April 2014 DEED RESTRICTION FINE POLICY

Cinco Residential Property Association has established a deed restriction fine policy, which has taken effect March 1, 2014. The policy provides another tool for the Association to convince residents/owners/renters to cure deed restriction issues that they have been cited for. The process for the fine policy basically mirrors the current deed restriction policy. When a deed restriction violation is cited, a notice will be sent out to resident explaining the violation, asking the resident to take corrective measures. If upon a subsequent inspection, the violation is still not cured, a second notice will be sent. This notice will also inform the resident of the fine policy and explain that unless the violation is cured, a potential fine may be placed on the homeowner’s account. The notice will contain additional information regarding the policy and will also include a list of various offenses and related fines. Most of the fines are $50 per month per violation; however, certain violations may carry fines as high as $150 per month. If, upon a subsequent inspection, the violation is still not cured, a certified notice will be mailed providing the resident with the following additional information: (a) if the violation isn’t fully cured within 30 days, a fine will be assessed on the account. The resident/owner has the right to meet with the Board to discuss this matter. If the fine is assessed, the fine amount will become immediately due and owing and the resident/owner will be prevented from using Association facilities such as pools, tennis courts and parks. Additional inspections will be performed and if the violation still isn’t cured, additional fines will be assessed or the Board may elect to take additional steps, including sending the account to the attorney for legal action. The thought behind this policy is to convince those few residents/owners, who need convincing beyond violation notices to do the right thing and cure the violations. This is not an attempt to make additional money from our residents/owners/renters, but a tool to help get the matter promptly resolved. As always, at anytime during the

Hopefully the information provided here will give you a better understanding of the issues and methods of curing them. Obviously with the spring season in full bloom (yes - the pun was intended) lawn and landscape issues will become a bigger part of what we address over the next few months. The other items, including trash and parking, are simply ongoing matters that we deal with daily.

If your lawn is not properly mowed on a regular basis, you may get a “Force Mow” letter from us. That is our last ditch attempt to get your to fulfill your responsibility, but basically what the letter states, is that if you don’t mow your lawn (within a 5 or 10 day period - depending on the letter terms) the association will have a contractor mow your lawn for you and your account will be charged for the work performed. We don’t recommend using us as your lawn service, as we can be expensive.

1) LAWN, LANDSCAPE AND TREE MAINTENANCE Article V, Section 2 - Owner’s Responsibility: “Each owner shall maintain his or her Unit…. All maintenance required by this Section 2 shall be performed in a manner consistent with the Community-Wide Standard and all applicable covenants….” Mowing - Lawns must be mowed on a regular basis and here in south Texas, that means weekly during the growing season (Mar. - Sept.) and at least every other week during the rest of the year. Less than weekly mowing during the growing season simply isn’t going to work. During our warm fall and winter weather, lawns never go truly dormant, so mowing all year long is necessary.

Weeds - Even when you mow regularly, weeds will make an appearance in your lawn. When weed growth is prominent just mowing won’t take care of the problem. Weeds must be treated with an appropriate herbicide to keep them under control. Edging - Trimming any growth that extends over the sidewalk, walkway and the curbs must be cut back. And don’t forget those pesky weeds that grow in your expansion joints (the gaps in between the concrete sections of your sidewalk, driveways and walkways). These weeds can either be treated or removed with a weed eater. Trees - Front yard trees are a great enhancement to the curb appeal of your house, if they are properly maintained. Trees must be watered regularly, mulched (if they are in a tree bed) and even trimmed on a regular basis. Don’t forget to trim those suckers……. the tiny branches that grow along the trunk of the tree below the crown area. They serve no purpose and are unsightly looking. Tree Stakes - When trees are first planted, their roots are confined to a plastic bucket or burlap bag. The first thing a tree does when planted is spread its roots out to establish a good solid root base. The roots growing through the ground is what holds a tree in place. Metal or wooden stakes are placed in the ground and attached to the tree trunk with wires to keep the tree upright until the roots have a chance to establish their control. This generally takes about one year, after which the tree stakes must be removed. If the stakes are left in the ground longer than a year, they will be detrimental to the longer term growth and survival of the tree. The longer stakes remain in the ground (beyond the first year) they harder they are to remove so pulling them earlier rather than later will make your life so much easier.

