in a safe place and file a copy with your homeowner’s insurance. This helps increase the chances of recovering your property and securing a conviction when the suspects are caught. • Use your exterior lighting at night!! A well lighted home is an unattractive target. • Park your vehicles in your garages (if possible) and in the driveway (when not). • Lock your vehicles and do not leave valuables in the car at anytime. (it took less than 1.5 minutes for a purse to be stolen from a vehicle locked and parked at a school in view of the complainant while she was picking up her children while she was out of her vehicle).

• Make arrangements for someone to pick up your mail and paper while your are away. • If someone knocks on your door, acknowledge them (not necessarily opening the door) speak to them through the door, if you don’t know them advise them your are calling the constable’s office. • Stagger your light timers in different rooms to make the house look occupied while you are away. • Have a neighbor check on your home daily and let those as well as the constable’s (vacation watch) know of service companies (day/company name/etc) that will be at your home while you are away. • Use your sprinkler system as a deterrent at night set them to go off sometime between 2 AM-5 AM. • Keep shrubs and trees trimmed around windows so a burglar cannot hide behind them to break into your home. J. Goff, Harris County Constable, Precinct Five Lieutenant Patrol I 281-492-3624 Authorities are investigating a shooting, which occurred in Lakeview’s park. Authorities say a teenager has died at a Houston-area hospital after he was shot while in a parked car with several other youths inside on May 14th. The Harris County Sheriff’s Office says that night’s fatal shooting appears to be an accident. Investigators did not immediately release the name and age of the victim. Authorities believe the boy was in the front passenger seat when he was struck by gunfire. The driver then drove the victim to a hospital in Katy. Deputy Thomas Gilliland says emergency personnel were unable to save the wounded boy. Hospital officials notified the sheriff’s office. No charges were immediately filed. Investigators are expected to do gunshot residue tests on the hands of the other teenagers to determine who fired the weapon. Anyone 16 years of age and is subject to the county’s curfew and must be off the streets between midnight and 6 AM. Also included are daytime school hours between 8 AM and 2 PM. This applies to home schooled children as well. Officers have instructions to either arrest offenders or take them home to

Deputies do not need to come by your house is you feel that might cause problems or endanger your family. Please remember to abide by the laws the legislature has put into place regarding personal signage. It is very embarrassing to have an officer show up at your home to remind you the practice of placing personal signage on county owned sign poles and Centerpoint owned streetlights is not allowed.
WEST HARRIS COUNTY REGIONAL WATER AUTHORITY
The West Harris County Regional Water Authority and other regional water users have been granted an extra 5 years to plan and carry out the next phase of its conversion from groundwater to surface water - a change that gives planners and engineers additional time to get this mammoth project done right. At its meeting in January, the Harris County Subsidence District also voted to delay the next conversion date from 2020 to 2035, to reduce the percentage conversion from 70% to 60% and to delay the 2030 conversion date to 2035. They kept the goal of converting 80% of usage from ground water to surface water. The Subsidence District decided that it makes sense to allow time for this work to be done in an orderly fashion. Recent studies indicate that a reduction in groundwater pumping through conversion to surface water sources has had a positive impact in the Houston/Galveston and Fort Bend County area. Subsidence - the compacting of ground layers caused by excess groundwater pumping - can damage the aquifer and lead to increased flooding and foundation problems. An average of 35% percent of the Authority’s total demand is now being met with surface water, which is provided by 28.25 MGD contract with the City of Houston. As part of the now 2025 deadline, the WHCRWA is working to acquire easements for a major 96 inch “second source” cross-town pipeline that will bring surface water from Lake Houston to West Harris County. The Authority is partnering with the City of Houston and other water authorities in this massive project, which also involves expanding the City of Houston’s Northeast Water Treatment Plant and installing distribution lines to bring that water into neighborhoods in West Harris County. In all, the Authority expects to acquire about 690 new easements and widen another 600 existing easements. Further out, the Authority and its partners, through the Coastal Water Authority, are planning construction of the Luce Bayou Interbasin Transfer Project, which will bring Trinity River water to Lake Houston. The Texas Water Development Board recently agreed to participate in financing the project.