Those along the front foundation of the house and those between two sets of driveways between the houses. The front landscape bed is fully your responsibility. Shrubs needs to be watered, fed, trimmed and replaced when they are dead or dying beyond recovery. The beds also need to be weeded and mulched on a regular basis. The shrubs between the driveways are a shared responsibility between the two sets of neighbors and also must be maintained on a regular basis. 2) PLACING TRASH OUT FOR PICK-UP: As you should be aware, the scheduled days for your trash to be picked up are Mondays and Thursdays. Article XII - Use Restrictions, Section 8 - Clothesline, Garbage Cans, Tanks, Etc. “….All garbage cans, above-ground storage tanks, mechanical equipment, woodpiles, yard equipment and other similar Items on Units shall be located or screened, so as to be concealed from view of neighboring Units, streets and property located adjacent to the Unlit!. All rubbish, trash and garbage shall be stored in appropriate containers… and shall regularly be removed from the Properties and shall not be allowed to accumulate thereon. Notwithstanding the above, trash receptacles may be placed within public view for collection beginning at sunset the day before pick-up and may remain within public view until 11 :59 PM on the day of pick-up.” Unless it is the evening before or the pick-up day; trash or trash cans cannot be visible from public view. The easiest way to assure that trash is not visible is to store it behind the fence or in the garage. When setting trash out for pick-up it should be out no earlier than dusk (sunset) on the day before pickup and the empty trash can should be returned back to its non-visible storage area by the evening of on the pick-up day. When placing trash out, please make sure it is secured so animals (or kids) cannot disturb it. Also, please place it out by the curb in a manner that does not block the sidewalk. Also, please note that if you are trimming trees or shrubs, the branches must be bundled per the trash company’s specification. Finally, please be aware of your pickup schedule when it relates to holidays. If you have any questions related to pick up around the holidays, please contact your trash company.

Parking Article XII, Section 2 - Parking and Prohibited Vehicles, Paragraph (a) Parking: “Vehicles shall be parked only in the garage or driveway serving the unit…. Under no circumstances shall occupant vehicles be parked in a manner so that any part of the vehicle extends over the sidewalk…. This rule doesn’t allow a lot of room for interpretation. You cannot park in the street, only in your garage or driveway - this includes overnight parking. If you are going to have family or friends visit for an extended period of time, such as over the holidays, please contact the association for occasional, temporary approval for on the street parking. This rule will be strictly enforced. Article XII, Section 2 - Parking and Prohibited Vehicles, Paragraph (b) Prohibited Vehicles: “Commercial vehicles, vehicles with commercial writing on their exteriors, vehicles primarily used and designed for commercial purposes, tractors, mobile homes, recreational vehicles, trailers, campers, camper trailers, boats and other watercraft and boat trailers shall be parked only in enclosed garages….” Again, not a lot of discussion here; all such vehicles must be parked in garages where they are not visible from public view. UNSIGHTLY ITEMS STORED IN PUBLIC VIEW Article XII - Use Restrictions, Section 6 Unsightly or Unkempt Conditions. “It shall be the responsibility of each Owner to prevent the development of any unclean, unsightly or unkempt condition on his or her Unit.” Please do not store any items on the exterior of the house where it can be seen from public view. This includes, trash, toys, stacks of bricks, dirt or mulch bags, coolers, sports nets, baskets, boxes, etc. The two key terms here are “stored” and “public view.” Stored does not mean your kids are playing football outside and leave the ball there when then run in for lunch. Stored means that the football is in the same exact spot of your front lawn for the past week. Public view is something that can reasonably seen by someone walking or driving by the house. PETS Article XII - Use Restrictions, Section 4 - Animals and Pets. “No animals, livestock or poultry of any kind shall be raised, bred or kept on any portion of the Properties, except that dogs, cats or other usual and common household pets, not to exceed a total of two (2) pets may be permitted in a Unit. However those pets which are permitted to roam free or in the sole discretion of the Association, endanger the health, make objectionable noise or constitute a nuisance or inconvenience to the Owners of other Units… shall be removed upon the request of the Board…. Dogs shall at all times whenever they are outside a Unit be confined on a leash held by a responsible person.” The most common pet complaints we get are related to dogs and the two biggest dog complaints we receive are related to barking and pooping. All dogs bark and we know that, but you should make sure that your dog’s barking is not disturbing your neighbors. Dogs that are left out on their own, especially during the day, will generally bark out of boredom. This barking can go on for hours at a time and is highly annoying and frustrating to those living around this animal. Please control the noise your dog makes - that is being a responsible pet owner and a good neighbor. Also, please do not let your dog’s poop on someone else’s lawn or if they do, please be courteous and pick up after your pet. When our landscape company runs across a brick wall with vine growth, the vines will be cut back and removed from the public face and top of the wall only. The vines will be removed by cutting and will not be treated with any type of herbicide. The vines on the resident facing side of the wall will not be touched. Moving forward we will continue to trim these vines back on an ongoing basis.

PICK UP YOUR DOG’S WASTE

When walking your dog, please do not allow them to walk in people’s yards. In the event your dog does wander onto someone’s property and uses the bathroom please pick up all of the waste. A single gram (about the size of a dime) of dog feces contains 23 million fecal coliform bacteria. Dog feces may harbor dangerous bacteria and viruses such as: whipworms, roundworms, tapeworms, parvo, giardiasis, salmonellosis and cryptosporidiosis. Pet waste is not fertilizer. It actually kills plants and grasses. Improperly disposed of or left unchecked, dog waste pollutes our environment and can even filter into our water supply. Uncollected dog waste that washes into streams and storm drains is the #3 contributor to water contamination. Pick up your dog’s waste. Not only will it help the environment, but it will ensure you and your dog a clean and safe area to enjoy together!

PARKING IN THE STREET

Did you know it is against Cinco Ranch Covenants for residents to park in the street (Article XII, Section 2(a))? Additionally, when a number of vehicles park in the street, emergency vehicles have a difficult task maneuvering down the street. Due to the size and clearance needs of these emergency vehicles, a street lined with parked cars obstructs the passage and delays response time. While it is understood that during certain events, vehicles parking on the street is an unavoidable circumstance, please be aware of clearance needed for traffic. Ask your guests to park their car as close to curb as possible and not line both sides of the street. Be a courteous neighbor by communicating you are having a gathering at your home and may need additional parking. Ask if they would mind guests parking in front of their homes to help eliminate the congestion on the street. Remember, parking on the street for residents is prohibited and can impact the ability of emergency services to reach you or a neighbor in an emergency. CINCO AND CINCO SOUTHWEST SHARED USE AGREEMENT

Cinco has 7 pools available during the swim season. Cinco Southwest has three pools, the Lake House Pool and the Rosewood Pool and Rollingwood Pool. All of these pools are available for use by both Cinco and Cinco Southwest Residents. The shared use agreement was signed in October of 2009 through the end of 2014. All Recreation Facilities are open to both Cinco and Cinco Southwest Residents. This includes pools, tennis courts, parks, hike and bike trails and the Lake House Recreation Facility. There are charges for renting some of the facilities. Members must purchase their Pool Key Cards from their appropriate Management Company. If you live east of Katy Gaston Road, you are in the Cinco Association and can purchase your Pool Key Cards at 3022 Windemere Park Lane. Keys are $25 each. Bring a picture ID and a check or money order made payable to CRPA to purchase your keys. We do not accept cash or credit/debit cards. For instance, did you know animal control in Fort Bend County is all the way down in Rosenberg, but if you live in the Harris County portion of Cinco and your dog is picked up, it is taken all the way up by I-45 and Canino Road near Little York Road?Â (The worst scenario is if a dog that lives in one county ends up being picked up in the other county.) Also, if your pet is brought to one of these locations, you likely will only have three days to find it before it is released for adoption OR euthanized. Harris County Animal Control advises, “All dogs and cats must be kept under restraint while in the unincorporated areas of Harris County, Texas. The custodian of a dog or cat is not authorized to have, harbor or keep any unlicensed dog or cat or to allow any dog or cat to become a stray.” Restraint is defined as “the control of a dog or cat under the following circumstances: 1. When it is controlled by a line or leash not more than six (6) feet in length, if the line or leash is held by a human being, who is capable of controlling or governing the dog or cat in question. 2. When it is within a fully enclosed vehicle. 3. When it is on the premise of the custodian and the animal does not have access to sidewalk or street. Laws written to ensure that owned animals are confined to their property or kept on a leash make freeing a community of unrestrained and free-roaming animals easier. Although most dog bites occur on the property where the dog lives, unrestrained or free-roaming dogs do pose a substantial threat to the public. In addition, unrestrained animals are at increased risk of being bitten by rabies-infected wildlife. Enforcement of restraint laws is essential in enhancing the animal control program efforts to reduce the risk of rabies in our community. LICENSING OF DOGS AND CATS The primary benefit of licensing animals is identification, should that animal become lost. Do you have a transformer in your yard? If you do, please do not directly surround it with mulch or dirt. Transformers must have the sides exposed so they can cool properly. Otherwise they will over heat and burn out. Also, the sides of a transformer can rust through due to mulch holding moisture against them. Please do your part and clear the area around transformers in your yard.