The Subsidence District’s recent decision to delay the 2020 goal to 2025 addresses the new water demand forecast based on the 2010 Census, which shows many communities in the Authority are growing faster than expected. Previous forecasts had pegged the 2020 population in the West Authority at 455,000. Based on the official 2010 Census, the Authority had already reached that level by 2010 and the 2020 population projection is now at 548,000. Water demand projections also are on the rise, which means the initial 30% goal continues to be a moving target. The Authority recently extended water lines to 3 districts - Harris County MUD 500, MUD 433 and MUD 418 - to serve the fast-growing master-planned communities of Town Lake, Cypress Lakes and Bridgeland. The Authority also continues to build projects aimed at completing the water line “loop” for various districts, to ensure their service would continue even if the pipeline repairs were to become a necessary part in the future.

The Authority’s current groundwater reduction fee if $1.75 per 1,000 gallons and the surface water fee is $2.15 per 1,000 gallons. These fees typically are passed along by the water utility districts in addition to their own consumer water rates. With future rate increases unavoidable, homeowners, businesses and water utilities have an increased incentive to conserve water supplies. The Harris-Galveston Subsidence District also recently increased the “disincentive permit fee” levied to discourage over-reliance on groundwater, from $5 to $7 per 1,000 gallons. On the positive side, the West Authority is working to encourage the use of recycled water by golf courses, amenity lake owners and others. On each regularly scheduled collection day, Best Trash will collect residential refuse at the curbside. Trees, shrubs, brush trimmings and fencing must be bundled in lengths no greater than 4 feet with no branch diameter larger than 4 inches and bundles weighing no more than 40 lbs. The bundling is required to allow quick pickup and size limitations are required to avoid damage to the compacting equipment. Heavy/bulky items (appliances, furniture, carpet up to 1 room rolled up 4 ft. wide and weighing less than 50 lbs) will be picked up either collection day. By Federal Law, refrigerators, freezers or any other item containing Freon must have the Freon drained and have an accompanying bill to validate such service was performed. Items excluded from normal collection are dirt, rocks, bricks, tires, cement, batteries, motor or cooking oil, waste generated from a private contractor or any items deemed to be hazardous materials. Best Trash will leave a tag explaining the reasons for non-collection of the item.

I have been with Precinct 5 for over 20 years and have spent the entire time as a Deputy/Sergeant in the contract deputy program. Primarily, I have worked in contracts in the city. I am a Certified Crime Prevention Specialist. Because this will be my full time assignment, I will be working with all of the contracts much closer than has been done in the past. I will be reviewing all of the reports of crime occurring in the various neighborhoods and meeting with the deputies assigned to the contract programs and discussing problems. In addition, I will be reviewing reports made by Houston Police Officers, as a result of calls they make in the City contracts. I will be working closely with their crime analyst in an attempt to deal with problems as they develop. As a Crime Prevention Officer, I will be able to do home security inspections that may qualify home owners with a discount on their home owner’s insurance, as much as 5-10% depending on the insurance carrier. The House and Senate successfully negotiated a two-year budget that will restore approximately $4 billion of the $5.4 billion in cuts to public education that were made by the 82nd Legislature in 2011. While the budget still needs to be approved by the full House and Senate and signed by the governor, this key negotiation between five members from each side is expected to be the basis for the new funding system through 2015. This is a huge step in the right direction for Texas public schools and Cypress-Fairbanks ISD and I commend the members of the Recommended by 83rd Legislature - specifically those within the CFISD delegation Tom Tynan, who worked diligently to make this education budget replenishment SportsRadio happen. 610 am I would especially like to thank Sens. Dan Patrick, John Whitmire, Joan Huffman and Glenn Hegar and Reps. Patricia Harless, Allen Fletcher, Bill Callegari, Gary Elkins, Dwayne Bohac, Sylvester Turner and Jessica Farrar for using the power of their votes to keep our students’ best interests in mind. We have been fortunate in CFISD to maintain academic excellence amid financial constraints, but the additional infusion of money will be paramount as we seek to provide students with the best possible educational experience. Thank you for any feedback you gave to our local legislators that stressed the need for a properly funded education system in Texas.