If you live in a gated section, the streets and curbs are maintained by the Association with funds from the separate assessment billed annually. On a related note, the driveway “apron” is the responsibility of the individual property owner, no matter who maintains your street. Also, the sidewalks adjoining residential lots are the responsibility of the owner. Recently, signs have been added to the area surrounding the lake at Lake Pointe advising residents not to feed the ducks at the park and lake. The ducks are a part of nature and the lake is a natural area, but feeding the ducks in this manner causes a duck population growth and subsequently the mess that goes along with it. GARDENING TIPS FOR APRIL

Mulch - If possible, buy Bagged Mulch. Bagging helps eliminate a great many pests that die from various causes while in the bag. When you buy ‘loose’ mulch that is trucked to your home, you are also buying ants, roaches, termites, etc… Spend a little more on bagged material and save lots of future pest problems. Keep your mulch at least 4” - 6” below the top of your homes exposed foundation edge/side. This will aid in minimizing pests in your home and allow for quick and accurate termite inspections. Shrubs, Flowers and groundcovers - Trim all shrubs/plants at least 12” - 18” back from your home. Do your best to create a plant free zone that is 18” - 24” wide around your home. The exception is your lawn - it can grow up next to the slab as long as you keep it 4” - 6” below the top of the slab. The most conducive to termite infestation are groundcover plantings, growing high against your homes exterior or (especially) ivy that grows on your walls. Trees - Spray your trees at least twice annually. The spring spray eliminates overwintering pests and fungi while preparing trees to resist the pest onslaught of summer with residual pesticides. The fall spray also kills pests from the summer, prevents most fungi from occurring over the winter and puts your valuable asset off to a healthy winter’s dormancy. Lawn - Spring is the perfect time to do a fungicide treatment to stop brown patch in its tracks along with other fungi. If your lawn is thin and weak in some areas, here are some important fundamentals: a) lawn aeration b) fertilization c) weed control. Most important is proper watering: • Water once per week (unless you get a 1/2” rain or more - then do not water.) • Water heavily (1” - 2”) for total lawn coverage. • In severe drought, water every 5th day. • Water from 5 AM to 7 AM in the morning - NOT AT NIGHT. • A heavy deep weekly watering makes the turf grow deeper, stronger and more drought resistant roots. • Less watering also saves you money!! Pope John XXIII High School in Katy headed to the state championship meet February 14th, in San Antonio. 10 of the girls and 6 of the boys on the 20-person team qualified for the state meet and competed in many different events, including all of the possible relays. The girls team was especially excited to head to the state meet and defend their state title; Pope John’s girls team were two-time defending champions in search of a “three-peat.”

Pope John XXIII High School announced that senior Jack Parmenter has been named a National Merit Finalist in the 2014 National Merit Scholarship Competition. About 1.5 million juniors in more than 22,000 high schools entered the 2014 National Merit Scholarship Program by taking the 2012 Preliminary SAT/National Merit Scholarship Qualifying Test (PSAT/ NMSQT®), which served as an initial screen of program entrants. The nationwide pool of Semifinalists, representing less than one percent of U.S. high school seniors, includes the highest-scoring entrants in each state. The number of Semifinalists in a state is proportional to the state’s percentage of the national total of graduating seniors.

MCMEANS STUDENT WINS BEST OF SHOW

Amber Wang, 8th grader from McMeans Jr. High, has received the 2014 Houston Livestock Show and Rodeo “Best of Show” award for Katy ISD. Amber went on to compete against other district’s “Best of Show” winners for the title of “Grand Champion.” The announcements were made Saturday, March 8, 2014 at 10 AM. Artwork of students will be showcased in the Hayloft Gallery, located on the first floor of the Reliant Center in the west end of the Lobby, for the duration of the Houston Livestock Show and Rodeo. As the winner, he was bestowed with the honor of performing with the Clear Lake Symphony on March 21, 2014 at Gloria Dei Lutheran Church. He performed the 1st movement of Beethoven’s Violin Concerto in D major.

MESSAGE FROM THE SUPERINTENDENT BUILDING TOMORROW TOGETHER

Have you driven recently across the Grand Parkway extension and noticed the number of new residential and commercial construction projects emerging just north of I-10? Just less than a decade ago this was vast open land, rice farms and cattle. Soon, there will be bustling streets and housing complexes, like we have seen in other parts of Katy. It’s amazing to witness what Katy has become in such a short period of time one of the nation’s fastest growing suburbs known and envied for its schools and strong economy. This is an exciting time for Katy ISD as we experience such exponential growth. More families and businesses are moving here because they, like you, believe in the value of our community and schools. But in order to continue to thrive, it is imperative that we build tomorrow together to adequately serve the educational needs of our students, today and in years to come. Through data presented annually by our District demographers, PASA and discussions with residential developers, we’ve been able to identify future enrollment projections and where we will see many new neighborhoods within the next couple of years. This will inevitably bring many of our campuses to full capacity and create a pressing need to provide additional classroom space throughout Katy ISD. Our staff presented to the Board a presentation on a proposal for developing a facilities review and bond process to help us begin to meet the growing demands and inevitable outcomes of our schools’ reputation and strong economy. These steps are instrumental to ensure that the quality educational opportunities our students receive today continue to keep pace with our growth. The Board will now take some time to process the proposal presented to them. Rest assured, I will keep you updated and hope you will support our efforts as we move forward with our growth plans throughout the year. Let’s build tomorrow together! Houston Professional Fire Fighters Local #341 began their annual Fillthe-Boot fundraising campaign for the Muscular Dystrophy Association on Saturday, February 15, 2014 during the hours of 10 AM and 2 PM. Fire Fighters were out in the community collecting funds for the campaign. The Houston Professional Fire Fighters Local 341 have raised more than $7.3 million for the Muscular Dystrophy Association through the annual “Fill the Boot” campaign. The Fire Fighters count on the generosity of Houstonians as the main reason why the department manages to secure such successful campaigns. Fire Fighters will also be out April 5th and May 3rd to collect funds for the campaign.

The Fill-the-Boot campaign takes place throughout the United States annually and has been raising money for families served by MDA for 60 years. THE LONE STAR SYMPHONIC BAND

Want to retire your old, tattered, torn, discolored or worn American flags with dignity? The Katy American Legion will be collecting such flags on two dates in April in two locations. The dates are Saturday, April 12th and Saturday, April 19th from 10 AM - 2 PM and the places are Kroger Grocery at Mason and Peek Roads and Lowes Home Improvement Store on the I-10 feeder at Fry Road. Collected flags will be destroyed (burned) in a dignified ceremony held in conjunction with the Katy Elks Lodge annual Flag Day ceremony. Flag Day 2014 falls on Saturday, June 14th. VOLUNTEERS NEEDED The West I-10 Volunteer Fire Department (VFD) is seeking applicants who are willing to become a member of the organization and want to provide this critical service back to your community. You will find, as a member, you cannot belong to a more important, life changing organization than one that is designed as a first responder to care for citizens and neighbors during a critical time in their lives. ESD #48 and ESD #1 provide first responder service through the West I-10 VFD to an estimated evening population of 125,000 residents. This does not include those who work or travel through the area throughout the day. You, as a resident who lives, works or recreates in the Katy area, should be quite aware that the district is growing at a rapid pace. We are looking for men and women like you to help keep pace with this communities growing needs. In 2013, the West I-10 Volunteer Fire Department responded to over 6,000 calls for assistance. This includes medical, fire and motor vehicle incidents. In addition, West I-10 will provide mutual aid to other departments in the region, including Willowfork, Westlake, Katy, Fulshear and Cy-Fair Fire Departments. The Department relies extensively on the presence of volunteer firefighters to assist in scheduled staffing of fire stations. In addition, you may be requested to respond to the fire station from your home when a significant event occurs. Volunteer members receive their firefighter training through the department. It takes approximately five months of weekly training to become certified to respond to and perform your trained duties at fires and other critical incidents. CROSSROADS mentors are regular people, just like you, who help prevent or reduce youth involvement with the juvenile justice system by fostering supportive mentoring relationships. NCL STAR CHAPTER, KATY, TX

The Star Chapter of the National Charity League (NCL) honored the Senior Class of 2014 at its annual Senior Presentation at the Marriott Houston Westchase in February. At the dinner and dance attended by family and friends, the chapter members recognized each of these 22 women for their accomplishments and contributions to the community during their six years of service in NCL. They have contributed over 6,000 hours to their chapter and community, working with 28 local charities. Each young lady learned to serve her community, be a leader and open her eyes to the cultural arts around her. NCL LADY BIRD 2014 GRADUATES ARE HONORED FOR 1,100 HOURS OF VOLUNTEER WORK

Imagine a group of 15 teenage girls who are involved in varsity sports, competitive dance and AP classes finding 1,100 hours during their high school years to help the less fortunate in the Katy community. That is what the 2014 class of National Charity League (NCL) Lady Birds has done. These motivated graduates have made an impressive impact on the community volunteering at Katy, Ft Bend and Brookshire area charitable organizations. The teens have hosted bingo, birthday and Christmas parties at a residential facility for adults with developmental challenges and for homeless children at a local shelter. They have tutored elementary school children, mentored troubled teens, helped build homes for Habitat for Humanity, visited hospital patients and worked at food pantries. The young women have collected aluminum cans and worked bingo nights at a local church to raise money for computers to be donated to sick children in hospitals through Keep Kids Connected. The National Charity League (NCL) Lady Bird Chapter was proud to recognize and honor its graduating seniors at its annual Senior Recognition night at Sweetwater Country Club on February 8th. The members, their family and their friends celebrated the accomplishments of each of the young ladies at a dinner and dance. Their volunteer work throughout high school and the positive impact on the community were celebrated. These graduates were diligent in continuing to volunteer, year after year, always finding time in their hectic schedules. The young women from four different Katy high schools were mostly strangers when they joined NCL but became a dynamic team as they worked tirelessly by donating their time to help developmentally challenged children at Sire ride horses for physical therapy; providing comfort to hospitalized children with donations of handmade blankets through Project Linus and passing out turkey dinners through Eternal Food Ministries during a 29 degree freezing rain, as well as passing out boxes of food during 103 degree summer heat. Congratulations NCL Lady Bird Class of 2014!

Ayusa, a non-profit organization that promotes global learning and leadership through cultural exchange and leadership programs for high school students from around the world, is looking for American families in the Houston and surrounding areas interested in sharing their America with international high school students for the 2014-2015 school year. Applications for interested host families are currently being accepted. Ayusa foreign exchange students come from more than 60 countries, are fully insured, bring their own spending money and are proficient in English. Whether from Japan or Brazil, India or Sweden, Ukraine or Mexico, France or Lebanon, foreign exchange students are a window into another culture and a great way to travel the world without leaving your home.
